What does he think about religious freedom for muslims, what does he think about whether the laws should generally make exceptions on the basis of religion or should more or less apply the same rules to everybody. Reporter gorsuch also wrote a book that criticized assisted suicide, which is legal in some states now raising questions about the balance between state rights and the constitution. He has questioned the scope of the executive branch. He has written a bit about that. At the time at leastconservatives were very pleased because he said courts carefully scrutinize. As for another hot button issue, abortion. There is legal issue records on where judge gorsuch stands on that issue. His defenders will say gorsuch is independent minded, but doubters point to trumps pro life promises. They have voted for change and they voted for the economy and for jobs and this is not that. Debora villalon in San Francisco tonight. Thanks, deb. Today San Francisco became the first city in the country to sue President Trump over his order to withhold funding from sanctuary cities. People rallied on the steps of city hall today supporting the lawsuit. As a sanctuary city, San Francisco could stand to lose as much as 1. 2 billion in federal funding. The City Attorney Dennis Herrera says the executive order is not only unconstitutional, but says it is unamerican. He says the lawsuit is necessary to protect citizens from the, overreach of a president. He also said a recent Supreme Court ruling will help support his case. As recently as 2012 the Supreme Court in a case involving the Affordable Care act said the federal government cant put a financial gun to the head of local and state governments. Everybody is shocked and going nuts, you know, get over it, get used to it. It will be that be like that for at least four years. The San Francisco Republican Party says President Trump is in charge now and only doing what he promised to do when he was out on the campaign trail. Two additional states are suing the Trump Administration over the executive order restricting refugees and immigration. Massachusetts has announced legal challenges to President Trumps order. Shoppers were escorted out of the building and bombsniffing dogs were called in. People were told to stay away until the all clear was given at 6 00 tonight. The threat was unfounded. Now to hayward where a search is underway about an inmate who escaped custody today. Henry lee tells us it happened while deputies from kentucky were driving the the prisoner to the airport for extradition. Center it had is is a picture of the escaped inmate. He was wanted in kentucky for fraud and Identity Theft arrested for dui by the chp in hayward earlier this month. Today Sheriff Deputies from boone county, kentucky picked him up at santa rita jail in dublin headed for sfo, but their rental car got stuck in photographic near the eighth street offramp in hayward. While they were on i80 this morning, traffic was at a standstill. That suspect jumped out of the back of the rental car they had and escaped on the freeway. He was last seen going on the freeway southbound. It is is unclear if the back doors of the rental car were properly locked or not. The inmate was still in handcuffs when he escaped. Alameda county deputies converged on the area, but they could not find him. I reached out to the boone county kentucky Sheriffs Office asking what happened and what precautions they took. The deputies hadnt been fully interviewed, but in a statement he said, we as a department want to thank the california authorities for their Quick Response and for launching the intense man hunt. Additionally we regret any inconvenience this has caused any of the people in the hayward area. There are protocols in place and things you are to do. But right now that will be up to kentucky officials to deal with. That is not our issue. Our issue right now is the recapture of this escapee. Reporter the defenses opening statement, attorneys for antonin garciatorres raising doubt sierra lamar was murdered, chipping away from the prosecutions case. It is clear from this case the battleground will be the dna evidence. What the defense did today is to suggest it was contaminated at the outset. Reporter the defense questioning dna testing results claiming investigators didnt follow protocol when handling evidence, including a backpack with the 15yearolds clothing. Prosecutors said had Garcia Torres dna. The defense arguing the backpack was dumped on an unsanitary card board surface. As for the rope in his car the defense saying when first photographed by authorities that rope didnt have hair. The reflected beads found on the jeans, questioning why no beads were found in his trunk. If they can suggest the dna is not properly analyzed, it wasnt properly collected. If it is not reliable, that completely undermines the case where there is no crime scene and no body. Reporter the defense attacking charges garciatorres tried to kidnap three women back in 2009. Prosecutors say garciatorres fingerprints were found on a stun gun battery from one attack. The defense arguing Garcia Torres worked at safeway and handled batteries. Again one person living on the sailboat got a real scare. The fire broke out on a power boat just before 6 00 this morning. The man was found asleep forced to paddle away. He told us he knew he had just seconds to get out. I just woke up to a big loud bang, a boom. It was right next to me and i knew it was pretty serious. When i opened my eyes i could see the big blow in my window. And then more crackling, popping. Three boats were completely engulfed on fire. Flames were up 30 to 40 feet high. You could feel the feet from 100 feet away. Initial reports of the man living on one of the power boats was missing, but turned out he had just gone to work. No one injured. He says it has been a long district. Hes been a refuge to newcomers, not only providing jobs and the housing for the Transgender Community, but for immigrants as well. The history of the tenderloin is is going to be commemorated and will also be a living thriving cultural district and not just back on the wall. Reporter replacing these buildings in the 900 walls of the tenderloin district, this a hotel and condominium complex, which will transform years of urban blight into the nations first transgender cultural district. Supervisor jane kim announced the legislative package tonight. Im excited for the first time ever. As far as we know in the world that we are commemorating a social cultural district for our transgender and nongender conforming community. Weather that community will cover six blocks on market and two blocks of sixth street. The project barely got underground when they learned these buildings were about to be torn down without preserving the history of the neighborhood. That is when the District Coalition stepped in. The very first pieces of lbgt and the civil rights uprising happened in the tenderloin with the Transgender Community. The