Im jose diazbalart. Right now, we are tracking the very latest on the deadly storms and tornadoes that slammed into parts of the South Killing at least seven people. Well bring you a live report from alabama. Also this morning, were following the very latest on the controversy surrounding the classified documents found at President Bidens former office and delaware home. What the Special Counsel is looking into, coming up. On capitol hill a growing number of republicans are now call ong one of their own to step down after congressman George Santos admitted to fabricating parts of his resume. Well have congressman Robert Garcia about that and more. And here in miami, i had the chance to speak with the charity providing migrants with legal advice, food, and shelter. Well discuss the challenges facing Asylum Seekers later this hour. We begin with the cleanup and recovery just beginning this morning after a dangerous storm system swept across parts of the unleashing a series of destructive tornadoes, mostly in alabama, but also in georgia and kentucky. At least seven people are dead, six were killed in alabama. A 5yearold boy in georgia was killed when a tree struck the car he was traveling on. Scary moments captured for workers at a recycling plant. Large pieces of sheet metal slamming into the building where they were sheltering in place. At least 42 tornadoes were reported according to the National Weather service Leaing Tens Of Thousands without power. Many are thankful to be alive. I heard a sound i never heard before. It sounded like a freight train. And the wind picked up so strong, i had to jump out and i ran because everything was shaking like never before. Joining us from selma, alabama, blayne alexander. Selma was one of the hashdest hit areas. Whats it like there today . Reporter i think where were standing gives you a pretty good picture. Look what the wind did to this building. So were standing in Downtown Selma right now. And really everywhere you look, youre seeing some example of the devastation that the storm brought to this area. You see this building right here. Its really just almost like somebody took a claw and dug through it. Just ripped away this side. Where im standing, i can see bricks that were ripped off the building. That shows how strong the wind is. We can turn our camera in new mexico almost any direction to see how much is hit. There is a lot of damage down here, but this is another pile of what were looking at. Power lines through the roads. A the lot of the streets are impassable right now. And officials are asking residents to stay inside because its not safe to come out. I think you see a picture down here, but when you look at a piture from up above that really shows you what were talking about. We can show you drone footage that we shot not long ago. That shows not only how widespread this path was of the tornado here in selma, but also just how it hop from place to place. Some places are not touched a at all. Others are destroyed. Now this is just the damage that were talking about, but the toll in the Neighboring County was greater. Were talking about six people who were killed. A total of seven deaths so far have been attributed to this storm. Including a 5yearold boy in georgia, who was riding in a car and the tree fell on that car crushing him and killing him. Unfortunately, Officials Say as they continue to survey the damage, they continue to try to sift through the wreckage, they do anticipate its possible that death toll could increase. Lets talk about the outbreak of tornadoes. It is official. This was an outbreak. Were talking about more than three dozen reported tornadoes across alabama, georgia, and throughout the south. Officials are going to be surveying, trying to decide what they are looking at. The National Weather service says that it could take some days before they are able to confirm all the tornadoes. One note i want to make about this is the timing of this. Were in the middle of january. This is the middle of winter. While its not unheard of to see tornadoes around this time, were talking about an outbreak and the ferocity of the tornadoes is something we typically dont see in january. New developments what may have caused the Computer Outage that led to chaos at airports across the country. Nbc news learned investigators believe one or more Contract Workers may have introduced corrupted software to the faa system damaging some files. Investigators dont know if this was a malicious attack or human error. Wednesdays outage caused delays and cancellations affecting hundreds of thousands of passengers. The Transportation Secretary tells nbc news the faa is reenforcing its computer and Cybersecurity Protocols to ensure this doesnt happen again. This morning russia is claiming its first victory in ukraine after a series of setbacks. The Defense Ministry is claiming it has taken control of the Mining Town Of Soledar in eastern ukraine. Ukrainian and Russian Forces have been locked in an intense battle where recent Satellite Images show the scale of devastation in soledar. Ukrainian officials have denied the claims of victory. Nbc news has not been able to verify russias claims. Earlier this week john kirby said if russia was to capture soledar, it would not make a significant change in the war. Even if both soledar fall to the russians, its not going to make its not going to have a strategic impact on the war itself. Joining