Im Andrea Mitchell in washington where President Trump is now suggesting that immigrants crossing illegally into the u. S. Should not get due process, writing in a tweet today that hiring many thousands of judges and going through a long and complicated Legal Process is not the way to go. Well always be dysfunctional. People must be stopped at the border and told they cannot come into the u. S. Illegally. This contradicts constitutional protections and provisions and ted cruzs proposed republican legislation to hire more border judges. Joining me now are my guests, welcome to you both. Kristen, set the stage, the president s tweets and what hes been saying, ramping up the opposition to due process for immigrants, which is, according to the constitution, are under constitutional protections. Its a remarkable escalation, with President Trump saying that he wants to do away with those Due Process Rights that you just mapped out. Speaking with Administration Officials, ive asked is this something imminent that hes planning to do . At this point in time, theres no sense that that is the case. However, a Senior Administration official, andrea, did tell me that the president and his top officials are looking into ways to essentially halt and stop people from coming here who are undocumented or having them return from where they came from immediately. Essentially again, withholding them from those Due Process Rights that are guaranteed here under the constitution. It is an escalation in rhetoric. Its not clear theyll be able to do this rlegislatively, but t sets the stage for what were watching for, the house expected to take up a compromise bill on immigration. President trump, as youll recall, at the end of last week, indicated that republicans were wasting their time trying to get something done on immigration, because they dont have democratic support. Based on my conversations over the weekend, if you listened to what lawmakers are saying, the president has indicated that he will support that bill if it passes. Of course, vising an uphill battle. The larger issue, more than 2,000 kids who remain separated from their families. The Trump Administration says they have a plan for reuniting them, and that all of the kids are accounted for. But this is an ongoing controversy for this president. Allen gomez, youve been covering immigration policy for so long. The obstacles to these Young Children, especially the youngest, being in touch with their parents no matter what the government says about having twice a week phone calls. And the parents, as well, knowing where their kids are and knowing how to reach them. Some of these kids are ininfant. This is one of the big problems theyre facing. When you think about the fact that children are in the custody of i. C. E. , the department of justice is involved, because theyre handling a lot of these prosecutions. The most recent we got on saturday from the department of Homeland Security saying of course theres a process in place. Theres signage so that parents can call a hotline to find out the whereabouts their children, but thats not following through. One of my colleagues was in a courtroom recently and he saw a judge writing down the names of the defendants, asking them the initials of their children and the date of birth so that judge can try to keep that child within that case file and see if they can follow it that way. I think that shows you chaotic and disorganized this rollout was, which is making it so hard for these families to Stay Together right now. The other problem is the lack of transparency, because access for reporters and no access at all for camera crews for photographers, still photographers. I wanted to play an interview that our friend, casey hunt did with Camela Harris im sorry, well play that in a little bit. Thanks to you, kristen welker. But just the point that Camela Harris and others calling for i. C. E. To be dissolved. Theres no sign that theres any move to get rid of some of these agencies initially out of the white house. There is no sign, but i think what youre seeing, andrea, are the battle lines being drawn. Camela harris, being talked about as a potential 2020 contender, although she didnt throw her hat into the ring with that interview with casey. But the democrats are ramping up their rhetoric as well, as they engage in this battle over what to do about undocumented immigrants who are coming here, democrats saying essentially they need to be treated better than theyre currently being treated now. How will this play out on the campaign trail . This was a Key Campaign Promise of this president. He ran on a promise to build the wall. He was tweeting about that again today. Hes not backing down, and neither are democrats as they get close to the important midterm elections. Thank you to allen and kristen. Its clear that the white house, this president believes this is a Campaign Issue thats working for him. Joining me now is senator cory booker, who just came out of federal criminal court in texas. Thank you very much. Youre a lawyer. What did you see inside that reassured you, if at all, that there is due process and theres no attempt to deny due process to these families. Well, the process is not working. I dont say that based upon what i saw in the courthouse. I saw a lot of dedicated americans. But last night i saw around midnight, 1 00 in the morning, i walked across the border and then tried to enter back into our own country, and talked to customs and Border Patrol folks who met me halfway at the bridge. I asked them, if people come here and present themselves for asylum, what do you do . He said we have to wait if thats pace for them, and then turn many of them away, because were not making space for people who are trying to go through the process legally. And that is very problematic to me. So we have a lot of challenges, socalled no tolerance policies that are undermining things that were working, and we have an