It comes at a very difficult time in this country as we talk about race in politics and race in equal justice across. Were going to have a live report coming up shortly throughout this hour. Were also, though, following some major breaking political news. Donald trump now appears poised to have to use the very first veto of his presidency. Senator rand paul, republican senator rand paul, we should say, has now announced publicly that he will go against the president and vote to overturn Donald Trumps Emergency Declaration at the border. The senator telling the Bowling Green daily news, i cant vote to give the president the power to spend money that hasnt been appropriated by congress. We may want more money for border security, but congress didnt authorize it. If we take away those checks and balances, its a dangerous thing. That makes senator paul the fourth republican to publicly announce a planned vote against the Emergency Declaration, which would be enough to overturn it along with democratic votes, though not yet enough for a vetoproof majority. It is widely expected that the president will veto that resolution. Lets bring in my panel, Kimberly Atkins, senior washington correspondent for npr and an msnbc contributor. Kevin serilli, Bloomberg News chief washington correspondent. And nick achorman here in studio, former assistant special watergate prosecutor and msnbc legal analyst. Kimberly, let me begin with you. Lets talk about this setback. How big of, how significant of a setback is this for the president knowing that he will have to now use his veto for the first time in his presidency at the hands of his own party . I mean, with the minor caveat that we have seen senator rand paul announce that he opposes something and have him change his mind later, assuming he does pass this vote against this bill it is a setback but it will force the president to veto this legislation that reverses the executive order. We saw several republicans including senator Susan Collins and senator Lamar Alexander really talk about this principle of separation of powers and not allowing the executive branch to usurp the authority of congress. Its up to congress to designate funding. And they see that as just a bedrock principle that they cannot back away from regardless of which president what party the president has in the white house. This is going to be an issue. Its clearly a small defeat at least for the president. But again, its going to take 20 republican senators to override a president ial veto. And even larger number of republican members of congress. And so that is still at this point a long shot. Lets pick up on that point that kimberly brought up. The data and the polls show that a majority of people actually oppose the president s national Emergency Declaration. So given the fact that were still a far cry away from the vetoproof majority for the Republican Party in the senate, could rand pauls decision somehow and with these polls that the majority of people dont want this National Declaration give some members of the Republican Party cover to challenge the president and lead to a vetoproof majority or is that just unimaginable at this point . I think its still a long ways away but i think its a good point youre making because senator Susan Collins and senator rand paul are two very ideologically different types of republicans who have now come out against this. But youve got to dust off the schoolhouse rock vibe to understand how this is really going to go through. The president is in no way at risk of having having congress override his veto power. The math just simply isnt there. The bottom line, though, is in addition to this congressional debate thats going on within the Republican Caucus you also have the threat from the courts. And thats really i think where the lawsuits, led of course by california, i think that might pose more of a risk to the president right now than republicans having enough votes to override his veedo. Thank you, kevin, for teeing up the question about the courts. Do you think, nick, that the only way to challenge this in a meaningful way and not just symbolically, will it be the courts who make the definitive definition . It very well may be that the courts make the definitive decision here. Youve got that case with harry truman during the korean war trying to take over the steel plants. I think theres good precedent to get rid of this because theres no emergency. The reality check here is this whole thing is based on a lie that was developed by two political operatives, sam nunberg and roger stone, for donald trump sew could go out saying weve got to build the wall. Oh, and by the way, mexicos going to pay for it. The whole thing is a fraud. No wall is going to protect southern border. Its certainly not going to do it on drugs. I prosecuted drug cases for years. People dig under walls. They go over walls. They bring it through the ports. They bring it through the water. They do it through airplanes. This is a big ripoff on the american people. Not to mention it begs the question why this didnt get done when you had a republicancontrolled house and the senate as opposed to now when theres more political theater involved in it. Im going to ask you guys to stay with me because we have another big story we want to get your thoughts on and its one we are following. Of course trump and the russia investigation. New numbers that really have to worry the white house this afternoon. 58 of registered voters say that donald trump has not been honest and truthful regarding the russia probe. Probably not a surprise. According to the very latest nbc news wall street journal poll. However, voters appeared split on whether the special counsel investigation had given them more doubts about trumps presidency. 