us now from ukraine is matt bradley. Matt, what more can you tell us about the situation there . Its a really interesting situation because its been nearly 72 hours since we first heard wind that soledar might have fallen to Russian Forces. This came from a post on telegram by a notorious private military contractor. He said he single handedly taken city with his own private army. Since then theres been a lot of back and forth. Ukrainians deied it. The kremlin denied it. And the news today is that were hearing from the Russian Ministry of defense. Russias proper army, not some private military force, saying russians have take that eastern city of soledar. But as you were mentioning and as we heard from washington, why soledar . Why would they be exceling so much energy and so many lives in order to take a city that really is quite small. Its about 10,000 people. This is something that has puzzled ukrainians as well. The question is say and we heard from the Russian Ministry of defense say that will allow them to take the city, which is only about a 30 minute drive from soledar. But both of those cities taken together arent necessarily a strategic prize. What we have heard from military analysts is that really this is more of a trophy for the man who runs the private Military Group who has been boasting for the past several days that its his group, his army that has done this deed and has made the first real victory for Russian Torss ever since this summer. And since the summer, we have seen the russian miliary being pushed back constantly to much criticism from the military community in moscow. So really in many ways, this looks like a political Vanity Project by a man who is nothing more than an oligarch who is trying to rise himself up within the ranks of the Military Establishment in moscow on the backs of the corpses of his own men. Matt brad lee, thank you. I want to turn to the deadly tornadoes sweeping through the south. Joining us now is ernie bagot. Whats the latest from your county and surrounding areas . Well, were still conducting some Search And Rescue efforts right now. Were hopefully moving into the Recovery Phase very soon where well start doing some damage assessments, so we can get a better idea of what weve got. We are leaving one of ft scenes right now where unfortunately our total has just climbed by one more. So right now youre reporting Seven Fatalfatalities . That is correct. Talk to us about just the dimension of the destruction. Im sorry, i lost you there for a second. Describe f you would, the dimension, the size of the destruction. So what were seeing now is a 20mile path that has moved through the county. Were not sure on the width of it, but we have a 20mile path. This storm system left from selma and Dallas County and moved in all the way across diagonally and into el more county. Its a longlived storm. We did have seven so far, and we accredit the fact that that wasnt worse to the fact School Systems kept the kids in school and sending them out what can people do if they want to help . What sources dots you need . Were advising everybody that wants to make donations to move towards our county website. It has information on what they can do. Were asking volunteers to hold off until we have a center set up so we can actually process people in. I thank you very much for being with us. I know this is a very difficult time for all of you. I appreciate your time. Coming up, the Trump Organization was just sentenced. 1. 6 million for a long running tax fraud scheme. Details ahead in a live report. Also up next, new reporting about the importance of a classified document found at one of President Bidens former offices. Plus calls continue to grow for embattled congressman George Santos to resign. What he is saying has to happen for him to step down. Youre watching jose diazbalart reports. Youre watching jose diazbalart reports. So its decided, well park even deeper into Parking Spaces so people think theyre open. Surprise. [ laughs ] [ horn honks, Muffled Talking ] cant hear you, jerry. Sorry. Uh, yeah, can we get a system where when someones bike is in the shop, then we could borrow someone elses . No no or you can get a quote with americas numberone Motorcycle Insurer and maybe save some money while youre at it. All in favor of that. Now to a growing questions about President Bidens handling of classtied information. Sources tell nbc news that document found at a washington, d. C. Office, the president used after leaving the obama administration, was marked top secret sensitive compartmented information. Thaps the highest classification level in government. The discloure came hours after Merrick Garland appointed robert hur to serve as Special Counsel to review the matter. The announcement that came after the white house revealed that classified documents were found at the president s home near wilmington, delaware. The president said he takes classified documents and information seriously. Some republicans are demanding an investigation. With us to talk about had this is White House Correspondent mike memoli, ashley parker, and and david weinstein, a State Prosecutor in florida. Mike, what more do we know about where things stand with the investigation into these documents. Jose, we still have a the lot of Unanswered Questions about this whole matter. Yesterday was an important day where we learned a considerable amount. You led with an important