They want to have the gun control conversation but President Trump says it wouldnt have made any difference in this case. Brave person who happened to have a gun or rifle in his truck go out and shoot him and hit him and neutralize him. I can only say this, if he didnt have a gun instead of having 26 dead he would have had hundreds more dead. Pete williams and nickels is at the pentagon. New details on the gunmans past. According to Police Report that our affiliate kprc found it turns out in june of 2012 while kelly was awaiting his courtmartial proceedings after he had been charged with Domestic Abuse for assaulting his wife and child Authorities Say the military accused him of trying to carry out Death Threats against his military chain of command after he was in the word of this Police Report caught sneaking firearms on to the air force base in new mexico where he was serving. The Police Report says that he was referred for some kind of Mental Health evaluation or treatment to a Behavioral Health institute that is located in new mexico not far from the air force base. Again in the word of this Police Report he escaped from that, the police were called. They found him in the bus station and turned him back over to local police. So that tells us one thing that the air force was concerned enough about his Mental Health that he was sent to this Behavioral Center for some kind of treatment or evaluation. So those are the raw facts. It raises a second question here about whether there was another opportunity to flag something in his past that should have stopped him from buying a gun. We all know about the military issue. Another provision says you cant sell a gun to somebody who has been adjudicated mentally defective or committed to a Mental Institution. So one thing we are trying to figure out here is was he involuntarily committed to this facility for treatment or evaluation and if so should that information have been given to the fbi to put in the database that could have given material from the military. We just dont know what the circumstances were but we know the information was not given to the fbi because they said there was nothing in his record that would have prohibited him from buying a gun. The stat sheet you read you said commit today a Mental Health facility. Does it matter if he was committed there against his will or if he self checked into that . The language seems relatively vague. It does matter. Here is the way that code of federal regulations defines that term. A formal commitment by a court commissioned or other lawful authority. This includes a commitment involuntarily but it does not include a person in the Mental Institution for observation or voluntary admission. Got it. Pete williams, thank you. This Mental Health institute feels like the more we hear and updates on this mans past the more egregious it is that this information was not passed from the military to the fbi. There are still things we dont know. From this report from our houston affiliate it looks like crucial time in 2011 from april 27 when he first started assaulting as he later pled guilty to to november of that year when the order was signed and he was put into confinement. Remember, he receives 12 months for two counts of assault. One of those including assault against his step son. So a child in that case. Think this will focus attention on just what happened in that proceeding. Who was the general convening it . Were prosecutors happy with the outcome . This seems yet another example of things not quite going the way they should a. If he was confined to a Mental Hospital that is yet another flag that should have been raised to give this information to the fbi to prevent this individual from purchasing a firearm. Lets be clear about what he did with his step son. He fractured his step sons skull. That is disgusting. The air force clearly did not do their Due Diligence in this respect from what we are learning. Is there any indication, hans, that there could be more cases like this . And do they have any grasp whatsoever on how many more there could be . We dont know. The answer to that is they dont have a grasp on that because they are reviewing and taking a look at all the cases and seeing in the case wheres there is Domestic Violence was that information transmitted to proper authorities. That is what they are doing. This could be this was a simple administrative failure. This fell through. Could be the air force has a systemic problem with transferring the data. They simply dont know. That is the point of this inquiry across the entire department of defense. We also heard from secretary mattis a few hours ago saying they want to get to the bottom of this and have a comprehensive review. How are people effected by this reacting to the news thats coming out about this killer, this seemingly growing list of all the reasons why he should not have been able to get a gun . Reporter there is a lot of anger on the ground here. There is a lot of shock, as well. Again, this is a very Small Community. If you walk over to the gas station where the gunman was first seen there are people working there providing meals and waters for everyone on the ground who saw everything go down. They are still in shock. A lot of anger and dismay at the fact that this could have been prevented when you look at this mans record and the new information that is surfacing. We had a press conference with the latest details with the fact that texas rangers, they have the suspects cell phone and have not been able to get into that phone because of the technology and the encryption. They would also not release what kind of phone it was. That is likely to reveal more about what was behind the motive. Also, the Wilson County sheriff told cnn that the pastor of the First Baptist church behind me apparently did not want devin kelly inside his church which would lead us to believe that he knew him from before, that there was some kind of relationship there. In the press conference we heard authorities did not want to give out more information as to the motive and the link between the suspect and the target. We did learn something very harrowing, however, it is the fact that very few people inside that sunday service were not injured or killed. So if you can just wrap your head around that for a moment. Almost everyone