Im Andrea Mitchell in washington. We are hearing more today about the private autopsy performed an Michael Brown commissioned by the family on the unarmed teen shot over a week ago by a Police Officer in ferguson, missouri. The medical examiner says brown was shot six times, including twice in the head. This is the private medical examiner. The former medical examiner of new york city. As dr. Baden met with the mother, she had the lingering question as any mother would have. Was my child in pain . And the doctor shared with her his opinion. He did not suffer. Well be hearing from one of the medical examiners who assisted with that privacy autopsy in just a moment. First, to the latest with the violence overnight. The protests that continue. The National Guard is now being called in to help. Joining me from ferguson is ron allen and msnbc. Coms National Reporter trymaine lee. First to you, ron. Tell us what happened overnight because we had hoped there had been Prayer Services all day, hopes that it would be calmer with captain johnson from the state police. What happened . Well, it was the worst night of violence yet, andrea. Just exactly what people didnt want here. A lot of concern about what would happen when a second night of curfew was imposed. Violence erupted around 8 30 before the midnight curfew. Big demonstrations going on. Peaceful demonstrations but the police here are concerned about a significant and they say growing element that is present and carrying out what they described as premeditated attacks. Perhaps the worst of it was described as hundreds of these protesters or doemonstrators descending on the Police Command center with molotov cocktails coming from that direction, we believe it was. Thats what really got the police concerned. And they went on a very high state of alert. There were multiple flash points around the city. Much confined to about a half mile stretch of a main street here in this town thats been the scene of so much violence before. But this time it was different. There were multiple flash points, demonstrators out in faceoffs with police. We were out with some of the protesters or criminals, whatever you want to call them at this point. Its very unclear. They were dug in and trying to hold their ground. The police were determined to move them and clear them off the streets. Just a surreal environment, a lot of mayhem and chaos. Unbelievable scenes on the streets of an American City now several days running. The question, of course, so many people have is, whats will stop this . When you talk to the protesters, the thing they want more than anything else is the arrest of this Police Officer, officer darren wilson, who shot and killed Michael Brown. There seems to be no doubt about that. The question is whether he used excessive force. We spoke to the county prosecutor here, bob mccullough, the man who is leading the state investigation that could result in charges from premeditated murder to no indictment at all. He said he will begin presenting evidence to a grand jury some time this week. A process as he outlined it that could take weeks or months. And listening to his comments, any observer would be struck by the apparent lack of urgency of trying to do this quickly mean said he wanted to do it deliberately. Didnt want to be a rush to judgment. But the governor, governor jay nixon and others have been critical of him for apparently not doing it quickly enough. Fast enough. Theres obviously a great sense of concern here. A state of emergency. And many are questioning whether this prosecutor is really doing his job, frankly. And i know there have been a lot of questions because he was critical of the governors decision to even bring in the state police. Tryma trymaine lee, you are over at the quick trip in ferguson. What happened today with the revelation from this private medical examiner, dr. Michael baden who we know as the veteran medical examiner of new york city. And he was brought in by the family and reports that there were six bullets and that two were the fatal bullets, the two to the head. What does that tell us, the position of the bullets, the fact they went in through the back of the head . How is that dispositive from what we at least know from this private medical examination . Right. These are actually really critical developments. For the last week, people have been filling in the big spaces between where the Law Enforcement left open with their own rumors that the young man was shot in the back and elaborate on the circumstances around his death. Now we know he was shot at least six times. The last two shots into his head seem to be the fatal shots. The forensic doctor said that he could have survived any of the other ones. The gunshots came from an angle where his head must have been down. Another shot just beneath his forearm where he could have been shot from behind or shot with his hands up in a defensive position. These are critical developments that people will piece together in to their own narratives. Here on the ground, where frustrations and tensions are rising because of another night of violence. Because the National Guard is coming. Some are wondering, even the young guys out in the street, socalled criminal element, who is buffering the ongoing battle between them and the sflees some people said while the elders and a whole generation of people are in churches right now having speeches about what the problem is, they arent addressing the young people. And at night when the violence is at the height, they are left all alone and leaders, they are begging leaders to come and give them a framework to