detail, which is that the highest level of classification was found on one of the less than dozen or so documents found in President Bidens office here in washington. Were also learning that officials outside of the Justice Department and the white house have been briefed on the content of those documents. So thats significant as well. We also reported yesterday that a number of aids to President Biden who were working in his office in the final days of his Vice Presidency have been interviewed as part of this investigation and this review of the classified documents. Were learning about the chain of custody. Many of these documents were among those packed in boxes brought to a Storage Location and provided by the government to facilitate the transition to mike pence and system of those ended up elsewhere. We also learned new information from the Attorney General as he announced the new Special Counsel, as well as from the white House Counsel responding to these claims as well. And whats significant is we know of three separate discoveries of documents with classified markings on three different dates. The first november 27bd. Thats the original one. Then on december 20th, when lawyers for President Biden discovered some at his home in wilmington, delaware, and just this week on wednesday, lawyers for the president found an additional document with classified markings notified the Justice Department of that as well. So a lot more questions to be answered. Do we know about why the president ss team was cleaning out the Cloz Sit In The First place on the 2nd Of November . What we understand is that this penn biden center, this part of the University Of Pennsylvania where joe biden served as a distinguished professor and led their washington office, its still in his name, but the University Of Pennsylvania was hoping to begin, frankly, clearing out an office that President Biden had used, which he hasnt been using for at least three or four years. The president prefers to use an ovalshaped office in the building behind me. So the University Of Pennsylvania. Ed some of their office space back. So lawyers for the president went in to begin clearing those out. Thats when they made the significant discovery. So why was that Special Counsel appointed . While it appears that there was no criminal wrong doing here, somebody needs to run it to ground. They need to find out everything they can about the people moving those documents, see if the president knew what was involved and the movement of those documents, and it needs to be somebody who is impartial and not beholden to one side or the other and provide that information to the Attorney General. The american public, everybody around the world want an independent answer as to whether or not there was criminal wrong doing here. It doesnt appear there was, but we certainly all want to know what the answer is. How concerned are the president s allies about these disclosures . Well, they are concerned politically. Because it really complicates whats going on now with the investigation into former President Trump and his mishandling of classiied documents. While it bears repeating that these two situations are in no way the same in terms of the volume of documents recovered, in terms of everything we know about President Biden, they followed every procedure to the tee. They turned them over. He defied a subpoena. There was reason to believe and hes now being investigated for obstructing efforts to get these documents back from a sheerly political term, this is a real problem for President Biden. It allows trump and republicans to weaponize us against him and say, wait a minute, this is a witch hunt against the former president. Theres this Committee Investigating now with republicans in control of the house. The weaponization of government, this is another data point they can try to use. There are some questions just about how these disclosures came about. They didnt get them out in the full transparent way they promised. Its been a drip, drip, drip of heres a new document and heres new location and heres a new batch and series of leaks. So not from a legal perspective, but a political perspective, they recognize that this is a problem. Calos, when you look at the cases of the trump situation versus the situation here with the president , other than the fact there were classified documents, theres zero similarities between them. No one was asking for the documents that President Biden had in the different places. But politically, does this damage the president . Typically, politics isnt about details. When we look at the details, we can see the differences. Politics is typically about broad themes and what republicans are going to say is theres a great hypocrisy. Theres a double standard. This is about mishandling classiied information. Which by the way, is completely foreign to a member of congress. This concept going from one place to another. You were a member of congress. You handled classiied documents. And talk to me about how as a member of congress, when you go and get Classified Information, whether it be some kind of a request or a meeting, how are those documents handled . In the basement of the capitol, theres a facility thats designed to hold and for people to review documents and have conversations. Youre allowed access. You cant take a phone into that facility. Youre allowed access to documents. You can review documents. When youre