Musk up to now, with a plan to take over and serious questions about its safety. And we shake it up and off, with our Friday Night Panel, docking the biggest stories of the week, and some that you might have missed, as the 11th hour gets underway on this friday night. Good evening once again. I am Stephanie Ruhle. The january 6th Committee Just made its most aggressive move yet to twice impeached former president has now been officially subpoenaed by lawmakers investigating the attack on the capitol, and efforts to overturn the 2020 election. The committees letter left no doubt, they see donald trump as fully accountable. Heres how some of my colleagues reported on this historic subpoena, and its carefully worded allegations. This new material puts trump at the center of the plot to overturn the election. And later attached to the subpoena, chairman Bennie Thompson and vice chair liz cheney right this, quote, as demonstrated in our hearings, we have assembled overwhelming evidence, including from dozens of your former appointees and staff that you, personally, orchestrated and oversaw, a multi part effort to overturn the 2020 president ial election, and to obstruct the peaceful transition of power. One of the lines that struck me the most, as ive been reading through this, in just the last few minutes, where at one point they say, you were at the center of the first and only effort by any u. S. President to overturn an election, and obstruct the peaceful transfer of power, ultimately culminating in a bloody attack on our own capitol and on congress itself. Earlier tonight, Committee Member jamie raskin discussed the subpoena with some pointed challenges to the man at maralago. The idea that somebody would ascend the highest office in the land, president of United States, and then, refused to testify about the worst domestic violent insurrection and attack on the u. S. Capitol in our history is astounding. At the very least, somebody who is willing to send other people into battle to stop the steal on the patently false grounds that the election was stolen, certainly, should not be so much of a snowflake. Its not even to come forward to state his own rationale for why he did that, and why he continues to claim against all the evidence that the election was stolen from him. Trump has now been ordered to submit documents my november 4th, and appear for a deposition on november 14th. The 1 6 committee wants to see Trumps Communications with a long list of his allies, including former strategist, steve bannon. Bannon of course, defied the panel subpoena, and today he was sentenced to four months in prison for contempt of congress. But he will not be behind bars for a while longer. The judge hooked him up, saying bannon could remain free, while he appeals his conviction. There is also new reporting about Trump White House lawyer eric herschmann. You remember that guy. He gave some very colorful testimony over the summer during the january 6th hearing. Axios has now obtained emails from herschmann, expressing concerns that the former president might sign Court Documents and verifying voter fraud in georgia. What was he concerned . Because there wasnt any. Despite that, trump signed this sworn statement anyway. The Georgia Prosecutor has been looking into possible efforts to overturn the 2020 Election Results in that state. The South Carolina senator, lindsey graham, is still trying to avoid talking to that very grand jury. Just yesterday, a court rejected his latest appeal to toss out his subpoena. And today, graham asked the Supreme Court to block the effort to force him to testify. Also tonight, a disturbing new report on those documents seized from maralago. The Washington Post says, some of which was recovered by the fbi from trumps florida club, included highly sensitive intelligence about u. S. Adversaries, iran and china. The white house refused to comment on these specifics of the report, but a spokesperson did say this. We take the proper treatment of classified and confidential information very, very seriously here. There are protocols in place that are designed, specifically, not only to protect sensitive information, but to protect our ability to continue to collect and analyze that kind of information. And lets not forget, the Midterm Election is now just 18 days away. President biden has spent much of this week, stocking up his agenda, and his administration s policies. And in an exclusive interview airing this weekend on the sunday so with Jonathan Capehart biden offered his warning about what will happen if republicans take over congress. This is a choice, a choice between what kind of country they want, between, for example, do you let do you make sure that you are able to afford Prescription Drugs for people that are elderly . Do we have a certain stance where we are able to negotiate medicare, or negotiate drug prices . The republicans have made it clear, i think they want to do is a lot of them, most of them voted against the bill to reconstruct america through the infrastructure bill, highways, roads, you know . They all voted against the inflation reduction act, which provides Environmental Security and safety. They dont have a platform other than tear down what ive been able to do, weve been able to do. And i dont know what they are for. With that, lets get smarter with the help of our lead off panel tonight. Charlie savage, washington correspondent for the New York Times and author of power wars the relentless rise of president ial authority and secrecy. Professor Melissa Murray of nyu law school. She was a clerk for Sonia Sotomayor on the federal bench before her nomination to the Supreme Court. And former Florida Republican congressman carlos curbelo. He was a