Want to bring in nbc news capitol hill correspondent kasie hunt, we have a statement from blags blasey fords lawyer and that shes in discussions about testifying next week. Reporter this appears to be the headline we have been waiting for. We should underscore nbc news is working to confirm, i keep checking my email, this story the New York Times has. The reporter of the story has an email she writes from lawyers for dr. Blasey ford that say she does want to testify. And i will say based on the sources i was talking to, this actually doesnt necessarily surprise me because those two other letters did leave the door open for her to eventually testify, they just focused on the aspects of this she felt needed to be different. The word fair is of course going to be the big negotiating point. What exactly is fair. The question of her safety obviously could potentially dictate whether it is a private hearing or public hearing. Were pretty used to conducting these high profile events on capitol hill. It is not uncommon for there to be managed chaos is what i would call it, but obviously security protocols here have been pretty strict and is something the hill is used to dealing with, but of course she and her lawyers said she has been the subject of Death Threats so theres obviously a lot of concern about making sure she feels comfortable and safe in whatever context shes going to testify in. One thing that stuck out to me is that according to the times reporting, theyre saying monday is not possible in a flat out way. Theyre saying next week rather as the time frame for her testimony. There are a few procedural complications with that. If theyre going to move forward sometime next week, they have to let the committee know that thursday, today, or friday to hold it a week from today or a week from tomorrow. Thats a rule the committee typically operates under and thats why the deadline of monday was set in the first place, because we rescheduled the hearing for next monday, this past monday, which feels like a long time ago to me now, frankly, i am sure it feels longer to judge kavanaugh and to dr. Ford who have been going through this personally. But i do think that we had sort of reached this impasse where both sides were frustrated how things were playing out. Republicans were drawing a harder line in the sand, no, were not giving you any more time. We move ahead with the vote if you dont show up. Dr. Ford taking time behind closed doors to figure out what she wants to do. Obviously significant step toward the hearing thats been in limbo and which would be just a spectacle of enormous proportions with unbelievable stakes, seems on track to be more likely today at this hour, ali. Despite requests from the attorney for the professor, blasey ford, a public hearing is still scheduled for monday in front of the Senate Judiciary committee as she was saying. A group of Democratic Senators comprised of former prosecutors and state attorneys general sent a letter to the white house saying the fbi needs to investigate. The letter argues declining to have the fbi take action under the circumstances also abandons the precedent that president george h. W. Bush set when he asked the fbi to investigate after anita hill raised allegations against judge Clarence Thomas in 1991. One of the Democratic Senators joining me now, senator from vermont, patrick leahy, senior most member of the Senate Judiciary committee, also a member when anita hill testified in 1991, and he was a state attorney in vermont back in the day. Senator, good to see you. Thank you. Tell me what youre trying to get at. The Senate Judiciary committee cannot ask the fbi to reopen the investigation, the president has said the fbi doesnt want to, and it is not what they do, but in fact the Background Investigation if the white house asks them to open it up, they can. Of course they can do it, and of course the chairman of the Senate Judiciary committee could ask them to. Anita hill, republican president , republican chief counsel, they said wait a minute, those allegations came up, step back, and they interviewed a large number of people. I was one of those who believed anita hill, but at least you had all of the evidence before you. Here theyre rushing to judgment, almost like theyre trying to hide something, step back, take a deep breath, let the professionals with no partisan interest in this either way, let them talk to the various witnesses and get us some answers. Lets talk about the function of the Senate Judiciary committee. Youre saying let the professionals handle this because the fbi or Law Enforcement bodies have investigative experience to get to things that the Senate Judiciary committee, as much power as it has, it is not built that way. When i was a prosecutor, you mention i was a states attorney, we had cases, especially sexual harassment, we called in people trained in that area and let them at least do the investigation. Then the prosecutor in this case the senators have to use their judgment, how will they act on it. But were not the ones investigating, let the professionals do that. Let them talk to anybody thats involved and come back with a nonpartisan, nonbiased report and then each one of us have to makeup his or her mind what theyll do on it, but we dont even get the chance to makeup our mind if you rush it through and not allow all of the facts to come out. What are they trying to hide is the first question. If theres nothing to hide, then take the time to show that. Back in 1991, senator