Time hosting, a quick background note. Im a professor and i am involved in Community Organizing and labor organizing. In the past i have informally advised the fast food worker efforts, which is why this morning im especially eager to dive into our lead story on the growing fast food striker movement which this week went global. On this thursday hundreds of employees of at least 17 fast food chains across the country walked out on their jobs calling for a wage increase to 15 an hour and the right to unionize without retaliation. This is not enough money to be working for 8 an hour. If i have to come twice, third time, five time, im going to be here. Zble want common respect. We want the ability to unionize without anything coming back to harming our families. We have to make a change. From los angeles to pittsburgh to chicago to new orleans, workers raised the call to fight for 15 in cities across the country. And the American Workers werent alone. They were part of a worldwide protest that also included fast food employees in more than 30 countries around the world. Building on a wave of momentum that all started with this moment. A single day of protests in new york city in november of 2012. During which employees at a handle of of kburger king, taco bell, wendys, mcdonalds and other fast food restaurants walked off the job. The movement is part of an organized campaign called fast foouf forward. Sponsored by the Service Employees international communion. It is by far the biggest organized labor action at fast food restaurants if history. If you measure success by reaching the wage benchmark of 15 an hour, its clear theres still a ways to go. The medium wage of fast food workers hovers at 8. 96 an hour and they are still no closer to a formation for a union for fast food collective bargaining. If you add up the series of smaller victories for low wage workers over time, its clear the movement has by no means been a failure. For starters, there was this moment from president obamas 2013 state of the union weeks after the first protest in new york. Tonight, lets declare in the wealth yegs nation on earth, no one who works full time should have to work in poverty and raise the federal minimum wage to 9 an hour. We should be able to get that done. Congress responded with the usual degree of inaction on the president s pro poe poe sal ls. During his address a year later following another series of protests in 2013, president obama mentioned the minimum wage again, with a couple of slight but significant adjustments. In the coming weeks i will issue an executive order requiring federal contractors to pay their federally funded employees a fair wage of at least 10. 10 an hour because if you cook our troops meals or wash their dishes, you should not have to live in poverty. Of course, to reach millions more, Congress Needs to get on board. Tom harkin and George Miller have a bill to fight they be lifting the minimum wage. So join the rest of the country. Say yes. Give america a raise. Last year according to the National Conference of state legislatures, four states, connecticut, california, new york and rhode island passed laws to increase the minimum wage. In november the new jersey voters enacted an amendment to increase this year. Four more states, delaware, maryland, minnesota and West Virginia and the District Of Columbia have also enacted minimum wage increases. Other bills to increase the minimum in hawaii and vermont are awaiting signatures of the governors in those states. And while fast food workers are still demonstrates for 15, workers in seattle could soon collect tem in their paychecks. The citys mayor recently inkreelsed minimum wage to 15 an hour. That would give seattle the distipgs of having the highest level in the country. The fast food strikes not only proceeded the policy shifts, but also helped to push minimum wage onto the political agenda and this years midterm election. And while the latest call to raise the minimum wage continues to go nowhere in congress, the increase has the support of the vast majority of americans. More than 7 in 10 people polled any a National Wage increase for fast food workers is a good idea. Now they have a forum thanks to the bright spotlight the workers have shined on the uncomfortable truths of the fast food economy. Employment growth during the economys slow recovery has largely been driven by the addition of jobs in lowwage industries. With e know despite the perception as high turnover positions occupied by transient young employees, 70 of fast food workers in the United States are adults over the age of 20. And we also know just to survive, more than half the families of all the workers have to supplement the paycheck by seeking public assistance. Thats an estimated cost of 7 billion a year dpr tby fast foo workers. There can be no doubt after all we have seen and heard that its only going to pick up speed. I want to read an excerpt from an article about conservatives going after Worker Centers, and he writes, a group called Worker Center watch launched a series of youtube videos aimed at discrediting the a black friday protest. One video depicted the activists as professional protesters who havent bothered to get jobs themselves. Another group from the restaurant opportunity center, walmart and other centers are nothing more than union front workers designed the to make more money for bosses. We know this is lef vied against lowwage protests, suggesting they are not really movements. What do you make of that claim . Well, i think the claim is ridiculous. We are hard working people. We are all workers. Regardless how you feel what we are doing. It doesnt matter what we are doing. At the end of the day. Im working and trying to provide for my family. I deserve better for me and my family. Last week, heather, the ceo of sub way sat down in an interview with cnbc and said something i found absolutely stunning. When asked if he was concerned how a federal minimum wage would impact his business, this is what the ceo of subway said. This would impact subway plus every other competitor. It would not put any brand at a particular disadvantage. It may have a slight impact on consumers a wage increase will happen and all the Restaurant Owners will have to recoup that with a price increase. Are thats what i tell my workers. Heather, this is from the head of the largest fast food chain in the world. Is what do we make of this . Well, i just have to say its an honor to be here with you this morning. Theres nothing more powerful than shining a spotlight on the traditions contrary to our values one is the incredible ceo to worker disparity in fast food. It is actually the worst in the country. The gap between the average ceo and worker in fast food has quadrupled to over 1,001. When you think about what is happening to front line workers who are relying on public assistance, we