administration that is committing moral vandalism against the ideals and values that we all shared. In fact, weve been Gabe Gutierrez and other reporters have been down there on that bridge with families for days, in some horrendous rainstorms last week. And they were sus cyexisting on donated pizza. They go to the legal ports of call to try for asylum, but theyre not getting in. Theres a deliberate slow walking of it, is it not . Right. Just walk through that in your mind. Say you show up with Young Children, youre turned away for presenting yourself for asylum. Generations of americans have come here seeking asylum. We created a Legal Process, which is being undermined. If youre down there for days in a down that i was warned by the mexican officials that it suspect always that safe, we have Young Children at that point, in many ways, the slope is being breached for you to try to get in, in a way that is not a legal point of entry. So this system is being gummed up, our values are being assaulted, and its resulting in the challenges we have today. I wanted to ask you to respond to the president s rhetoric about immigrants. He first of all has been falsely accusing them of being all criminal elements, and emphasizing whatever cherry picking of statistics to say that they are responsible for so much criminal violence, which is not the case statistically. But referring to them as infecting america. What is the impact of that . So in the courthouse i just came out, people pulled me aside and said they were republicans and said they think what is going on is wrong. That the knowledge of everything from the wall is not necessary, all the way to saying again, these are republicans that pulled me aside having this conversation with me. Saying that crime is going down in these communities, and so the rhetoric, the bigoted rhetoric, not to mexicans or americans but to human dignity, is not contributing to this situation, not in any way helping us be a country. I just came back from lebanon and from turkey and these countries that are dealing with immigration problems, where were seeing millions of people pouring into their country. This is a situation we can handle in america by preserving our security, and affirming our values. But this president seems to want to politicize this, seems to want to make it a november Campaign Issue. Seems to want to rip up fear and hey hatred. They have been telling me how integrated the economies are. Theres a much better way to go about this. And deal with people who are coming here, often due to situations that we have some responsibility in. One person told me in a high level position in the building, our demand for drugs, we have to take some responsibility for the crises going on down there. And step up and figure out ways to be a part of the solution. Whether its helping to invest in those communities, invest in their security. Because again, this is north america. We are all interrelated in this story. And all have responsibilities one to another as human beings. And america should stand for those values. You dont buy their argument that these children will be reunited with their families, and everybody is registered and its possible and its working for parents to find their kids . No. I mean, this is the one of the moral lows of our country in the past decade. We have over 2,000 children that have been separated from their families. The folks here are telling me stories of people being deported back to guatemala, ecuador, el salvador, honduras, without their children, with no plan in place, no plan in place to reunite them. This is a grievous assault on the dignity and humanity of others. This is a betrayal of our values. They have no plan in place. They have no plan even to identify the children who have been separated. I think this is a moral crime thats going on in our nation. And this administration should answer for what theyve done. There is some criticism that democrats and other critics are going overboard, and have, in fact, gotten more republican support from the president , by being so critical. Here you have Maxine Waters, a fellow democrat from california, who said this at a rally on saturday. And if you see anybody from that cabinet in a restaurant, in a department store, at a gasoline station, you get out and you tell them theyre not welcome any more anywhere. Do you support that kind of appeal to tell people, people like Sarah Sanders at the restaurant that Maxine Waters said to tell others in the cabinet youre not welcome and to confront them . So first of all, i subscribe to an ideal of radical love, the kind that my parents taught me. And yes, you should protest. Yes, you should confront injustice. But do it in ways that great leaders did, that did it by recognizing the dignity of even those who you oppose, even those who hate you and are trying to destroy you. I worry in our country right now, that were deskrenlcending. I call on all americans when it comes to the injustice of separating children. I think we all should be not sitting confidentab abcomfortab have to get to a point in our country where we can talk to each other, where we are all seeking a more beloved community. And some of those tactics people are advocating for dont reflect that spirit. So yes, if i saw an administrator out and about, theres nothing wrong with confronting that person. To do it in a way that is more reflective of the values, lets elevate people like ghandi and king and reflect their values in our urgent activism, but always leading with love in our country. The defense secretary has been out of the loop on decisions, including the creation of a sixth Military Branch for operations in space, and the withdrawal from the iran nuclear deal, although mattis saw that one coming. Joining me now is robert costa, moderator of washington week, and carol lee, political reporter who reported this story. Carol, weve seen this coming, and it has something to do with the