express themselves and take action thats other than violence. So again, the tension here is increasing. Here at ground zero, well see how it all plays out. Trymaine lee, thank you. A lot of questions as to why it is taking so long to do the official autopsy. Attorney general eric holder will be briefing president obama within the hour on the situation in ferguson. The department of justice requested a third autopsy of michael bron. This one done by the federal government saying in a statement, due to the extraordinary circumstances involved in this case and at the request of the brown family, on friday, the Ferguson Police chief released surveillance of the video of an apparently unrelated Convenient Store incident involving brown before he was shot and killed. No details of the shooting itself. Thats what i asked missouri governor jay nixon about on meet the press. What justifies releasing the video about the Convenience Store while there are still no details about what happened with the shooting itself . That is what caused everything to erupt again on friday night and led to the curfew having to be imposed. Yeah, we and our Security Team and Highway Patrol did not know that was going to be released. I dont thing attorney general knew that. We disagree deeply. I think for two reasons. Number one, to attempt to in essence disparage the character of this victim in the middle of a process like this is not right. Its just not right. And secondarily it put the community and the region and the nation on alert again. This is these are old wounds. These are deep wounds between in these communities and that action was not helpful. Should the police chief, chief jackson then, be fired or have to step down . I mean, weve moved the Highway Patrol in to manage security. The Justice Department and the detectives in st. Louis are doing the investigation so but with all due respect, governor, hes still doing things like releasing that video without even reporting to the state police captain, captain johnson, who is supposed to be in charge. Well, everyone can rest well assured weve had very serious discussions about that action and how much it we thought it was not the right way to handle the victims family, which i had a chance to speak with. They were deeply troubled when you see your son gunned down in the street and then you see a police chief begin an attempt to do to attack his character. Thats just not the way to operate and we made that clear to everyone and our hope and expectation is that now our folks are in charge of security and we have these dual investigations going on that that bump is behind us. Well, its more than a bump, isnt it, though. How ferguson is reacting to the governors comments and the way hes handling this crisis. Joining me is state senator Maria Chappelle nadal. Thank you for being with us. Should the police chief be fired . I think he should resign, absolutely, right now. Its sort of stunning that he could do this without the state police captain, captain johnson, knowing about it, whouithout th governor knowing about it. Is captain johnson really in charge . You know, last night i started thinking about this entire ordeal and i received some information from the ground this morning, and i almost think that captain johnson is being used as a pawn to cover for all of the mistakes of Governor Nixon at this time. Captain johnson has certainly impressed a lot of people there and around the nation for how, you know, committed he is, how passionate and how well he knows the community and his courage. So he certainly is doing an important job there. The question is the lines of authority and why theyre not clear and what will the National Guard be doing . Well, heres how i see it right now. Because of our Chief Johnson here, or jackson, in ferguson, not communicating and also communicating conflicting information to the press and to our local daily newspaper, i call into question some of his actions, especially because the people in this community are very upset. And they are very hurt right now. And they want to have Transparent Communication at this point. And they want to receive justice. One of the biggest problems right now that a lot of my young people are thinking about is the fact that this Police Officer is on paid leave. He gets to sit at home and what im hearing from ground zero is, if it was a young africanamerican man who shot someone, he would not be sitting at home right now. He would be in jail. And so i am looking at some of the actions of captain johnson. Yes, he is from the community. Yes, he has a lot of respect. But because st. Louis county as well as the chief of police in ferguson, are not communicating with captain johnson, there is a disconnect. And again, something that has been mentioned before is there is a total disconnect with communicate with the young people who are out here every single day. They are the ones who are hurt. They are the ones who are victims. They are the ones that any given time, right place, right time, can be muccal brown. One more question, briefly, can you explain the protesters, the legitimate protesters, the community and how they are affected by the looters n the outsiders perhaps who are trying to exploit this and creating a lot of the violence . That is a very good question. I will tell you that many of the members of this community are upset theres an outside influence that is coming into ferguson and misrepresenting the values of this community. We want to protest in peace. But there are negative senses here, a lot of angry young people, and i have to tell you, andrea, there are some young people who are