A. M. Some of the details despite actual threats to her safety and her life, dr. Ford believes it is important for senators to hear directly from her about the Sexual Assault pitted against her. She has agreed to move forward even though the court has refused to subpoena mike judge. They refused to add other witnesses that are essential for the truth about the Sexual Assault. There are other details to get to. Jeff bennett is standing aside for us. Jeff, there are also other logistical issues about the statement from debra katz. The statement that caught my eye is that dr. Ford has agreed to go forward with the hearing even though the court refused to subpoena mike judge. This whole thing has become a he saidshe said, especially if you believe Christine Blasey ford. She said there was another person in the room, who has been described as mike judge, Brett Kavanaughs childhood friend. The committee did not choose to subpoena him. But you saw where Christine Blasey ford through her attorney said she is willing to testify in open court on thursday. Regardless, other important logistic logistical issues remain unsolved, including who will be asking the questions. Dr. Ford through her attorneys has said she wanted to be questioned by the senators themselves. But you can see here how the Republicancontrolled Senate Judiciary Committee wanted to avoid the potential spectacle of having 11 middleaged men questioning a woman in the trial of her life, particularly coming just a couple months before the midterm election. We now have it official. This hearing will happen on thursday at 10 00 a. M. There are still a few more details to iron out. I can tell you theyve been reacting here with frustration because they said Brett Kavanaugh agrees to be heard publicly, deserves a chance to defend his name, even though white house officials have been trying to undercut the story they anticipate Christine Ford will tell on thursday. Alex . All right, jeff bennett, this will certainly be politics theater of the highest caliber thursday at 10 00 a. M. With me for more on this, a member of the house Judiciary Committee which voted to impeach richard nixon. Also glen kirschner, nbc legal analyst. I know you have been yourself through very highprofile congressional hearings. I want a sense of what this is going to look like, what dr. Ford will face when she sits in that witness chair thursday morning at 10 00 a. M. Well, what shes going to face is assuming that the senators get to ask the questions im not sure what the format is going to be, if theyll just turn this over to counsel. But a lot of the senators wont have the time, the interest or the ability to ask the proper questions, and they have to be extremely careful because while theyre going to want to satisfy their base on the republican side and kind of beat up on her, they know they cant do that. They know thats going to turn off many, many americans. So i think its a very delicate matter. I dont know how its going to work out. I think it has tremendous peril for the republican party, for kavanaugh, but i think what troubles me most about this is that they have not that the Senate Judiciary committee is refusing to do a proper investigation, and that tells me they are worried about finding out the truth. And that is extremely disturbing. Glenn, what is your take on this in particular. Who will be asking the questions . It is not clarified if its been worked out whether its the senators or outside counsel thats been brought in, which is what they said they wanted to do, maybe me female counsel, to this delicate line of questioning. Whats at stake here . It seems to me with the senators normally asking the questions and all of a sudden theyre refusing to do that, that seems to me to be a part of weakness and fear that they dont want to be responsible for these questions, so theyre trying to push it off on a third person, and i assume if it doesnt go well, theyll blame that third person. Also, alex, if i can, i just want to take a moment to debunk the truth that nothing can be proved when its a he saidshe said contest. After 30 years of trying criminal courts in washington, d. C. , i cant tell you how many times i had to prove a fact of consequence in my case when i had two conflicting witnesses. Because two witnesses who either observe or even participate in the same incident can see things differently from different vantage points. They have different Life Experiences and perceive things differently, not to mention they will have different abilities of recall and different abilities to communicate what they saw. So i have to tell you that things are proved every day in courts of law when its essentially he saidshe said, one witness contradicted by another witness. People might be surprised to know that in the courts of the district of columbia, and in most courts albeit in slightly different ways, there is a jury instruction that says you can convict somebody, highest burden of proof that we have, you can convict somebody based on the testimony of one witness alone, including cooperating witnesses, and weve heard a lot about what those are. People who plead guilty, have a wide interest in the outcome of the case. You can convict somebody on the word of one corroborating witness if you believe without a reasonable doubt that witness testimony convinces you of whats trying to be proved. This is really a myth that nothing can be proved on a he saidshe said basis or just two conflicting witnesses providing information. Very important point you make, and i also want to remind our viewers that this is not a criminal trial that will be happening on thursday. There is no potential for conviction, if you will. This will be a congressional hearing in front of a Senate Judiciary committee trying to get at the root of the truth and what happened or did not happen here. Regarding