We get to this hour with republican Susan Collins, despite what she calls compelling testimony from Christine Blasey ford. I found dr. Fords testimony to be heartwrenching, painful, compelling, and i believe that she believes what she testified to. I dont think she was coming forth with a political motive. Do you still think it is possible that he did it, you just dont have the proof to back that up . I do not believe that Brett Kavanaugh was her assailant. I do believe that she was assaulted. I dont know by whom, and im not certain when. Meanwhile, one of the key democrats on the Judiciary Committee on what she thinks her side should focus on in the aftermath of this confirmation and whether she would support an impeachment process if democrats regain control of the house. Jerry will do what jerry will do, but im tired of people who support the accounts of shaexua assault, but im focused on the elections because all these angry people know that it is the people who sit in the senate that stay elected who are making these decisions, and theyll go to the polls and vote differently. I was there when his nomination was announced and there was thunderous applause, as you might imagine. The president viewed that victory as a win for the nation and a win for the constitution. He also boasted a bit about his role in selecting kavanaugh and keeping his confirmation on the rails. We talked about this on a different stage in mississippi, took an attacking mood, attacking her. Either youre with the democrats or youre with the republicans. Susan collins, who you saw in the opening of the show, was also asked how President Trump handled dr. Ford. Heres what she told dana bash. I felt that the president was not respectful to dr. Ford. I have always been respectful toward her. Im the one who pushed for a hearing. Hes not involved in the advice and consent of constitutional duty, so i believe he should have said nothing. Reporter you saw senator collins say there that shes always been respectful of dr. Ford. There are people here this morning who are saying thats actually not the case, because you saw where Susan Collins said she didnt fully believe dr. Forms claim. Christine blasey ford says shes 100 sure that her attacker was Brett Kavanaugh. But to President Trump, he is still taking indirect aim at some of those female protesters. He said last night that he praised republican senators for refusing to back down in the face of shameless campaigning by the democrats, suggesting somehow that these protesters were part of a democratic plot. That really is the message, the postkavanaugh midterm message that the president is really sending to his base, that people need to get out there and vote in order to keep both houses of congress under republican control, alex. Its interesting. Youve got Mitch Mcconnell saying these folks are just angry mobs instead of americans expressing their feelings like they have the right to do. Thank you, jeff. It really had touched off a fire in the grassroots of conservatives who felt aggrieved by what was happening to kavanaugh. But i think the fact that Brett Kavanaugh has been confirmed means that the balance of grievance now shifts to democrats. Republicans got what they wanted, conservatives got what they wanted by adding kavanaugh to the bench, and now the question is, do democrats who are already fired up going into this election, does this give a little extra fuel to their efforts to turn out voters . And if it does, that could make a difference not only in the house but also in key senate races. To that point there, in the sense of some polling recently, it shows some democrats are wary of kavanaugh. Do you see that being the case as well . No, i do think that Republican Energy surged in the middle of the kavanaugh fight. But now the fight is over. Weve got a month until election day. And it tends to be the case in politics that the people who were angriest are most motivated to turn out. And the people who are angriest right now are democrats. The people who are celebrating are republicans. To me that makes it likely that though there may be some residual carryover of energy on the republican side narrowing that Enthusiasm Gap with democrats, i suspect it will fade. John, did that surge happen a week ago thursday in a span of about four hours from the end of Christine Blasey fords testimony where you had many people believing her, including the president , saying that he found her credible, to then four hours later at the culmination of Brett Kavanaughs testimony, which was fiery . Yes. Exactly right, alex. You combine the rage that Brett Kavanaugh expressed, the rage that Lindsey Graham expressed, that had a galvanizing effect at kind of a primal level with republicans that republican conservatives tended to think thereafter Brett Kavanaugh and thereafter me too. That got people voting. I heard that from republican voters. Whats your sense, melanie, of the political impact of kavanaughs confirmation . Mitch mcconnell said this is going to be a gift, and i agree its probably going to be a gift for them in the senate, but i think its going to be a curse in the house. Thats because defending dozens of vulnerable seats in the swing state that Hillary Clinton carried in 2016, so they need to woo over these independent, modern women. Theyre already fired up by the me too movement, and i think this will pour gasoline on the fire. Yes, they got kavanaugh on the bench. They may end up keeping the senate, but i think it could cost them the house, which is also particularly interesting, because that is where democrats could launch impeachment proceedings, open up investigations, hearings, not just against kavanaugh but the entire trump organization. Theyve been calling to the left to impeach the president himself, so theyll have choices to make going forward, but it could really cost them in the long run. Howard, i know you wanted to talk about senator graham and how he talked about how kavanaugh was treated. Take a listen. I think dr. Ford was treated well. I think the roles were reversed. The slut whore drunk was kavanaugh. Im so glad i didnt have ta