willing to give up their lives right now. In fact, theres a young man that i talked to when i got to ground zero here at the qt and he said, i dont care about giving up my life right now. Its amazing that i made it to the age of 21. So because there are so many young people that have been hit time and time again with harassment and intimidation, a lot of these young people feel as though its fine to give up their lives right now but what they are doing essentially is taking away from the message and from the intent from those who are trying to communicate that we need a transparent investigation and we want to make sure theres a grand jury and an indictment. And the one thing that would make this community certain that there is transparency in this process is if this Police Officer, darren wilson, was put in jail right now. Today. There are witnesses that is all you need are witnesses so that he can be arrested and put in jail. Then they will know that there is transparency. Louis now in his first live interview is shawn parcels, a forensic pathologist and assistant and medical investigator who assisted in the private autopsy of Michael Brown. Thank you for being with us. The fact there were six bullets and, according to dr. Badens report today, two, the two to the head were the ones that were fatal. That he could have survived the bullets to his arms. Can you explain using the we can throw up the graphic as well, of what you found in this autopsy. Yes. Thank you for having me, andrea. What we concluded was the majority of the shots, obviously, came to the right arm and all of those were survivable. And even the one that went to the top of the head and came through and went down into the chest cavity, could have been treated had it not have been treated, he could have died from that injury but it would have been much slower. The one that came to the very top of the head or the apex of the head was the one that killed him instantly. Can you tell from the graze wounds to his right arm, i believe, whether they came in from the back or the front and whether he was holding his arm up . You know, in what posture was he actually trying to show that he had no gun . Was he facing the Police Officer . From a Forensic Science point of view, we dont have enough information gathered at this point in time. Dr. Baden and i need to understand more the events that occurred at the scene. One thing i want to emphasize is that theres two parts to an autopsy investigation. The one is the obvious autopsy but the other is the scene. Sometimes the scene investigation is more critical than the autopsy itself because without the scene info you cant put things together at the autopsy. And understandably, you dont have the access to that, nor to the clothing and to the possible gunshot the powder from the gun wound, because that is in the official hands of Law Enforcement officials. Why has it taken so long i think i heard dr. Baden say in all of his experience in new york city with controversial, you know, confrontations such as this, this can be done quickly. Why couldnt the cause of death and the wounds incurred be released quickly to the family and to the public . Thats a great question. And i dont think i have the answer for that. In my past experience, oftentimes once the autopsy is done, the preliminary results are released, and i think we all have come accustomed to that when we see something locally, for example, we hear someone was shot and the next day find out they were shot, say, two times or it was a stabbing or whatever. Why they have hung on to it here, i cant really answer that and i think theres just a lot of pressure and a lot of issues going on. And why they havent released it sooner is really beyond something i can comment on. It is rare. I dont want to say rare. It is odd they havent released it yet. Can you tell us something about the trajectory of the bullets that were the fatal bullet shot to the head . Are you talking about the one to the aapex . Correct. That bullet came in to the very top of the head. And it is consistent with Michael Brown bending over or falling over face first towards the ground. What we dont know is, you know, was he coming at the officer, was he surrendering and giving up . Those 24 questions that weve been asked that we cant answer at this time because we dont have the facts. But we do know that those two shots came in last and given the trajectory and the abrasions to the face, we know that after that occurred, he hit the ground and ended up on the right side of his face. Do you know how close he was from the gun . No. At this point in time our preliminary investigation shows all gunshot wounds were at a distance. We need to be able to examine clothing to see if there is perhaps any gunshot residue to show that perhaps maybe one of the shots that was fired happened in close range. But at this point in time, on a preliminary basis, they are all from a distance. When we say distance, as dr. Baden pointed out, one to two feet or greater. Were not saying for sure that it was two feet. Were not saying for sure it was three feet. We just know it was greater than those distances. He was briefed today by his national Security Team on the fastmoving situation in iraq where there are conflicting reports over whether kurdish and iraqi forces backed up by u. S. However, we do feel like it was slightly late but better late than never as they say. One of the kurdish officials there. Joining me now is ambassador Nicholas Burns for Political Affairs and a professor at Harvards Kennedy school of government. Nick, thank you for being with us. There are conflicting