Chuck Grassley, chairman of the committee, agreed with the idea that the president asked the fbi to investigate the claims that anita hill made. Lets listen to what orrin hatch said in 1991. I have to say, chairman biden, and the Ranking Member thurmond, when they heard about this the first time, they immediately ordered the fbi investigation, which was the very right thing to do, appropriate thing to do. They did what every other chairman and Ranking Member have done in the past. And the investigation was done and it was a good investigation. Senator, why the difference now . Why would grassley and hatch agree and say it was a good thing to have the fbi investigate in 1991 but not think so now . Back then the senate actually worked and tried to be the conscience of the nation. Sometimes we got things right, sometimes got them wrong, at least you tried to make it work. Now we have a senate that for over a year blocked a consensus and nominated merit garland simply because he was nominated by barack obama. And as soon as they got a trump nominee, theyre trying to rush them through, set all of the old standards aside, for example, on one of the obama nominees, they got 99 of her records, but the white house, here theyre allowing 8 or 9 of judge kavanaughs record. Theyre just changing the rules. The end justifies the means. But the American Public has a right to ask why are you rushing, why are you changing the rules, what are you trying to hide. Senator patrick leahy, thanks for talking to me from vermont, Ranking Member of the Judiciary Committee. Several of you have been tweeting me, asking what the fbis role is in this kind of situation. For more on that, want to bring in shawn henry, former executive assistant director of the fbi and Msnbc National Security analyst. Shawn, the issue seems to be that theres no federal crime that would be investigated, that if this were investigated it would be as a state crime and hence the fbi wouldnt have normal ability to just go in and investigate this, but as senator leahy said, the client of the fbi at the moment with respect to the nomination is the white house. So if the white house were to ask the fbi to do it, they would do it. Yeah. I think it is important to make the distinction. The fbi has already conducted a Background Investigation on judge kavanaugh. In fact, theyve done it multiple times. He is already a federal judge. They have done a Background Investigation previously than this subsequent one for his nomination to the Supreme Court. I think whats important to understand is that this is a suitability for employment investigation. So theyre checking on the nominees character and on his loyalty to the u. S. Government, his trustworthiness, et cetera. The fbi takes the results of that report, they interview coworkers and neighbors and references, they do standard types of criminal checks, et cetera. They take that report, they send it to the white house. The white house reviews that for the nomination process. Theres no criminal investigation here by the fbi. They dont have any jurisdiction about any of the events that occurred more than 30 years ago, but they could go back and do a followup investigation to look at these allegations if in fact the white house went to the fbi and said we want you to followup on these allegations to determine the credibility of the allegation, ali. I guess thats an important distinction to make. Theres likely not to be any criminal charge to come out of this, but theres an establishment of facts that the senate now is charged with trying to figure out, and as senator leahy said, theyre not really good at that, theyre not really equipped for that. So the mind goes to the fbi, you think theyre an investigative body. What can the fbi do if this is not their bread and butter, if they dont investigate one off crimes, do enterprise crimes and bigger things, lets say the white house said open this Background Investigation up. Would the fbi itself investigator get other Law Enforcement agencies involved . So first i would say that in terms of any type of criminal investigation, any statute of limitations would have well expired by now in any event, so theres no criminal investigation here. If the fbi were asked by the white house to go back and continue on their suitability inquiry, their Background Investigation, again, going to the candidates character, his personal beliefs, his loyalty to the United States, they would go back at the direction of the white house and followup on this allegation. They would likely start with dr. Ford to get her perspective of what happened to see if she knew if there were any other people who might corroborate her story, maybe there are photographs, maybe she has a diary entry and documentation she can provide. But it would start with the fbi sitting down with dr. Ford, collecting Additional Information about her perspective, what occurred during the incident. And follow up there if there were additional pieces of information to corroborate this. But theres no criminal investigation. It is important to understand the distinction here. Shawn, thanks for your analysis. This is the third day judge kavanaugh spent at the white house. We have been told he hasnt spoken to the president directly. Despite the ongoing controversy, he is standing behind his pick for the Vacant Supreme Court seat. Kelly odonnell, do we know other than the obvious that theyre probably working on a strategic, and the white house is steering the nomination strategy for Brett Kavanaugh, it