Anything that keeps this storyline in the focus is going to be damaging. Now, fortunately for donald trump, he has so many other damaging stories that sort of switching them around, you can sort of argue thats a good thing, but Michael Cohen recording conversations with donald trump, thats not something you do by accident, and its probably not something you do just once. Questions become what else does he have and why are you talking to reverend sharpton, and the signal thats sending is that he wants help, and he needs help, and thats a message that im sure donald trump is getting in the white house. And julia, we are not exactly sure how the existence of the tape was leaked, but will you agree that it likely came from Michael Cohens camp since this looks bad for the president . Right. Right. I think the fbi originally got the tape from those raids back in april, but, you know, yeah, the leak does look bad for the president. I think the question surrounding all of this is why would Michael Cohen, President Trumps longtime personal attorney and fixer, someone who is supposedly very loyal to the president , even think to record these conversations in the first place because if there was an actual payment made or an intent to make a payment, that could be very damaging legally for the president some in terms of Campaign Finance laws and stuff of that nature. Potentially very damaging for the president. Rudy giuliani pushing back saying, well, the president did no wrong doing in all of this, but, you know, still a shock among those around trumps circles about why cohen would do this in the first place. Ozzi, Michael Cohen having recorded this and possibly other conversations, does it shed light on what the relationship truly was . I mean, isnt he the same person who said he would take a bullet for the president . Yes. And clearly, its a rubber bullet or maybe not even that much. Julia is 100 correct. Why would his own lawyer be recording this unless he thought there was a need to cover himself or if he thought he needed an insurance policy against his own client. Clearly he had concerns about what was happening. He wanted to record this. You do that in order to protect yourself. All of the tough talking that weve seen from donald trump, all of the tough talking weve seen from Michael Cohen, when they stand up and have to face legal consequences, they often back down. And the Michael Cohen tape being one headline. Julia, this now, of course, coming on the heels of the helsinki summit. President trumps back and forth on russia mudd meddling and now inviting president putin to washington. The post says this morning that russia continues to shape the narrative of the helsinki summit. Especially about the narrative that the two made. What does it mean to have President Trump tell the American People what he agreed to during that private meeting with Vladimir Putin . I think theres a split in the white house. Weve seen reports that chief of staff john kelly has has, you know, reportedly pushed republicans on capitol hill to come out at least, you know, privately against the president , but weve seen many of them come out publicly kind of in a signal to our nato allies, you know, as a way of saying were not going to let russia come between us. We are on your side. Within the white house i think there are two different camps on this. I think you have President Trump and many of his staff that disagree with this. Well really have to see where that goes from there. I think the issue of the translator is really coming into play right now because democrats are saying they want the president s translator, who would have been one of the only people in the room with trump and putin at the time. They want her to testify on capitol hill. However, the white house is likely to push back on this because this is so unprecedented. The role of a translator is to be a confidential person in all of this. Kind of like a doctor or a priest in that regard. Very unprecedented. Shes one of the only people that knows what happened. Well have to see what goes from there. I want to quickly play for you what secretary pompeo told reporters yesterday when asked his thoughts on President Trumps invitation to Vladimir Putin to come to washington this fall. Listen. Im happy that the two leaders of two very important countries are continuing to meet, and if that meeting takes place in washington, i think its all to the good. Those conversations are incredibly important. We have our Senior Leaders meeting all across the world with people that we have deep disagreements with. It is incredibly valuable to the people of the United States of america, the president putin and President Trump continue to engage in dialogue to resolve the difficult issues that our countries face between each other. I think this makes enormous sense. He is set to testify before the Senate Foreign Relations Committee on wednesday. What is the expectation for what hell reveal about the summit or any agreements with russia . Anything he reveals will be informative since almost nothing came out of that summit. We had the press conference. We had that very confusing, you know, wouldwouldnt moment with the president , but in terms of agreements and concrete understanding of what these two World Leaders said when they met for over two hours, anything pompeo can shed light on would be informative. Now, clearly, if he says anything to undermine the president , he will be on a long list of aides who are being shown out the door. It is very difficult for someone in his position to sort of articulate what the benefits are by bringing in putin into the white house for that meeting when he is also being when putin is also being criticized for everything he has done in cri crima, for his instigations with nato allies. It is very unclear what the United States is getting out of this kind of friendliness between trump and putin. If pompeo can shed light on that in the senate hearing, that would be informative. And you say weve gotten nothing from this summit. Julia, i want to go back to your point because you were talking about this. The translator. What is the conventional thinking on congresss ainbilit to have that american translator testify even if its behind closed doors, or is this Wishful Thinking by democrats . Well, the entire thing is unprecedented. This really hasnt happened. Like i said before, translator in this kind of situation serves as a gobetween between a dignitary or official leader and a counterpart in that regard. Their role is very confidential. Like i said, a priest or a doctor. Very unprecedented. However, i think democrats will argue that there is too much on the line with russia at this point. Theyll argue that they pose a National Security threat to the u. S. In terms of election meddling and such. I think theyll say there is cause to bring this translator, marina gross, in to discuss this. It will be discuss to see if that happens. The