All of that, plus we are watching the Supreme Court, a key decision being announced any minute now, potentially on daca. Well have that for you as soon as we get it. We understand right now that the Supreme Court is going to be issuing that opinion in any minute now. It has been coming out every monday and thursday. We understand the decision is going to be about the deferred action for childhood arrivals, that is also known as daca. That was an executive decision that was granted and issued by president obama back in 2012. It has subsequently been challenged in court by the Trump Administration. We are expecting that Supreme Court decision now any minute. When we do get it, well bring in nbc news justice correspondent Pete Williams. To give you a sense of what is at stake here, let me read for you the three cases that have essentially been boiled into one decision coming out any minute now. It was the trump verse the na p naacp, mckinnon versus nadal and the department of Homeland Security versus regents of the university of california. Here is what is at stake in this Supreme Court decision. Essentially the Supreme Court going to decide any minute now whether President Trump can essentially shut down the Obama Era Program as i said that is known as daca. It essentially granted temporary protection to deportation from 700,000 young people brought into this country el legillegal. We cross over to Pete Williams. The Supreme Court said the Trump Administration wrongly tried to shut daca down so daca is going to survive. The Trump Administration could try again to shut it down, but that seems like it would be unlikely something that the government would try to do during an election year. So here is what happened. Remember, daca, this is the program that says young people brought to the u. S. By their illegal immigrant parents can stay in the u. S. If they meet certain conditions, they had to be under 16 and so forth. About 800,000 young people known as dreamers have taken advantage of the program, set up by executive order by president obama and no one ever disputed if President Trump wanted to, he could, by executive order, shut it down, but thats not what the Trump Administration did. Instead, the attorney general at the time Jeff Sessions said in his opinion, daca was illegally started, and so the department of Homeland Security, based on that guidance, ordered that daca should be shut down two years ago. A number of states and the university of california systems sued, saying no, that cant be right, that when you have a program that many people depend on, another law says that you cant shut it down without going through a certain set of procedures, and today the Supreme Court, by a 54 decision i think, im just doublechecking my notes here, uhm yes, 54 decision said they went about it the wrong way. Now, surprisingly, this decision was written by the chief justice, john roberts. So we have another decision from a conservative Supreme Court with an outcome that would please i think the democrats and the liberals. So the issue here was, did the Trump Administration go about shutting it down the wrong way, and the answer is yes. Now, obviously they could try again, the court says, but again, i think thats unlikely to happen during an election year. So bottom line, daca continues. The young people that are in the program, they have to reup every two years. Well see what the next step for the Trump Administration is. Back to you. All right, thanks to our justice correspondent Pete Williams with that breaking news coming out of the Supreme Court, you heard there, Pete Williams saying the Supreme Court by decision of 54 with the decision being written by the chief Justice John Roberts says daca survives, daca continues. That means about the 800,000 or so dream d. R. E. A. Ers in this col be able to reapply. Lots of questions for the Trump Administration what theyll do next about the program. For now it seems based on this decision, based on this day, daca will continue. I want to bring in msnbc Supreme Court analyst Tom Goldstein, Msnbcs Jacob Soboroff in los angeles and Julia Ainsley in washington. Tom, we spoke on monday after that historic decision. Another very by some accounts surprising decision coming out today. Pete gave us the quick legal breakdown of the case, but tell us more practically what this means Going Forward for the 800,000 or so dreamers in this country this morning. Theyre not going anywhere. Thats just the bottom line. The Trump Administration had kind of promised to hold off repealing daca and ordering deportations even if it won in the Supreme Court which it was expected to do but now the Supreme Court has said absolutely not. The original Obama Administration policy remains in effect. The Trump Administration as pete rightly says, could go and try again, but its extremely doubtful theyll do that, to try and give a new rationale for repealing it right in the runup to the election. On some level, maybe everybody wins, the Trump Administration got to show a hard line on immigration but not take the political hit that would have come from winning in this Supreme Court. Julia, let me get your thoughts quickly. Give us the time line of how we got here from 2012 from the time the president , then president obama signed the executive order, that allowed children that were brought into this country illegally to stay here and the decision we just got minutes ago, give us the quick snap sis legally as to how that played out. Reporter thats right, eamon. This started under the Obama Administration as a way to allow children who had been brought here illegally by their parents to stay, if they had Work Authorization and remained in school, or worked. Then