is coming out of the white house counsel, don mcgahns office, but do we know specifically whats going on . Reporter some idea. With this nomination and others previously, the white house remains the headquarters for a Supreme Court nomination confirmation process. Thats part of why judge kavanaugh has been here at the white house multiple days this week as he was prior to this latest series of events breaking open. It has sort of been his new office between here and capitol hill. We are told by some of our sources there has been a question and answer preparation. Thats done for every time theres a witness going to appear before a committee. As it stands now, the expectation is that judge kavanaugh would appear monday, be at the Judiciary Committee, facing new questions that would deal with the allegation made by Christine Blasey ford and all of the things around that, and that that would be his moment to stand up for himself, to say his side of the story, and what we understand is that the white house says that according to their assessment of how the judge is doing, that he feels confident, that he believes he can hang in there if you will, have hope about this process. Thats the point of view from here. It is the case that the timing issue has really been driven by Senate Republicans who would like to see a nominee on the court by the first monday in october. Always the start of the new term. Democrats throughout the process tried to slow it down, thats part of the tension that happens when theres a fight over this, and what is new is what you have been talking about, the question of who should investigate and who should not. Senate Judiciary Committee has investigators and Chuck Grassley has deployed them for many different topics over the years, people with investigative skills. He is saying he would do that again. Then theres the issue discussed about potential vochinvolvement the fbi. Biggest difference between this and anita hill and Clarence Thomas, that was workplace with adults and lots of people in corroborating situations in the workplace for the investigation. This as you discussed is a very different thing. The white house will continue to likely be home base for kavanaugh as he prepares for whatever comes next, and youre right the president said publicly he decided not to talk to kavanaugh so there would not be any interference from the oval office to the process. Moments ago, the Harford County maryland sheriff held a News Conference on the fatal workplace shooting we were reporting in aberdeen, maryland. We are learning more about the suspect in the case. Listen to what was said moments ago. There are seven people that have been shot in todays incident including the shooter. Three people are suffering from injuries which theyre expected to survive, three others are victims of our shooter who lost their lives here today, two at the scene, and one at the hospital. And the fourth loss of life is the victim. Im sorry, is the suspect, or shooter. The victims names we are not in position to release, we have to make notifications, thats a process ongoing. We are not prepared to release victims names. We will get them out as soon as possible. The suspect is a lone female suspect, age 26, who had last known address in baltimore county. She has died at the hospital from fatal injury, self inflicted gunshot wound. It appears again as i said this morning that she was armed with one handgun and several magazines. No shots were fired by any Law Enforcement responder. Our detectives are still working to establish a time line, but at this time what we know is that the suspect was a temporary employee employed here at the distribution center. She had reported for her workday as usual and around 9 00 a. M. , the shooting began, striking victims both outside the business and inside the facility. We do not at this time have a motive for this senseless crime, and the investigation, even though were only hours into this, it is early in an investigation this size and scope. So the sheriff is saying six people were shot, three killed. The suspect, a 26yearold woman also dead. She shot herself. And as the sheriff said they dont have a motive yet. Hurricane florence killed 36 people, including two women that drowned in South Carolina when a sheriffs van taking them to a Mental Health facility was swept off the road by flood waters. The deputy survived. This comes as rain swollen rivers in the Carolinas Continue to overflow banks causing major flooding in some areas. The National Weather service says some areas expected to rise well above flood stage this weekend. Flooding has inundated the small town of nichols, South Carolina, close to the border with North Carolina, two years after the town was flooded by rain from hurricane matthew. Marry and a marry and a whats the situation where you are . Reporter people here refer to the devastating flooding during Hurricane Irma matthew, call it the 100yearold flood. In this town, there were 450 homes. Only 7 were left standing during matthew. I want you to look at the pictures right now. The flooding from florence is expected to be much worse. This is essentially now a town underwater. All of that water, ali, that we saw in North Carolina that you withstood during your hurricane coverage is slowly making its way here like a slow motion disaster, like a bubble that reached nichols and is making it south to conway, South Carolina, where you had President Trump yesterday and could threaten myrtle beach further south. The response to nichols, we brought high water vehicles like the one youre in now. Helicopters on scene on stand by, capable of hoisting people out if they need to. Also boats and other equipment here to support the town, get through the crisis. 