Roy moore he said that more evidence is going to come out to undermine this women. Doug jones can win this race if people look at it like a referendum on basic deessential sill and not a partisan fight which is why moore and trump are trying to make this into a tribal war of politics. These are not women who suddenly are coming forward. These are women, shelby, who have been talking about this to people close to them sometimes for 40 years. And many of these women didnt want to come forward but they felt most of them who wants to put their name behind this so for the rest of their lives the first thing you see or hear is they may have been molested by a man in the u. S. Senate. I also think what President Trump said is so interesting because hes undermining all of the senators who have distanced themselves from roy moore and even threatened to expel roy moore. What happens if he does win . What happens if hes in the u. S. Senate . You have senators calling for his removal and you have the president saying, he denies this. Why would you kick him out . Hes just undermining those in his party and weve seen that with this president time and time again. And trying to explain why hes saying what hes saying. Roy moore is somebody who got kicked of off the alabama supreme court, right . This is somebody who is being accused not of sexually assaulting women, but sexually assaulting girls as young as 14 and he says hes concerned about a candidate whos soft on crime. Its crazy and doug jones obviously a former prosecutor put people in jail all the time, hardly soft on crime. I think trumps political sensibility were formed in the 1980s and whenever hes going forward, he reaches into a tool kit and soft on crime almost a generic charge, as far as these accusers, he was the chief judge of alabama. So why would you ever want to make an accusation against the man who is in charge of the system of justice of your state . Of course they didnt come out. And more than that, when you look at the thread that runs through all of these, these are women who are dealing with men in a position of power over them, a position of power either over their jobs, a position of power overly their lives, or your 14yearold girl whos in a position of he said she said with someone who is in a position of incredible power. And when youre 14, youre mortgagified. You dont want to come forward in the first place. Men who could plant stories in the media, men who are in charge of the justice system. The michigan democrat admitted reaching a financial settlement in 2015 with a former staffer who accused him of Sexual Misconduct. The woman claimed she was fired after refusing conyers sexual advances but the congressman has denied those allegations saying in a statement, quote, my office resolved the allegations with an expressed denial of liability in order to save all involved from the rigors of protracted litigation. The resolution was for millions of dollars but rather for an amount that equate today a reasonable severance payment. The House Committee is now investigating. Kasie hunt joins me now. So the Detroit Free Press which we should say is not a conservative bassion, theres another Sexual Harassment lawsuit that was filed against conyers what do we know about that . Reporter hi chris. My apologizes. I couldnt hear you until the ends of your statement. John conyers, the senior, congressman in frankly all the house. Hes the longest serving member. He holds a very powerful post as the top democrat on the House Judiciary Committee and he has now been accused by two different people, one woman anonymous in a buzzfeed story, the other who is named in Court Filings that were released late last night, both women saying that he essentially made them uncomfortable, made unwanted sexual advances and that it had ramifications in their office in the way that they believe was against the law. He is facing calls for an ethics investigation. The House Ethics Committee has opened such investigation and now youre starting to get a sense of whether or not his colleagues believe that he should step down. The Detroit Free Press, his hometown paper, calling on him to resign. The the New York Times writing a story this morning that suggests and hints at something that some people in washington have been talking about already, he is 88 years old, he is by some accounts in difficult health. In that lawsuit, the woman in question notes that she was responsible for making sure she took his medication. She was responsible for calling to wake him up in the morning. She was responsible for knowing his whereabouts. The times reported that he has gone to at least two meetings in his pajamas in recent years. Again, all of these questions piling up around the congressman and the other piece of this, chris, that i think is part of the narrative youre starting to see playout here is theres frustration among younger democrats that congressman conyers has been in this position of power for so long and that they havent had as much as of a chance to rise because that pathway has been blocked to them. I would argue that thats a separate issue from what were talking about which is Sexual Harassment. Sure. I do want to ask you while we have time and i understand i understand your point. Youve been reporting