have to look at the other part of the enterprise, which is the incredible amount of profit and ceo pay. But the subway ceo makes 3 billion a year. We have a recent report that looks at who does the daytoday business of running fast food businesses, its mostly franchisees, 76 . Isnt it easy for you to say sure, you can increase it, but hes zil going to have his 3 million. He is going to have his 3 million. He has it. Thats the thing. To therefore it shouldnt be a problem between the franchisees and the ceos. At the end of the day sh this is why were standing up. We know the corporations have the money for it. They talk about prices. Prices have been going up. Now thats a problem that the price is going up . Youre always bringing up prices. Letting us know one day youre coming in its one price. The next week its another. At the end of the day its tri dick louse. So you work at kfc. Youve been involved in every strike, right . Six . Or is this number seven . This is my sixth strike. I assume you work for a franchise owner. The argument is franchisees are squeezed in terms of cost, so how do we respond to the issue about franchisees getting squeezed versus then Parent Corporation . I was just going to say from my perspective, it is true that the Franchise Deal is one of the worst deals in business. That the same kind of behavior that ceos are using against lowwage workers are often the same for franchise owners who are Small Business people who have terrible legal deals. And there should be reforms to franchise laws to make sure that, you know, the Small Business owners who own individual stores actually get a better deal. But that said, this is question about how we order the economy joer all. Fast food is the single lowest paying job in the economy. These low wage jobs are the future unless we do something about it. I want to give you the last word. I think you met an employee from denmark who works at mcdonalds, wake to new york to support the protest and wrote an article about the 21 an hour wage. She says to anyone who says fast food jobs cant be good jobs, i would answer mine isnt bad. Parts are just fine under the union agreement. I have paid sick leave. Workers are still fighting for in many places in the world. We get overtime pay, guaranteed hours, what was that like to meet a worker from denmark who makes 21 an hour . First of, before i get to the 21 an hour, it was more powerful that she told me that they have a union. That is the most important thing that the workers today are really fighting for. A union, sticking together and having a voice if their workplace. Once we have a union, that money is going to come. The 21, thats incredible. Why is the United States behind . These corporations started here in america first. They started right here. Your breadwinner right here. And you left us behind and knowing overseas is making that much money. Mattress discounters while business franchising and outsourcing practices are popular in the fast food industry, is thats not the only sector contributing to the rise in subcontracting. In the agricultural industry, the number of subcontractors increased by 50 between 1993 and 2002. This leaves 50 more workers vulnerable to labor practices that Large Companies do not have to claim responsibility for. And the Labor Conditions do not only affect adult employees. This week the Nonprofit Organization Human Rights Watch released a 138page report exposing the experiences of children. Ages 7 to 17 who work in tobacco farms in kentucky, north carolina, tennessee and virginia. Those are the four states responsible for 90 of american grown tobacco. Nearly 75 of the 141 interviewed reported nausea, vomiting, reduced appetite and more. All symptom ls is with acute knack teen poisoning. All of these children describe a life of desperation. It feels horrible. It feels like theres no air. You look beside and youre only half way done. And you feel like its time for us to get out. You feel like youre going to die in there. Let me emphasize they also reported using sharp tools, working close to pesticides and working at dangerously high heights. All of this begs is question, why exactly are these children working under these conditions in the first place . Joining me now is the coauthor and lead researcher margaret worth, chaung for joining us. Thank you for having me. You interviewed many of the children and parents peached in the interview. One of the parents described the financial struggles that motivate many of the children to do this work. So lets listen. The more we cut, the more money we make. With their money, they try to buy the school supplies. I want them to complete high school and get a diploma and good jobs where they dont always have to work in the field n the heat. Is that a primary reason why the children your sbe viewed work in the tobacco fields . Theyre in between a rock and a hard place in terms of family situation . Yes, i heard similar stories in all four states about why kids do this dangerous work. So theyre using their earnings to buy school supplies, to help parents pay the bills, to buy clothing and food for the family. And so bra zid and india require tobacco formers to be over 18. Here in the United States, children as young as 12 with wrork in fwam fwak farms. Hue is this legally permissible in the United States . Most of what we documented in the report was perfectly legal under u. S. Laws. They have really strong child labor laws for every sector except for agriculture. They can work for at younger ages and longer hours and in more hazardous conditions. A 12yearold working 14 hours a day on a tobacco farm is perfectly legal. Without legislation to fix the laws to prevent the conditions these kids are working in, what can be done . What do they recommend in the report from Tobacco Companies as well as in terms of legislation. Lets start with Tobacco Companies. We are calling on Tobacco Companies to adopt clear policies to get kids out of dangerous work on farms and in the supply chains. The ones that make the most popular cigarettes by p buy tobacco grown in the u. S. They need cloor policies that prohibit kids under the 18 from doing the dangerous work documented in the report. And you reached out to Tobacco Companies and asked them to respond. R. J. Reynolds wrote in response to your report because farm workers are not our employees, we have no control over their recruitme recruitment, the hiring and conditions of their employment. How do we respond to their lack of accountability here . Theres Broad International consensus that businesses have responsibilities to protect the human rights of workers in their supply chain. Even though the companies themselves are not hiring workers directly. They need policies. They need stipulations in their contracts that make sure that workers are staying safe on the the jobs. And theres something our government