20 soldiers that have been stationed at the city hall. They have sandbagged that city hall. We kept that city hall right now as you see, flood waters are around, how deep they are, only three inches of water in city hall. Other places up to 6 or 7 feet of water. For us to understand whats headed to places like conway and myrtle beach, whats the response like in the rest of the state, especially further south . The South Carolina National Guard has almost 3,000 soldiers. They are stationed up and down this river. Our leadership is here. Flooding in the carolinas comes as puerto rico marks one year since Hurricane Maria devastated the island territory. San juan, puerto rico, where a celebration is set to go any moment now. Researchers released a report saying maria is to blame for nearly 3,000 deaths. President trump has disputed that total. A year later thousands of Puerto Ricans are struggling to rebuild. Some still havent received any assistance from the federal government, so private organizations stepped up to help. One of those private organizations is the 100 roofs program, sending carpenters from new york to puerto rico to rebuild homes and train Puerto Ricans to become construction workers and roofers through an apprenticeship program. We have these disputed numbers that George Washington University Says of the number of people that died, we know almost everybody has power, but not everybody has running water. But there are houses still not rebuilt. Yes. Over 60,000 homes are without roofs today, a year later, of the devastation of Hurricane Maria. The delayed devastation, thats exactly what had occurred in puerto rico and is still occurring. Our hearts go out to the victims and people who are struggling with hurricane florence. It is funny some of us are debating the devastation in puerto rico. Obviously making a documentary out of this is helpful in establishing the historical record. Absolutely. It was really important to go down there in february, rosie and i went there through maran were there not only showing how the Apprentice Program works that we are doing, where we are rebuilding roofs and teaching locals carpentry. We wanted to get into the island and in the communities in the mountains and speak to the families, these people that have lost a lot, some lost family, some lost their homes and roofs, and speak to those we were able to have a positive impact which we could see the roofs we built. It was a real tangible experience to meet the people, see how emotionally effected they were. One community in the mountains was a community that were people that were mute, they couldnt communicate, speak, get word out what they were dealing with, and while we were there, there was a woman every day couldnt stop crying with the idea that people were here showing up to help her. Thats something we have been trying to do. We think we can duplicate the program through the island. This is an important matter. I was in san juan after the hurricane hit, there were parts of san juan you could see that had power, or people had generators, the devastation wasnt as serious, but there are parts of puerto rico people not from there probably wouldnt know and havent seen, ramone referred to some of those mountainous areas that suffered not only devastation but such delay in getting any kind of help back in to them. Yes, and theres still a delay, a lot of them still havent received assistance. Whats good is that the tourist area of puerto rico is open for business. I encourage everyone to go there and bring their dollars and help. But once you step outside of the tourist areas, you see the devastation is still in effect and so many are suffering. We see 100 roofs. Thats 100 families. 100 families are sitting in their living rooms to date with a roof over their heads. And these are the regions, these are the areas, the communities that the tourists dont go to, and they shouldnt be forgotten about. They are american citizens. Ramone, people ask what can they do. In trying to determine whether you are telling falsehoods or not, ive got to determine what your motivation might be. Are you a scorned woman . No. Wow. Obviously one doesnt have to dig too deep into the 1991 hearings to figure out how this shouldnt go in front of the senate if dr. Blasey ford does testify, but you dont think the senators want this to happen. I dont think that judge kavanaugh wants this to happen. I have been saying since early on this week that judge kavanaugh was hoping dr. Ford would not show up for the hearing, so i was surprised when we started to hear she wasnt going to. This is a good thing for dr. Ford, her lawyers and she made the right decision to appear next week at some point. I think it is smart that they negotiate conditions and terms for the hearing that will be fair to make sure the process is fair for her and that we dont have a repeat of the anita hill hearings. Her lawyer, debra katz, has written in a letter to Senate Judiciary committee, dr. Ford asked me to let you know she appreciates the options you suggested. It is not a long letter, not overly confrontational, focuses on her safety and security. One of the things you would recommend if you were representing dr. Blasey ford is that her lawyer gets to sit next to her. Absolutely. There