on this complicated process that staffers have to go through to file harassment claims, right . Sure. Some people have called the system archaic. This has been about the fox guarding the hen house. What are the chances that somebody like Jackie Speier who is one of the people spearheading, no pun intended, are actually going to get anywhere . First of all, chris, i would just say the conversations about connier should resign or not will have more layers. The Ethics Committee investigation that relates to Sexual Harassment sure and that is of course the primary issue that has caused us to talk about any of the rest of this information. As far as Sexual Harassment goes and the process in congress, the more that we see this, the more likely it is that theres going to be incredible pressure on these members of congress to do something. They are the ones who wrote these rules in the first place. Back in 1995 when they created the office of compliance, which is the office where congressional staffers go to complain, they that actually was a step forward at the time. There was nothing for staffers to do. It has evolves into something that critics say is very much stacked in favor of the accused, in favor of the lawmaker and its stacked against the accuser. I think the more sunlight is on this issue and Jackie Speier has said since the conyers news broke, that she had referred to a democrat and republican in the hearing who she knew had been charged with Sexual Harassment or had allegations of Sexual Harassment levelled against them. That connier is not the democrat that shes aware of. We know this is a problem and its a persistent problem and hopefully well see potential that this will change for some of the people who struggle with the system. Its not clear yet where its going. You have new reporting about how democrats are reacting to this news about congressman conyers what are you learning . Democrats are really not running to the defense of representative conyers. There are people who are already hinting that this might be that this might be the hint he needs to take in order to resign because of some of the issues that kasie said but also because of the allegations being very serious. I reached out to Jackie Speiers Office Yesterday and she said these are serious charges that the Ethics Committee needs to be looking in to this and nancy pelosi who is really been someone who i think is very cautious when it comes to her members and to the democrats, that she reached out and very swiftly said, the House Ethics Committee really needs to open this investigation. I also was on the phone with the members of the Congressional Black Caucus and they were telling me, this is someone who obviously has not just been a long serving house member but someone who started the Congressional Black Caucus, hes a founding member, he was endorsed by both barack obama and Martin Luther king. This is somebody with a very storied career. I will defend his legacy but i will not defend anybody for Sexual Harassment charges. So essentially you have the caucuses that usually would rally around representative conyers really taking a step back and saying, we really need to get to the bottom of this. There are only a few people coming to his defense, one of them being representative cryber. Hes unsure whether these allegations have substance. For all he knows these allegations could be completely madeup. Cryber is in a small minority. What do you think is going to happen here . My gut tells me that the House Ethics Committee is going to thorough look at this and theres going to be a lot of pressure for conyers to want to resign. I should say because hes such a long serving member, hes title dean of the house, i think its going to be very hard to get him to resign if thats what people are pushing for. His Office Yesterday was pretty steadfast in saying that he was going to stay the course and that he was caught off guard by the ap when he said he didnt know what these allegations were. Theyre also defending him when we reported at the the New York Times that he showed up to some of those meetings in pajamas. His office denied that and said that did not happen. Theyre pushing back hard on these allegations. In the meantime, you have Jackie Speiers legislation which would make members of Congress Personally responsible for these financial settlements, does that get us any where . Congress is very good at protecting its own butt. The settlement process that were now learning more about is engineered for coverups. Its designed for coverups. If im one of these victims i have a hard time believing that the system will now turn around and do a fair job of investigating but i do think that the energy is on speiers side to push for reform here. I think its hard to defend the current status quo. There will be a push and a bipartisan one to change this. There has to be nonpartship here. You cannot say if youre a democrat, roy moore is bad, but then look the other way when its a democrat whos accused. Right. Were seeing this transcend Political Party and race, occupation, industry. I think one important point of all this its not enough to do an investigation. You have to change the system. The system has been failing women at Companies Like weinstein and charlie roses