paraphrase that or say it on my own. Whats your reaction to that, john . This had nothing to do with pr promiscuity. He was casting it as a feminist argument that you slut shame people who were promiscuous and reversed that with kavanaugh. It was about assault. He was trying to fuzz up the issue the same way Susan Collins was saying, yes, we need to respect the me too movement, we need to believe survivors. In fact, i believe dr. Ford, she was a victim of Sexual Assault, however, she was confused about who did it. The reason they felt the need to fuzz up the issue is that, in fact, a majority of people in the united states, according to our nbc wall street journal poll, say if Brett Kavanaugh did what he was accused of, he should not be confirmed to the court. But a majority of republicans believe that even if he did it, he should be confirmed. In other words, the Republican Party as a group, a majority of them, dont think this was that bad. They think that this was kind of a, well, teenage guys do that kind of stuff thing. But senators had to kind of conceal that and make the case that it was either about something else, oh, are we going to convict guys for drinking beer in high school . No, thats not what it was about. It was about assault. I want you to weigh in on this also, melanie, and how it is people can say, we believe dr. Christine blasey ford, we just dont believe the part about 100 Brett Kavanaugh. Where does that come from . I think its just part of the gop strategy. They knew they couldnt attack the accuser herself, so they instead decided to focus on making kavanaugh into a victim. There was a theory that he was falsely identified, that there was someone else who actually committed this assault against dr. Ford. And i think it just speaks to, you know, the sort of counterculture response that were teague to the me too movement. You saw the president saying its men in america facing the scariest time right now and that theyre not getting their due process. Rates of Sexual Assault are much higher than the rates of people who are framed, but i think its a very effective rallying cry and strategy for the gop base and especially for trump supporters. And for me, it does not appear that hes somebody who should be given a lifetime appointment to the most Important Court in the world. Even if you dont believe or believe dr. Ford, the other issue is one of temperament, the other is an issue of impartiality and blind justice. And i think that adds to the case being made that a no vote is the appropriate vote. Joining me now is democratic congresswoman sue delaney of washington. I know you were at a rally yesterday. Is what Heidi Heitkamp said yesterday, is that a message democrats want to hear . Forget shes in a red state and fighting for her job, right . I think Heidi Heitkamp saw what happened in the Senate Hearings and really listened. She saw a woman who was literally terrified, poised, honest and courageous. She also saw a man who was belligerent and angry, someone who screamed at senators and evaded tough questions, but also who was blatantly partisan. And she knows that we expect our justices, especially those who had received a lifetime appointment to the highest court in the land, to be impartial and objective, and he was anything but that. So i applaud senator heitkamp for standing up, for being a leader and taking a strong stand against someone who should never be on the Supreme Court. How about the signs youre going to be looking for which will tell you exactly the kind of Supreme Court justice that Brett Kavanaugh will be . Well, we need Supreme Court justices who are going to listen, who are going to be objective and impartial. I think Brett Kavanaugh was disqualified from the beginning and he showed that in his senate testimony. So im very concerned that this wasnt something that was clear to republican senators and that they were willing to, as Mitch Mcconnell said, plow through, anyway. I want to play for you what chairman grassley said yesterday, once again clarifying his comment about why he thinks there is a lack of women on the Judiciary Committee. I should have said, we even have a hard time getting men to serve on this committee. In fact, i think three men are serving on this committee only because the leader asked them to. So, really, its not something whether youre male or female. There is a lot of work on the committee, and there is a lot of controversy to it, and its more politically and ideally divided than most committees, and a lot of people, men and women, dont want to get mixed up in that. He previously said he believed women didnt want to be on the Judiciary Committee because its a lot of work. So how much did this give you a window into how all this played out, and i guess the bigger question, where do we go from here . I thought his comments were incredibly insulting. When i first joined the house, i served jute dishthe judiciary c and there were no republicans in that committee then, either. This is a situation where republicans have not listened to womens voices, have not allowed women to be represented. This is something they needed to address and women are angry, and were going to see that at the polls come november 6th. We have great candidates, women running across the country, so no longer will womens voices be silenced. Im curious about this next potentially contentious issue, because how Ranking Member nadler is sidestepping the question, but he said if the democrats should win next month, it will open the window into how they handled the sexual allegations against Brett Kavanaugh. He said, it is not something we are eager to do. We are going to have to do something to provide a check and balance, to protect the rule of law and to protect the legitimacy of one of our most important institutions. Do you think this could lead to an investigation that could lead to impeachment . When i talk to folks across my district, my swing district, folks say they want to see leadership in congress, they want folks who are going to stand up for the people they represent, stand up on issues like health care, Economic Opportunity and make