member of the republican conference for two years during the trump presidency. Melissa, we gotta start with this subpoena. We waited for it for days, and if you read this thing, its like a criminal indictment. What do you think are the most important points . , well it is definitely a shot across the bow, and it puts the former president right at the center of what the committee calls a multi part effort to overthrow the results of the election, of a validly conducted election. And the really spell out the ways in which Different Cases are joined together. Its not simply the riot of the capitol, but rather, the efforts to advance slates of false electors, the efforts to overturn and find votes in various swing states, all of this was connected. All of it failed, the many different challenges that made their way through the federal courts. And then, finally, culminating in the january 6th insurrection. All of this, they note, puts donald trump at the center. He is the person who orchestrated this, who oversaw it, and ultimately, he is the one that they need to talk to. Charlie, the committee is asking for Trumps Communications with some of his closest cronies, with tony ornato, his former Secret Service guys, and for records of his legal fees. They want to know who is paying them. What else are they looking for . Well, what do they really, really want is, of course, for trump himself show up and talk about that. But theyre looking for all kinds of records about all these things weve been talking about, the fake electors scheme in various states, the efforts to reach out to groups to get them to come on january 6th. But they know that the biggest spectacle would be to actually confront trump and question him, and grill him, and see what he has to say. Interestingly, it has been reported by publications and others that trump has told he could do it, but only on the condition that you can do it live. The committee could not end it out what he says, and it would be a spectacle. He could maybe take over and make it the trump show. This is not a subpoena for him to show up and testify live before a hearing. It is a subpoena for him to shop for a deposition that would be taped, and then, they could air excerpts. So, i think, as much as he might have been, perhaps, tempted in those lawyers would have told him he will be insane to do it, that he might want to do that spectacle. They have this gigantic event with himself at the center of attention. He is not going to be interested in testifying behind closed doors, and ceding control over what gets showed to the public, which is what the committee has in mind here. So, i predicted that what he will do is try to tie this up in court, and run up the clock for the next two and a half months, if polls are right, and republicans take over the house in january, they of course will drop this committee and drop the subpoena. So he only needs legal arguments, to last two and a half months, and there is so much undecided here, its such an unusual situation, the attempt to force a former president to testify, turn over documents. There is a lot of arguments, both procedurally and constitutionally, he can easily use to get himself across the finish line in january. And make all this go away. And there is no reason for him not to run the clock. Its what he does best, and it works for him, carlos. But clearly, this is major news. This is a former president of the United States getting subpoenaed. And much of what the January 6th Committee is trying to do is and for the American People. But do you think the American People are aware, while this is huge news event was breaking, which was fox news airing . Crime, crime, crime. Crime, inflation, immigration. Thats all they do, all day, every day, just going right to the fears of the American People. What does it say that millions of americans dont even know that this is happening . Yes, steph. This work that the committee is doing is gonna be very important for history, for the safety, the integrity of our democracy. And i think its also gonna be very influential in 2024. This work is going to have an influence on the republican primaries in 2024, and maybe on the president ial election, the general election in 2024. This year, this election is going to be about crime, immigration, inflation, and abortion as a lot of democrats are making this point on the campaign trail. I dont think that what the committee is doing today is gonna have a big influence on the result in a few weeks. But if republicans win in 17 days from now what happens to the fate of all of this work . Thats right. In january of next year, if republicans do take the house this will all be over and, done with. Of course, some of this will be left to the Justice Department, and theyll still be able to prosecute those who did not, who lied to congress, or who did not show up when subpoenaed by congress, but without a doubt, if republicans take over, this committee, you can say goodbye to it. Of course, a reminder, the doj has informed the public that they need more money to continue their work on january 6th, and if the republicans do when, i get a sinking feeling they wont get it. Charlie, youve been working overtime this week. So i have to put you back on the spot. Former obama official ben rhodes he was asked today about that report that really scary report, that intel about iran and china was recovered at maralago. Watch what he had to say. People already know that these documents were in an entirely secure location. People wandered in and out of that club. Weve seen Cell Phone Videos of people getting drunk at weddings at that club. You are telling me that the Chinese Government did not try to get people it maralago. Charlie, i have gotten