in the house and in the senate, places where you dont have robust hr department, there is no method to bring attention to this and also investigate it and hold people accountable. No matter what industry youre in, the system fails women so you cant just do an investigation and say we believe the women and not change anything. Lets talk about charlie rose, a former intern, for his show spoke to nbc news and she alleges that rose showed her a graphic sex scene from a movie. She goes over to his apartment just to deliver mail in 2002, this is how she describes what happened. I knocked and he said come in. I proceeded to go into the living room and he said i want to show you this scene from this movie. And he said have a seat, you know. Relax. And he proceeded to turn on the film, secretary, which is a sexually involved film, involving s m, unfortunately and he asked me how does this make you feel, you know . Does it turn you on . That kind of stuff. We should say that gordon said rose did not touch her but you also have a lot of these people who are being accused saying things like, i thought my feelings were reciprocated. Can we just say, shelby, if a woman tenses up when you touch her, if a woman says no, if a woman starts crying, its not okay, its not reciprocated . Unwanted. It blows my mind. Were seeing a pattern of this. Ive been having a lot of conversations with the men in my life, where do we draw the line, whats harassment, whats not . If a woman is not only reporting to someone higher up who has more power but also cannot or doesnt feel like they can say no, thats harassment. If these young secretaries, if these young assistants dont feel like theyre in a position to say no or express their uncomfortable, thats a sticky situation, thats harassment. And you cannot sit down and show a sexually explicit movie and say everythings been fine. Youve been put in a position for speaking for all men. Ill just acknowledge that im putting you in an awkward position. Men of a certain age, men who are in their 50s and 60s who frankly take offense at the idea that every man who is as old as Harvey Weinstein or as old as john connier, it was a different situation back then. Well, you know what . Again, a woman says no, you understand that that means no. A woman is crying, she doesnt want you touching her. Im just wondering what the conversations are among the guys about this. Look, i think there are some men and hopefully a lot of men who are taking this as an opportunity to listen to these stories and think about their own lives and conduct. Most men are not predators, but i think all men should be thinking about is there a time that i made someone uncomfortable or acted inproently in a lesser way and those conversations have to happen and look, the whole 60s things, it was different back then because a sense of entitlement was powerful because the opportunities for women to push back and fight back were much fewer. The cultural is changed. The behavior was still wrong back then. Its a ridiculous excuse. The other thing that i wonder about is now were getting these high profile incidents and we talk about it because it is charlie rose, we talk about it because it is Harvey Weinstein. If you work in a Small Business some where and youre a young person coming up and youre an intern and its your first job, you need that job. Youve got College Loans and you need to pay those off. You need to pay your rent or put gas in your car and some guy that nobodys ever heard of outside of your company is a predator, is anything going to change . Are we at that point or is it just that these high profile situations, people are going to be, i dont know, embarrassed or forced to make changes but theyre only going to be in certain places for certain circumstances . I think its really tough to say whether or not a young woman who is working for a small company, maybe in the midwest and is being sexual pli harassed whether or not shes going to feel like now is a time i can feel empowered because so many people are living paycheck to paycheck in the country, so many people are economically distressed that they feel they have to stay in these jobs. I wrote a story last week interviewing 50 people talking to women who said that they stayed in a lot of these congressional offices or stayed or worked for a senior aide because they were so tied to their success. This was a person that was able to write them a recommendation letter or get them a raise. I also think part of me, because im an optimist, women are watching the news and saying if he can go down, i dont have to take this. If these journalists are speaking up, i can now speak up and i wont face the same repercussions. I can only hope that women out there have a support system where even if nothing changes in that office that they can say, i have to get out of this situation. Im going to tell this person and theyre going to help me at least get a new job. Thats the bare minimum that women can remove themselves from those situations. Lets be clear about the type of information that was accessed in this breach for both uber, riders and drivers, they stole names, email addresses, mobile phone numbers and for u. S. Drivers the hackers accessed 600,000 drivers license numbers so uber puts out a statement. They