inside that church was physically harmed when this man perpetrated this attack. We also learned that he did not have a conceal carry permit, that that permit was most likely denied to him. He also most likely according to authorities used a semiautomatic weapon and they are prepared to say that they are certain nobody else was involved in this attack. No new details about this mans relationship with his mother in law . There was some talk about whether he not he might have thought she was in that church at some point . Reporter so this is what we know that we have heard on the ground. We know that he according to the Wilson County sheriff had sent threatening Text Messages to his mother in law that frequented this church. She was not, however, present that sunday when he committed the massacre. We also found out in the press conference that his grandmother in law, if you will, no one really related to him was at the church at the time but they are known to have frequented the church. I also confirmed with the sheriff that they are not local to sutherland springs. Everyone as you can imagine awaiting for more details from the cell phone and still awaiting more details on the victims. That full list of names has not been revealed to us yet. On that cell phone viewers might remember that the same issue arose when we were talking about San Bernardino and the couple that killed a number of people at the office party. They were trying to get into the cell phone. It was a big back and forth between Law Enforcement and apple because apple was trying to protect privacy of users. Somebody did come forward and help investigators unlock that cell phone. There was a master key for that particular model. It is unclear if there is a master key for whatever model of cell phone. If you allow me, that actually came up during the press conference. Someone asked about the San Bernardino case. Officials said that that was useful only in that instance. Apparently it is not something that they can replicate and use in this case. Exactly. That was for that particular phone, that model of that year. It is unclear what sort of cell phone investigators wouldnt tell us what sort of cell phone kelly had in his possession and whether or not there is some sort of skeleton key for that cell phone to allow investigators to get into it. When you have a cell phone, Something Like an iphone you only get a certain number of tries to get into that phone before absolutely all the information is wiped clean from it. It is certainly a risky prospect to try and punch in numbers you think might unlock that phone. It paints a much different picture than carter page portraying. It is different than what carter page has been saying but is there any reason to believe that carter page may have had a bigger role within this campaign, more influential role, more contact with senior officials than the campaign wants to admit . Potentially. We both covered this campaign and he was not a daily presence on the campaign. He clearly in his testimony it has become clear that he had coordination and communication with Senior Campaign officials before and after the trip. Just another example of these figures in this russia investigation not being fully transparent and not telling the truth initially. There are these revisions and things they claim they didnt remember at the time and it is just this happens over and over again and it feeds a bigger problem of trust and honesty in terms of what the Trump Campaign officials are saying. That is part of it but also part of it, why did people like carter page or George Papadopoulos believe that hawking connections to russia would get them influence or any sort of stature within this campaign. That is a question i still dont have a good answer for. The answer may be that it was part of both, that the russians were interested in some kind of relationship and that the campaign itself was interested in a relationship. This comes just over a month after we saw the first reports detailing allegations of Sexual Misconduct by the disgraced movie mogul. Today there is also new reporting about the apparent lengths weinstein went through. He reportedly hired private security agencies to gather information on people to expose them. Journalist ronan faro writes he had the agencies target or collect information on dozens of individuals and compile psychological profiles that sometimes focus on their personal or sexual histories. Weinstein monitored the progress of the investigations personally. The article says one of the agencies black cube is largely run by former Israeli Intelligence officers. The company told nbc news that it never discusses clients but that it does not get involved in Sexual Harassment cases. Nearly 90 women have accused weinstein of Sexual Harassment. He has repeatedly denied allegations of nonconsenseual sex. His attorneys did not respond for comment but the spokesperson told the new yorker it is a fiction to suggest that any individuals were targeted or suppressed at any time. This is a case that we think at least in part revolves around a woman who is an actress that people might know. She was on boardwalk empire. She says that in 2010 she met Harvey Weinstein at a hotel. They ran into each other. He offered her a ride home and that led to what she calls a rape. Then she says it happened again a little bit later that year also in 2010 that he also raped her so twice. We believe that that is what they have been investigating. Police have certainly confirmed that they have been looking into that case involving that actress. He may or may not be in the state. Last week the head of chief of detectives here in new york said he believes he is in arizona right now. Thats where we think he had gone for treatment. He said he wanted to seek help. And also the news in the new yorker that exisraeli spies were working on weinsteins behalf in order to collect information on the victims calling the people that would pose as journalists calling to get stories and people would pose as accusers to try to susz out what the journalists knew. It is an incredible read. Weinstein has long denied any allegations of nonconsenseual sex. In the new yorker what you learn is that they hired several different firms including the one that you named which included former israeli spies. Thats serious stuff. They