48 say yes. 47 p 47 say no. The president lashing out at the investigation this weekend of course on twitter. He called himself an innocent man being persecuted by some very bad conflicted and corrupt people. And during his marathon speech, over two hours at cpac yesterday, he had this to say. But they fight so hard on this witch hunt, this phony deal that they put together. This phony thing that now looks like its dying so they dont have anything with russia. We want to bring out several key moments coming up in this story. First trump fixer turned president ial nemesis Michael Cohen back on capitol hill this wednesday. And several of the people cohen named during his testimony may also be brought before committees soon. Most notably Trump Organization cfo Allen Weisselberg and trump associate felix sater. And of course theres the big question. Will this be the week that Robert Muellers report is completed and will that report ever see the light of day . Joining me once again Kimberly Atkins senior washington correspondent for npr and senior msnbc contributor. Nick cerilli. And nick akerman, former Watergate Special prosecutor and msnbc legal amount. Kimberly, let me begin with this poll i mentioned earlier, the majority of voters 58 not believing the president ial has been honest and truthful about russia. When you factor in the president s comments slamming mueller, calling it a witch hunt, going after the russia probe even as recently as yesterday, how significant is Michael Cohens testimony on capitol hill given what we heard last week . I think we dont know yet how significant it is because a lot of the most Important Information he probably delivered at those closeddoor hearings that we did not see, and it will be another closeddoor hearing this week as you pointed out. That is where potential evidence of obstruction is reportedly being shared by Michael Cohen and that is what house investigators are looking very carefully into. With respect to his public testimony, we didnt really learn a ton of things that we didnt already know. He did bring receipts in some sense, most significantly those checks that the president wrote in office. But i think 12k3w4r50i6r7b8g9sds you see people who probably understand it but are comfortable voting for it anyway. You see people turned off by it. Thats crystallizing politically. And i think thats you why see President Trump giving speeches like he did at cpac yesterday during to gin up his base, solidify his base, continue to disparage this investigation so politically he might be able to survive it. I think thats where we are right now. Im not sure that the Mueller Report politically is going to have a big difference. But of course it will make a big difference as to what congress does next. Kevin, that brings up an interesting point, which is what is congress doing to try to ensure this report gets made. You public . The nbc wall street journal poll finds that 2 3 of americans actually want muellers findings to be released to the public. Are you seeing any kind of movement on the hill to try to ensure that when this report gets to the attorney generals office, william barr, that he in some capacity releases it to the public . Youre hearing that from democrats, and virtually every democrat ive spoken with regarding this particular issue for the past several weeks when the Administration First floated by William Barrs predecessor the acting attorney general at the time that this would be not publicly released, i mean, there was swift condemnation coming from the left. I totally agree with what kimberly said in the sense that i would pick up on the fact that republicans and democrats have virtually frozen into their respective views as to the russia investigation and its really ultimately going to come down to the Mueller Investigation once it does conclude, does wrap up for folks to be able to look at this. I would just lastly quickly make one point, which is that President Trump addressing cpac last night, that was classic campaignstyle donald it up. I went to countless political candidate rallies for then candidate donald trump during the first president ial cycle and i can tell you it was a marathon last night. He took an ax, a political ax, so to speak, and bulldozed his way through it. That from my point of view was the official start of the president s 2020 reelection. Truthfully. Interesting point. Speaking of that, nick, i want to get your thoughts on something that the house chair of the Judiciary Committee jerry nadler had to say. Watch this. Fellow democrats already say the evidence the president has obstructed justice in the russia investigation is an abuse of power that justice impeachment. So can there be impeachable offenses like that that are not crimes . Oh, sure. Crimes and impeachable offenses are two different things. We have to lay out for the american people, and we cant depend on the Mueller Investigation for this. The Mueller Investigation, number one, we dont know when its ending despite lots of rumors. Number two, its focused on specific crimes. And we have to focus much more broadly. On abuses of power. Nick, whats your take on . What are some examples of abuses of power that may not necessarily be crimes but at the same time can be impeachable offenses . There are lots of things it can be. Could be the stuff with the payoffs to the women in the Southern District of new york. But i think the bottom line is if there is going to be an impeachment proceeding its going to come not because of a Mueller Report but because of an indictment bringing together everything thats known about the russian investigation, indicting high people in the administration with respect to the two indictments that we already know about on the russian intelligence officers. That relating to the social media indictment where the russians used social media to suppress microtarget voters and suppress the Hillary Clinton vote and the breakin to the Democratic National committee. I think theres not going to be a