drunk at weddings at maralago, and photographed my husband all up and down that place. Luckily, i didnt steal any intel, and it was many years ago. But given how unsecure it is, how concerned should we be . While, especially for the documents that were marked top secret, sensitive compartmented information, that is among the highest most carefully guarded secrets of the u. S. Government has. And so, from a National Security officials perspective, that is truly hair on the fire. You know, we have been trying to figure out what these documents were, and there was some early reporting, though, they were looking for nuclear documents. That seems to at least the discussions surrounding, that seems in retrospective, have been overstated. So, i also ought to be cautious about this, because my own organization has not matched that report. But it would not surprise me that there were documents about iran and china among the 103 classified documents that the fbi retrieved in august. And so, what would be interesting about that is to the extent these are intelligence documents, documents that are based on intelligence reporting, about adversary countries like that, it would not need to say, and we know this because we have broken into the cell phones of ex people, email accounts, or the janitor, you know the president of irans office win. Weve not to be so sensitive especially name these people because often, in countries that have, where we have very little visibility, National Security officials will say that just seeing that we know this and this allows an adversary to be like, oh, it could only have been these six people who these communications have been compromised. And that means that those channels very quickly, get dry up. And so, that is why from intelligence officials perspective, if it turns out that these werethe United States states is so focused on, instead of just random classified information, i think it would be of particular concern to the government, if those who were compromised at maralago, when they were being stored in securely there. Carlos, this is not the political. National security, public safety, these are things that should matter to all americans. And frankly, historically, you would think republicans would make a big sting can deal about this. Does it surprise you that we havent heard from many . Like so many things, during the trump era, quietly and privately republicans are alarmed. They think this is horrifying. They are against it i have to stop you. When you stop, ready . When you get the job of a public official, you no longer have the privilege of private views. Isnt that baloney . Think people should speak up. What is at stake here, as you said, its serious enough for people should speak up. I get it, sometimes people are quite. They dont want to, you know, make waves, and do anything that might hurt their party. But this is more than about a party. This is about National Security. And again, republicans are saying, privately, i hope if after this election republicans are in charge, some of them would be willing to speak up, and actually say, we need to put an end to this horrifying chapter in american politics. On 1 to 10 scale, where do you put that in terms of likely happening . Unlikely, but one can still hope, but for the good of the country, i hope it does happen, steph. If this was a tape show, this is where weve got to the scene of dumb and dumber, so, you are saying, there is your chance. Because there isnt one. Melissa, lets talk steve bannon. He was sentenced today. But he was still spouting off on Tucker Carlson tonight. Our friend Andrew Weissmann tweeted this earlier quote. Key flaw and the bannon sentence today was not requiring him to go to prison now. There is no substantial issue on appeal for all his actions which is necessary to have kept him out pending appeal. Now he may never go to jail. What do you think about this . I mean, today, it just seemed like a Big Old Press Opportunity for steve bannon and his double popped collar. Well, he certainly seems smoke, as he left. It probably would have been at smoke, if he was wearing an orange jumpsuit. And andrew i think is right. This is another opportunity for him to run out the clock true to the trump fashion, while he is appealing his sentence. He can basically wait until maybe two years and if this president is back in power again, he could seek yet another pardon. And all of this would be water under the bridge. So, again, the Justice Department got some over to wanted here today. They got a four month sentence. They had requested the maximum of six. They did not get the 200,000 dollar fine. They were hoping for. Its just a 6500 dollar fine. The big thing here is allowing this to be state on appeal. That really gives bannon an opportunity to try and work the clock out. Carlos, is this a win for bannon or the Department Of Justice . He blows his nose with 6500 bucks, and now, we are talking about him. I think he made pretty well. I mean, he should be paying major consequences for what he did, and i dont know hes not even being the major fine. Carlos, thank you for being here in person. Why was carlos so good on the air tonight, because he brought his doctors into this. Video charlie savage, Melissa Murray and carlos curbelo, thank you. And you need this. I love it are we in a wayfair commercial . Maybe. Personal sauna. Ok i need that. Ahhhhh after months of uncertainty wayfair, youve got just what i need and a whole lot of headlines, that Takeover Deal between elon musk and twitter could actually be just one week away. But there are still a huge amount of questions that remain. So, lets begin our dear friend, nbc news tech correspondent jacob ward. He wrote the book, the loop