are serious work. One of the stories that they tell is that rose mcgowan met up with a woman who called her and pretended to be something she wasnt, said she was a Woman Working for womens rights and helping victims of sex crimes. Could she meet with her. They met four times this year as recently as two weeks ago this woman thanking her for speaking out and saying that you are a hero. You are very brave. So it was all a trick in order to get information out of her. And that was happening again and again as you said with reporters, as well. There is one other wrinkle here. David boise the attorney, very well known attorney, he fought for gay marriage rights and Marriage Equality to the supreme court. He was representing Harvey Weinstein and has just put out a statement. It just came out in the last couple of minutes. He used to represent mr. Weinste weinstein. He said he is no longer a client of mine. What came out in the new yorker is he signed for the contracts with the investigators to happen. At least two were signed by him. In a new statement he says while i told mr. Weinstein that i was not in a position to represent him on these issues meaning the Sexual Harassment allegations his request to contract with investigators seemed at the time like a reasonable accommodation for a longtime client. I regret having done this. It was a mistake to contract with and pay on bahalf of a client investigators who we did not select. It was not thought through and that was my mistake. Reporter we mostly smell rain out here. It has been a gloomy, wet and cold day here. Democratic stronghold. The numbers have been good here. They are sort of on track with 2013 when Terry Mcauliffe was elected governor. The enthusiasm is with the democratic ticket. Part of it is people who say they just want to oppose a president who they dont like. I am very much against donald trump and everything he stands for and i think a vote for the republican ticket is a vote for donald trump. I think gilespie is following his play book. Gilespie. Reporter and make no mistake ed gilespie doesnt have to win in counties like this. He doesnt have to come close but he has to cut significantly into the margins up here. The ed gilespie of 2013 was pretty well situated to do that. Hoohe was seen as a bush romney republicans. You are seeing some say he tilted more towards the donald trump play book they have seen that sort of turn off voters here. It is the tradeoff between Northern Virginia republicans and republicans in other parts of the state who are looking to embrace donald trump a little more. That is the dynamic i think we are watching. So gilespie hasnt campaigned with donald trump. He is campaigning on some of trumps issues. He is talking about ms13 and confederate status. Is there concern among democrats that those two topics will have some resonance among virginia voters . Reporter look, democrats know ed gilespie is a pretty savvy politician. He gave a scare running a couple of years ago. He wouldnt have picked up on these things if he didnt think they were going to work in some capacity. The ms13 ad which democrats have said is divisive and racist is something that may be useful in him in activating some trumpbased voters, folks who are playing on fears around illegal immigration. I asked about the status ad. He said virginians like the idea of keeping these status up and putting them in context. Republicans think they can exploit the issues. Steve, secret between us is that you and i often have arguments about polls and whether or not we should read into them. Our offices are right next to each other and sometimes i will speak loudly and you can hear me through the wall. When you look at these polls its close. Ralph north amonly up by a couple of points. How much stock should we put into this . Remember what happened with the polls around this time . When you see it you take it with a grain of salt. There have been a lot of polls in the last week or so a dozen polls here in virginia. And you do see a lead. Its a small lead but its a steady lead basically almost every poll taken has shown him up a couple points here. Thats close enough. Something funny can happen here. Gilespie can win this thing. If gilespie does win i think you have questions to ask about the polls. If you are a democrat you feel pretty good going in that this is where you want to be. Youre haunted a little bit by last year. 12 polls with the advantage. How is race playing into gilespie . How much of a factor do you think it will be depending on who northam whether or not minorities end up showing up for northam . Just to put a finer point on that, this issue that gilespie faces here running on this sort of trumpism. Look at the blue areas. This is the clinton trump result. He basically got one out of every four votes coming out of these blue counties. Here is a really good example. This is Loudoun County. When he ran for the senate in 2014 he actually won Loudoun County by a very small margin but won it. Donald trump last year in the same county running against Hillary Clinton he lost it by 17 points. This part of the state really rejected trump, really rejected trumpisms. The question for gilespie is by running on trumpism is he going to fall to that minus 17 level in a place like Loudoun County or can he get it closer to where he was in 14. If he is down at the trump level he really has to make up for it down here. Rural areas is where trump was winning some of the counties 70 to 80 . Trumpism could maybe get him to that level. He will say things from afar that he wont necessarily say face to face with someone. Hes face to face with these asian leaders, south korea, japan, china. So it would stand to reason that he would not be as combative as he normally is. Its awkward to say, yes, we want to have a war over here where you people die. So then, unless we can work out a deal some kind of a freeze for a freeze which i think secretary tillerson is trying to get, i think the north korea military would like to get but i think is probably unachievable because probably President Trump wouldnt go for it and probably kim jongun wouldnt go for it. Then the alternative is we settle into long term deterrence in which they have the capacity to destroy los angeles, which is not an option we want. And one that donald trump says he wont stand for.