done reviewing them, you have to return them and leave. You cant take anything in and out of one of these facilities. So for members of congress in particular, this is extremely alarming because the process for them is very strict. Its very scripted. And the fact that both these former president s had documents this their personal offices or personal homes is troubling. And republicans are going to hit on that. They are going to say this is fundamentally about the same thing and donald trump shouldnt be held to a different standard than joe biden. There is a difference between handling documents or being shown documents to a member of congress then to the executive. Absolutely. For members of congress, theres one centralized location. In the executive branch, they each have their own secure fult where they can view these documents. It may not be as large as the one congress. It may be smaller or several of them. Thats why these documents end up in a place that has the separate location. I agree with carlos. There needs to be a better way to keep track of all of this when youre done looking at it. To make sure it goes back to the skiff and doesnt leave that area and get collected with a bunch of other papers. Does the fact that at least one of these documents has the highest classiication make a difference . It does and it doesnt. It does because you have to have a very high level of clearance to even look at the document to begin with. But whether its classified or the highest level of classification, it still has to be looked at in a secure location. So it doesnt matter if its at the lower end or higher end, it shouldnt have left that location. Thank you all very much for being with us this morning. Up thex, the Trump Administration was just sentenced for engaging in a massive tax fraud scheme. How the maximum fine couldnt even pay for a trump tower apartment. Youre watching jose diazbalart reports. Rts. We have breaking news out of new york, where the Trump Organization has just been sentenced following its conviction of tax traud. The Trump Organization has just been ordered to pay a 1. 6 million fine. The company say it is will appeal. Earlier this week, the only individual charged in the scheme, the chief Financial Officer was sentenced to five months in jail. Joining us now is investigative correspondent tom winter. Good morning. Whats the latest . Good morning. 1. 6 million to be precise. The maximum fine that could have been imposed on the Trump Organization and the Trump Payroll Corporation for their convicted crimes of all centering around alan weisselberg, as you suggested. Now serving time at rikers here in New York City for an effort to effectively pay less amount of money on payroll taxes, on what they would have to put forward as far as medicare taxes that come out of the paychecks in this effort to give Wooes The Berg the luxury items all in an effort to make weisselbergs life easier to commute to the Trump Organization and to act as its cfo. You see him there between the formerer president and his son eric. So thats what this means as far as today. For the trump corporation, now you have to look at this in the totality of what the former president and his Company Faces and that in the immediate term is nothing. And New York State from a criminal perspective, theres no longer any cases outstanding against him. Theres the very broad civil case brought by the Attorney General, which alleges a whole host of fraud and financial crimes, but only on the civil side. So its not really something that will impact the company or the former president or his children from a criminal perspective. The Manhattan District Attorneys Office say this is investigation remains ongoing. They have the former president s taxes. They were the first to have them and winning their argument there is after trumps attorneys tried to thwart their subpoena. So where this case goes is a bit of a question. Michael cohen suggested on our colleagues show earlier this week that he expects a a call from the District Attorneys Office that felt like a little bit more than a hunch. Well have to see where this case goes from here. And see whether they want to talk to him, whether they want to talk to him about the Stormy Daniels payments. That could be interesting, though no legal analyst has been able to provide he with a charge that could be potentially brought over that course of conduct. Tom winter, thank you. Appreciate it. Up next, congressman George Santos, who admitted to embellishing his resume, refuses to resign. What his constituents are saying. This morning a growing number of Congressional Republicans are joining democrats in calling on congressman George Santos resign after he admitted to fabricating parts of his resume during the midterms campaign. While House Speaker Kevin Mccarthy admits hes a long way to go to earn trust, he says the issue is now up to the house ethics committee. Santos himself has apologized for embellishing his resume and says he will not resign unless 142,000 people ask him to, referring to the swabts who elected him in november. Joining us with the latest is capitol hill correspondent ali vitali. Also with us is correspondent george solice. So more of santos gop colleagues are saying he needs to step down while democrats filed a complaint to the ethics committee. What happens next . Now we wait. We see what actually next if you listen to George Santos himself, hes