can do. You mentioned these are amendments that would prohibit kids under 16 from the kind of tobacco farming your report details. Heres a quote. From the report. Many of the comments were from parents who own or operate farms who believe that the departments proposal would limit their ability to employ their own children on the farm and provide their children with handson experiences in education. So there were proposed registrations and then what happened . Regulations were proposed in 2011 that would have kept kids under 16 from tobacco farming. They were withdrawn in 2012 because people thought they were going to affect family farms. Family farms whoufb except from the regulations. Were calling on the department of labor to reintroduce registration regulations. And were calling on the Obama Administration to support this effort. In certain states like ohio, we see continued efforts so decrease early voting. Imagine if we had nine different days for voters to make it to the polls over the course of five weeks. Sl thats the scenario that just wrapped up in india. 550 million votes were cast. 550 million. It was the largest democratic election in the history of the world. Opposition candidate will be the next Prime Minister after helping his feart to a landslide victory over the sindh ya national congress, led by the long ruling gandhi family. He will face a mountain of challenges, including a struggling kmi with nearly a Million People joining the search for work every month and not enough jobs to meet demand. Thats according to the latest analysis out this week from the washington post. Which is a little bit down from the last estimate that had republicans at an 82 chance to take over the senate. Those are high odds for the republicans, but remember, elections can be unpredictable. And candidates matter. Look at the Missouri Senate race in 2012. Incumbent senator Claire Mccaskill started the race vulnerable with republicans eyeing her seat as one that could flip, but her campaign made the savvy decision to support todd aiken and the republican primary. Going so far as to run an ad calling aiken the racist true conservative. He woen the primary and was beating mckas mccaskill in the polls and then this happened. If its a legitimate rape, the womans body has a way to shut that pregnancy won. Then mccaskill won. 55 to 39 . Even as governor romney easily carried the state of missouri, so yes candidate in the primaries that choose them are extremely important. And there are two bigs ones this tuesday. In georgia five republicans are vying in a close race to run against democrat michelle nunn. In kentucky, Tea Party Candidate is Challenging Senate minority leader Mitch Mcconnell. Me has little chance of winning against the well funded establishment candidate, who was first elected to the senate in 1984. The latest nbc news poll shows mccobble ahead of bevin by more than 30 points. Accuming mcconnell survives the primary as expected, he then goes on the to face secretary of state, alison lungerson grimes. In a state mitt romney won in 2012, the republican leader of the senate is in a statistic call tie with his likely democratic component. Heather mcgee, professor at princeton university, julia, the author of governing america. And robert trainum, a former senior adviceer ed adviser to. Im going to come right to you first, robert. The east wra way to torpedo a candidacy is to Say Something really awful about women. Eventually republican candidates in kentucky and the Georgia Senate races will be running on with im. Does the gop have a strategy to not say the worst thing about women possible . Yes. And thats a short answer. The long answer is the to run the right candidate. What you saw when that individual said some things about rape, a lot of republicans came out and condemned those remarks. Mitt romney did that as well as Mitch Mcconnell. Its not gust the gop. Number two, when you talk about Mitch Mcconnell in kentucky, thans thats an interesting race. He has an antiincumbent record running against the tea party. Hes also running against alison rimes, that they have called us around for the first time in many, many years. I think Mitch Mcconnell is going to win the seat, and the reason is because hes right on the issues, not necessarily because hes running against a woman. Julie, we know matt bevin is 30 points down in the race. He was on up with Steve Kornacki this morning. And we want to show the clip and talk about it. When was the last time you heard him say he wanted to yank it out . Now hes for fixing and patching. The man is not a conservative, and hes not doing anything to fight the obama agenda, and hes using his minority status as an excuse for doing nothing. And that type of cowardand inability to represent his constituents is exactly why hes vulnerable and exactly why hes going to lose the seat. So julian, hes talking ability obama supporting the Affordable Care act. Clearly hes running to the right of mcconnell. Is the aca still an issue for republicans in their primaries and the general elections to run on . Its still an issue. Its clearly faded. Part of that is simply a response to the successful information that came hout in the past few months. The kinds of general arguments about the conservative establishment that hes talking about, i do think resonate with tea party republicans. The problem is a lot of republicans want someone who is going to win in november. Not someone who is ideologically pure. Theyre still there, but not as powerful electorally. Whats interesting, kelly, especially when we talk about women candidates. Alison grimes is in the margin of error. F michelle nun is very close to her gop opponent. These are redstate democrats, and theyre also women. Uds, so what does this tell us about the potential of women candidates . You know whats fascinating is these are the twoit states where we see the democrats saying if we can hold z seats, were going to curve the tide for the republican estimated takeover. And so to have women as the nominees of the party and have the party really come around them, it says something about whether women can win in states like this. And i think theyve been really successful. Both the women have worked to build a base. Both have political backgrounds. They both challenge the the tea party commentsful you know, Alison Grimes is called an empty dress. That doesnt help. That messaging doesnt help. It helps her because it rallies women around her. So i think that these women are really at the front lines of the race and the contest to really keep the the senate. So party matters. The candidates matter. I want to talk about a republican woman, and this is joanie who in a crowded field was trailing in the polls, and then she ran this ad. Lets take a look. Im joanie ernst. I grew up castrating hogs on an iowa farm. F so when i get to washington ill know how to