trump, as a candidate, campaigned to end daca. When he got into the white house, it seemed that he didnt want to make the argument anymore. Instead he punted this onto his then attorney general Jeff Sessions who said we are going to end this because we are being sued by states like texas over the legality of daca. They made the argument that daca was not legal, rather than just repealing it straight out. Now the Supreme Court is saying that was not the way to go about this but essentially trump wanted this out of his hands. He put it in the hands of Jeff Sessions and Jeff Sessions actually put it in the hands of congress, saying that congress would need to act to make daca a law in order for it to stay. Congress did not act. The president had other chances where he could have sustain daca as a win for his wall. As we know, there were negotiations back in 2018 where the president sat with republicans and democrats from the senate, but he decided that he would not negotiate with remember that famous word about the shole countries, that was another time the president let daca fall so instead we have today, after this has been taken over to the judicial branch, every branch of government has had a chance to address this issue, and now the Supreme Court has decided that the obama that the Trump Administration did not have the right legal basis for ending daca. Julia ainsley, stay with me for a moment. Lets cross over to jacob soboroff. Over the years youve been speaking to either activists, dreamers, a host of people, really, about this subject, and this is obviously a very important decision. I want to quickly cite one important hole really if you will from the latest political Morning Consult poll, 69 of those who voted for trump in 2016 say dreamers should be protected. Threefourth of registered voters say dreamers should be allowed to stay in the united states. This decision reflects in some ways a popular will among americans who wanted to see that. What are you hearing on the ground when you speak to ordinary folks about where dreamers should have been in this country . Reporter i know you mentioned activists and a lot of people think activists when it comes to dreamers. The reality when the country is going through the covid crisis talking about essential worker, front line verse responders, nurses, doctors. These are our neighbors. Here in los angeles its probably the easiest place in the country to meet a d. R. E. A. M. Er of the current active 680,000 dreamers of them, 80,000 are here in los angeles, and it isnt just activists or front line workers or people with important jobs. Its everyday citizens and literally your neighbors and i know pete is looking at the decision. Julias looking at the decision. Im looking at texts from dreamers themselves and i know were going to hear directly from dreamers in a minute. Jose aguilar, a barista at my local coffee shop not far from my house. When the decision came through, first things first, it was six emojis of exclamation points. He says im relieved. I can sleep better now. Now what . Give me permanent status, please. And thats it right there. Thats the message to the congress of the united states. These are people just like jose, who was brought to this country when he was 1yearold from mexico by his parents to live here. Hes lived here, now 29 years old, and at the end of the day, all he wants is a life which is the only life hes known. If this were to have gone the other way, if he and the other hundreds of thousands of dreamers would have been subject to deportation, they would have been sent to a life they never knew. Hes never lived more than a year of his life in mexico, and thats the story that repeats time after time after time the idea of picking people up and sending them back to a country they dont know, when effectively theyre americans. Hes angelino, a californian, just not a citizen of the united states. That is the conundrum, the limbo these dreamers have been living with their entire lives. Jacob, thank you for clarifying that. I meant activist in the sense of the organizations out there on the front lines. We obviously all know dreamers in all facets of life in this country so thank you very much for clarifying that. Thank you, julia as well and Tom Goldstein as well for breaking that decision down for us. Joining me as jacob was saying is jesus contreras, a daca recipient and paramedic in houston. Great to speak to you again. You and i have spoken in the past when we discussed the pandemic and the coronavirus and the response there. You were brought to this country by your parents at the age of 6. This is obviously an important date. I want to get your reaction to the Supreme Court decision that just came down. Im actually very pleasantly surprised. I have been on the edge for the last few months, just kind of worried to death on what the decision of the Supreme Court was going to be. A lot of my activist friends and a lot of the people that are involved in immigrant rights works, theyve been kind of preparing us for the worst, so im relieved. Do you have any sense, and i know that you perhaps heard some of the legal conversation that we were just having about the fact that there are still Unanswered Questions but as youre saying youre relieved. Do you have any concern about what might happen between now and the election in 2020 or do you think that for the time being, this is not something you should be worried about . You know, honestly, i dont think its something any of the nearly 1 million dreamers should have to worry about on a daytoday basis, but unfortunately that is our reality at the moment, until we have permanent legislation that can secure our place in this country, we will always