earlier this morning, congre congresswoman, senator Lindsey Graham went so far to suggest that the democrats are using dr. Ford. Thats the quote, theyre using her. What do you make of that accusation . I think its too bad that senator john mccain has passed, because i think Lindsey Grahams true colors are coming out now. He knows better than that. This is a woman. We already have some evidence, third party evidence, corroborating evidence that she was troubled enough about this attack that took place against her to discuss this with a therapist, to see a therapist several times. She is now facing Death Threats . This is something thats a manipulation. Nobody wants to go through this. Senator graham is also concerned. He was a military prosecutor. What message has been sent to the military where weve tried so hard to get victims of rape to come forward, and now to accuse someone who comes forward without having heard her, without having done an investigation and claim this is political . Its an outrage. I mean, hes attacking the victim . And he shouldnt be doing that. And he sets a terrible example for all cases of rape and particularly cases of rape in the military. He knows better and he shouldnt be doing this. By the way, we dropped the laws on corroboration. It used to be that rape victims never were believed. Every single state has gotten rid of that. Lets get past it and get to a situation where we can take a womans word and seriously investigate it and seriously look at it. We have another potential person here, mark judge, who may be also someone who engaged in a criminal act. But they wont subpoena him. They wont subpoena any other witnesses for a fair hearing. They should be questioned first to determine what they have to say and then decide how you want to go forward. So this is a sham proceeding. This is a ridiculous proceeding. Its absurd and its really not where we should be in the United States at this time. Glenn, in an effort to get at the truth, the expertise you shared with us in your last statement when you said you have gotten to the bottom of a he saidshe said situation, whether its male or female is irrelevant here, but different points of view. How does one do that in a situation like this . What is the key that republicans and democrats need to be asking of these two witnesses to get to the truth of different perspectives. Here is the key, alex. The key is there will be no investigation of this and there will be no outside witnesses or collateral information or evidence brought to bear on this question. We can see this coming a mile away. They are going to rig the system so there is no corroboration at the hearing, and then were going to hear them complain that we cant make a decision because this is uncorroborated he saidshe said information. So if youre rigging the system to avoid the possibility of corroboration, how can you possibly complain at the end of the day that we cant decide this issue because there is no corroboration . Thats the real sin here, is that nobody is allowing a fair hearing and then theyre going to complain about lack corroborating at the end of the day. Christine blasey ford has agreed to testify on thursday at 10 00 a. M. Before a Senate Judiciary committee. You need insurance. But its not really something you want to buy. Its not sexy. Or delicious. Or fun. But since you need both car and home insurance, why not bundle them with esurance and save up to 10 . Which you can spend on things you really want to buy, like. Well, i dont know what youd wanna buy because im just a guy on your tv. Esurance. Its surprisingly painless. Than rheumatoid arthritis. About 15 minutes ago we learned from dr. Forbes lawyer that she will appear at 10 00 a. M. Thursday in an open hearing but theyre still trying to hash out the conditions with which she will testify. The statement says in part, despite actual threats to her safety and her life, dr. Ford believes it is important for senators to hear from her about the Sexual Assault against her. She has agreed to move forward with a hearing even though the committee has refused to subpoena mark judge. They have also refused to invite other wntsz who are essential for a fair hearing that arrives at the truth about the Sexual Assault. Lets bring in political reporter for msnbc news. Before we get to the questions, we want to remind all viewers that judge kavanaugh has denied the Sexual Assault. John, first your reaction of the letter we got from dr. Fords lawyer, ms. Katz. What sticks out for you here . Simply the fact were going to have this hearing and shell be able to tell her story. Well also hear from judge kavanaugh, and youre right to say he has denied this. All present in that room know what happened independently. I dont believe someone who makes an allegation like that. I went to duke university. I remember the duke scandal where people were falsely accused. However, the relevant point was made by glenn hirschner in the previous segment. It is clear that the people running this leadership do not care what is true. They are determined, as Mitch Mcconnell said, as the chief counsel to Chuck Grassley said, they are trying to ram this through and figure out how bad is it if we go ahead and confirm this nominee . Theyre trying, as glenn indicated, to prevent the possibility that there is cooperation from mark judge. They realize they need to let her tell her story and Brett Kavanaugh will tell his. Then theyll have two bad options. One, people have seen they dont care what is true. They will listen to the testimony and decide whether or not to go ahead. If they do go ahead, theyre going to enrage a lot of democrats, women voters around the country. If they dont go ahead, theyre going to enrage their base which is expecting them to confirm kavanaugh. So its a very difficult situation and you cant rule out