cut pork. Mother, conservative. As a result of the ad, shes got a lot more money flowing in, heather. And theres an interesting gender politics going on there. Sle says lets make them squeal. Shes probably referring to men in washington, d. C. What does this say about this cycle for us . Whether its a democrat or republican woman. I think it says congress is less popular than head lice, i think is the comparative in some polls. Its a very much anticongress sentiment. It has not just to do with the Republican Tea Party thing. It has to do with the fact that people of all ideological stripes are seeing people in washington further away from them than the right is from the left. Thats extremely problematic given how much the economy is suffering and how much theres a sense that nothing has any solutions for the problems keeping people up at night. You look at Mick Mcconnell who is the poster child for Campaign Finance gone wrong. So we have a lot more coming back. I like we got to talk about the the hogs. In both houses of congress, Democratic Women far outnumber republican women, and the gap has been growing for years. In the past three decades, democrats have increased the number of women representing their party sixfold, while republicans have not doubled the number of women theyve had in congress. In state legislatures, considered a pipeline for national candidates, the number of Democratic Women has tripled in state legislatures since 1981. The number of republican women have risen 3 . Neither party is close to gender parody, but to get there, women need to run. This year more than 200 women are running for house races. 151 democrats and 82 republicans according to the center for american women in politics. 29 women are running so far. 17 republicans and 12 democrats. Today we talk to one democratic woman running for her state legislature, sandra fluk social justice advocate and candidate for California State Senate who joins us live from washington, d. C. Good morning, sandra. Good morning. Thanks for joining us. Why is it important to have women running for office . Well, because its important that our elected officials represent our population. Thats at the core of being a democracy, everyone having a voice in government, and that applies not just to women, but people of color, folks from every ethnic background, the whole population. So youre not new to the public sphere with this campaign. Oning for office is a different aspect of that sphere. And im wondering what is the Biggest Surprise so far. Well, any first time candidate will tell you one of the things hardest to see up close is the dire need for Campaign Finance reform in the country. And thats certainly something ive seen up close. What i have really enjoyed is getting to talk more to voters. The really important concerns were tackling in california. I want to come back to the panel. What can you tell us about the trend of parties over time . Why the democrats are more successful than republicans . I think the trend you mentioned earlier is spot on. Right now we have 30 of the Democratic Caucus women. 8 of the Republican Caucus women and that trend line is true. Were increasing democrats. One is infrastructure. And wen know when women run, they need to be asked. They need support. They need Financial Support and encouragement. Were not seeing the same infrastructure on the republican side. You have campaign trainings. I think an estate where you have a merge and close the the gap and all the the efforts the to get progressive women to run. Were not seeing the same strength on the republican side. The republican women of the house in their efforts is important. The last is women cant get to the primaries. We found that in our research. Theres infrastructure. What about policies . Theres more to it. This is an issue since the reagan administration. In 1982, Elizabeth Dole is talking about the gender gap and studying it. Its about policy. Its not just abortion issues, its economic issues. Its government reform issues. Its something republicans have struggled with for many decades now. I think its the combination of is infrastructure and strategy, combined with a disconnect between republican policy right now, and where many women voters are. Its something thats harmed the Republican Party. How do women attract more im sorry how does the gop attract more women candidates . One, shes right. The infrastructure has never been there. And you have the republican from florida. You have olympia snow, the current senator from maine, all talking about this issue, and saying first and foremost, its about making sure women get asked and making sure women have the support to run for office. But theres two sides to the coin about policy. There are republican women out there who disagree with policies when it comes to womens issue. There are republicans who are prochoice or prolife. There are republicans who fundamentally disagree with what democrats or progressives say about some policy things. Again, theres two sides of the coin. A prime example is if the Current White House would actually pay their women staffers the same as men, in terms of pay equity, there would be more transparency there in terms of making sure everyone gets paid what they should be paid what a lot of democrats are talking about. But i readily admit, i ready admit that the Republican Party needs to do a better job of recruiting more republican women to the run for office. Sandra, youre known for support of reproductive rights and other womens issues. How does that frame your candidacy . And do you run as a woman candidate or a as a candidate that happens to be a woman . I dont know that i have much choice about running as a woman candidate. That one was predetermined for me. The way i look at it is 50 of the folks in the district that i am working to represent are women. The rest often live in households that include women. The types of issues that we label as womens issues are important to everyone. When were talking about Affordable Access to child care or family leave, two policies i really want to work on in the California State Senate, those issues matter to a lot of the district. And i hear that when i get asked questions by men as well. That doesnt mean the socalled womens issues are not the only ones im talking about. Do you agree or disagree with the following statement . The economic and political systems in the country are stacked against people like me. Well, the majority of people agreed. 