how technology is creating a World Without choices, and how to fight back. All right, lets talk about the most recent headline, jake. If this deal goes through, musk could lay off 75 of twitters staff. Without them, who is left safeguarding this thing . Is it gonna be a free for all . Twitter, like it or not, is where millions of people get their trusted information. Thats right, i mean, stephanie, this is the place where it will leaders make announcements to one another, where you know, you learn the major events of the day, and yes, like you say, elon musk, according to multiple reports, its considering cutting about 75 of the workforce, as part of what he promised to investors, as part of his plan to take it over. He said, not only would i be able to triple our revenue within three years, but also, its gonna be double within about three years. He also said, hes gonna cut it down to about 2000 people, which for twitchell, is an absolute Skeleton Crew. Its a very, very interesting, you know, truthful, it just crazy to me. We just got to this place, where we thought were just one week away from the end of this saga, will he by . Will he be forced to . Is it gonna happen . And just when that saga comes to a close, this whole new premise comes together, where we have wrap our minds around the idea of what will this company be like, if youre once it. And its only 2000 people working there, i mean, that really is a Skeleton Crew by twitters standards. And hes gonna do all the things that he says he wants to do, hes gonna fight the auto made span bot problem. Hes gonna create some kind of super a version of this thing, hes gonna need a lot of people. So putting all these, folks and making all these promises, i dont see how those go together. The white house is set to be considering Security Reviews of his ventures, including twitter. Walk us through this, and specifically. Could this end up being the greatest Golden Parachute ever for musk, the white house takes a close look, they look at his involvement, they look at his communications with putin. They say, you know, weve got trust issues here. Were not gonna let it happen. And musk gets the deal of the century. He gets to walk away from this bad dream, and not actually have to buy by the company. You know, its such an interesting take on it, right . On the one, where at this place where it really seems like these two companies are coming together, right . Like twitter, highly motivated to make the deal on the verge of a possible global recession. There are certainly being offered the highest share price they could possibly hope for in that position. Youve got musk, desperately, presumably trying to avoid going to trial, where discovery would blow up all sorts of revelations about his inner workings, and then suddenly theres this possibility of a National Security review in which musk could say, listen, i satisfied all the requirements a judge put in front of me, but, now they National Security review has blown this up, and he could conceivably walk away. Now, it is important to note here that although bloomberg is reporting that this kind of review has been concede by the white house, the white house says its not gonna be necessarily doing this. Theyve been denying these reports so we dont really know. But certainly, theres lots to look at, right . There is of course the fact that world leaders, you know, move their messages back and forth across the spot for. It makes it a huge National Security issue. Plus musk just cant stop running his mouth about all sorts of things. Right . Hes putting out roger boasts about how the situation in ukraine should be resolved. He is saying things that are pro chinese. I mean, he is a very interesting figure. Its not a quiet restraint kind of public there when it comes to this stuff. And so they seem to be in looking at these dealings, and youre absolutely right. It might be the one way he actually shoots the moon, and gets out of the deal, although again, stephanie, i still dont know. Why is this guy one of my twitter . Its not clear to me at all. Maybe hes got some grand plan, and he doesnt go through it. At this point, were guessing, but it is interesting at this point, you through this welcome to the deck that i certainly do not see coming. Shoot the moon, you are corny, given his love of our space. He cant stop himself, he chooses not to. This is my last question. You just said a moment ago, twitter getting the highest price they could possibly hope for. And the eve of a possible recession, does that not make you wonder who in the world is financing musk because, it was just before he was toast, when all sorts of his communications would have been made public once he wouldnt go out there and a whole bunch of other really rich people might not one out there, so who do we know much about was giving him the money . We do nothing has a consortium of investors. Many of whom where investors in which are already. You have the prince of saudi, you have the qatari statement, you have chinese investors, all it seems interested in being part of musks play for this. So there is a crew of investors, but these are the same investors that play around the edges of tech all over across the u. S. So, you know, i think the thing that is sort of, that would be sort of amazing to watch here, for me anyway, is the next thing. If it does go forward, and he does buy it, and he does go to a Skeleton Crew, with all this foreign money, and everything else, what is twitter going to look like, right . We have seen the company trying to get a handle on world events until now. Who knows what this thing will look like after friday . We will soon find out. Jake ward, always great to see. Oh thank you for joining us. When we