the possibility that if they think its going to be badly that judge kavanaugh withdraws before the hearing. Given your assessment here, john, before i get to ally, what you said at the very top was, look, you dont know what happened. You werent in that room. But it was with recollection from dr. Ford that mark judge was in that room. The thakt they a the fact they are not subpoenaing him let alone anyone else who may have been at that party, that fact alone, what does that tell you about the outcome of this, regardless of come what may, Brett Kavanaugh gets con firmed firmed or not . They have made clear that they dont tell what is true in this situation. If they did care, they would go through with the fbi investigation, which, including anita hill, to put mark judge under oath before cameras just like Brett Kavanaugh. But they dont. They want to confirm him and theyre looking at a very bad. They can show that they dont care whats true and push ahead, or if they dont push ahead, strengthening their base. Do you get the sense that dr. Fords decision now to follow through on this shes going to be there 10 00 a. M. Thursday is that catching them off guard at all . I dont think so. I think everyone here when her lawyer came out and said, yeah, shes willing to testify, have known that was something to work toward. Obviously weve seen them clearly take seriously and they talk about kavanaugh being peppered with questions, some meant to go over the line, and in some questions, him saying who will be questioning ford when she does get to the hill. Jeff also mentioned this earlier on in the show, that the optics of old white men questioning a woman at her most vulnerable point telling a most vulnerable story is not a very good thing for people to see. It does hearken back to what we saw in the anita hill trial, so there is that. And there are women across the country who are. There is concern, i think, on the part of republicans ive spoken to women more as a reason to come out against republicans when they see the way they handled. And ivanka trump havi and ivanka trump saying to her dad, we have to get to the bottom of everything. Have you heard anything from Brett Kavanaugh that when they went through who could be nominated, raymond ketledge and others, that there is a chink in the armor . They know there are other judges they could push forward on, but one thing they know is that President Trump is concerned about President Trump and the effect on President Trump. So if he comes to the conclusion that Brett Kavanaugh and this entire process is too much of a millstone around his neck, he will throw a millstone in there, and as ally indicated, Brett Kavanaugh looks like hes been in some of those private sessions uncomfortable with the questioning. In the end i think it will down to how does, that people will be able to see them. Its about winning, right . Its not necessarily about the attlez, weve seen him with these allegations toss them aside for 2016. Im not saying the president and the house would be disqualifying, its the idea that if he cant get him over the finish line then, that needs to be said. Coming up next, President Trump has compared himself to one of our greatest president s, Abraham Lincoln. But how does President Trumps ability to lead compare to some of our president s . This hour, a statement from counsel for judge Brett Kavanaughs accuser, Christine Blasey ford, says she has agreed to testify thursday morning 10 is 00 a. M. Before the Senate Judiciary committee. Heres part of what was written by debra katz, her lead attorney. Despite actual threats to her safety and her life, dr. Ford believes it is important for senators to hear directly from her about the Sexual Assault committed against her. She has agreed to move forward with the hearing even though the committee has refused to subpoena mark judge. They have also refused to invite other witnesses who are essential for a fair hearing that arrives at the truth about the Sexual Assault. Were going to talk about this as well as an extraordinary new book right now in president ial history. It is highlighting the importance of leadership, also empathy in an american president. One american president seen as having those qualities in spades is the founder of the republican party, that being Abraham Lincoln. President trump has praised lincoln in the past and recently he compared himself to lincoln. This is what he said about two weeks ago. When Abraham Lincoln made the gettysburg address great speech, do you know he was ridiculed . They said it was a terrible, terrible speech. 50 years after his death, they said it may have been the greatest speech ever made in america. [ applause ] pretty good. Pretty good. I have a feeling thats going to happen with us. In different ways, thats going to happen with us. Joining us now, doris kearns goodwin, author of a new book, leadership in Turbulent Times. Doris, i saw you smiling there and youre one of the best people to put this into perspective. Do you believe that americans will have a warm and fuzzy feeling about him after the fact . The guys i studied, even when they were in office they cared about how they would be remembered, so they transferred their personal ambition to an ambition for the people. Thats the difference. Everybody starts with a personal ambition, but at some point it goes beyond yourself and you have to think how youre making peoples lives better and will you be remembered in history for that . Fdr gets us through the depression, Teddy Roosevelt gets a square deal and Lyndon Johnson will forever be remembered for sif civil rights, but it takes an Extraordinary Part of yourself to do better than when you started. That book appeared like it could have been written by the opulent oval office, but do you think were living in Turbulent Times . I think i can give reassurance