That announcement just hours after a fivepart tweet rant ripping special Counsel Robert Mueller as the prosecutors about to file details today about Michael Cohens sentencing, and the reasons for breaking their deal with paul manafort. Joining me is ken delainian, and msnbc White House Correspondent Kristen Welker, and also former justice analyst matt miller and attorney general to eric holder. And kristen, we are looking at the big change norse Justice Department and of course, why william barr . Well, President Trump today said that william barr had been his first pick. Look, he is seeing him as someone who is widely respected. And he has oobviously been a log time washington attorney, and served in that role before as you mentioned under former president george h. W. Bush. But something that you touched on at the top is significant for this president. He is questioned why Hillary Clinton has not been coming under more scrutiny, and he has made more comments about robert mue mueller, and questioned the political motivations, and now in the confirmation hearing, all of the comments will be at the forefront and you can expect the democrats to pounce on those, but the are republicans insist that he has a long record and that record will stand, and ultimately it will be the reason why he gets confirmed. Now, of course, the republicans have a majority in the senate. All of those factors led to the president s decision to no, maam name him, and you mentioned that he also intends to nominate Heather Nauert for the u. N. Ambassador. She is of course, a fox news, fo former fox news anchor, and then of course, has served as a spokesperson for the state department and andrea, the other person that the we are watching closely is chief of staff john kelly with four sources telling us that he could be on the way out in the dayshead, andrea. And ken delainian, let es tk about ken barr and a little bit more about his background. Well, he was the attorney general in the latter part of the george h. W. Bush administration which given the warm glow around the funeral and the pageantry and remember iing the former president , probably bodes well for his confirmation, but he was involved in some c controversial pardons involving the iran contra scandal back then, and the comments that kristen allow uded to modern da scandals, and talked about the allegati allegations that Hillary Clinton was somehow allowing uranium to be sold to a russian president , and it was onot a problem for donald trump to be investigated by the justice directed to Hillary Clinton. And also, some comments that Robert Mueller had made to democrats, and so he may have said some things that made donald trump happy about the Mueller Investigation and the clinton scandals, but give n gi pause. And she was not actually involve md decisionmaking of that, but it was an interagency decision made mostly by treasury. And lets talk, matt miller, this Important Role of william barr, and what happens to Matt Whitaker and he was critical of james comey. Yes, he is the pick that you would expect from the typical republican president who this president is no. He is aggressive views on the executive power and those are not necessarily deal breakers, but the senate because of the way that the president has tainted the relationship between the presidency and the Justice Department between the Public Comments and the private interference, what is critical is that bill barr assure the senate that his appointment is not tainted and he does that by making the commitments that the attorney general and assistant attorney general said in watergate not the interfere with the general counsel or the district court, and so they will do a thorough vetting of him, and get those commitments, and find that he is able to serve in the job that they act on it with due speed, because the situation with matt whisktaker is not transparent in his ro role. And we have heard nothing from him. And now, with paul manafort, and cohen, and on manafort, it might be the first revelations of what was the break there . An important filing, andrea, but we may not see much of why it is important. The judge will, and the parties will, but we may end up with a document much like the one that was filed in the flynn sentencing. More black lines. Lots of black lines and ink spilled on the black lines. And that said, i have always maintained that nothing sensitive should be in the public record. And so that being said, there may be nothing interesting. And Kristen Welker, to what extent do we believe that the action on the new nominations is a distraction from the possibility of the chief of staff being fired imminently or the chief of staff resign iing imminently or the filings from the special counsel today getting a little close to home with Michael Cohen. That is the right way to the look at it, andrea. We know that the relationship between the president and the chief of staff is something that has royaled th roiled this whit some time, and flasheses between john kelly and a number of top official, and john bolton and the first ladys office for example, and so this is something that president has been grappling with for some timed and they have disagreed in public at various moments over immigration for xexampleple. So no doubt that he could want to shift the focus away from the fact that he may be poised the see the chief of staff to be removed or resigned, and then to the