major Mueller Report as such. Its really going to be one indictment at a time. And this is exactly what happened during the watergate era. Everybody was divided. Public opinion was divided. But once major indictments came down indicting the president s attorney general, his two top aides, and a whole series of other top aides in the administration, the whole atmosphere changed. And these polls right now i think are meaningless in light of what we might see with major indictments coming down. Interesting to hear that. Nick, thank you very much. Armed with a message of equality and Voting Rights for all, a number of democratic president ial candidates are in selma today marking the 54th anniversary of the day known as bloody sunday, when Alabama State troopers attacked peaceful civil rights protesters as they tried to cross a bridge in that city. It was a watershed day that helped build support for the Voting Rights act later that year. Several 2020 contenders and a large crowd are gathering on that bridge right now to reenact history. And for some of those candidates today doubled as a campaign stop. It also showcased a growing divide between two wings of the party. Nbc news correspondent al li vitali is live in selma where a reenactment of the historic civil rights march is under way. Weve seen some tensions between the past few days between Hillary Clintons camp and those backing Bernie Sanders as he gets back into the race full thought p. Were there signs of the divide this morning not just between those two but among the other democrats that are down there . Reporter yeah, so i think that thats a divide ive seen both playing out when ive been talking to voters on the campaign trail and also physically in person here today. Hillary clinton and Bernie Sanders clearly still have a built bit of bad blood from 2016 and it was really on display when they were at the church and apparently Hillary Clinton hugged cory booker, it was apparently a very warm moment and then it came to Bernie Sanders and there was a very chilly, icy moment between the two of them. So obviously, thats a tension that were going to continue to see over the course of 2020. But here on the Edmund Pettus bridge many people have just marched over the bridge and the candidates are all on the other side of me in front of me. But i have to tell you just a really moving moment. A lot of singing. A lot of memories here on this bridge. For the moment that it was in the Civil Rights Movement, Hillary Clinton, cory booker, Sherrod Brown, his wife Connie Shultz all marched across. Bernie sanders wasnt present for this. He does have a rally in chicago later tonight. But the weather seemed to cooperate even just for this short moment to walk across the bridge and remember bloody sunday. What were the other candidates focusing on as they spoke to voters in selma today . There was a lot of focus on Voter Suppression and how to combat that Going Forward. Front of mind for many of these both candidates and supporters here today is the idea of what happened in the georgia governors race with Stacey Abrams and brian kemp. I was talking to Sherrod Brown a while ago and he said he feels that election was stolen from Stacey Abrams. Thats something ive heard from voters across campaign rallies, who talked about what Stacey Abrams meant to them in 2018 and the role she could play Going Forward in 2020. But Voter Suppression was on the top of everyones mind here. All the candidates spoke about it. Take a listen to what they had to say. You cannot preach right and do wrong. You cant come to selma to remember what happened in the past and leave here and forget the obligations of the present. Real populism is never racist. Real populism is never antisemitic. Real populism doesnt divide people. Real populism doesnt push some people down to lift others up. Now, democracy and the right to vote is not some esoteric intellectual concept. Its our turn to demand that we end all Voter Suppression in this country. Reporter and so yes, this is about remembering what has happened here during the selfrights movement. But theres also a desire to mobilize the energy of this group of people who are here today remembering this and put it toward voting in 2020 and all of the elections beyond that. All right. Ally vitali live for us in selma, alabama this afternoon. Thank you very much. While the 2020 contenders make their case to voters, some brand new nbc poll numbers show the president faces an uphill battle to reelection. Only 423410 voters said theyd send President Trump back to office. But that number isnt exactly a slam dunk for democrats either. A majority of the people surveyed are confident about the economy, which has often worked in favor of an incumbent president. With me now is matt macowia. A republican strategy exist president of potomac strategy group. And alisha mills, a fellow at hafrkds institute of politics. Great to have both of you with us. Let me start with this new nbc poll number we have showing President Trumps Approval Rating at 46 . Thats three points higher than it was a few months ago. Should democrats be worried that trumps numbers arent lower given everything that has happened to this presidency so far . Yeah, i think thats right. Thats the right way to look at it because if you look at the nbc wall street journal poll, 46 job approval is the highest hes ever been at in that particular poll. It is important to point out in a generic ballot race with trump versus a generic democrat he was down 4841, which is a sevenpoint disadvantage. However, last year he was down 13 points at one time and 16 points at another time. Look, hes in a range. Hes in a middle range where he could be reelected he could also be defeated. We have a long way to go. We have to see what happens with the Mueller Report, see what happens with trade, the economy. What happens with these investigations, who the democrats