Reporter erika, good morning, now the aunt and mother of this teenage murder suspect were here at the round house earlier this morning. They tell me this 15 year old turned himself in overnight. Now they want to issue apology to the victims family. You have my deepest condolances, and this was never meant to happen. I cant imagine how you guys feel. We apologize for everything. A message from one family to another. The aunt of tyfine hamilton speaking exclusively to Eyewitness News outside police head quart et cetera shortly after she says the 15 year old murder suspect turned himself into police. Investigators say hamilton was the triggerman in that deadly shooting of an overbrook father who was out walking his dog last week. Hamiltons aunt says she doesnt know what happened with the 15 year old that night, but says he wasnt in his right mind. When he was involved i just know he was off his medication. Hamilton along with 15 year old Hamilton Smith and 14 year old all play basketball before they decided to rob someone. Their Victim Police say 51 year old james stole man. Please, dont shoot me, please, dont shoot me, and they still shot him one time. Police say they tracked the trio down with the help of Surveillance Video and announced arrest of two suspect thursday. Investigators say the 14 year old is cooperating and being charged with robbery as a juvenile, smith is being charged as an adult with murder and robbery. Hamiltons mother and aunt were with the teen as he turned himself in overnight. He hasnt been taking his medication, and it is not right, you know, what happened. Stoleman leaves behind young daughter. Police say he told her it was too late for her to go on that walk last week. Investigators say, a woman flagged down officers at 22nd and allegheny after seeing a man caring a shotgun. Once officers saw man fitting the deaths script sean, they drew their weapons told that man to drop his. When he didnt, they fired a shot, but that suspect was not hit. The male raised the gun pointed it at both of these uniform officers, thats when one of the officers, one of the officers, fired his weapon. Suspect then dropped the weapon and fled from police. Police caught a suspect short time later after he reportedly hid inside a bar. They say he did not fire his weapon. Well, Eyewitness News cameras were rolling when this melee broke out inside a town hall meeting on approving police and community relations, when the dust settled ten people were escorted out in handicuffs. That fire started in the first floor of a home in the 2200 block of south warn okay street around 11 00 last night. This may be a suspicious fire because we have located multiple points of fire in the dwelling. We had the fire marshall on scene investigate having the fire. At this time we dont actually have a cause. The victim is a man. He was found in one of the second floor bedrooms. The home did not have any working smoke detectors the cause of the fire has not yet been determined. A fire in the germantown neighborhood of philadelphia sent one woman to the hospital with severe burns. It broke out on the eighth floor after highrise in the 6,000 block of morris street. The injured woman is in stable condition. But about 60 of her body burned. Sort residents allowed back inside with the exception of the unit directly surrounding the damaged apartment. This all happened just blocks from where officer Robert Wilson was killed on march 5th. And investigators say the origin of this deadly south philadelphia fire is suspicious. When a parent has to burr a child it is senseless. But in this situation december the 15th, around 2 45 in the morning, Police Officers pull over a car that didnt have his lights on. They were on the stop, talk to the man. One officer later saw that the gentleman had a gun lodged between the console and the front passenger seat. They tried to get him out of the car ran out trying to get the gun, he was shot. The question for me, what happened was a tragedy but it wasnt criminal. I have to determine that what the Police Officer did, i have to show beyond a reasonable doubt, what did he was unreasonable in thinking that he had to use that force to protect himself other officers or the civilians. There were three civilians there. So my decision was based on the evidence, based on witnesses of civilians that had three different points, 15 feet away watching there is and dna. The dna unfortunately of Blanton Tate Brown was unfortunately for him and those that went to protest his dna was on the handgun that he was trying to get and had been stole friend South Carolina it was a 22 caliber tower ills, fully loaded. I will be the first one to tell you that the criminal Justice System historically hasnt always been fair. Racism does exist. I understand. This was something that didnt have to happen. He do have just surrendered to the police. But instead he was trying to get his gun. Why would he be doing . Ill let you figure that out. But the Police Officers acted in the way we want them to tact. It is very sad. Often see the police are have to make decisions, split seconds we just saw two weeks ago, the dangers they face when sergeant Robert Wilson the third was murdered in a hail of bullets, at the game stop, 22nd and lehigh.