55 agreed the deck was stacked against them. 39 disagreed. The pollsters have been asking the question for years, and this years answer was very different than those of midterm elections. While a majority, 54 , apparently thought things were pretty fair. In 1994 again, more people thought things were fair than stacked against them. In 2002, a whopping 59 thought things were pretty fair. Only 34 thought the deck was stacked against them. In 2010, it was a tie. 47 agree that the deck was stacked against them. 47 disagree. So now with more americans believing the deck is stacked against them than in all of the previous midterm years, have democrats found the right strategy in making their policy push about an increase for the minimum wage . Heather, take that and run with it. I think youre coming to me because its called stacked deck. Perhaps. I think so. I think the issues, the underlying issues that people can work hard and still not get ahead, much less get by, have been with us for 20 years. Theyve been with us throughout the wage growth in the middle class for the 2000s. Things like occupy have driven the elite discourse to reflect whats been going on around kitchen tables in america. Yes, actually, its true. We are very slow as americans to move to the structural. We always want to say its the individual, but finally theres more of a National Coherence around the ideas that our policy is structure is just not working. I agree 1,000 . I this is its like an onion that you have to peel back. I think people say, wait a minute, im a black person or a white person and view it through the lens. And you remember the angry white male situation we had when a lot of individuals out there, particularly during 1993 and 1994, we saw the republican revolution. My guns are being taken away from me. And the country is getting browner and browner. Okay. Fast forward to 2014 and the question becomes whether or not that angry white male feels even more alienated or put into a certain degree. My point is simply that its much more complicated than i think we all know. I think its a response to two things, one is the structural problems in the economy, and left and right can agree on the problem, maybe not the solution. And its not about shortterm recovery. Its about jobs being gone. Enthe ladder to the middle class being much more difficult to get on. And thats a longterm problem that were not dealing with. And the second is the problem in the political system, where in some ways the deck is stacked against people. And so neither side with get the solutions theyre hoping for. Whether its minimum wage or something else. I cant resist. We have to bring back our friend joanie earnst. We know about the hog castration ad we showed you. She just released a new ad this month. The Los Angeles Clippers are out of contention for the nba title, but their owner, Donald Sterling isnt out of the news. The players lost to the oklahoma thunder, four games to two this past thursday night. Sterling was not in his customary court side seat because hes been banned for life by the nba after racial comments he made in audio recordings, which were published online by tmz. Sterling was also fined 2. 5 million but now he says he does not plan on paying any of that fine. They claim sterling has done nothing wrong, and that quote, no punishment is warranted. The letter also indicated sterling will not pay the 2. 5 million fine that is already past due and ends by saying this this matter, quote, will be adjudicated, meaning hes taking steps towards suing the nba. The attitude in the letter was quite different from sterlings interview with Anderson Cooper earlier in the week when he said things like this. Im not a racist. A made a terrible, terrible mistake. And im here with you to apologize. But that apology isnt all he offered. They added this, too. Am i entitled to one mistake after 35 years . I mean, i love my league. Am i entitled to one mistake . Its a terrible mistake and ill never do it again. One mistake in 35 years. This from a man who five years ago paid the largest government settlement ever for a housing discrimination case involving apartment rentals. That was also the year he was fending off a Racial Discrimination lawsuit from a suit baylor eventually won two years later. And according to a new usa today report, stearling may yet find himself in legal jeopardy gel. Sterlings childhood home and another property in los angeles are still listed as owned by his grandmother and mother. They date to 2001, that bear the womens full names, last names or initials. The issue is both women have been dead for a long time. And that requires the death of the homeowner to be reported to the county assessor, a step that triggers a reassessment of the Property Value and typically a tax increase. What kind of tax increase are we talking about . According to the report, in 2013, the property tax for sterlings boyhood home was 603. 66. His mothers property, 1,545. 11. Based on the current market value, the combined annual taxes would be at least 13,000. Now whether or not he ends up suing the nba, it seems Donald Sterlings own words and actions may be causing him even more trouble. Joining me now again is Heather Mcgee. Dave, let me start with you. How do you solve a problem like Donald Sterling . Donald sterling is not going to make it easy for the nba. Beware. Donald sterling does not have a case against the nba, because at the end of the day he is a franchisee. It would be the equivalent if i opened a quiznos and served rat meat and mexi melts. They wouldnt keep me open very long. And Donald Sterling has been the longest tenured owner in the nba. He knows where all the bodies are buried. And if this goes to open court, it could prove an absolute nightmare for the nba. Does he have a case here to make about due process . That the league in some way acts so quickly that they undermined themselveses . Not particularly. Not based on the agreement he signed with them. F the leeague has the right to protect themselves against financial foreclosure. To disenfranchise Donald Sterling, and it seems thats what they intend to do. Amy, what do we make of the latest article about the property tax issue . Is this going to relate in any way to his problems with the nba . Or is it something totally separate . I think its totally separate. Theres been a long documented history of this man trying to operate within the margins as much as possible. When he goes outside the margins hes able to reel it back in. I. E. , suing for millions of dlaus, all of these lawsuits, because technically we saw adam silver say when he was questioned, why wasnt this man held accountable . He was never technically found guilty in the court of law. This is just another example. I dont see how this affects whatsoever the future of him being able to own the clippers. Lets go back to the interview for a minute. Does he just have nothing to lose at this point . The fact he didnt know he was openly gay and making references to never be jealous. He clearly did not do preparation for this. And that completes the sad caricature of him as the unhinged racist billionaire. He has stuff to lose. He has his team to use. The fact he does all the p. R. Just means if it ever gets to a jury, km is the end