point to what extent is the Russian Investigation or the expectation that we will learn more getting under the president s skin . All you have to do is to look at the twitter feed this morning and a num bber of tweets about e special counsel taking fresh aim at him. In one, andrea, saying that Robert Mueller and leaking lying james comey are best friend. And just one of muellers issues. And so of course, you would have the doj pushing back on that characterization firmly. The president is on the way to kansas city, missouri, and we will be listening carefully if he is verbalizing anything in the tweets, but no doubt, it is increasingly concerning this president , and this administration. And one of those tweets that, kristen, we just referred to was against Rod Rosenstein and he tweeted, will this scathing document written by lying james comey by Rod Rosenstein who actually wrote the are report conflicted. And yet, this is the president ak a knowledging and shouting out to Rod Rosenstein last night at a hanukkah celebration at the white house. Rod rosenstein, and where is rod . Where where is rod . Ro rod, whe rod, where are you . You are entitled to a much better place. Okay. Thank you very much. And how do you thank you very much. How do you square that circle . Well, i cannot square if circle, bun of the things that Rod Rosenstein did and precise ly the right thing to do was to seek the ethics advice of the p professionals within the office, and so to the extent that the president is tweet iing or sayi that he is conflicted the Career Department officials have looked at what rod said and knows and wrote and decided that he can remain in the case which is frankly looking like good thing for the rule of law. And is he the still in charge of the probe or Matt Whitaker . The person who runs the department of justice is Matt Whitaker, but the Deputy Attorney general is overseeing everything, and he or she is the chief operating operator of the office, and so even if he has the official signoff, rosenstein is overseeing the investigation. And he was in the justice team under eric holder and so what happens if william barr is confirmed, does whitaker return to chief of staff or nominated for Something Else . It is a good question. Because usually a push and pull between the attorney general about what jobs and who s is gog to pick for which job, and usually coming to a consensus, and eric holder, the one person he decided was his own chief of staff and that a smart piece of attorney general and cabinet. Jeff sessions, it is notable took Matt Whitaker and had him forced upon him by the white house, and you saw what happened is that Matt Whitaker sat there at the doj and was the white house eyes and ears and the attorney staff and attorney general should not be doing, and so ultimately, people would say it is very unusual for a chief of staff to turn on the boss and accept that position and back channelling to the white house after the attorney general is fired. So you hope that bill barr, someone who has been in the attorney general and he would have the sense to insist on the chief of staff and own picks to surround him. And ken delainian, what else might we expect from the mueller team, and how late may it come . Are we going to get a weekend . Well, maybe not, andrea. The judge in new york thankfully set a 5 00 p. M. For the cohen memos and who knows about the manafort document may land, but this is true, that we have learned to temper the expectations given the flynn redacti redactions, but we would like to see to what credit they give him and do they use the phrase substantial assistance and the details may be redacted but if Michael Cohen is offering substantial assistance in his investigation, donald trump will be very worried about that. And kristen, likely that john kelly is out by the end of the day or given the fact that they are having the Christmas Party for the staff today maybe they will wait and not put coal in the stocking yet . Well, they may wait, because there is a dinner tonight of the advise force the president , and he is expected to be there and i spoke to sources who said that by all accounts he is expected to be there and boy, that is going to be an interesting dinner, because one of the people among the leading names to replace him nick ayerers ws s the chief of staff for the Vice President is also expected to be at the dinner. Could it happen today . It is a possibility, and the best guidance we have given were the days ahead, so we will be checking those phones vigorously to make sure that we dont miss anything. To put a fine point on that, kristen. As you know better than anyone, we are going tointo the campaig season for the president s reelect which is what they are planning for, and nick ayers is a political expert. John kelly, the esteemed general is not, and so you can imagine that is an explanation of him moving on as you get into the post midterm part of the firstterm president. That is an important point, and based on my conversations with a number of sources who were close to the the white house, and familiar with the administration and inside of the administrations, they say that the president was disappointed in the wake of the midterms that they did not hold on to the house, and john kelly is one of the people he holds responsible. Heather nauert is going to be working with nikki haley to replace nikki at the United Nations, and she is going