come back, lets get excited on friday night invite panel is here. On the mature messaging with republicans hitting on fear, fear, and fear. The democrats were warned that if they do this, you will fire up inflation. Individuals were hurting, families were hurting, businesses are hurting, we passed the carac, with the senators supported. I really wish he had stood up his party on this vote. You are calling trump americas hitler. Then you kissed his ass. In just 18 days, voters finally get to try to do something about all of that. Republicans, they are disciplined. Every candidate, every Message Hitting on one thing, fear. Inflation, immigration, crime, and while they are not offering any policy solutions, these issues go right to the Kitchen Table and they scare us. But scarier than all those things is democracy at risk and in peril. Without a respected rule of law, we have nothing, which is what democrats are trying to explain. But here is the problem. Voters, they are not think about democracy when theyre at a gas station or the grocery store. So, i want to know how do democrats play this . And we have a great round up of people to cover this and more. Here tonight, Stand Up Comedian pete dominic, hayes brown, Msnbc Daily Columnist and editor, jonathan greenblatt, ceo and National Director of the antidefamation league, and my dear friend nbc news correspondent stephanie gosk. Welcome to you all. I want you all to chime in. But haze, to you first. Some of the arguments republicans are making are not even true. But the fear is real. So what do democrats . Do i mean, that is one of the things why republicans are choosing these issues to run on. Because so often things like immigration crime, even, inflation its more based on biden. Theyre based on how people feel than the actual policies at play. He will know that no republican is saying here is what we do to actually fix inflation, because there is nothing that congress can even really do at this point. It is up to the federal reserve. There are steps that could be taken in theory that will lead us to exception. But no republican wants to come out and say while, if you want to fight inflation, we have to encourage a recession. No one wants to actually talk about what it needs to be done to actually move forward on these issues. I think democrats need to do a pretty good job of calling republicans out on their lack of having anything that could actually potentially be done about these issues. But for republicans, they continually push forward these soundbite clips that make people feel upset, feel scared, feel they are not in control their own lives. Thats not new though. Thats not new. Im old enough to remember weapons of mass destruction in iraq, and so many lies that activate people. And this is always been led by the rightwing media and then republicans in office had to follow along and take their Marching Orders from the most influential people on the right. I think this is not about messaging, not with 18 days at this point. And democrats are never gonna be as effective using fear because we like to use nuance, have a longer conversation, top policy. Right now, my local democrats, im telling people im just going to go knocking on doors and say do you like clean Drinking Water . Because it is in peril. Its true, its effective, it might work, right now what the democrats should be doing, what im doing, is organizing. Its not about the message at this point. People know who theyre going to be voting for. If you are the solution, youre gonna be part of the problem. Here three weeks from the election. If you are going to do hyperbole, this is the time to do it, right. Republicans are going all in. Lets make it sound crazy, and then we can blame biden and the democrats. Sounds like a good message. It does not matter if its true. And for that matter, democrats do a little bit of this as well. This is the season for hyperbole. I would give americans a little bit more credit, they know that is what their politicians are doing right now. Exactly. But what happens to society when the whole goal to motivate voters is to pray upon fear, its to sow distrust in our minds, what is that to the culture . So, i would tell you that i think disinformation is corrosive to democracy. So, when they go to the hyperbole and say these things that are totally outrageous, it alienates voters, it scares them. And that undermines the fabric. While, yes and no, because some of the voters theyre trying to reach, trying to turnout, especially on the right, are motivated by hate. They are motivated by the things they are being spoonfed. They are motivated by the idea that there is an invasion happening on the southern border right now. Theyre not thinking about okay, lets go one step further and really talk about hate. Because it is more than hyperbole. We have seen a spike in antisemitic racist rant, not on the fringe, is from political leaders, cultural leaders, kanye west is off of twitter because antisemitic comments. Donald trump is now being criticized for his antisemitic speech. And you are seeing more and more members of the gop heading into the midterms saying things out loud and not being condemned for it. Thats a speech. How bad is it . We had that today with a mastriano campaign. Doug mastriano, running for the governorship in pennsylvania, has repeatedly invoked antisemitic tropes. He went on gabba, which is a nasty cesspool, you know, of slander. He took money. He gave money to the founder of gab, whos a real piece of work, a white supremacist, and eudora. Bringing all that together, today, a spokesperson for the campaign is calling out joshua pirro, calling him a secular jew. His campaign that is specialized in stereotypes and slander, criticizing