of the rainbow, if he ever gets there the marketplace of ideas has rejected him. Its almost a positive to be criticized at this point. You talk to someone like Magic Johnson. Age shaming him. Magic johnsons stock almost goes up because Donald Sterling is this crazy uni hinged person. It appears hes very senile and old and doesnt mentally know what hes doing, or hes very sane and knows exactly what hes doing, but he seems so innocent in what he was saying that i dont think he realizes what he is saying is so wrong and offensive. Thats the dangerous part of a racist, in my opinion, is because you can give a lot of money to charitable causes. You can appear to be warm and loving. But you say things so hurt. And disgusting, i dont think he knows what hes doing wrong. He also called Anderson Cooper a bigger racist than himself. While also trying to appear apologetic and sincere. In the case of others with the transgressions, oh, im sorry, im sorry, im sorry. They want to continue the pattern of behavior. Only that all of this stuff, every time we say one word about Donald Sterling and the latest outrageous thing he said and who he offended, why did the nba coddle this man for over 30 years . Why was he part of the nba Coaching Fraternity . Why as recently as a couple of years ago did hay fine chris paul to the Los Angeles Clippers on a silver platter. Why did doc rivers, a person who has come out of this very respected as the spokesperson for civil rights in the league, why did he sign a contract with the man. Why did chris paul resign tw this man . Tha what him coming to court raises a ton of questions. Why didnt the nba care . All the the issues about how racism festered behind the scenes and how the nba was fine with it, as long as the trains were running on time. Thats the thing the nba doesnt want in open court. On this point and because its nerd land, i couldnt help but treread the nba constitutio. What is the constitutional basis for kicking sterling out . What grounds does the nba really have . Im not a lawyer, so i couldnt interpret it. What standing do they have . Use can use the metaphor that is binding. The owner agrees theyre not going to sue the nba. To the extent that he challenges that principle at all, the nba has the two subsections, one is he will not do anything adverse to the nba. Certainly the nba will argue that threatening the team boycotts the game, loss of marketing and sponsorship under that umbrella. The thing that is new is refusal to pay the 2. 5 million fine falls under another more explicit section that doesnt need interpretation. The failure to pay your dues and debts is grounds for firing. Thats the grandiose one for a legal basis. Im not a lawyer either, but im told thats the hook. Its really the user analogy of a private club. You abide by certain rules by joining the club. If you are fined and get a fee, thats what they can get out of it. Much more here. Were going to get back to Magic Johnson. I want to make one clarification a part of the introduction and the lawsuit between Donald Sterling. A jury ruled in favor of sterling, not baylor in 2011. Heres some of what sterling had to say. Hes a man we think would be educated. And a man who is smart enough to build this type of wealth and own a team to have an incredible platform to change the world. But hes doing it in a negative way. That was obviously the Magic Johnson response to what Donald Sterling said. The kind of goes that has sex with every girl and catches hiv, and is that someone we want to respect and tell our kids about . I think he should be ashamed of himself. So johnson responded with that cnn interview the next night saying when i saw the interview i was sad. Im going to pray for this man. I hope he can see the mistake hes made and the people he hurt along the way. Its not about me. What was that sterling attack about anyway . And i was to refer to this column in the New York Times where he wrote, quote, lets start here. Contracting hiv or aids is not evidence of a character defect. Its simply a disease and should be treated as much. They seem to separate out and shun people with communicable diseases, particularly centuries old one is outragesous and mustnt be tolerated and glossed over. So dave, im going to come to you first, how much should we care . Donald sterling is beneath contempt. Hes a racist in his comments about Magic Johnson frankly did not deserve Magic Johnson going on cnn to respond. That being said, there are two things we need to say which produces an uncomfortable discussion. Is t the first is there is something about the fact that Donald Sterling insults Magic Johnson and everybody rushes for the vapors. Decadesf Donald Sterling terrorizing the poorest people of color in the Los Angeles County area with his housing practices and no one in the nba gave a damn. Thats a problem. F the second problem is there may be a discussion worth having hes not doing charity work. Hes investigating lowincome is service jobs, starbucks, Magic Johnson movie theaters and theres a discussion about how much this helps people. The problem is when the discussion starts for the mouth of Donald Sterling, immediately everything is tarred by that because hes such a repellent human being. So dave, i want to follow up on something you said initially. Thats the words from sterling versus his actions over many, many years in terms of discrimination. We saw attorney general eric holder said this referring to racial reparks made by both sterling and rancher cliven bundy. Announce themselves in headlines. They are more subtle. They cut deep. And theyre a terrible impact that endures long after the headlines have faded and obvious ignorant expressions of hatred have been marginalized. Heather, is he right . Are we taking our eyes off the prize by focusing on words versus actions . Absolutely. I think we all get to feel good when we isolate Donald Sterling out of the community of accepted behavior. Right . Absolutely that is wrong. But the facts of, you know, its Magic Johnson said he was an educated man that made money. He made money by being a slum lord millionaire. F he gained the system, being systematically racist and exclusionary. The fact that didnt come to light. That wasnt a national outcry. It didnt get National Press in the same way that, you know, a taped conversation saying something mean ability one of the most powerful africanamerican men in the country is vl telling to us. The fact that the conversation we had earlier today about minimum wages, right 1234 the tolerance for poverty work by disproportionately people of color and high pay by disproportionately white executives, thats the racism that we have today that we dont talk about in those terms because were busy talking about his use of the n word or Something Like that. Hasnt the affair given us the opportunity to talk just about the things that attorney general