because the times these four men lived in were far different than it is now. Lincoln came in and thousands of people were about to be killed in the war. He said he didnt think he could live through it. Teddy roosevelt has shaken the economy more than the tech and global revolution have today. There is a feeling there will be a revolution. Obviously fdr comes in at the height of the depression. And john kennedy has just been killed when lbj comes in and there is a feeling there was a conspiracy abroad. Yet each one of those leaders was fitted for the time. Yet i think leaders get through that and we get through it stronger than ever before. I think now the feeling of the lack of moorings, we dont have that feeling of unity against the divisions. You told me lincoln is the one you go back to again and again for a lesson in leadership, and you said Teddy Roosevelt could directly apply to this president , President Trump. What could donald trump learn from these president s in particular . I think from lincoln he could learn to use hot letters. When lincoln was angry with somebody, he would write a mean letter to somebody, set it aside and hope he would cool down psychologically and never would send it. So if there was a person that it just didnt go anywhere, went into the files. There was a reporter who wrote a review of his book about the spanishamerican war and said he had put himself in the middle of every single battle that he should have called the book alone in cuba. Everyone was laughing at him. What does teddy do . He writes a letter and says, my wife and child are very happy with my book. He could have is learned from both fdr and teddy about the press. Fdr had two scheduled meetings every week with the press and teddy had schedules with the press. He realized he had a swelled head in the state legislature and he was getting nothing done even though he was blistering language and all sorts of yelling and screaming, so he stopped. He realized he had to collaborate and compromise. We should learn from the past. Its the way we learned from our parents and grandparents. Absolutely. What about empathy . How important is that for a president . Whether its something that person personally feels or at least its portrayed out there in the public. Its the key element in leadership. What it means is being able to understand other peoples point of view and to be able to empathize with other classes, different races, different sections of the country. Lincoln, i think, was born with that empathy, but president roosevelt thought it would just be part of politics. But then he went to ten menteme he went into the slums, so he learned how people feel. Eventually it became part of who he was. And he said the rock of democracy will founder if we dont understand other people and we think of them as the other in classes, sections and parts of the country. Thats where were at right now. We need somebody so badly that can heal those divisions and those divides. So given this great divide in this country, doris, is it possible for this president to weather the Turbulent Times with a message of unity . Can there be a single voice as the focus of that, or can that voice emerge from such great partisan divide . I think its true that everybody has a megaphone now so the bully pulpit of the presidency doesnt have the power it might have had before. That could be a good thing, because most places come from citizens. If citizens have a megaphone, everything had to do with the waking movement, the progressive movement, the gay rights movement. They were always underneath the leaders. When citizens bond on the outside to leaders on the inside, if citizens get active as they are, so many people running for office, lots of women running for office, and people getting more energy and running for politics, it cant be a spectator sport anymore. Thats the way the divided will be healed, if they take the time to learn what others are thinking or feeling. We need to show everybody this book leadership in Turbulent Times. Of course, Abraham Lincoln is on the cover. My guy. Christine blasey ford has said she will testify this thursday at 10 00 a. M. Before a senate committee. Well have more on this next. Take your razor, yup. Up and down, never side to side, shaquem, you got it . Come on stay focused. Hard work baby, it gonna pay off. Ok here we go guys, you ready . Hi cinturones por favor. Gracias. I would have listened to her, but im being honest with you and everyone else. What do you expect me to do . You cant bring it in a criminal court, you would never sue civilly, you couldnt even get a warrant. What am i supposed to do, go ahead and ruin this guys life based on an accusation . Republican senator Lindsey Graham just this morning on whether there is anything Brett Kavanaughs accuser can say to lead him against Brett Kavanaughs confirmation. We learned that dr. Ford has agreed to testify thursday morning at 10 00 a. M. Before the Senate Judiciary committee. Lets bring in the strategists, morris reed, republican strategist lauren zelt and former chairwoman of the nevada state republican party. Lauren, youre here in the studio and im going to go to you first. Do you believe senator grahams approach to this hearing is fair . Do you think most senators already have their minds made up on this . I would hope that they dont as a person and as a human. Politically, think they may but they shouldnt. They should wait to hear from both dr. Ford and also from skw c and judge kavanaugh. You heard that we shouldnt secondguess dr. Ford but also judge kavanaugh can have a voice. Its my hope that senators can listen ernestly and make a decision thats outside of politics. Whether thats likely, i dont know. Morris, your reaction to the remarks of senator graham . Its very clear. We want you to do your job, senator, and thats what we send you