be worried and afraid of what our legal status might lead us to. It could lead us to deportation, and all we want to do is continue to work hard, continue to support this country, and support our communities. When our communities need us, so the last thing i want to have to worry about and any of my daca peers want to worry about is being deported and taken away from their families. Let me ask you really quickly, if i can, about, have you had a chance to speak to your relatives and friends about the decision . I know that youve been waiting to have this, but was there family anticipating this with the same concern that you were right now, if you had a chance to text with them in the last couple of minutes . No. You know, as a matter of fact, i work 24hour shifts on the ambulance. I just got home from my shift right now. I was finishing up a report for a guy about my age who committed suicide last night and so its the last thing that People Like Us want to have to worry about is getting home from an immensely draining job and have to worry about Something Else thats just as bad. I havent had the chance to speak to anybody else, but you guys. I was driving on the way home, trying to drink a cup of coffee so i wouldnt fall asleep. Im sure its good news for a lot of my friends. Im sure my family is staying in tune and in touch with whats going on, but at the moment, you know, i havent had a single second to digest the decision or read into it. So, yes. First of all, let me just say thank you so much for all the work that youre doing on the front lines. We are very thankful you are able to join us this hour with this perspective. Lets cross over to the white house, nbc news senior white house digital reporter Shannon Pettypiece joins me now. This is one of the cases perhaps the white house was not wanting to take deliberate action on as Pete Williams was saying, the president could have been more aggressive. He deferred to the Supreme Court to see how they come down on it, said he did not want to make a decision about daca until the Supreme Court renders its decision. They now have that decision. Where do you think the white house goes from here . What is their initial reaction . Reporter this is a politically interesting situation were in here. The president flip flopped on his support for this program. Early on, he praised it. Then he moved his rhetoric floeser to whatfloes closer to what his base of conservative supporters are, accusing dreamers, some are them are hardened criminals which is not true. You cant apply for the program if you had a criminal record. Hes been back and forth. We havent gotten reaction from the white house what they plan to do Going Forward. It continues to be a question. On the political side, this program is widely supported by americans. 85 of americans support this program. So in a way, the president can say to his base and constituents he was tough on immigration, while not having to face the consequences of seeing thousands of dreamers being sent out of the country before an election that the campaign is very desperate and eager to boost their hispanic support in, particularly in states like arizona. So as we saw with last weeks ruling on Workplace Discrimination against lgbt community, the administration avoids a politically unpopular decision from the court that they would then have to defend and to their supporters can say we tried our best and the Supreme Court went the other way. What else can we do . Shannon, quickly, before i switch gears and break down the legal aspects of this, would this be perceived in political terms as a setback from the president , given that his position in the past on immigration, how much immigration has been a core signature issue for his campaign by political measures, i know he dodges a bullet going into november but at the same time, is it decision, given the fact it was written by the chief justice conservative member of the court seen as a setback to the Trump White House . Reporter well, immigration is the number one issue for republicans, Supreme Court justice is number one issue for republicans. Here you see the president s conservative justices, neil gorsuch and Brett Kavanaugh staying on the side of the administration, and i think it could actually raise the argument for conservatives for why they need the president in here for another four years, they can get more conservative justices, john roberts to them is a bush appointee, not in the conservative mold of the justices that trump and his allies and his administration would like to see appointed. So i think it could even strengthen that argument that they could make about why Supreme Court justices are more important than ever, and why the president needs to continue to remain in office. Certainly will be a call by the president and his supporters. Shannon pettypiece, thank you so much. Maia teresa kumar president and ceo of voto latino and msnbc legal analyst, neil, let me begin with you, historic day in terms of the decision, a bit of a surprise i think by some accounts, even Pete Williams account. What do you make of that decision so far in the first few minutes after youve had a chance to review it . It is a little bit surprising from the oral argument in which i think the challenger to the Trump Administration faced a lot of tough questioning. The Trump Administration trying toi to basically defer a decision on daca, Something Like that, they ended daca in 2017 and then they went to the Supreme Court and sent their top lawyer, the solicitor general, to go and defend that end of daca, and the Supreme Court today said no way, thats illegal. Just as last year, it said no way, you cant add a Citizenship Question to the census. What