government is recommending one month. anyone who practices federal criminal defense will tell you that is a very rare, very low recommendation by the government. >> so it is for show? >> it is largely -- the sentencing today? i wouldn't say it is for show. >> no, one month. you are saying it is so rare, why would they do it? >> that's right. i'm asking the same question myself. i think because the government's -- one of its principles is that defendants should serve some punishment even if it is minimal, and in their mind i'm thinking for them, they probably think a defendant like this should serve some time, but it would be very inconsistent with the sentence handed down to stanford sailing coach earlier, about a month ago i think. he got zero months. >> what he did was different from what she did. >> it was different, but his recommended guideline sentence was 33 months at the lowest. the government recommended 13 months, and he ended up getting zero months. so i don't know how this court stays consistent and gives her anything other than zero months.