Historic District gets their name from the cafeteria rights in 1966. Jane compton owned this cafeteria, a Gathering Place for the Transgender Community. Staff called the police to crack down. Because cross dressing was illegal at the time, police raided the business. A deal struck with the developer and the city preserved that history bringing out much more. Housing jobs and the community center, you know, down the line all these things. Reporter during the hotel a condominium complex was no easy task. But the supervisor kim says they had to move forward for many different reasons. Its great for San Francisco. Im so proud to be a part of the sanctuary city. But if people cant afford to live in San Francisco, then it is a step forward. Reporter some in the neighborhood remained skeptical. I mean i welcome the fact that were providing a space for the Transgender Community, more open and accepting space for anyone to be honest. But also mixed emotions because it just depends if it is going to dislocate people who live in the neighborhood. Then that might be something we should think about. The bay area Quality Management district has declared a spare the air alert tomorrow. The areas expect today be unhealthy especially with those with respiratory problems. That means all indoor and outdoor banning is prohibited unless it is your only source of heat. The spare the air alert is the 7th so far this winter season and the second this week. Reporter its too early to call the idea of the Las Vegas Raiders dead in the water, but another major obstacle surfaced today in the plan by mark davis to have a 2 billion stadium built there. Yesterday casino mogul Sheldon Adelson who had committed to roughly a third of the stadiums financing pulled out of the deal. The raiders had said they had backup financing in the event if that happened. That financing was to be provided by the Goldman Sachs group. Today comes word Goldman Sachs commitment was contingent on adelsons involvement in the project. That leaves at best a 600 million hole in the deal. Additionally the climate in las vegas may have been poisoned. Adelson used his considerable influence with the Nevada Legislature to get 750 million of public money committed to the deal. John rolston is the editor of nevada independent who wrote a column yesterday detailing the break downs of negotiations between adelson and davis. After Goldman Sachs and the raiders went to the nfl and it was announced Goldman Sachs was going to finance this deal even if adelson got out he was not thrilled with that. It made bad negotiations worse. The goldman folks realizing where their bread was really buttered went to adelson this morning and said dont worry well get through. Reporter in addition to understanding the relationship with Goldman Sachs, davis may also have underestimated the influence of major casino owners have over the las vegas political scene. Adelson is known as a guy who was a very, very tough guy, doesnt like to lose, has been known to think if he is wrong to sue. So we will see how angry he really is. He has a lot of political crowds here. He owns a major newspaper. So if he is really mad were going to find out pretty quickly. Reporter further complicating the deal for davis is a group of Nevada Legislatures who arent very happy. They look pretty foolish right now. They have egg on their face. The board of trustees for Californias University has scheduled to vote in march on a possible tuition hike. Itd be the first increase in six years. It would affect all 23 csu campuses. They told the board today if the money is needed to accommodate the record high enrollment. The university is looking to hire more faculty and create more classes. State funding could leave no option, but they call it a last resort. The proposed hike would increase the current undergrad situation by 207 for the 2018 school year. If you have not signed up, the deadline is just hours away. The States Health Exchange Program faces an uncertain future with President Trump calling for a repeal of the Affordable Care act. But the director says anyone who starts the application before midnight can get coverage for all of this year. Reporter interstate 980 in oakland a twomile stretch that connects i880 with highway 24. Many areas in North Oakland say it disconnects them from the rest of the city especially downtown. It is like were many jail. It just feels like you are not a part of oakland. Reporter that is a key reason in a National Nonprofit organization has placed them on the top ten list of freeways that should be torn down. Even oaklands mayor is no fan of it. 980 was a built as an entry to a second bay bridge. It never got built. What it has done, it has created what i call a mote, you know, a vision. Reporter a group to connect oakland has been advocating for the removal for several years. The group says a boulevard could go in its place perhaps with bart running underneath. You can actually use it in a much more efficient manner. All while still connecting that neighborhood that has been separated for so long. Reporter removing tree weights is not new to the bay area. For example when they destroyed the cyprus freeway, the mandela parkway took its place. Center people could have better access to job opportunities, to create opportunities for businesses, affordable housing, open space. To complain about 980 even in the traffic snow of the bay area it is underutilized. 980 runs at about 42 capacity according to one study. Some residents told us they find 980 to be convenient and worry about more traffic removing it would require traffic in Environmental Impact studies that no doubt Numerous Community meetings. Still. If they rerouted or something, we would still like a whole community to be open rather than the division. Reporter getting ready of 980 isnt something that would happen any time soon. An investigation is underway in the north bay after a woman injured in the car crash says she was kidnapped by the driver. The Highway Patrol says 54year old Douglas Stevenson of antioch was speeding and driving under the influence on northbound highway 101 in sonoma county. They say he lost control near castania road and crashed at about 12 30 this morning. The woman passenger told officers she did not know the driver and was forced into his car against her will outside a San Francisco homeless shelter. Some residents called in the sound of the crash and they heard a woman yelling the driver at the time of the crash walked away from the scene, he was detained at the crossing. The woman was taken to the hospital with broken bones and lacerations. Stevenson was arrested on suspicion of dui and kidnapping. You can get fog. Thats what will happen tonight. Temperatures are obviously the temperature, right . And then the dew point is the actual temperature. Dew point temperatures most bay area locations are found in the mid to upper 30s. If your temperature gets to 38 it needs to reach its dew point. You get fog.