it really means is the rule of law is coming back to this country and the Supreme Court both in the decision on monday, on title vii and lgbt rights today is standing up to those people. It is others who want to try to get this deferred benefit, and so its a really remarkable and great day for our democracy, and for the rule of law, and it shouldnt be surprising but unfortunately given some of the news over the last three years, it is. Have you had neal, have you had a chance to glance the decision by chief Justice John Roberts there . I have, and so five justices led by the chief justice enjoined by justices breyer, ginsburg, sotomayor neal, do you mind if i cyou . Senator Chuck Schumer speaking on the senate floor about this. Lets take a quick listen to on immigrants and so many of us are descendants of immigrants. Wow, what a decision, and let me say this. In these very difficult times, the Supreme Court provided a bright ray of sunshine this week with the zig on monday, preventing discrimination and employment against the Lgbtq Community, and now this daca decision. To me, frankly, the courts decisions were surprising, but welcome and gives you some faith that the laws and rules and morets of this country can be upheld. Wow, this decisions amazing. I am so happy. These kids and families, i feel for them, and i think all of america does. Now on some other issues, but again, i cannot the Supreme Court you were listening there to Senate Minority leader Chuck Schumer on the floor of the u. S. Senate talking about that Supreme Court decision, apparently very emotional as you can see, saying surprising but welcome decision. Is he so happy for the dreamers in this country, reminding folks that we are still a country of laws. Let me go back over to neal. I apologize for cutting you off. Ill bring marie into the conversation as well but neal, ill let you finish your thought before you were saying before i interrupted. My apologize. Senator schumer speaks for so many americans, with that emotion, the heartfelt emotion and commitment to the rule of law, and so the decision today so far the parts of it read, its not surprising in one sense. The chief justice is a person who believes in law and rules, and what he said in this opinion for the majority of the court is that the Trump Administration essentially acted illegally. They acted arbitrary and capriciously by not even bothering to think about the reliance interests that all the people who relied on the daca program over the last years. They blew it off. They didnt care about it, and this Supreme Court said trump, you dont get to do that and thats what the court is at its finest in points in American History as its been this week. Neal, stay with me. Maria teresa, please give me your reactions to this, because the big question Going Forward i think is, we may have closed at least one chapter on the issue of daca in this past couple of years, but certainly the debate about immigration, what could potentially happen next by this administration is far from uncertain. Exactly right. When trump put forward this lawsuit, he was trying to undo an executive order that hoe bama crafted that obama had crafted in the same as eisenhower and ronald reagan, so this was a complete bogus lawsuit from the very beginning, but it does send a sigh of relief when it comes to witnessing the fact that our judicial system is acting in the balance of power. They are living up to their oath that they are going to be separate from an administration oftentimes during these times we are skeptical that is happening. This was a clearcut from the administration, and gives over 800,000 individuals a sigh of relief. Roughly 200,000 Daca Recipients are essential workers on the front lines and it starts giving people hope of what we can do when we change the guard in the white house. I have to give my hat off to the united we dream, they have relentless in their fight. These are individuals that are not part of a political system in the sense t vote but they have showed every single citizen what it means to protest, what it means to use your courts, what it is to create allies such as you saw with senator schumer and dick durbin. This is how you actually make change in america, and i get a ray of hope because i know that these individuals since Trump Took Office i cant stress enough have been living in an emotional instability. The amount of this decision all of a sudden actually allows them not only to take a deep sigh of relief but it will be able to mend their Mental Health, get back to work, and continue contributing to our wonderful nation. I couldnt be more thrilled but more importantly more in admiration of all the incredible work these individuals have done. Voto latino worked closely with the Obama Administration when they were trying to craft this and to see this result today is an alleviation but also again great joy. Everyone stay with me. Were continuing our breaking news coverage. I want to cross over back to the white house, New York Times chief White House Correspondent peter baker on capitol hill, msnbcs Garrett Haake as well. Peter, let me begin with you and ill pick up on the question we just were talking there with both neal and maria teresa komar. Where does this go next for the white house . They have obviously by any measure been set back this week twice with the Supreme Court decisions. Where does at least the fight for immigration and certainly for Daca Recipients go from here from the Trump White House perspective . Yes, its a great question. We dont know yet but theyll hear a lot of sighs of relief, republican side of the aisle because they dont want to have to deal with this in the next few months before the election. If