to be ambassador to the United Nations, and she is very talent and smart and quick. She is going to be respected by all. Now, nauert came to the state department from fox news where where she was a correspondent and anchor. And richard, thank you for joining us, but i would have to say that Heather Nauert had a tough time under Rex Tillerson, but under mike pompeo, she has been a trusted adviser and ed a voe kated for more transparency and openness to the press, and something that tillerson fought vigorously against, and that said, she had no diplomatic experience and how does she match up against her predecessors in this role . Well, to some of the pred sors were some of the most impressive names in American Foreign policy from adelaide stevenson to Tom Pickering to others, and so she has big shoes to fill, and the confirmation hearing is going be potentially tough. She has something to prove, let me just put it that way. And she has had no previous diplomatic experience and she is a quick learner, and smart and at the same time Madeleine Albright another predecessor to her, and susan rice, and others with the diplomatic and Foreign Policy experience. Interestingly, Rex Tillerson gave one of the first interviewing to Bob Schieffer in texas, and they are both texans, and he had this context for what it is like, and he asked where did you go off of the rails with this president for whom you did not know. Lets watch. And the president would say, here is what i want to do, and here is how i want to do it. And id have to say to him, well, mr. President , i understand that is what you want the do, but you cant do it that way. It violates the law. It violates a treaty, and he got really are frustrated. And is so that is how he fell out with the president. So that is the other question. Whether someone like Heather Nauert can be an adviser who can talk back to the president. Nikki haley did occasionally. Yeah, but this job doesnt necessarily have to be someone who is an adviser. One of the Big Questions is whether if she is confirmed, andrea, if she has the rank of a c cabinet rank and whether she is an adviser or essentially like some of our other 150plus ambassadors, and quite possible, she is the u. S. Permanent representative to the United States, and she s gois going to instructions which by the way is the same way that every other u. S. Ambassador works. She is going to have the support of the secretary of state mike pompeo, and john bolton has his own confrontational approaches to the United Nations and other institutions, and so she is going to have to navigate that relationship, but one thing to watch for again is what is her role, and whether she is a spokesperson for the United States or she remains or becomes a Foreign Policy principle and adviser to compete and interact with the others. And another role of course is to be a negotiator, and going up against the Russian Ambassador who has 30 years experience, because that a tougher role. Nikki haley gave an interview to the atlantic magazine and distanced herself in a pronounced way in thehashoggi a other diplomats have not done including pompeo and secretary mattis and she says you have saudi diplomats that did this in a saudi embassy, and we cant give them a pass, because that is not what america is, and we cant condone it, and we cant condone thuggish behavior, haley said, to the atlantics writer. And clearly staying in new york so that her son can graduate high school, but not going back to the south carolina. She may well have a National Elected future. She could be running in 2020 on some part of the ticket. So, beginning to distance herself from donald trump, richard. I would say she was separating herself to some extent, but she was still being loyal and trying to thread the needle. She was placing herself in a conservative republican Foreign Policy are tradition, and she is basically saying that we should not choose between the interests and values, and with we need to have both. This is an administration that has chosen an interestonly approach nfor the most case. She was closer to the reagan and george w. Bush and really to what is a lot of the neo conservatives and supportive of israel once she was in the u. N. , and in the saudi case, she was not specific about how the balance the american interests and values and she did not say whether she favored cutting off arms for the saudis to not use them in yemen that the people on the hill are thinking of, and another interesting thing that she said, andrea, the president was bluffing visavis when he threat threatened to use the military force, and that the socalled madman approach was based upon nothing. That is interesting Going Forward. Because north korea is showing zero interest in getting rid of the nuclear weapons, and zero interest in getting rid of the Nuclear Missiles and what she said is that the threat of military force was never real, and this is going to weaken the u. S. Hand Going Forward and that is going to be interest, because right now, this is a major Unresolved National security challenge s s in the united sta. The logan a act that said that private individuals cannot interfere with u. S. Foreign policy, and from there we had the firing of flynn, the prosecution of flynn, and the firing of james comey, and when trump says why dont yu go easy on this, and we come full circle to the sentencing. And sally yates is saying to them, and first of all obama