nominate. There are some huge variables still out there. Aisha, let me get your thoughts on this because there are some interesting numbers that show more democrats want policy thats bring major change. To be the driving force of the campaign, even though as we mentioned the economys doing well and even though policies might be more expensive and more difficult to pass into law as we hear some of these issues that republicans have jumped on as socialist, things like medicare for all and what have you. In the polls in the poll voters also valued things like bold ideas in their main priority over someone who focused just on beating trump. Which do you think should be the focus of the candidate and the party Going Forward . Is it beating trump or is it trying to make it an you shallcentric race . Heres the thing. We can chew gum and walk. I think it needs to be both. What youre seeing is that democrats know that the strategy of just resist, resist, resist is not necessarily aing longterm strategy to transform the nation. We need to resist donald trump and get rid of donald trump because he is a horrible actor for this country. At the same time the democrats have to put forth a bold vision for who we can be in the future. Where does our country go from here . In the posttrump era. And i think the people are really, really thirsty for ideas, for policy solutions that are really going to change their dateday lives. And thats what weve been lacking because weve been watching this krazy clown show play out with this administration on television that people are wondering where are we going to go from here . The democratic candidate that can answer that in a compelling way, in an inspiring way is going to be the person who wins. So to that point, matt, when we talk about some of the big issues that democrats are adopting in pushing for medicare for aushl in the case of Bernie Sanders free college tuition, the label that gop members and others are using is socialism to describe that policy. It is a word that shows it only has about 18 positivity in terms of how americans view that word. How much do you think of the gops focus will be painting the democratic candidate, whoever they are, with this broad stroke of socialism . Yeah, i think its going to be an integral part of the president ial general election once the democrats choose their nominee. I think democrats sometimes struggle when theyre asked to find the difference between the Democratic Party and the socialist view. And so the poll you pointed out did have i think only 18 peshs viewing socialism positively in america, 50 viewing it negatively. The program they appear to be putting forward, whether it is medicare for all, whether its green new deal, whether its free college, all these things are hugely expensive and would take us much more in the direction of some of those countries we see in europe and i dont think thats a drek the country wants to go. The president wants to and the republicans want to define the democrats as being extreme. Aisha, how do democrats and the democratic candidate combat that stigma that matt laid out . They just simply put the people back into the politics and the policy. All the policies that we talk about are actually about making life better for americans. We want to make sure that our planet exists so that we have sustainability for regular people. We want to fix our economy so that folks can have good jobs but also have fair wages where even though theyre working 40 hours a week they can actually pay their bills. I think the way the democrats continue to message and continue on the path theyre on where people are listening and excited by their ideas is to focus on the policies as they relate to people. Republicans want to get us off on a sideshow where they could care less about the def sxit is about spending when it comes to going to war, for example. But when it comes to policies that affect people, they dont want to spend any money. So i think the democrats are on board by just focusing on the people. Less than a week after his trip to vietnam President Trump is clearly setting a trend when it comes to his discussions with dictators and its that trend to continues to draw concerns. Take a listen. I spoke with the crown prince yesterday. And he strongly said that he had nothing to do with this, this was at a lower level. And some really bad things happened to otto. The president s decision to take the north korean dictator at his word has drawn criticism from all sides, including warmbiers family, who said in a statement, kim and his evil regime are responsible for the death of our son. No excuses or lavish praise can change that. Even at yesterdays cpac conference in maryland when President Trump had an opportunity to lay the blame for warmbiers death squarely with kim jong un he failed to do so. Joining me to break this down, gary semor, senior fellow with the korea project and Senior Executive director of the crown center for middle east studies. And steve clemons, editor at large at the atlantic. Steve, let me begin with you if i may. Why do you think that donald trump seems to give these authoritarian, in some cases dictatorial leaders, a pass on some of the more basic issues where his own Intelligence Community says otherwise . Well, two quick pieces to it. I think first every president thinks that they can bend or move the character of leaders they dealt with. Bill clinton thought he could do that in the middle east. He wasnt president yet, but joe biden, the biden doctrine, the piece i wrote talked about joe biden and personal relationships and understanding where those leaders could be moved. So thats part of leadership. But the other part of it is Donald Trumps incredible narcissism that goes to such a point that he actually disdains those advisers around him whom he looks at as lesser than him. And that hes able to do things that the