this had gone the other direction this would have been front and center on the campaign trail making a lot of Senate Republicans uncomfortable at a moment when many of them face tight elections. Youll probably hear the Trump Administration pull back from talking about this very much between now and the election, they had hoped to have some kind of, some talk about a deal, Jared Kushner was interested in pursuing on capitol hill between now and then. That now goes by the wayside and instead, of course, what the president can say is that he tried to tell immigration supporters that he gave it a try and blame the court for his failure to make a change while not having the speed of front and center issue that would galvanize the other side of the debate right before people go to the polls. I was going to say interesting to hear if we get any reporting on the steven millers of the white house and the more hard liners and whether or not they want to make this a front and center issue for the remainder of this campaign saying as you mentioned, peter, the president tried but it was the Supreme Court and use that as a rallying cry for more judges on the Supreme Court. Garrett haake, your perspective on car to the hill. We heard from Chuck Schumer, very emotional, he was surprised by the decision but he obviously welcomed it. I suspect that youre probably going to hear from republicans a slightly different tone about this decision in the sense they may not have to deal with this before the election. Reporter yes, look, i think even republicans by and large especially those in the senate who are up for reelection this year will welcome this decision. It was a fairly lonely decision made by President Trump to try to undercut daca in the first place. That program is broadly popular and a bipartisan way across the country, so, too, on capitol hill. You remember, it was early in 2018 that this debate over daca spurred the first real immigration debate we had in a while in the senate, four different bills put on the floor, four different bills failed. This has been such a thorny issue. Weve had no major immigration policy that gets to the president s desk through this body. I think having this defused at least for the moment by the Supreme Court will be welcomed to cross the board and i think it sets up democrats to say this is an issue we could potentially actually legislate, if democrats get full control of congress and the white house come 2021. None of those bills that were on the floor two years ago now got more than i think 54 votes was the max, the president s favorite bill only got in the 30s. So were still a long way from getting any real permanent legislative solution on any of these immigration related issues. And there are no clear Immigration Solutions for so many of the complex issues were trying to deal with. You have a president saying he still wants to continue with his border wall and he has made immigration front and center of his political doctrine, if you will, in this country, since announced his campaign. The reality of it is, though, there are still so many Unanswered Questions particularly about this program. It has support. Why is that support among americans for Daca Recipients not translating into Political Action on capitol hill . Why do you see that as being a problem when we look at the numbers, 69 of those who voted for trump say dreamers should be supported. 80 of democrats also as well. Its staggering numbers in support for some action on dreamers, but its not translating into Political Action. I think it has everything to do with the president s rhetoric and how he will perceive anyone, even people in his own party who are contradictory to whatever policy he has, as the enemy and for individuals that are trying to get reelected, they would rather stay mute. Were having the conversations on folks on capitol hill from both sides of the aisle. I have been in rooms, ive had conversations where people say were in disagreement with him specifically on daca but we cannot say anything. That say lack of leadership, cowardi cowardice, they, too, hold the same balance of power. I want to be clear there, is a stark difference between what trump is perpetuating coming for reelection and joe biden is r perpetuatin perpetuating. Joe biden declared on day one hed provide a pathway to citizenship for dreamers and individuals that have lived here for a certain amount of time and that actually are able to pass required background checks. That just is a stark difference. The fact that we are a nation of immigrants and we have a president who does all of a sudden recognizes that say problem. Go ahead. Sorry about that, i think we were having a little bit of a mic issue. Maria, did you want to finish your thought . Go ahead. There is a dissonance and we have to make sure the only way immigration is going to get resolved is by the will of the vot voters. We saw in in 2018 for the first time a majority of americans coming out to vote their values. It has to be done in november because otherwise what we have noticed is and what we witnessed is that absent the American People really recognizing, demanding this, congress will not act. We want to go back to capitol hill to continue to get reaction. Joining me now is a democrat in the house intelligence committee, congressman mike quigley from illinois. Thank you so much for joining us. First of all, give me your reaction to the Supreme Court decision. You know, this is a dark period in our nations history. Who knew the Supreme Court would give us a happy moment touring this time. Two times in one week. I am just so happy for the Lgbtq Community and the d. R. E. A. M. Er community. Its a bright moment that gives us some