needs to be a chair next to her with her lawyer present. You saw the clip just before, inappropriate questions need to be objected to. That needs to be negotiated with the senate prior to the hearing. So that way you can speak up and be recognized at the hearing. I remember the iran contra hearings, oliver north had brendan sullivans famous words, he said im not a potted planted potted plant. Whoever is there needs to be sure she is not asked about prior sexuality activity with other people and irrelevant questions meant to embarrass her. Her lawyer would know thats unfair. Thats a highly politicized question or meant to effect her credibility. Absolutely. And in terms of her safety, i think what her lawyer is getting at is not safety to and from the hearing, theyre talking more of a long term safety issue, having the fbi or marshals be sure the next month, two, or three that she is protected and people that are making Death Threats dont interfere. Whatever happens, shes is not on trial. The senate is not a jury and this isnt a trial. Thats right. Theres no real burden of proof here other than to convince the senate if they shouldnt confirm this appointment. It is not a trial, but they should call witnesses other than dr. Ford and judge kavanaugh. Those are two obviously very important witnesses, but there are many other witnesses, including the other person, mr. Judge and other people who said he is not going to testify. They can subpoena him, they can subpoena others. We need to hear from other people who are either corroborate claims or not. I said earlier this week i didnt think there was going to be a hearing, never thought it was because dr. Ford wasnt going to testify. I thought she would. I thought it was judge kavanaugh that wouldnt do the hearing. I stand by that. I think now that she will be here next week to testify, i dont think judge kavanaugh will go through with it. He is at the white house. I am sure doing debate prep. When you look at things in the yearbook, there are so many things for cross examination on that, he will be hard pressed to go before a committee under oath and answer tough questions about whats in that. The social media giant is facing intense scrutiny for how it handles racist messages. In a new report by motherboard, leaked documents show facebook bans White Supremacy but allows White Nationalism and white separa separatism. It suspect always associated with racism. Most people in my audience didnt know there was a distinction between White Supremacy, White Nationalism and the way facebook looks at it. Why do they look at it like they do. Facebook makes these distinctions because theyre trying to figure out a way to decide whats allowed on facebook and what is not. They dont want to alienate some customers which might be white nationalists, white supremacists, decided to draw the line, and facebook makes this distinction even though black history and experts dont, civil Rights Groups dont, and White Nationalism is actually just a veil. They use real people to determine what does and doesnt go on with computer systems, most are here in the United States. How is someone able. Can you explain to my audience or was someone able to explain what an example of White Nationalism is that doesnt offend in the way White Supremacy does. Right. I dont have a specific example, Facebook Says acceseparatism includes white people. White supremacy is when you say white are better than other races. Thats the distinction theyre trying to make. Theyre able to apply, they have rules that curator can apply to a given post . Facebook has a policy team made of lawyers, expolicy junkies from congress, Public Policy folks, they make the rules, and 7,000 moderators enforce them all around the world. Someone may report something and then this moderator will decide whether or not it applies. So they have basically a check box. Does it have this, does it have x, y, or z, then an algorithm determines, not algorithm, Computer Software determines if it is erased or not. Are the rules clear enough, knowing what the rules were, you and i can make the same determination . It is hard to tell. They contradict themselves. Racism is banned on facebook but White Nationalism is not. If you apply this across thousands of fieps types of con all over the world, you can see how facebook has a hard problem. Whats their argument here. Obviously they would like to keep as many people on facebook as possible, but that cant be a very good argument. Is it first amendment, freedom of speech, openness of debate . Facebook wants to have one Global Community across the entire platform, 2 billion people, more than 100 countries worldwide. They want to have one set of rules that can be applied equally across every country. That fails to take into account historical context, different countries, so Facebook Says they need the rules because there are separatist movements in africa that are distinct from those in the United States. But what we see here is facebook is protecting separatist movements where there is history of racism and sub jug agency of people in general. Up next, we look at the impact of tariffs on farmers. Liberty chinese retail giant alibaba says the trade war between the United States and china has up ended its plan to create a million jobs in the United States. Jack ma made the pledge during a meeting with President Trump just before his inauguration. The promise was made on the premise of a friendly u. S. china relationship and rational trade between the two. Weve