saying to president elect trump two things, north korea going to be your trouble, and dont hire flynn, because he is trouble in some fashion, and sally yates then going to the the white house saying that you have a problem with Michael Flynn and 18 days later, they get rid of flynn. So, harry litman, what is the story here, and what is the reason why Robert Mueller would now say dont give him any jail time after everything that has gone down . Well, mueller presents a panoramic view in the memoranda sentencing of someone with a serious departure and serious transgression unlike some of the thi things that champ champions are saying, but someone who led an exemplary life of public service, and then in large part for the profit motive paid for by turkey and for that reason, he wanted to engineer the change in russian sanctions. Really went awry, but then immediately came back into the fold, you could say, of law and order. Came to mueller first which is a huge breakthrough that a prosecutor is always looking for, and that as mueller notes helped others to come to the table. It was a completely unfettered and thorough coop ray or the. So coop ray or the and exactly what you want from someone who has committed a serious crime, and he has committed a serious crime, and virtuous before and after, and that is going to add up to a recommendation for a nonjail sentence. And now, the other issue before russia of course is turkey which you alluded to, david, and the fact that on election day, he had written a column that was engineered by erdogan and the cleric in turkey where he was going after the cleric and we have reported on msnbc, and carol lee and others under consideration for being extradited to erdogan, and something that had been refused by the obama team, and the fact that Michael Flynn was angry at obama, because he was fired from the defense team and james clapper. He had big chip on his sho d shoulder, because i knew him when he was a twostar general in afghanistan, and he was an outstanding commander and a very honest sometimes really shockingly so critic of past intelligence practices. And as harry said, this is somebody who had been an exemplary servant, and that he was ainngry, and that person we heard him saying locker up at the Republican Convention was angry Michael Flynn. And working with mueller, he decided to make a change and be cooperative and be a good citizen in the more prodissitra sense of trying to help the prosecuto prosecutors. And the signal that mueller is sending to everybody else from the sentencing is cooperate early and fully. Yes, that is it. Cooperate early and fully and you have all of the side shows with giuliani trump champion saying stuff, and the real coin of the realm goes through mueller and the court, and play it straight and cooperate early, and lit benefit you as it should. In North Carolina, Democratic Congressional candidate has withdrawn his concession after massive widespread voter fraud. The state board of elections is now refusing to certify the electi elections in the states ninth Congressional District as investigators are looking to see if an operative frontrunner mark harris tampered with absentee ballots. Offici officials are gathering subpoenas for a hearing to be held later in the month. A top official tells chris hayes, that he would not oppose a new election if voter fraud was found. Down here in this state, they are political mercenaries and hitmen and they dont care who wins or loses or the budget policy, but they care about getting paid. If the board of electors come out and say that we have substantial reason the believe that the outcome of this race could have been altered, then we absolutely should have a new election. So lets get the inside scoop from nbcs katy beck in North Carolina and nbc contributor Charlie Sykes contribute for forthe Weekly Standard and catherine sidiqi. And now, katy, what is happening there . Now there may be another election given what is happening . Well, andrea, a lot of people are asking questions of who knew what and when they knew it, and it is not the first time that the political operative has been under the microscope for questionable activities and collecting absentee ballots going back to races in 2010. Here in bladen county, we have spoke spoken to voters who said, yes, they came to collect the absentee ballots to turn it in. And one woman said i did not sign it or seal it, and turned it over thinking it is official. And then weeks later, the official showed up to ask her questions saying that her vote was not turned in. So we know that the investigators were on the ground and talking about the ir reg lair tis before irregularities before the november election. We know that there is a convicted felon from back in the day involved in it, and before the election, and so a lot of questions about should something have been done sooner and were there any red flags, and what is the integrity of the election moving forward. And Charlie Sykes, a net pickup of 40 seats for the democrats. We have this one in play, and so it could turn out to be 41, and we dont know yet. But what does that say about North Carolinas process . It is so interesting that we have heard about voter fraud in florida, and now the one place where reps say that it may have actually happened is in North Carolina on the republican side. Yeah, there is voting fraud, but this is election fraud. And it is a different