department of defense and all of the intelligence agencies and all of the advisers around him cant. So those are the two drivers of this. One, its a characteristic of the job. And two, theres something peculiar about donald trump and the way he deals with advice which he doesnt seem to take very well. Let me play you gentlemen both the sound bite of the president yesterday speaking about warmbier. Im in such a horrible position. Because in one way i have to negotiate. And the other way i love mr. And mrs. Warmbier and i love otto. And its a very, very delicate balance. Sew seems to, gary. He seems to at least the president echoes how he has dealt with other controversial killings of in the case of Jamal Khashoggi not an american but obviously someone who worked here in the u. S. Whenever he was asked to condemn the Saudi Crown Prince he always puts it in this anz actional way. He pointed to the deals we have with saudi arabia that are just too valuable to turn away from. Why do you think this president is incapable of seeing anything other than a transactional way . Well, every president faces a dilemma when they deal with odious dictators. Whether theyre our friends or our enemies. On one hand theres no value in publicly offending them, in insulting them. In fact, that would be counterproductive in terms of the objective that the president s trying to achieve. On the other hand, theres a tremendous cost to publicly exonerating these dictators because that undercuts domestic Political Support for your Foreign Policy. And President Trump cant seem to quite get that balance right. It is a difficult balance. But its one that he has to be able to accomplish in order to both have an effective Foreign Policy in terms of dealing with reprehensible leaders, of which unfortunately there are quite a few, and at the same time not saying things that cause a domestic political uprising that damages support for his Foreign Policy. But gary, doesnt that also possibly embolden other authoritarian leaders to continue carrying out these attacks, knowing that hey, you know what, this president doesnt seem to care if i do this or hurt this, hurt this american or hurt this dissident or what have you . Well, as i say, i think if you avoid vindicating them, if you avoid excusing them, then that will reduce to some extent the likelihood that these dictators will carry out actions like assassination and torture and political repression. Of course theyll do that anyway because its in their interest. Thats how they maintain control. So i wouldnt exaggerate the extent to which what any american president says is going to necessarily fix a much more fundamental problem with the character of these regimes. Steve, let me just ask you really quickly. The Administration Just days after the summit is now announcing that the u. S. And south korea will no longer hold largescale military exercises. The president even tweeting out just a few minutes ago that the reason hes actually doing this is to save america money. This is something that north korea has obviously wanted for a very long time. They refer to it as war games, smyth president once adopted in his own language talking about this. Why is the u. S. Doing this while seemingly getting nothing concrete in return . Because he basically kowtows to foreign autocrats and he likes to kick our allies in the teeth. I mean, i just want to be honest about this. When i was here the first trip that donald trump made to south korea i was on msnbc, it was about 3 00 in the morning and donald trump was at one of the camps where our soldiers were based and he said he could have built that base on time, built it for less money. And that base was not for our security anyway, it was only for south korea. And therefore, he undermined the very purpose of his trip, which was to assure the south koreans that their security was our security. This is a person who doesnt like allies and doesnt like americas Global Military presence in the way weve shaped it. And thats a real problem. Yeah, its been hard to wrap our head around in some of these areas where the u. S. Has been a traditional i guess stabilizer in some of the more unstable parts of the world. Habitual and pathological liar. But not aw lylears lie all the time. Many Media Outlets paid attention to what Michael Cohen did not say in his congressional testimony. There was a very telling sentence in his Opening Statement that talked about the culture of lying within the Trump Organization and implying, same thing for the administration, of that it was the norm to lie, implying obviously that its the exception for people to be truthful. So all of the specific instances of where the president had lied, where cohen had lied, where others had lied, all lead you to a conclusion, at least for me, is that there is an inevitability hopefully soon that the american public, even people who support him, realize that his ethical behavior has no place in the white house. I have Great Respect for both the people both members involved here, have developed a nice relationship and friendship with the freshman member. So i just think we have to be really careful. I am a strong supporter of israels right to be a state. But on the other hand, i have disagreements with this administration and israel. Visavis the settlements, for instance. Thats different than and i think thats fair, obviously, that this is a democracy, we should have differences of opinion within the democratic framework. I think the bigger thing you sort of hit on is whatevers happening in this country, and ill be perfectly honest, i think its social media, i think its 24 7 news, no offense to you, and then i think its this president where its just every day there is some drama. So i think within that context, at least for me and i think for a lot of my colleagues, you just have to be really careful because people are watching all the time.