been reporting on how farmers have been faring. In its july report on current economic conditions, the Federal Reserve reported that while the u. S. Economy is in good shape, manufacturers in all districts expressed concern about tariffs and in many districts reported higher prices and supply disruptions that they attributed to the new trade policies. Dozens of trade groups, including the u. S. Chamber of commerce and National Association of manufacturers say the tariffs will lead to the loss of thousands of jobs. But not everyone agrees with that argument. The American Alliance of manufacturing supports the president s tariff. Its president scott paul joins me now. Scott, talk to me about this. Were hearing from people who say the tariffs and the countertariffs mean its going to be harder for americans to sell their products overseas. Something weve been succeeding in doing more and more of over the years. Why do you agree with them . Ill say that im hopeful that the tariffs lead to change. Tariffs for the sake of tariffs arent worth doing. And so this has to result in a rebalancing of the trade relationship. With china. Weve talked to a lot of manufacturers. I talk to hundreds of them last week. And yes, there are concerns about the tariffs but also concerns about the existing economic relationship with china and how completely inadequate it was. We always point out, scott yes. The thing that most people in the world would agree with it is bad about our relationship with china is its handling of intellectual property and it takes American Business to go in there with interesting things and the chinese take them and all that. This feels like a blunt instrument to deal with a fairly specific matter. The challenge, ali, is that weve gone through two administrations so far since china entered the wto and we made no progress on intellectual property. End lgs dialogue, wishful thinking. They didnt really get us anywhere. And there are extraordinary costs to this. John huntsman and Craig Barrett who are free trade businessmen and leaders did a survey on ip theft in china. It can add up to at least 300 billion and perhaps 600 billion every year. So theres a real and tangible cost to American Businesses here. And we know the cost for american workers. We saw one out of every three manufacturing jobs leave in the first decade china was in the wto. Again, i will say that i dont support tariffs as just for the sake of putting up tariffs like William Mckinley did more than 100 years ago. They have to lead to something. If they can lead to progress on this and get us a little more leverage than we otherwise would have got it. Okay. Then i think a lot of businesses will say well take the medicine if the outcome is going to be tariffs that lead to lower tariffs or whatever, lower trade barriers are the goal. The danger with doing it the way were doing and i got your point about the danger of negotiating and not get anywhere. The danger of doing it this way is the possibility of a trade war. 37 of americans are worried about a trade war. Were in a trade war so to speak. But the point that it could be a much more serious matter over time to come. Right. Although i will say that i think most americans are willing to give the tariffs a chance. And youve heard this articulated by even speaker ryan again. Paul ryan very free trade republican who says im willing to give the tariffs a little more time and what we found is thats where most americans are right now. They are either outright for the tariffs or they want to give them more time. But theres very little support for withdrawing them at this point. And again, this is a test. We have not tried this approach before but we have tried the approach of endless dialogue and it didnt really get us any outcomes. I mean, the really the ball is in chinas court. How will they respond . Will they make some changes under the radar . Will this fundamentally shift our relationship . Thats the outcome that folks in American Manufacturing and the workers on the factory floor are seeking. Now its time for the Trump Administration to deliver that. Scott, good to talk to you. Where is trump getting these employment numbers, and what are the jobs that he talks about . All right. Lets take a look at this. The short answer is those numbers come from the bureau of labor statistics or bls. Its a unit within the department of labor. The agency oversees a Current Population survey conducted by trained workers from the census bureau. About the 12th day of every month they call or visit 60,000 households nationwide. About 110,000 individuals in total. They try to estimate two important things. The share of the workers the share of the population thats in the workforce and people thats by the way people who have worked or looked for work in the last four weeks. And the share of the workforce currently out of work which is how we get the unemployment rate. The bureau of labor statistics conducts a separate Payroll Employment survey. Thats the number of people listed on the payrolls of 147,000 businesses and Government Agencies nationwide. And from that survey, the bureau of Library Statistics produces and publishes employment hours and estimations for the nation, states and major metropolitan areas in very Detailed Industry levels. Thats how we get the number of jobs created each month which is a net number. When you find out the 201,000, its the number of jobs added minus the number of jobs lost which brings us to the net number of jobs created or 201,000.