Standing Firm saying in a 142,000 comment that he made that hes not going anywhere. And this is despite the fact that every of freshman lawmaker who was elected this cycle when him from New York State has said that they think he should resign. They are not the only ones. There are currently eight total republicans who say that they think santos should resign. Now thats not a huge number. But were going to see if that lends to a growing chorus or not. The important thing is when it comes to congressional leadership, the top house members have not said that they think santos should resign. Instead they are doing exactly what you said at the top of the segment. Theres an ethics investigation. Speaker mccarthy said he will have to build trust. Hes not going to be around any Classified Information because of the committees hes been assigned to. Nevertheless, this is something that as republicans try to push forward with their agenda and present a united front going into the divided period of government, they are also going to consistently be dealing with santos as a distraction. So if santos were to resign, something he says he wont do, but if he were to resign, what would be the next steps to fill that seat . Then we would see millions of dollars start flooding into that part of New York State. Thats because this would then be an open seat, and you have to think of it this way. New york state allowed republicans to take the majority because they were able to make so many gain there is. Not just in my hometown area, but also in the santos part of the state as well. So hes a Majority Maker its why Republican Leadership is not part of the chorus telling him to resign. Because they already have such a slim majority. They dont want to mess with the numbers. If you look at the demographics on the ground but also the fact this could be a moment where george is, where voters are angry. They could see this as a referendum on santos himself. That could give democrats the momentum and allow them to notch another seat where mccarthy cannot afford to lose any at this point. Youre outside the office where legislate torts called for his resignation. What can you tell us. Reporter a rally just started moments ago. People from his District Camming on him to resign outside his shuttered office. These people are vocal. Whether its congress that ousts him or under his own va ligs. Theres a Campaign Starting with the wheresgeorge. If they see him here to get him plastered on social media as a way of calling him out. To get their sent the about these fabrications and falsehoods and how heavy been betrayed by George Santos. Take a listen. My basic message is to he should resign. We didnt elect him. Whoever voted, no one voted for whoever he happens to be. Which no one knows a the this point because everything has been a lie. My basic message is youre not representing us. We dont know who you are. Reporter theres not a the lot of love lost for representative George Santos this his district. There arent people here still supporting him. We have heard from people who are waiting to see what he does if he can make good over the next couple years while he serves if he doesnt resign, but as far as the eem here, they are pred pretty adamant they want him gone. The they are saying were going to do this. Were going to make sure that you cannot represent us here after everything that has come to light. They are waiting to see if there are more falsehoods. This is probably just the very beginning and people here are going to be on the lookout to see if they spot him to try to oust him. They are trying to make him a public figure out here on social media to hopefully get him to resign. Thats the latest here in new york. Thank you very much. Joining us now freshman democratic congressman Robert Garcia from california. Its good to see you. Its good to meet you. Youre a member of the freshman clasp watts your rex to this scrutiny facing congressman santos. Theres no question that George Santos is a missive fraud. Hes a serial liar and has no Business Being in congress. People have no idea who they elected. Hes completely ineffective. People have called for him to resign. Theres no reason why he should be seated in congress. And its really sad to see not knowing who represents him. So as an incoming freshman, its really shameful to see someone like him serve in congress. You have seen the moves against him already with the house ethics. You have seen his colleagues calling him to resign. Were nearing a oint its going to be up to the house to expel him. Thats something i absolutely support. Theres conversations already starting. Republicans and democrats move in that direction and we should. So congressman, youre just getting to capitol hill. What are your Top Priorities being in the minority, but what are your Top Priorities as you begin your career in congress. For me, im one of those that im so grateful to have had a chance. When i was a kid, i came here with my family. And i was given the opportunity to become an american citizen and serve my Community First as mayor and now in congress. And every single kid got the same opportunity that was given to me. Immigrants are some of the most patriotic people. We know what this v loving this country is all about. Actual real patriotism is not screaming and yelling. But real patriotism is helping people. Thats what being a true american is all about. So for me, Immigration Reform