sure that congress is doing its job in terms of oversight of the executive branch. That can only happen if we have a democratic majority because republicans have shown themselves to be lemm ii nrk il this president. People want to see leadership, not lemmings. Whatever firing up there is right now, who is going to be able to maintain that . In our region i have seen many folks fired up, women, m a men across our region who are knocking on doors and helping get out the vote. Because they know how important it is that everyone vote in this election. Your voice will not be heard if you do not vote. To make sure, again, that we elect leaders who are going to stand up for the people in our country. And i think were going to see many people out on november 6th and were going to see democrats take back the house. Did the white house and republicans, because theyre in charge, did they play by the rules, but did that mean that justice was not done . And if thats the case, how do we remedy that . Unfortunately right now there is no remedy. Because hes sworn in. And hes Justice Kavanaugh. So i think we just have to face thats reality. There is no remedy, there is no reason to look backward, all we can do is look forward. If you talk about the investigation, when senator collins says it was a serious investigation, that really doesnt pass the straight face test, i got to tell you. Because no investigation of a Sexual Assault, dr. Fords or ms. Ramirezs, is complete without interviewing the victim, which was not done with dr. Ford. Or if there is an accused who is willing to speak, and they did not interview judge kavanaugh. I think the reason for that is because they were afraid if they started asking judge kavanaugh about his drinking in this time period, he would lie to them. So they were specifically precluded from asking him questions. Additionally, in the ramirez investigation, she handed them maybe 20 witnesses and people were beating down the door of fbi offices all over the country to speak to them, and the white house specifically did not allow it. And the reason for that is, they did not want to find out the truth. This was not an investigation that was a search for the truth, this was an investigation intended as a fig leaf to try to calm everybody down so that they could go ahead and do the vote a week later. Lets take a look at this new report. This is from mother jones. It came out this week and its focusing on a now resurfaced interview its a video of Brett Kavanaugh from 1998. I want you to listen very carefully. Its not an interview, hes actually giving testimony. Take a listen. The president , if hes wise, will oversee the special prosecutor at arms length or else hell have to face the music like president nixon did. This raise s a role for the president. The president oversees the special prosecutor, the special prosecutor oversees the president. The president fires the prosecutor, impeachment proceedings wouldnt be far behind. Vthe very same year he wrote the special report on impeachment and politics and said, weather the constitution allows indictment of a sitting president is debatable. Do you think he Still Believes impeachment should follow if the president fires the special counsel given he was nominated by trump . No. I dont think he does. Heres the thing. I think people, when theyre not in their nomination hearings, say what they think, not in the hearings. What he said in successive law review articles was he rethought his views about the special counsel and the power of the executive and that he thinks now, after going through the process with clinton, that the executive should have more leeway and generally the process should wait until you couldnt indict a sitting president and it should all wait until after the presidency is over, unless, of course, impeachment comes up. He had a very different view when he was with the star people and upon reflection. Thats going to be his view. Heres the thing, people say things when theyre not in the nomination, when theyre not trying desperately to be president , and we should listen to them. For example, the Republican Party has been saying for 20 years, we are going to nominate justices to overturn roe v. Wade. Believe them. Thats what they say theyre going to do, and thats what they have done. And Justice Kavanaugh, before he went into the room and had to sort of try to become acceptable to senator collins, he said what he supported was renquists view of roe v. Wade which was a dissent which said there was no right to privacy. Before he was in the hearing room and had to get senator collins approval, he wrote in garza which essentially approved a roadblock set by every young lady who wanted to play by the rules to have an abortion. You have to look at what they say what theyre not under the glare of the cameras. What he said then was basically hes opposed to the right to choice. And i expect thats what they will do. With regard to president ial power, how do you interpret whether the constitution allows indictment of the president from him, because he suggests no. He is opposed to the president being indicted. She also said there was no corroboration found, so she didnt go solely off emotion and temperament and went off fact and fact alone. Its normal for human beings to show empathy and sympathy for people. There are people who felt that for dr. Ford and also judge kavanaugh. In the end, fact wins over feeling. Does that mean, amy, you believe the fbi investigation was complete . It was a thorough investigation . Thats what weve been told so we have to believe it. Morris, your opinion on that . People tell me about the boogeyman, i dont necessarily believe in it, amy, but i think the democrats mishandled it, in my opinion. Understanding politics, you want to have leverage. They had no leverage from the very beginning, so if they really wanted to send a message, they should have walked away from the process from the very beginning. Now that theyve forced the situation, they have to go with the cards that were dealt. I dont believe it was a thorough investigation. I feel they should have handled this more forcefully