say they had not seen evidence of fraud or misuse tied to the breach. Can they know this, stephanie, that this is not being misused, otherwise why steal the information . Uber paid the hackers, this was a year ago, 100 grand and the hackers agreed to delete all that information but we dont know that they have. Theyre hackers. Theyre criminals here. The thing that is so stunning is lots of companies have been hacked. Equifax was hacked, yahoo was. They were much bigger breaches but uber chose and they have a bad track record in terms of credibility of not alerting the public who had their information stolen and not alerting the authorities and in some states if you dont report a breach you could get a big fine. So they decided lets have a coverup here and its not their first and lets let it ride. Theyve got a new ceo in town because the other ones were tossed. Great, clean slate. Let me tell you what happened and well change our practices and well make it better. None of this should have happened the new ceo says and i will not make excuses for it. We are changing the way we do business. Our business is looking at this and saying, this is not okay any more. Its not okay any more. The new ceo has a chance to have a clean slate. He defected earlier this month, crossing the countrys southern border into the Demilitarized Zone. You see those north korean soldiers, his former colleagues run after him, open fire and as you are going to see, you then witness on camera, a daring rescue. In the dramatic footage, released overnight, a military jeep hurdles towards the Demilitarized Zone, a border considered one of the most dangerous in the world. Inside the vehicle, a north korean soldier risking his life, desperate to defect. Heavily armed Border Guards racing to intercept him. The defector leaps from the jeep, seconds later. His former military colleagues, firing 40 rounds, he is shot at least five times, his motionless body slumped against a wall. The footage released by the u. S. Led u. N. Command then shows a daring rescue. South korean soldiers crawling to him and dragging him to safety. Just last month, inside north korea, we visited the border area known as the dmz. Our military guide took us through the very same road where the defector is seen and to the heavily guarded border where north and south are just steps away from each other. That is the border between north and south. The escape, an embarrassment for north korea, which insists defectors are kidnapped or lured by the south. Its also a diplomatic violation. Were going to go straight to Pete Williams for the latest on this. I guess, pete, this preliminary injunction goes a step further than the first one . It does go a little further. The essence of both of them is this. Both the judges say that the government can discriminate, but when it does, it has to have a good reason and explain why that theres a governmental justification for it and both judges, both the one in maryland and the one in the district of columbia in october, said that is completely lacking in this latest ban of transgender service. Both of them note that earlier the military had thoroughly studied this issue and included that transgender individuals could serve. Then comes this president ial tweet followed by a memorandum ordering this change which didnt have that same kind of thorough justification analysis. For that reason they say its discrimination against transgendered individuals and is unconstitutional. The Trump Administration has indicated late yesterday that its going to appeal one of them. But it has to appeal both of them and succeed in both if they want to try to turn the ban back on. In the meantime, harvard is facing an investigation into at admissions process. What can you tell us about that . The Justice Department is looking into whether this school is improperly discriminating against asianamericans. Theres a similar lawsuit going on already by a man named edward bloom who has made somewhat of a career of mounting these affirmative action challenges that appear to favor minority admissions. This in the past hes said that theyre unfair and sort of reverse discrimination to whites. Here hes serving reverse discrimination against asianamericans. Now the Justice Department is looking at the same question demanding that harvard turn over a number of documents about its policies specific about the admission of past classes and harvard has said it will comply. The government said if you dont comply with our demand for documents, then well take you to court. So the government hasnt yet sued harvard, its still in essence in the discovery stage, if you will. Prelawsuit discovery stage. So is the argument that this violates civil rights law . That its basically discrimination. Thats the claim here. Now, this is a tricky thing. Because the courts have in a sense been all over the map. But in a couple of rulings, the u. S. Supreme court has said that schools can take race into account. They cant have quotas. But they can consider race as one factor in order to achieve diversity in the student body. And on that basis, the court has twice said that schools can do this, so the question here is is it achieving that kind of diversity and how it is working. Pete williams, always good to see you.