reports. The iraqi and the Kurdish Forces claiming theyve retaken the dam. The isis pushing back. The pentagon says its not clear that the story is not over and weve seen more strikes today. With that said, this is a critical point, and the white house last night notified the congress under the war powers act. We are more and more engaged. This is not a humanitarian mission any longer. I think thats right. Its in part a humanitarian mission because of the unfortunate situation that involves tens of thousands of people in mt. Sinjar. In reality, the focus of the american effort is to try to stop isis from invading kurdistan. Iraqi kurdistan an important partner of the United States. The american air strikes have been effective in doing that. Theyve certainly slowed the isis advance and theyve certainly rolled back isis at the mosul dam. Whether or not its been fully retaken, the Kurdish Forces have made a lot of progress over the weekend. The big question, however, for the United States is, if you can stop isis, can you actually roll them back and eject them from iraq . And thats a different story because isis has a lot of money. A lot of firepower. They have thousands of recruits and theyve been very effective on the ground. So we might begin to think of iraq and syria as a combined theater where the u. S. Needs to take will need to take air actions at least. And in fact, that border is disappearing and its the border through which their supply lines move and their fighters move back and forth . Dont we have to go to syria if we really want to roll back isis . Isis in iraq . Thats going to be the central question in the weeks ahead. I understand why president obama said this might take months because were using a limited amount of tactical american air power. Its been very effective. On the grond the Peshmerga Forces fight better in the mountains. They arent a conventional army an the ground. So they are going to need that help. And if the goal here is to try to defeat isis in the months ahead, thats a challenge of a different magnitude. It will demand the administration look at that northern part of syria and ascertain whether the United States and other countries involved ought to be active in northern syria. That is a complicated question legally and politically. And, of course, i think the president has been right to limit this to say the United States will not put combat forces in, but this does mean, i think, that the United States air force at least or air power from our naval vessels will be active in iraq for some time to come. First to you, mayor, you have been in situations. Youve had Police Shootings in baltimore no doubt. What could take a week to even get the most preliminary autopsy information to the family . I think this whats going on right now is a case study in what not to do. And i really hope that others are taking a look at this. Its a breakdown in relationship between the police and community. Its very clear that there is a history of distrust and the way that theyve handled it has just exacerbated that fact. And, liz, tell me about the communitys reaction and what you are hearing from your listeners and readers to the way theyve handled this to the lack of any information about the shooting itself. And what seemed to me to really spark outrage on friday was the local police chief unilaterally releasing that video of the confrontation in the Convenience Store which he then indicated may or may not have been related to the death of Michael Brown. I think what im hearing from people, and i think an easy observation can be made is that you have a Police Department, the city of ferguson, a Police Department, the county police, and you have the governor of the state of missouri. You have contempt between those two parties when you see a prosecuting attorney, Robert Mccullough challenging the governor and the governor removing the militarization thats going on on the streets of st. Louis. Thats a clash right there. And it shows the problems that we have. And then we interject an africanamerican, captain johnson, brought in by the governor to calm things. And then we see contempt directed at him as well. You have press conferences that are going on that the captain has no knowledge about. The content of that, what that says to the community once again it almost underscores validates their concerns. If captain johnson is not respected, if captain johnson is not listened to, if captain johnson is ignored, what happened to Michael Brown . The exact same thing. So the people are constantly getting messages that we will not respect you. We will not Pay Attention to you, and your word has no value. Ruth marcus, weve been talking about leadership here. The governors leadership. The lack of lines of authority. The undermining of captain johnson by the local police chief. Why the local police chief hasnt been removed or hasnt resigned is a question thats been raised by many. And then the question of the president. He did come back for a scheduled Staff Meetings today, not related to this. But this is what Valerie Jarrett had to say to our friend on National Urban radio. We need to make sure the residents of ferguson are safe, that the looting stops, the vandalism stops, that the people who live in the community have confidence that justice will be done and thats the president s primary objective right now. And so hes going to be having meetings with eric holder within the hour. Is there something that he should have done before this because he didnt get into it until, you know, midweek when he finally ordered them in. And the fbi witness investigators were not in