configuration of the National Security cabinet. But its telling given south korea, the joint exercises. This was a concession to kim jongun at the table in singapore. Without consulting the defense secretary. Right. And even when we spoke to people inside the white house and they were addressing each of the points in the story, a white house official said, well, you know, mattis knew that it was possible that trump may do Something Like this. But the president was in the meeting with the leader of north korea, and just made the decision. So he had to then inform another colleague, another Administration Official that told the defense secretary that this had happened. And you had to then find a way to prepare for that. And robert costa, its the ad hoc way that this administration conducts Foreign Policy, there isnt a process, they dont have meetings to hash out these issues. This is not the way john bolton operates and not the way most importantly donald trump operates. Its also a reflection of the new dynamic inside of this administration with former secretary of state Rex Tillerson out of the picture. Now secretary of state pompeo, National Security adviser bolton, based on my reporting, are the president s real confidants when it comes to Foreign Policy. Thats not to say the president doesnt respect mattis. He views him admirably. But its the president , pompeo and bolton when it comes to the decisions, and not so much the defense secretary. And a couple of other issues. The space force. This is one of the things that mattis is proud of is reshaping the bureaucracy at the pentagon. The last thing he wants is another new creation. Right. And the fact also that there are other discussions such as sending troops to the border. Yep. And he has said he was asked what he thought of sending troops to the border for instance and told the president he didnt think that was a very good idea. When it comes to the space force, mattis is on the record sending a letter to senator john mccain last fall saying this is not something he thought was necessary when theyre dealing with overhead at the pentagon and trying to reconfigure different ways of combatting various threats. So notefully when the president ordered this, he said to the chairman of the joint chiefs, why dont you handle this. Andeneral dunford said were on it. He didnt direct that to mattis. In speaking to people around the president , he has increasingly felt mattis has slow walked things he wants done. One person described it as the president feeling like mattis looks down on him or thinks he knows better. So its a combination of that and the president feeling emboldened to listen to his own instincts over any of his advisers. Carol lee, great reporting there. Just quickly, robert, do you think theres going to be any change . My own take on mattis is hes going to work and live with this. I think youre right. It doesnt seem like mattis is heading for the door and theres no replacement being bandied around. So for now, he stays even though hes diminished in some aspects of the decision making. Joining me now, former assistant u. S. Attorney in the Southern District of new york, and director of migrant rights and justice for the womens refugee commission. Welcome both. What is the legal basis for Court Procedures for these undocumented immigrants . The legal basis is the constitutional protections that are afforded to all people who come to this country, whether theyre citizens or not. The due process clause talks about persons, not citizens. Its very clear theres Longstanding Supreme Court case law that backs that up. And you know, it is really what the president is asking or talking about doing is having what would amount to death sentences for people at the border. He wants border officers, opposed to immigration judges, to be the ones to make very complicated decisions about who has legitimate asylum claims and who does not. Thats just one example of where this could go wrong. Whether he likes it or not, and it appears he doesnt. There are people coming to this country, who have legitimate fears of death and violence to their family, and those things need to be looked at and decided by professionals, immigration judges, not Border Patrol agents making split second decisions. Michelle, what are you hearing from the field in terms of the ak december that people a of the access that people are getting in this chaos . The chaos thats been created is making it harder than normal to get access to an attorney. As has been mentioned already, people are in detention facilities, they dont have free access to the outside world. And already as it stands, less than 14 of adults in immigration detention get access to an attorney. Less than 14 . Yes. In a normal period, not in this crisis. So when were told parents are going to be able to find their children who have been farmed out to foster homes all over the country, theyre now on the west coast, theyre in the midwest, theyre in new york. How is it parents track down these kid it is there is records of who has gone where . It really is entirely based on the Parents Initiative to make that phone call. Phone calls are quite difficult to make for immigration detention. Theres a 1800 number they can call. Were hearing from parents that phone number is busy, or if not, theyre maplaced on hold for 30 minutes. And even if they do get through, they have to leave a message with a callback number, which is impossible because they cant receive calls. Or they can make telephone contact with their child, that may not be verbal that. Is not a solution or even close to reunification. And mimi, when we talk about telling people to come to ports of entree, weve already seen through our own report iing tha people are finding that the procedures of ports of entry are not there for them to request asylum. Theyre being told its days where its only supposed to be the matter of a day. Right. So what this stems from is this idea