there to do. Its astounding that these senators are worried about asking questions and theyre looking to someone to ask questions for them. This is not the 1920s or the 60s. Theyre mishandling an excellent opportunity, and i dont understand why the judge had to step forward and tell them hes welcome to look into it where he can clear the air. What he that haunt them for the entire tenure, so its the judges responsibility to say, i want this done because this is my reputation on the line. Can i ask you for more that you have, is it fair to have something their record that follows them forever . If the judge is innocent, she should step forward. That would go a long way. The way Clarence Thomas handled it, it was clear, at least to some of this, that he perhaps did some of these things. If this judge said, this is not who i am. I want my family, particularly my daughters, to know that i handled myself appropriate nearly my entire life, then i welcome this investigation. Lets not rush, lets get it done properly. Senator mccarthy argued that a hearing would not argue this was a fabrication or that kavanaugh is a hero. What are the chances, assuming the final details get worked out to both sides contentment. Are we going to be no closer to settling this nm. This is not a political proceeding, its not even a judicial proceeding. But they sit in a capacity thats very important that they are in a position to lay out facts before the American People and decide not who is credible, but decide if judge kavanaugh is worthy of sitting on the highest court in the land in which he will have tremendous responsibility in deciding layers of how to. Senator Lindsey Graham who we look toward as. That is not the point here. We are giving someone a fair and honest hearing, because there is too much at stake here possibly letting someone in who committed a rape, and we have to make sure thats not the situation. I have to point out, lets keep in mind kavanaughs statements in which he said, this is a completely false allegation. I have never done anything like what the accuser describes to her or to anyone. But still, i want to point out a new poll from fox news which found a Record Number of voters now oppose kavanaughs nomination. This is 50 to 40 . This is a 10point difference up from just one point last month. What concern does that pose heading into the midterms . Would americans pose better if kavanaugh just withdrew from the situation . I know how these polling companies work, i know they can be easily skewed. I quickly glanced at that poll before i came on with you, and they said they had 1003 people that they had spoken with live, and they were likely voters. Now, it did not give me the breakdown of their actual party affiliation. So thats in question. I dont believe that its 5040. I honestly dont. And i do think that it was correct for Lindsey Graham, for senator graham, to bring up those questions. And actually for that author to point blank say, hey, look, we might not come up with anything. I think its important we hear from the accuser and the accused, because no matter what the outcome is, both of their lives they basically have been tainted no matter what the outcome is, and thats a shame. So i hope that we can see judge kavanaugh confirmed, Justice Ruth Bader ginsberg actually said it best, that she believes this has been a partisan show, and its unfortunate. It doesnt have to be a partisan show. The judge could say i want it to be investigated. He can tell the senate, please slow down. There is no rush. Let this woman have her day because i want to go in with a clear conception. He has gifr. Its your deduction that mark judge will not be subpoenaed or any witnesses will be subpoenaed to testify. How do you feel about that in an effort to get to the truth . I think that decision was likely made i know members of the committee have really been grappling this week with how to handle this, right . I do think its a little unfortunate that more witnesses are not going to be able to testify. You look at the allies of the witnesses from statement that cant corroborate the act. But you also look at reporting and what they did with her husband quite moved me. I think it was a very honest account of a woman, who if she is telling the truth, has grappled about this. I remember that. All of you stay where you are because the fallout from the Rod Rosenstein story is next. What is the president likely to do about it . If you cant be on the team, if youre motte supporting this mission, then maybe you just ought to find Something Else to do. I assume talking about wiring the president , talking about the 25th amendment is not being on the team . Not remotely. Secretary of state mike pompeo on deputy ag Rod Rosenstein. Weve heard some different takes on that article. Doj officials said they thought he was joking. Rosenstein says he never pursued nor authorized recording the president or advocated for removing him from office. How are you making sense of this . If it was me, we would have fired him already. It just makes no sense. He shouldnt be in the position. If he cant believe in the commander in chief, we are all in politics. We know the first job is never embarrass you principal. If you dont believe in your principal, you need to move on. Advisers are advising him against firing rosenstein. Do you think the midterm s why he has a job today and he will be fired november 7th . I do think the midterms are why. The president was talking about the stench of corruption, the department of justice and fbi. He used it to rally up be base. I think his advisers are telling him not to fire him at this moment. Hopefully because were in the middle of the investigation, but politically, this helps base especially on the republican side get fired up before the midterms and i think theres a lot of political maneuvering behind it.