scale than we have seen. I suppose if there is any good news here it is the fact that the local republicans are acknowledging the problem, and they are not circling the wagons and endorsing a new election, and so at least they are not in denial, but again, this is something that ought to shock the conscious of the people across the kcountry, and anothe reason why the voter integrity and encouraging people to vote and making sure that every vote is counted ought to be a bipartisan issue as opposed to tribal issue in the modern politics. Then, of course, i want to talk to both you and sebrina about this, and sebrina, what about all of the lame duck rule changing in wisconsin where charlie is and michigan as well . Republicans have made a series of power grabs especially as control of some of the statewide offices have been handed over to democrats. So in with wisconsin, you saw the republicans in the legislature try and take action to in fact limit the authority of the Incoming Democratic governor including on welfare law as well as her pledge to overtu overturn the health care a act, and also in michigan to limit the power of the secretary of state when it comes to tens forment of Campaign Finance laws, and so there is clearly an effort here to ignore frankly the will of the democratic process and this is taking advantage of the lame duck session, and more republicans are inclined to sign this legislation that is going to call into question the electoral process. And now n wisconsin, is scott walker going to sign all of the legislation against tony evers, and does tony evers the democratic who was wielected toe the new governor, does he have Legal Options . I think that it is likely that scott walker is going to sign this. I wrote a piece yesterday urging him to reconsider the fact that it is a petty, vindictive and likely to the backfire and it does not add up to a lot of real advantage. The markets off 4 for the week. Theres some years people make 4 in the year and we have given that up in one week and a lot to do with this chinese executive from huawei arrested, a lot to do with Rising Interest Rates and this jobs report is not terrific. It is not terrible. Unemployment still at 3. 7 . We created 155,000 jobs. But that brings the 6month average to 194,000 a month. Much lower than the whole years average of over 200,000. So unemployment employment gains, new employment, is slowing down a little bit. Wage growth is still there. This could be a fact, a reflection of the fact that we have got fewer workers available to be hired but more people are thinking that this might be combined, might be signs of a slowing Global Economy and a slowing u. S. Economy. And a recession that could hit just as the president trying to reelection and didnt do so well for jimmy carter the last time that happened. Right. Talk to me about china because i know you have drilled down on the arrest of the chinese executive, a superstar as far as, you know, theyre concerned and here she was arrested in canada at the u. S. Request. This woman whos the daughter of the founder of huawei, americans dont really noah way. But it is one of the biggest phone makers in the world. Huawei, closely tied to the chinese government, the crown jewel of tech in china, the apple of china, if you will. This woman, that company, is accused of doing business with iran in violation of u. S. Sanctions. Now, it is clear what she was arrested on but she was arrested basically while trump and xi were sitting in buenos aires talking about a potential trade deal so the chinese are calling this a hostage taking and not sure the charges against her and typically violations of those type of sanctions you expel someone or you sanction them, take away the visa and not sure whats happening but it is making investors worry that if the United States would arrest a key chine this moment of tense negotiations, maybe thats a signal that things arent so well. We have known enough about this administration not to guess the motives. That combined with Robert Lighthouser as the official trade negotiator with china, they have 90 days and the president hyped it in the comments coming back on saturday night because china is not agreeing to any of right. And this isnt the same as a fight with canada on nafta where most parties kind of knew where we were going in the end with this thing. The problems with china are real. And theyre very, very complicated and both sides dont have a shared view of what the future looks like. 90 days is nothing in this game. Remember, the chinese take a long view of these things so thats what markets are saying, not sure they have something in 90 days and we buy a lot of stuff from china. If you buy something to arrive in 90 days or just beyond that, what are you paying for those goods when they get here . Will they be stopped at the port . Reporter she said she came in to the country illegally from guatemala. How did you get the job without documentation . Translator i told them that i dont have papers, i dont speak english and i was an immigrant. They said, no, it doesnt matter. Reporter sandra says she worked without legal documentation, as well, from 2010 to 2013. President trump has said the Companies Never hired people undocumented. We didnt have one illegal immigrant on the job. Reporter hes made immigration his cornerstone issue, threatening a possible Government Shutdown in two weeks if the border wall isnt funded.