hope that if things change in washington, well have opportunities to move forward so we can remove the uncertainty here for alltime. In the final analysis we have to pass comprehensive Immigration Reform to support dreamers but to include everyone who deserves protections. Congressman, i just want to tell our viewers as well theyre looking at pictures outside of the Supreme Court there as were getting more information about that historic decision. Let me ask you quickly on a point i was talking to maria about, and also one that you alluded to, there is support for action on dreamers in this country, bipartisan support. Threequarters of registered voters say dreamers should be allowed to stay in the united states, even 69 of those who voted for trump according to the political political Morning Consult pistol believe there should be action. Why as a member of congress is this not translating into action on capitol hill from your perspective . Discussion today, we were going to have about john bolton, its about lack of profiles in courage. It shouldnt take this. The Senate Passed some time ago comprehensive Immigration Reform on a bipartisan basis. The republican speaker of the house at the time refused to put the bill on the floor. Had the speaker put the bill on the floor, it would have passed. So now of all times, people have to step forward when they see whats taken place in the last three and a half years, and do the right thing. The best advice i ever got in this business is, in the final analysis, listen to everyone. Do what you think is right and if the voters support that, theyll bring you back. If they dont, at least you can look yourself in the mirror and say i did the right thing. I encourage all my clears to join us and support this decision and do the right thing for everyone who is in a similar situation. Congressman, stay with me. I want to update our viewers as we piece together reaction from capitol hill and the white house. Weve gotten reaction from senator josh holly of missouri the most disappointing week at scotus in years. He goes on to say scotus continues to invent and rewrite statutes at will. So obviously well be hearing more from republicans. There are some who are saying its just not worth continuing this fight but obviously senator josh holly as we saw from his tweet is disappointed with the Supreme Court decisions this week. Are you at all concerned, since this original challenge was brought upon by nine conser conservative attorneys general in this country who challenged President Trump to take action that this somehow could once again be challenged at a state level, even though you have the Supreme Court with this decision today . Its hard to imagine it being challenged any time soon, once the Supreme Court makes a decision like this. It will take something pretty dramatic for it to come back and final analysis, withment of so the other things we care about, what takes place in november. That will dictate policy for the rest of our life times because two or three new justices, who will be with us for many of us for the rest of our lives, impacting critical decisions like this one. You represent a district and a constituency that has i would suspect a lot of dreamers and if not impacted by a lot of dreamers, what is your reaction this morning. In l. A. County alone we have almost 1 million undocumented immigrants and a good chunk of those are and thats not dreamers so this is a big deal. I have dreamers who are korean, mexican, guatemalan from all backgrounds and all walks of life who are going to be excited and theyre not going to have to worry about being this decision hurting their future right now. So its a victory because it keeps hope alive for another day. Xwl one chapter of an important debate may be closed temporarily at least until the end of this election cycle but were still a far ways off from answering the bigger questions around immigration in this country. Where do you want to see this go from here . I definitely want to see us pass the d. R. E. A. M. Act to give a permanent protection to these dreamers, because theyre the ones that are in the balance. Theyre the ones that the government has all their information, so i know theyre always worried about that. I want to say we need to pass the d. R. E. A. M. Act but at the same time we need to push back and we need to make sure that we have a real debate about immigration and what immigration means to this country, but its better for it, its actually immigrants contribute to our economy, they pay taxes, theyre a big part of this country, and theyre even on the front lines of this pandemic, often working at the essential jobs. So i want to have that debate and pass real comprehensive Immigration Reform to take this issue off the table as a political wedge issue and future elections. But as long as Donald Trumps in the white house, you could never have a normal conversation and rational conversation about immigration. He just uses it as a wedge issue and a political hammer to get his voters out to vote in every election. Obviously twitter is the first place for a lot of these politicians to give us their instant reaction. Garrett, what are you seeing right now . Reporter i am noticing this interesting decision among Senate Republicans how theyre handling this. Cory gardner up for reelection in colorado one of the toughest holds for the republicans. Saying this was a good decision and he would support not just the d. R. E. A. M. Act but the house passed a version of the d. R. E. A. M. Act that goes even further than this in terms of guaranteeing legal status eventually citizenship for dreamers. Then you read the josh holly tweet that you just read, just elected in to 