the jewish person they are running against. Its crazy. Its horrible. Going from politics to pop culture, kanye west, i have not heard adidas drop him yet. Adidas has not dropped him. Balenciaga just today, but did not mention that its the antisemitism and the racism that motivated them to do so. This, stephanie, is what weve talked about on your show before, its the normalization of hate. It just becomes part of the public conversation. Adidas, a german based company, does not feel the need a german based company that outfitted the hitler youth. That has deep, deep relationship to the third reich because it was there, you know, making uniforms for the very marked. You know, when you think about where we are right, now the norms have been threatened. Theyre not criticize for coming out and criticizing the things. In fact, you might even get some votes. When you talk about immigration, when you have a very good conversation with immigration thats reasonable, and you could be talking to someone who has very conservative views about it. But that is not what scares people. Thats right. What scares people is coming on using the word replacement. And then people, that gets people to vote, right . We are seeing that as well on the lgbt front. I mean, the way that the groomer conversation has sprung up. I was actually in high school during the 2000 era when they were trying to push for the constitutional amendment to ban gay marriage. So, the fact that we have looped back around, almost, to the same sort of levels of homophobia and now transphobia being pushed, especially on teachers, push on students who are just trying to live their lives and trying to be able to exist without, you know, being dumped on and being called a pedophile, the fact that we have looped back around that is really kind of horrifying to me. Yeah, made a lot of progress in so many ways, in our lifetimes in all of these issues. And for the past few years, we are definitely taking a few steps back. Stephanie talks with the immigration issue. And jonathan knows as well as anybody about what trump caravan invasion did. That is what happened at the tree of life synagogue. That is what animated that guy in pittsburgh. And this is were only going to see more of this the more it gets spotted. We have to have a conversation where certain people are not invited. You cannot come here. You cannot sell that if youre selling that kind of hatred. But it could all Look Background to this free speech argument. And that i, feel, like a losing more. And people are trying to, like, frame the terms around right now. You say anything about, like, the actual content of the speech. And instead they come back, there are like why you try to cancel . Maybe whats more dangerous . A cultural icon like kanye, or a political leader doing things like this . They are dangerous in different ways. So, kanye with 31 million followers is incredibly dangerous. And when people in the Entertainment Industry are afraid to call him out, because what has been most deafening is the failure of other entertainers, are the people from hiphop or other present cultured to see a word in response to what he said. But make no mistake, the bully pulpit of donald trump, the bully pulpit of a political candidate is something also very powerful. And different kinds of keto they could accuse from. That say the stuff, you pay the price. And whether it is in the Entertainment Industry, or whether its politicians who come out and say, you know what dude, you cannot say that. And then you are out. That does not happen anymore. Why . Instead the overton windows been pushed, and were all boiling frogs, if you will. Were in the water, its heating up the Inflection Point was 2016. We are far past that. We are in current danger right now. And even you can blame the media as well. Anyone who isnt fighting kanye west on to the show is part of the problem. I will do anything i can for the ratings, even in the black sea the card. This is the. Issue were not going to talk about these issues because by Giving Provocateur attention, youre feeding him. If we ignore them, doesnt that just let the problem fester and grow . Yeah, and you see that with these politicians as well, like with Marjorie Taylor greene, you do not want to cover them. But because they are national speakers, and even though Marjorie Taylor greene, she is not influential in terms of legislation, she is not out there not one committee assignment. Not one committee assignment, but she will be getting one in the next congress of the republicans win, its true. She is someone that should be on the margins, on the fringe. But instead, she is being embraced catching and help with fund raising, she can help with political messaging. So, the fact that she can take this platform, this lack of a platform, almost, and be in a position to put forward legislation in the next congress, terrify. Hes been on the sidelines after a major hit left him unconscious during the bangles game three weeks ago his controversial concussion prompted the Players Union and lead to update their protocol. But the whole thing has raised a lot of questions about player safety. He spoke about it for the first time on wednesday. I was unconscious, so i couldnt really tell what was going on so, when i did come to, and kind of realize what was going on was happening, i didnt think of anything long term or short term. Our panel is still here. Steph, i turn to you first. What does this do to youth sports . What about parents watching this . Did you hear this description . It is chilling. I remember everything, then i got hit, then i dont remember anything the time i got to the hospital. Its a brain injury. He suffered a traumatic brain injury. And heres the