actually providing pathways, fixing daca, ensuring that we fix the issues at the border and across central and south america, its at the top of my list. So thats shotgun thats very personal to me that i hope to work on and make sure we continue to mve progressive items forward. Whether its headaching sure we are lifting wages for Working Families across the country and also protecting our community, which is under attack by the far right extreme republicans, especially those in congress. And so congressman, im thinking you talk about how you were brought here at 5 from peru. Your mother brought you here. You were 21 when you became a citizen. Thats how long ago theres any Immigration Reform. What would you say to that 5yearold boy, who came from peru and is now entering the halls of congress . What would you tell that 5yearold kid . Just to keep dreaming. Certainly, growing up here as an immigrant i didnt know english. My whole family was low income. And never would we have thought we would have had the opportunity to citizenship and certainly to have the opportunity to serve my community in congress or to go to college and to graduate. To have those experiences, i remember being a young kid growing up in high school and even in college not knowing i would ever be as equal or accepted as everybody else because i was not a citizen. And so that opportunity to citizenship, that changed my life. That changed my life and changed my familys life. Theres so many kids in this country, so had families in this country that deserve that same opportunity. We have to get back to a place where we are a facing of immigrants. We should be uplifting and we should be a country when people seek asylum, we uplift people. Thats something we have lost along the way. Congressman, i thank you very much for being with us this morning. Its nice to meet you. You too. Thank you. Up next, theres No End In Sight to the humanitarian crisis at the border. I spoke with a group helping migrants here in miami about the huge number of migrants arriing to florida. Youre watching jose diazbalart reports. Reat wchin diazbalart reports. Osevere ec. He fled cuba through nicaragua crossing the southern border in march. He says the hardest parts of his journey were crossing the rio grand and through mexico where he faced extortions. The last fiscal year there was an increase of almost 640 from migrants caught by the u. S. Coast guard in florida. Its estimated theres been 200,000 in miami last year. Yesterday we saw 150 people at this site alone. People are coming in because theyre not given any information about how their case is going to be handled. How would you describe the process in the last year and a half for people . I think in all honesty we have to characterize the process as confusing. Not people centered. And incredibly lengthy. Joining us now allen orr, an immigration attorney and former president of the American Immigration lawyers association. Good to see you. This is a reality, apparently. The fact is that almost every state is a border state now in many ways in if our country. And were hearing from folks who say its chaotic, the system is overwhelmed. How do you describe the system . How can the system be streamlined . I think Congress Needs to act to fund to streamline the system and upgrade the fundamental under currents of the system and that will change everything. But we need to understand that parol, the president s new program is not asylum and asylum doesnt require a sponsor. What does that mean . So that means that were asking people fleeing for their lives the only reason we care about you is if we have a sponsor, thats not what we decide was the law in 1942 and carried through since 44. So under asylum rules someone does not need a sponsor to save their lives or be covered under the asylum laws, which the u. N. Basically said yesterday. So the fact is under this program only the people who have someone here in the united states, with money, can even dream of asking for asylum. Thats exactly right. Its parole, so understand this Parole Program lasts for two years and then these individuals become like daca, the way fair of congress to decide if they have a pathway to citizenship or a green card or be returned home. So its not a fix, its a bandaid. 500 people arriving in florida where there are 21 Million People and 1. 3 million cubans is not an emergency. Democratic congressman henry quavar of texas told us this week the Biden Administration needs to listen to authorities not just activists. I saw you react, what did you mean . There are macro issues and micro issues. El paso did an amazing job meeting the need and getting the funding from the government. El paso saw people arrive every day and didnt do a State Of Emergency until several months into that. So instead of treating people like a problem, we treat them like the humans they are. But at least we feed them and clothe them if were capable of doing that which we are. Understanding he has immediate needs in the state, theres a large issue that needs to be addressed as well. You can listen to both sides because fixing the Micro Problem is the macro problem. If Congress Changes our Immigration Laws and regulations to meet the needs it would be solved. Using a system requires you to have a computer and phone and sponsor, thats a high level request for people that might not have power. Allen orr thank you for being with us. Appreciate it.