holder was talking about . I wish it had. Obviously on this twohour show on nerd land, yes, it does. This is important. Be because its confusing the state of race relations. We have an africanamerican president. We have a widening racial wealth gap. We have a global collapse that was targeting people of color. We have all these depictions of africanamericans in extremely pod and extremely negative ways. We dont have a common understanding of what racism is like today. And so these moments serve to confuse us because they take our eye off the ball. So, i want to bring dave back in on this. Youve written about the history of sports, how do we put this moment in context with the role of sports Many American relations over time . Its a great question. I have to Say Something about the eric holder line. I praise him for saying it and making that point. You wonder if he says it in front of a mire ror when you look at the deportation policy in the country. The targeting of arabs and muslims around terror stings. Ch even though hes so critical of the drug war and the fact that it continues and keeps rolling along. This idea of how structures and how racism is so baked into the cake of this country. And its very tough to unbake a cake. Thats the challenge of the 21st century. And its not going to happen by isolating and wagging our fingers at the Donald Sterlings and paula deens of the world. We have this conversation in two or three years for now. Ft whether its paula deen, sister soldier, every two to three years we have this moment that were supposed to talk about race and finally were going to people back the onion and then we move to the next topic. And i predict this will probably happen again, unfortunately. I think you like onions. Thats the second time. Youve mentioned them at this table. When we come back, were going to get much more into the players themselves and lebron and the other players, whats their reaction . If sterling refuses to go, will lebron and others refuse to play . When Donald Sterlings most recent racial remarks landed on the internet, he got responses from players on his own team, who as you may remember, staged a symbolic protest in the first game after the news broke. For a moment this week we thought more drastic action from players was on the way. Roger mason jr. , first Vice President of the nba players uson told showtime host jim rome that lebron james was prepared to lead a boycott of the league, refuse to play in protest if sterling or his wife still owned the clippers. Mason locked his comment back on twitter and lebron says we see what nba commissioner adam silver is doing and he continues forward. If he continues to move aggressively on the situation, then we have nothing to worry about. Should the players have that much faith in their league to get the sterilings out . The players should have learned anything, its that they possess this enormous power, this enormous lovrj. The players across the board, in the bedroom across from the owners get hosed in that negotiation. This is 2011 negotiations. They have no say over who the commission of the league is. And apparently for adam silver acting so swiftly was the threat of the boycott. One of the most troubling things is who makes the league . We make the league. We feed them, house them, give them cars, speaks to the larger plantation mentality. If they want them agitated about the power dynamic there. Thats not isolated to Donald Sterling. If the players dont take drastic action at this point next season, and if the sterlings are still the owners do they undermine their own strength . Of course they do. I never thought they were going to boycott. I know it was a lovely narrative to spin, and everyone was excited about the thought of it. But you saw players this week back off what lebron james said about when hes the owner, were backing out. They said hold on. And this is not going to be taken care of. If you see anything with Donald Sterling, he loves to litigate. I think in general in society we at large are sort of not very big fans. Were not fans of collective action. Collective action. Ill give this credit to sterling, hes taken his beliefs as demonic as they are and put them into action by being racist towards a whole set of people. He at least follows through on his beliefs and his actions as demonic as they may be. I am very skeptical. They have so much money to lose and it certainly seems in the past they have shown no ability to do Something Like that. In d. C. , the prospects for collective action by the players. The prospects are real. I feel good about the sourcing that said the golden state warriors, the Oklahoma City thunder with their conservative owner clay benlt, not to mention the clippers themselves would have walked if adam silver would not have come down so far. And if they havent walked, the threat of a strike can be an effective tactic. The threat was out there. Adam silver knew it was in the atmosphere. The players are saying they have faith. But the start of this year Blake Griffin said its 50 oo 50. If other players walk, the prospect for collect i have action is still very much on the table. The players have the amazing cultural capital, not to mention economic power. Maybe that just means no clippers games will be played. And i think we will all survive. Doesnt that undermine the players or the unions credibility on this question . I know youre excited about the prospect of collect action. The vp had to walk back those comments. Yeah, but ive got a lot of respect for roger mason. And he very much believes the union still has a role in presenting demands to the nba in wanting a timetable and not just having an adam silver savior fest in the whole thing. And ill tell you something else, roger mason has to be aggressive because the person theyre asking to help lead the stuff up, mayor Kevin Johnson of sacramento, people can use the goog ls themselves. They have an antiunion person with a history of owning slums. Giving them advice about what to do with their union. I want to broaden this conversation out and listen to what First Lady Michelle Obama said at a High School Commencement yesterday. She was speaking in kansas for the 60th anniversary of the brown v board of Education Supreme Court decision. Take a listen. This issue is so sensitive, is so complicated, so bound up with a painful history. No matter what you do, the point is to never be afraid to talk about these issues. Particularly the issue of race because even today, we still struggle to do that. The first ladys husband, president barack obama, said actually a Malaysian Press conference on something else, he was asked a question by nbc news about the affair and he said this. Ignorant folks want to advertise their ignorance, you dont have to do anything. You just let them talk. Thats what happened here. The United States continues with the