that if someone comes in not at a port of entry or they dont on its face have a legal basis for being here, then theyre going to face criminal prosecution, which in the first instance as i think people know by now is a misdemeanor, it can become a felony if its repetitive. In the first instance, its a misdemeanor, and that is simply adding to really its not adding any value. The criminal enforcement of a firsttime person coming here who, you know, maybe trying to make an asylum claim is sucking up resources from other enforcement of other legitimate crimes that the prosecutors and agents should be spending their time on. Theres already been some complaints for example from the u. S. Attorneys office in california that theyre having to take resources away from narcotics prosecutions to work on the increased workload with respect to these border prosecutions that are really adding no value whatsoever. You know, really they should be focusing the stepped up resources on processing the asylum claims that youre talking about, but theyre doing the opposite. Theyre slow walking them. Well, obviously its a crisis that we did not have to experience. Its always been a problem, but this was selfcreated and were seeing the fallout as well. Mimi and michelle, thank you so much. Your reporting is that the president is gaining strength according to polling data. We dont know all of the data since this crisis on the border became more critical with the children and all. But some data indicating that he has 90 support among republicans. Right. These last few weeks, really this whole year has been a unifying experience for the Republican Party. What remains of the Republican Party. I know mike murphy is a very different kind of a republican this day and has cautions what the Republican Party is anymore. But for the people who remain, they have solidified around donald trump in a way that now gives him the highest Approval Rating among his party for a republican this far into his term exceeded only by george w. Bush, who was riding high after 9 11. Thats pretty remarkable. And what i think contributes to that, andrea, is episodes like the Sarah Sanders red hen catastrophe, where you have her basically told to leave this restaurant, get out, we wont serve you. We have Maxine Waters essentialessential ly calling for violence against members of this administration. Criticized by cory booker on this show. There are certain lines that even in this breakdown of civility weve had in politics that people realize you shouldnt cross. All this stuff, the Sarah Sanders thing, the Maxine Waters incitement to violence, plays right where the white house wants it. To they want to be able to say see, these people hate you. They want to attack you physically. And this is what the left represents. Even though its only a small number of cases. And mike murphy, what also plays into this is when the president keeps saying the Mueller Probe is a witch hunt, and theyre out to get him, and misstating what the Mueller Probe is all about, that demonization of the Mueller Investigation plays into this fear and concern among the core supporters that theres an attempt to nullify the election and go after him unfairly. How does that play out many the midterms, or is it too early to tell . I think its probably too early to tell. Its tribal politics we have now. So anything that gives either side an ability to preach a victimization message internally helps the tribe get more excited. Its amazing to me that for a president who built his brand on strength, they sure whine a lot. I do believe when you imitate trumps behavior, you surrender to it. So personalizing all this as tempting as it may be, the people who find the Trump Administration offensive as i do, even as a republican, is not a good political tactic. That said, as a consultant for many years, i never believed in these weekly applause meter job approval polls. They often reflect what was on Cable Television 10 or 15 days ago. So i think you have to step back and look at bigger, more important factors before you protect into the midterms. And thats a good caution for all of us. Are you still a republican, by the way . Because some of your colleagues have said they no longer feel they are republican, that this is now the trump party. Well, trump doesnt reflect my values, but i dont believe he reflects republican values, either. So im going to stay and fight. Im still a conservative, and i look forward to a proatlantic alliance, profree trade, respect the rule of law Republican Party that i decided to work for 30 years ago. But its going to take a fight and im going to be part of that. And ruth marcus, not only the red hen, but now we have Melania Trump last week wearing the jacket, which certainly was sending a message, explicit message hard to know message it was. Weve seen a lot of conflicting signals. Well, she not only went out with that jacket, i really dont care, do you, message, which floored everybody and made me i couldnt really figure out what she was trying to say, but i thought wow, if she she really rattled us, because if she is the one who is saying she doesnt care, then there are no crumbs of compassion left in this administration. But then she went out last night and talked again about how you need to be civil, how its easier to Say Something mean than to Say Something nice. Its easier to not say anything than to Say Something nice. You just have to ask yourself, what world is she living in . Shes married to the king of mean tweets. So its a little confusing what Melania Trump is really standing for and what message shes trying to convey. In speaking of messages and the president s role in the midterms, mike murphy, the Harley Davidson issue, lets talk about tariffs for a moment, the market down sharply, paul ryan say thing is further evidence that tariffs, proof of the harm from unilateral tariffs, the best way to help consumers and manufactures, is to open new markets.