the community until saturday. A week after this had all happened. Well, i think theres two Different Levels. One is the president s rhetoric and the other is the actions of the federal government. And i think it was very helpful that the attorney general announced the other day that there is going to be, i guess its now a third autopsy that will provide some level of certainty. I thought the president and his statement did do a good job of trying to calm the waters a little bit, about not going out too strongly in a situation where he doesnt have command or knowledge of all the facts. Not coming out too strongly against the police. But saying this is a terrible situation, but Everybody Needs to calm down. I think here i would really put more of the onus of the lack of leadership, i thought the mayor had it exactly right. A case study in what not to do. I would put it on the state and local officials more than i would on the president because he is a little bit damned if he does and damned if he doesnt in terms of what he comes out and says. How could again captain johnson, the state police leader, not have been told that the National Guard was being called up . Maybe you can explain as a mayor the differing roles and what the National Guard to be able to do that, lets say, the state police cant. Theres a lot about the decisions that are being made and how its hand iled that i, frankly, as a mayor dont understand. Im not the first person to say its clear that theres the lack of community between them is evidence. I think there certainly are Different Levels of government not on the same page. They have to hit the reset button and have to be able to depend on more than just captain johnson. I think captain johnson is doing an amazing job. He is a son of ferguson, but hes one man. And, you know, the fac that there arent more officials that are out there able to stand with him is, i think, a testament to the deterioration of the relationship. I experienced the same lack of legitimacy of the Police Department in baltimore. I was able to get the homicides don to the lowest theyve been in decades, and i expected people to hoist me up on their shoulders and be excited about it. When i went to these communities, sometimes the communities hate the crime but hate the police more because of damaged relationships. And it takes work to grow out of that. And thats the work that my administration has been doing. And its clear that that work needs to be done in ferguson as well. And is there a risk with the National Guard . Weve been talking a lot about the militarization. When we first saw those up Armored Vehicles coming in from state police and county police sources, i guess county police more accurately an wednesday night, with these new forces coming in from the National Guard, does that exacerbate the situation or will that help . I think you have to learn from whats going on at the ground. Every time there is an escalation in the militarization there is an escalation on the street. If you continue to escalate with, you know, bringing in the National Guard and the way they are being used, and then you see also the further escalation, you have to learn from that. And you have to try another tactic. You know, they have they are dealing with the reality on the ground in ferguson. Im not there, but anyone can see that what they are doing isnt working. They are not reaching the community. They dont have the trust of the community. There are people, clearly, that are coming into this area that arent from ferguson that are trying to voice their opinion and maybe some are even trying to take advantage of that. But the people who love ferguson and want better for ferguson, you know, they need to be able to stand up and have a platform for that and it doesnt seem that theres anyone in the local government thats holding out their hand for them to do that. So that relationship isnt there for them to be able to take back their streets. Thank you all so very much. Coming up, more on the front line in ferguson. How did local Police Forces become so militarized in the first place . Joining me to talk about Foreign Policy is former republican president ial candidate and texas republican congressman ron paul. Thank you very much for being with us. I know this militarization of our Police Forces, which we saw for the furst time really graphically on wednesday night in ferguson, was a congressional program. It was increased after 9 11. What do you think needs to be done, and do you think congress will ever take a harder look at this because there are bipartisan proposals to end this program of surplus equipment being turned over to local forces. When this program came into effect, i was strongly opposed to it and tried to slow it up. It takes a long time to change a program. Once its established, the Congress Moves very slowly. But it should be gotten rid of. The founders didnt want a National Police force but they are very much involved in National Policing activities. I mean, the various agencies from the fbi on down. But to militarize them, give them military weapons, it creates a kultsure. Guns and tanks and gases that are illegal for in wartime are being used. So it is an atmosphere which encourages the police to overreact and its very, very dangerous. Police are supposed to be local people and they are supposed to be peace officers that are not supposed to be warriors. And now weve got the National Guard going in but are they justified given the violence that erupted from some people who are not the protesters but are looters, lets say, trying to take advantage of the situation . Thats always a