18. Hes not up for reelection for a couple more years although i read his tweet as more of a frustration. This is a guy who once upon a time might have had eyes on a Supreme Court seat himself, thinks of himself very much as a constitutional scholar. I see his concerns about this ruling might be more about the process that the court reached to get there, but you do see some division between those who have have stand for reelection right now in 2020 and those who are looking at a longer postdonald trump play trying to position themselves to be more conservative on this immigration issue. There are strange bed fellows on this issue. Keep an eye out for statements from Lindsey Graham here, now in a more powerful position than he was during that 2018 immigration debate. Hes the chairman of the Senate Judiciary committee. They handle immigration issues in the senate. He considers himself basically the left of Chuck Schumer even on immigration issues. Look to see what hes going to say on this and how the republicans in the senate start to shape what their policy is going to be on this immigration issue and how far they go from what we think the president s view is on this, although that has certainly shifted over time as well and very difficult to nail down on any given day. Garrett, ill let you get back to tracking the reactions for us. We will touch base with you in a moment if theres anything new on that front. Maria, let me get your thoughts on an importants aspengt s asp. Since the Trump Administration halted this program, there were no new dreamer applications, those that were already in the program were allowed to renew their applications every two years, and obviously there was concern with this decision that would end. Thats not the case anymore, as we said daca survives but for new applicants, those who were not able to apply over the last couple of years while this was working its way through the courts, do you have an update or do you have a sense as to when that might resume, when they would be allowed to go forward with new applications . This is part of the challenge is that there is a huge backlog for renewals but were encouraging people to renew, to apply, to get into the pipeline. Once you were in the system, that was not a problem, but it didnt matter, because the government basically stopped processing applications. Part of it was an influx of it, part of it was they didnt have personnel because there were budget cuts and part of it people were looking at it the other way. Now because of this decision, we would encourage people to start looking into their system. They should contact united we dream, at the forefront of a lot of this. Neal, let me get your thoughts about this for a moment, because whats interesting is about the origins of this case and as you mentioned back in 2017, the Trump Administration essentially ended the program, but there was within the conservative wing if you will the party some hard liners that spurred this on, the nine attorneys general to pushed the administration to take action on it. Are you at all concerned even though there is this decision from the Supreme Court legally speaking could you see some hard liners try to go about it on a state level in different legal challenges . Oh, absolutely. Theyre going to try. Texas has been at this for now six years, trying and trying and trying to eliminate daca, and it has failed essentially at every turn. Im not optimistic for them that their challenges will succeed in the future. Ive been reading the opinion while others have been talking and an intersection between the legal opinion here and the politics of this. The Trump Administration folks are already out on the camera saying oh, this is a win for us, because the trump can claim the Supreme Court. This decision is a blowout in the water for the Trump Administration, and if you have like me defended the, had the privilege of defending the government before our nations highest court you know, look, if youre defending president ial action, its really hard to lose at the Supreme Court. Theres so much deference. You really got to try. Its like failing a collapse at yale. You got to work at it, and here they managed to do it not just this time with daca, but last year with the census, and so what this is, is an incompetent administration. Any competent administration could have ended daca if they wanted. Any competent administration could have added the zit is enship question to the census. To run on the idea the Trump Administration is going to be tough on immigration, only in a kind of botched way, and thats what the decision today is about. Its like they couldnt do it. You did it illegally so there are were striking it down and i dont think that gives anyone including the hard liners in this country on immigration any sort of comfort about this administration, incompetent through and through. I want to pick up on that point for a moment. Does this case in itself, neal, aside from this specific issue of daca, does it address any issue about president ial overreach . That was at the core i understand from the attorney generals who brought this forward attorneys general, excuse my, i keep messing that up, they brought this in as a president ial overreach. Exactly. The Trump Administration oddly came in and said this is a violation of executive power, what president obama did, the first time the Trump Administration has ever thought anything was a violation of executive power. Normally they go into court and say the president can do anything he wants. Right. So its always been a big bogus and what the Supreme Court today said no, you didnt explain how this is an abuse of president ial power. This is deferring enforcement, which