legacy of race. And slavery and segregation. Thats still there. Heather, i find this interesting that the president made a choice to respond. To say this is a dmentic issue. He made a choice to respond, we see the first lady talking about this. What is different about the administration very reluctant to talk about race . I think a few things he would say he doesnt have to face reelection anymore. I think as with so many issues the people have led the mass demonstrations around the Trayvon Martin shooting. So much of the sort of demand for conversation about racial inequality and injustice has forced the president s hand, giving him the political space to say of course im going to lead on this issue in the same way as deficits or foreign policy. I think he felt unfortunately for the first five years that he could not even talk about what is part of america because hes africanamerican. Robert . The cynic in me would say the president politically could not talk about this as freely as he wanted to in the first term. One, the president is becoming much more comfortable with himself. And being fluent in the language, and the nuance language of race in this country. Its a legacy issue right now. And we have to lead on the issue. And the reason why we have to lead on the issue is were the first. Theres going to be a lot of space between the that and the white house. From your mouth to our ears. Hes trying to walk a fine line. Hes trying to make the public happy and not create fast lanes and do the right thing. But also he has big broad band companies lobbying him, and you know, have an interest. And it really comes down to a legal question if they can do this legally or if they have to do some other legal somersaults to get to a point where they can protect the internet. I myself, i love watching and streaming house of cards or walking dead. If the socalled fast lane is approved, how would i be affected as a consumer . As a consumer, you may have a better experience. I dont know how much of an online video watcher you are now. I watch a lot of netflix and amazon and so forth, and particularly in the even kz, it buffers a lot. The video quality drops down and it looks pretty bad. A lot has to do with the fact that the internet is basically a best effort nerk. So all the the packets are vying for space on the network, just like cars on a speeding highway. And so with the fast lane, it could make the quality better. There will be an h. O. V. Lane set aside for the traffic and you may get a better experience. So i want to turn to what some critics argue. And first i want toubt point out is a colleague of mean from professor tim moon who coined the term net neutrality. He had this reaction to the new rules. You dont want to buy a package of features that you can only access if you pay a certain fee. I think were a long way from that. And we also have to recognize that the internet is growing up. Its a commercial entity. A lot of companies spent a lot of money to build it. They make money from it. And it needs to be managed. Its a best effort network. If you think of it like a highway system and you have all the cars on the highway and theres no traffic lights. Theres no management at all, sometimes you get bottlenecks, and thats not good. F. Quickly i want to point out one other critic. This gets to racial inequality. We used to call this a digital divide. But rashaad argues the proposal would leave the door open for an exclusive fast lane. He goes onto say it would disproportionately affect black and lowincome communities already under service by the private market of Internet Service providers. How do you respond to that claim around the potential racial inequality . The proposal on the table now has nothing to do with that. But quite flankly for todays students the purpose of speaking to them on Graduation Day is a minuscule problem compared to the economic calamity that awaits so many of them. And the Consumer Price index has risen only 121 . As a result of treasury actions, rates are set to rise for Student Loans for the Upcoming School year. Not only is the debt accumulating to unprecedented levels, but it is hard to escape. Unlike of other types of debt, Student Loan Debt is very difficult to discharge after declaring bankruptcy. To discuss this crisis, Heather Mcgee, and jim mashore, the executive director of young invincibles, a national Nonprofit Organization amplifying the voices of young people across the country. Jen, why is a student a focus for the invincibles . It absolutely matters to this generation. Were looking at folks graduating with a ton of debt. Theyre really struggling to start their lives. Things like buying a home, buying a car. Those are things that are off the table for a lot of students. When were looking at the student debt crisis, we passed 1. 2 trillion in student debt this country. When you look at the forprofit sector, the forprofit colleges, we know one in ten students attend the forprofit college, but theyre responsible for nearly half of all student loan defaults on the student loan side. Theres a proposal on the table, we have ten days to get comments in about whats going on and how they can regulate that industry. We also know theres a lot going on in congress on this that we can have students be a part of. We know that senator elizabeth warren, no relation, by the way, has introduced a bill called the bank on Students Loan refinancing act, that would let them refinance at todays rate. Heather and jen, is this a good policy response . I think there are three different areas we can attack this problem in. One, absolutely go off to the bottom feeder forprofit colleges that really the ones that are advertising on the side of buses and subways. Theyre preying on lowincome working people working two jobs and trying to get ahead. The theres something that can be done. People should go to young invincibles website to raise your voice. The debt should be refinanced, yes, we should close that bankruptcy loophole that allows people to write off their mansions, their second homes, but not their student debt. But then we should also look at the driving factor in this, which is that we used to have a system of debtfree college for all in the 1970s, even through the 1980s. Student loan debt was not the same as it is as today. Fundamentally, this is no way to run a country. We need to move toward debtfree college for all. Jen, what do young and invincibles plan . We think it will help a lot of students struggling with high interest rates. Think about mortgages. If you have a mortgage, youre able to refinance that mortgage. That option is not available for students out there. This would provide that kind of relief. We think congress should act on that. And to heathers point, at the state level, with eneed states to be invested in higher education. In arizona tuition has doubled in the last five years.