former trump advisor told nbc news her work for me is perfectly legal. Any insinuation to the contrary is actionable and will be pursued in court. Joining me now is msnbc legal analyst danny savalos. What do you make of this latest are request from the mueller team . The mueller teamed subpoenas to social media specialists who had worked with roger stone, so this may just be a continued investigation in that direction. It just so happens that this manhattan madam has a sort of sundried past, but if she was just working for roger stone as a web master or in the commuter sense she may have relevant information about the flow of data to and from roger stones websites or his business or in some other capacity. If that sense those subpoenas would be consistent with the subpoenas handed to the social media strategist last month or two months ago. We may just be seeing Robert Mueller marching along and lining up all of the data and all of the people who had access to data even if they might not have had any personal knowledge of what was in that data flowing to and from. Danny, the other bombshell headline today is the secretly recorded conversation between President Trump and his former attorney Michael Cohen. Nbc news has confirmed the two discussed payments to a former play boy model who said she had an affair with trump and that the president denied the affair. Nbc also confirms that President Trumps attorney Rudy Giuliani told the New York Times mr. Trump had directed mr. Cohen that if he were to make a payment reeld to the woman, write a check rather than sending cash, so it could be properly documented. Danny, are we looking at potential charges against the president here . Such a difficult question because theres a very significant issue as to whether or not a president can be charged with a crime, whether a president can be arrested and then a separate question as to whether or not he could be indicted or if he only could be impeached, removed, and then criminally charged. Taking those questions aside for the moment, its hard to say at this point whether or not this is indicative or evidence of a crime because we dont know the contents yet of that recording. One thing we can safely assume is because special counsel has the recording that at some point the special master backed several months ago must have concluded this was not attorneyclient privilege. It may have just been a conversation between two Business Associates and that is why it was allowed to be released to the special counsels team. Do you think these conversations were recorded legally . There are two issues any time an attorney records a conversation. First, each state has a rule, a law, as to whether or not you have to be a oneparty state or a twoparty state. In other words, as long as one Party Consents to the recording in a state like new york, then the recording is legal, but if you are in california, for example, or pennsylvania, both parties have to conconsent, or e the recording is illegal. Theres a second layer when an attorney is involved. The new york ethics opinions are sort of hazy on this issue, but generally speaking, the rule is this. An attorney should not make a practice of recording conversations. However, one instance of a recorded conversation is not per se unethical, so if cohen made a practice of doing this, that might additionally be something that the new york bar has a problem with. And at this point we dont know if there are other tapes, but heres a question according to the times. It was recorded two months before the 2016 election. Would a payment qualify as a violation of election law . It could. This is a discussion that we had way back when this first came out. Its whether or not an in kind contribution inured to the benefit of the campaign, and that could be a potential crime, although heres the thing about that crime. Its very rarely prosecuted, and the notable prosecution of john edwards did not end in a conviction. I think its a wash, and its an open question as to whether or not this crime, failing to report federal election contributions, has any real teeth in the modern era. And in this tape it fell under the 1,452 items seized from cohen that were not ruled to be under attorneyclient privilege. Heres some more on that. One person familiar with the situation told me this evening that this was deemed privileged by the special master, but that the president s attorneys waived the privilege. I just spoke with Rudy Giuliani, who was the president s attorney, who said he wasnt sure if the special master had deemed it privileged or not, but effectively, they waived privilege today by speaking about what was on the tape. Can you elaborate on why this evidence is no longer considered privileged . Attorneyclient privilege is not a presumption. Its something that has to be created. There are many exceptions. Not every conversation between an attorney and a civilian, so to speak, is privileged. It has to be in connection with legal services, and it has to be something that is not spoken to a third party, which will destroy the privilege, and that privilege can be waived. For example, if Rudy Giuliani was speaking about Privileged Communications and then he went on tv and talked about it to the world, that might waive the privilege. There are a number of reasons why attorneyclient privilege might not apply. It is not the default position that every conversation is privileged. Its quite the opposite. There is zero evidence to support that claim, but she later pled guilty to exchanging prostitutes and receiving payment in terms of prescription pills. She pled guilty to that in federal court. Now, her connection to roger stone is very interesting. Roger stone advised her as a candidate. He didnt take money from her, but who very famously tangled with eliot spitzer, seemed to prop up his candidate that caused plenty of headaches and embarrassment for eliot spitzer. She obviously knows roger stone. They go back for a number of years. Roger stone has had his own colorful history. What Robert Mueller will get from an interview or a subpoena from Kristen Davis is not entirely clear, but there are plenty of stories that she could tell that would be fodder for tabloids. Lets talk about that. What kind of information might she be able to share with the special counsels investigators . Well, she said yesterday that she worked almost kind of like did a lot of web work for roger stone. That she wrote a lot of did web design and wrote position papers for him, but she said that she couldnt have been connected with the Trump Campaign because she was in prison for much of that time period. To dannys point, she could have insight as to the flow of information as to what has been going to roger stone and the timing of this is all very peculiar because last week roger stone said that he most likely is the person of interest in that indictment who had made contact with the dnc hacker gucifer 2. 0.