from the beginning. At the end of the day the women vote will be what it will be, whether they vote against it or for it at the polls, but thats how you change things. You vote. You have to change things by voting, and i hope all these protesters and people who are upset actually vote because thats what matters. They said what this vote means for senator collins. I heard from republicans who are somewhat envious that shes already getting significant rewards for her vote which i believe was well determined before her vote. Morris, is this really whats happening behind the scenes . I dont believe so, because it would have made the Koch Brothers go after her. If someone wants something, you go behind them. If they want the opposite thing, you go the opposite direction. We now have people who dont think with their brains. Theyre not thinking about the overall best interests of the country, theyre only following what the politics of the moment are. Well see what happens when people go to the polls, but no matter what happened here, if she had voted against it, the Koch Brothers would go the opposite direction, so i dont think this is a sort of coordinated thing thats happening. How about you, rita, choosing to accept the accusations against kavanaugh. Are you worried about the potentially worried female voters . Im not so much worried about that because of what im hearing from republican friends and women in the party. Number one, i just want to say, alex, on this very show with you, i called kavanaugh a fine pick. And since his appearance before the senate Judiciary Committee, i changed my mind. I think he lacked the temperament to take the highest seat in the land, and i believe his nomination should have been withdrawn. There are republican women who do side with me, but i find they are in the minority. They are proud of Susan Collins for doing the right thing. They think that her viewing this in black and white, rather, was a better thing. And i dont agree with that. I just feel that this was a sad moment where Susan Collins really showed her true colors and she couldnt put country over party because she knew what was at stake. What you said about Brett Kavanaugh being a fine pick and then you changed your mind based on what you said. Youre echoing in many ways the sentiments expressed by lisa murkowski. You said she couldnt vote for him for the same reason. She didnt think he was a fair inju jurist and that sort of thing and said he was not the man for this time. If thats the case, do you think that is not necessarily reflecting how people voted, but that that may be something that lingers, that sort of thought in the minds of these senators and others on capitol hill as they look at now this new justice on the Supreme Court . No, thats not going to linger because ive asked those very questions of the republican women that ive sat and talked with since dr. Ford and judge kavanaugh sat before the senate Judiciary Committee. They told me the very same words that Susan Collins did, that they do believe something happened to dr. Ford, but they dont believe it was judge kavanaugh who committed the assault. So, therefore, they do believe that he was qualified and that he should be able to take this seat and should be confirmed. However, i pushed back and said, dont you think hell be resentful . I really think hell go to the court with a grudge against democrats. Thats not what we do in american justice. Impartiality is supposed to be very important in this land, and i just think hes going to be resentful. But what im hearing overwhelmingly is they believe this will be short lived and that hell shake it off within a few weeks and months, even, and then sort of start acting normal again. I dont trust that. His normal has always been a grudge against the democrat. Look at the position he took in the bill clintonkenneth starr situation. This is a guy that never should have been selected because we want people that are going to look at the body of law without p preconception of republican or democrat. He never should have been put up in the first place. You know, don, the president claimed that his controversial remarks of Christine Blasey ford may have helped him get the nomination. I had one beer. Do you think it was nope, it was one beer. Good. How did you get home . I dont remember. How did you get there . I dont remember. How many years ago was it . I dont know. Where is the house . I dont know. Upstairs, downstairs, i dont know. But i had one beer, thats the only thing i remember. There were a lot of things that werent correct, werent true, and a lot of things left unsaid. It was a very unfair situation, so i evened the playing field. And once i did that t started to sail through. That is called gaslighting. This is like when the president mocked the physically disabled reporter. I dont remember, i dont remember, he mocked again and again. This is not only a mocking against Christine Blasey ford but to all women who have been survivors and came forward. This is why victims of Sexual Assault dont come forward because the most powerful men in the world make fun of you, and even those who dont outright mock you come out and say, well, i think she probably just misremembered. No, this is an accomplished woman. She most likely did not misremember, and she did not want her life permanently altered. I also want to say im highly concerned by Susan Collins saying she was somehow swayed by Brett KavanaughS Performance after Christine Blasey fords. Thats just intellectually irresponsible when you also consider there are several pillars that he had laid along the road of his testimony. Last thing i would like to say here, i have such a hard time hearing thinking adults say this is about the presumption of innocence in our legal system. This is not a clinical trial. Judge kavanaugh had neither life, liberty nor property interest at stake. Thats whats at stake when we talk about innocence before guilt. That is not the proper standard here. The proper standard is does he have the proper temperament as well as qualifications to sit on our nations highest court. To me he proved he did.