thing, less than a week before that, he also likely suffered a brain injury. They say it was his back. But people watching it all suspect, when he stood up and he stumbled, it was his head. Now he is going to be playing again and there was a Press Conference that the head coach and dolphins gave where he came out and said, this is not what you signed up for in the nfl. I thought there was a, hang on, it kind of is. And Tua Tagovailoa is a smaller quarterback, the quarterbacks get reamed, and they are trying to protect them more. Is he going to get hit again . Yeah, probably, right . I would think that the league, the owners, would want to take Health And Safety on. A healthy team is a winning team. But there is this underbelly, when you bring this up, that this is part of the Worse Ficiation of america, addressing it. Pads and helmets im with hayes, i think the new game with all the safety gear and do you think the owners really care that much about it . The league does. The league cares. Because its accidental for them. Is it . Because you already have families not letting the kids play football. I wouldnt let my foot kids play. Theres a perception that you are not looking after the safety of the players. And thats why they have acted as quickly as they have. Bottom line, they cannot have people who have skin in the game, quite literally members of the, team team doctors, coaches, players deciding when players get i would think they would think of them as investments, at the very least. Youve got to protect your investments, get a good return. Youre putting millions of dollars into. All right, as long as you are talking about money, we have to talk about a different debate, one that has been sparked all over the country, but it tiktoker laid it out quite well. Watch this. Not to sound like a yuck hater, but its gotten out of putting what i wanted, send out the order that got my car to pick it up. I get, there i give the girl my to pay for food. Shes been set off fat around and i get whiplash. Shes like, did you leave a tip . Girlfriend, for what, what did you do . That im actually gonna flip this thing right at you . I will be taking a tip. 20 , thanks. And when you are done, go grab me a, shift and clocking in. Because ive done more work for this establishment than you are. And i would like to be and say it. [laughs] this is another thing that covid changed. Because of covid, we are now cashless. Theres no tip to. Our covid reminded us how our Service Workers are important, and they are underpaid. Its why we are giving such big tips after covid. But it is it the consumers responsibility to make up for the Service Workers not getting paid . Especially when you got people who never got to taper for saying, here you go, heres my q r code. . And there are certain ones i mean, my coffee order is easy. Its black coffee, thank you. Tip . What, that took you five seconds. Its even worse, by the way, is when you want to donate to us charity for sick charity, and you have stayed front of everybody in line, i just wanted to buy a hammer. I feel weird. I guess so, being shamed into doing it. So theres, all kinds of ways. Its tough to know people how much money they are making. We should have cash for tips. There should be a jar. You can leave the change. Thats what i have to say. Its tricky. I disagree, actually. I think i might be the only person around the table kind of fine with this new paradigm on dumping. Im okay with it. Because what is the new paradigm on tipping . The new paradigm is tip more yes, tip more. If you are being served, then tip someone. I feel like a monster, hayes. As long as people are struggling to make a living wage people are struggling. So is the consumer, potentially. But if you are in a Service Industry jobs, i feel like it is worse. You are trying to make ends meet, off and on, often a parttime gig, with no control of your hours. I think if we are going to really fix this, and we should make it so that the minimum wage across the country can no longer be dependent on tipping, for one thing. I hate the no tip and i felt so awful. And the next time i went back i was like, i need to just start handing out twenties before i even my order my latte. Here, a 24 you, a 24 you. Here you go. Unionized. One of the two how do you think . You are Stephanie Ruhle i definitely tip. But i notice. I noticed this because my son applied for a job at a Checkout Guise of peace place pizza place. The guy said, dirty little secret, you are going to make twice as you think, because people are shamed into dippy. This is the owner of the pizzeria that set it. Thats actually interesting, that the owners its not another employee trying to give them not the employer saying, i wont pay as much as i should. That i think, is the unfair part. That, i think, is what needs to be changed. If we want to have a conversation about reducing the amount of tips we can do that, we can talk about the employer side of things, and actually paying people affair wage. Fair wages, real wages. About tipping walk around with a bunch of fives, and give this fives to people who dont normally get tipped, its amazing. Bingo, you feel good about, it the five means nothing, what are they going to do, with a taxi . But you have a moment. You are my door man. Thank you very much. We are out of time. But heres a tip its really a Public Service announcement this week. Its not how much you tip. Its how you treat the person who is helping you. That message is coming from the employees at the restaurant balthazar. Pete dominick, stephanie gosk, and on that note, i wish you all a very good night. For all of our colleagues across the networks of nbc news, thanks for staying up late with us. I will see you on monday night.