tough one but even the National Guard is a military operation. So i dont like the military to be moved in, but if you it should be a Police Activity but were seeing the consequences of so many mistakes and the question is how do you handle this because if you get rid of the militarization, it takes a while to do that. I think the less military, the better because the Police Became militarized. I cant see how bringing soldiers in are a very good substitute for the police. Maybe the state police or Something Like that. But not the guard unit which has been taken over by the federal government. They are not as independent as they may sound. The federal government uses the military overseas at will, whether its the guard or the reserve units. They go overseas at the president s command. So i dont think thats the solution. Let me ask you about military engagement overseas because the president last night, the white house sent a war powers well, a notification to congress under the war powers resolution about whats happening in iraq. It does seem that the mission now to try to retake the dam in mosul is not the same mission as the humanitarian quote unquote mission to save the yazidis on top of mt. Sinjar. Are we risking Mission Creep or should we be fighting against isis in iraq . No, were not risking it. Were doing it. This is exactly the way the war started 24 years ago. As you know, we used planes and bomb s and started attacking iraq. So it continues. So, no, its the wrong thing to do. Just think if wed have developed a noninterventionist Foreign Policy in 1990, there would have been no deaths in iraq. And it wouldnt be a perfect country. But it wouldnt be total chaos with it being every bit as bad or much worse than it was in 1990. So i would say that if that policy would have worked, and a lot of people are coming around to agreeing it was a bad mistake going in. If that was a bad mistake to go in, why is it a bad mistake to go home . Thats my argument. Why is always sticking around and excuses and the military actually had not left. Were just ghg now to protect the military as much as anything else. We certainly werent going to protect refugees an a mountain. That was just an excuse to escalate. So we dont have a precise Foreign Policy. I think obama wants to lean in that direction. Hes less militant so i sort of like that, but its not precise enough. Because he gets it from both ends. Some people like myself who want nonintervention say hes doing too much. When it comes to the neocons, they say, no, we need to have troops in there, we need bombs and to be more aggressive. And the only reason this happened is because we took the troops out. The war ended n the troops were brought home by directives under president bush. So they wont admit that. Let me ask you a quick question. About texas politics. What is this indictment of rick perry, now a judge said hell not issue an arrest warrant for the governor. A lot of people are saying its just politics. Is this a bad indictment . Yes it is. And i dont generally defend our governor very much. He has a fairly good grasp on economics, but when it comes to Civil Liberties and Foreign Policy, hes a disaster. So i dont promote him, but this is pure politics. Ill tell you, this is really a joke. And he doesnt come out of here ahead of the game because when you look into this and how this came about, it really becomes a joke. Is it accurate they did not know the National Guard was being called up . Thats what automatic being told, the white house wasnt given a headsup. There were conversations between the white house and governor jay nixons office about the fact that the National Guard was called up. One important point to note, by law, missouri is one of those states that doesnt need to get approval or the green light from the federal government. So that may have been a part of the calculation to just move forward. Still a lot of discussion here when president obama sits don and speaks with attorney general eric holder about the way this is being handled. I can tell you based an my conversations here, the attorney general is incredibly frustrated. Angered by a number of things that have happened. He ordered an independent autopsy to be conducted over the weekend, a sign he does not have faith in the state autopsy that will be performed. Hes also infuriated the police decided to move forward with releasing that video which allegedly showed Michael Brown robbing the store. The attorney general had specifically asked police not to do that. I anticipate that will be a part of his conversation with the president and hell update the president an the Justice Departments independent investigation into exactly what happened. Missouri governor jay nixon is ordering the National Guard into ferguson. New reaction just in from michael bron the family after the release of this autopsy they commissioned. It verifies that t witness accounts were true. Moments ago a group of Police Officers came by and said, quote, they could not stand static. Breaking news as the National Guard deploys to ferguson, missouri, and this hour as the president prepares to be briefed on this, a press conference has just concluded detailing the results of the private autopsy commissioned by the family of slain teenager Michael Brown. That autopsy found brown was shot six times, including a socalled kill shot to the top of his head. The attorney for Michael Browns parents spoke an their behalf at that press conference. His mother wanted to ask a question that dr. Baden nor any of the lawyers could answer. What else do we need to give them to arrest the killer of my child .