is a quintessential thing president s can do. They said maybe you can do this, but you have to have a good reason and actually explain yourself and Trump Administration, you didnt even bother to do that. Incompetent. To that point, peter baker sorry, maria, did you want to Say Something . Just to underscore, when we were working on this specifically with the administration, it was presented to the administration we knew eisenhower this done this and there was an executive order also conducted by ronald reagan, so this was not something that the administration pulled out of thin air. It was precedent to it. The Trump Administration wanted to overreach, was what the crux of the decision today basically is said he could not do that because there was precedent. Typically you think back to say decisions on gay marriage or decisions on the health care challenge, those were huge celebrations outside of the Supreme Court, a lot of stake holders who came to see history happen. It was combined with other moments were seeing right now, black lives matter signs, there were rainbow flags. Were seeing sort of this culmination of people who are taking a stand for minority rights, whether these minorities be people who are standing for black lives matter or for daca and dreamers and it was a small crew but it was organized and it was interesting to see how people came out and obviously knew that this was an historic day, even if they dont have the numbers theyd typically have outside of a pandemic. Is this as you were talking about earlier hard liners within the Republican Party say as we just heard from josh holly, this was a very bad week and the Supreme Court is reinterpreting laws. Yes, its an interesting question because the earlier ruling this week on gay rights, the president was very muted in response. He didnt take issue with it even though they opposed it in the Court Proceedings even though the ruling overturned the decision that was made even just last week or at least undercut it anyway with regard to transgender rights in the Health Care System and yet he didnt attack this court. He didnt complain about it in a vociferous way perhaps the ruling was written by one of his appoint geez neil gorsuch in combination with chief Justice Roberts and the four liberals. I assume well hear him talk later today and he may have a more aggressive stance. He has been particularly critical of chief Justice Roberts, in the campaign 2016 called him a terrible choice for the court, essentially a conservative apostate. I imagine when we hear the president in tulsa on saturday in front of a crowd of 19,000 supreme he might get more worked up because thats a crowd that he presumably is trying to appeal to with an antiimmigration message you may hear him weigh in on that one on saturday in a more vociferous way. Whats the latest on that back and forth over officer devin bronsons cooperation with prosecutors . As you said, ayman, they have until 6 00 p. M. To surrender. Over the next few hours well see those officers turn themselves in. As for the back and forth over brosnan, there was communication between the d. A. And officer brosnan. D. A. Paul howard was celebrating the fact that he would be a states witness and offer information about what he saw and experienced the night of the shooting. He was praised by brooks attorney saying this is incredibly unusual that an officer would agree to be a states witness and calling him courageous for volunteering to do so. Later in the day, the attorney for brosnan put out a statement saying he had not agreed to be a states witness and it was mischaracterized. He had been cooperating with the District Attorney but in no way was he admitting to guilt or becoming a states witness. Well see how it pans out in future proceedings. Moving developments there. First of all, what is your reaction to what we heard from the District Attorney when he announced those charges . I believe District Attorney paul howard has presented a reasonable case. I think a lot of the details were surprising, like kicking mr. Brooks on the ground. A lot of those things were really difficult to hear. Like i said yesterday, weve got to get to a place of a conviction. Its one thing to file charges and its another thing to get justice with a conviction. As you probably heard, some news out of atlanta overnight, that some Police Officers have called in sick basically in a way of expressing their disappointment or protest with the decision against their fellow officers. As a member of the atlanta city council, what is your reaction to that, and what should be done . We have to come together. This is a moment in time in which we have to rebuild the trust with the community and our local police. Its the only option at this point. Let me get your final thoughts on the messages these charges are sending to fellow officers and to the community at large. The reality is you have one side where the Community Feels like were moving to a place of justice. But then on the other side, you have officers that feel like theyre being disenfranchised and not given a fair and due process. This is why we have to come together, build together. The High Court Says that the Trump Administration cannot shut down daca, the deferred action for childhood arrivals program. Right now were seeing people out in front of the court, folks cheering that decision. The daca program protects roughly 800,000 people known as dreamers brought into this country as children by their parents. 54 decision. Saw chief Justice Roberts side with the courts traditionally more liberal justices. Justice roberts writing in the majority opinion that the government failed to give an adequate justification for ending that program.
