You have to wait more time. Reporter after a texas judge blocks the start of a plan that would have granted legal status to millions of undocumented immigrants allowing them to get drivers licenses, and work permits. I disagree with the texas judges rulings and the white house will appeal. Reporter the judge ruled the president did not have the authority. Once the president s action, this genie would be impossible to put back into the bottle. It would also allow parents whos children are u. S. Citizens to defer deportation and seek benefits. It does leave people in limbo. The people where the president promised them, if you sign up for this program youre not going to have to worry about deportation, theyre going to have to worry a little longer. Reporter supporters are confident the reform will move forward. I think it provides one more avenue from which to scam the community. Because they can say, give me a little bit more money and i will get you an application or i will slide it in the back door. Reporter organizers say Santa Clara County has the Third Largest immigration number with more than 110,000 of them that would qualify under the president 110,000 of them that would qualify under the president s plan. A man is now behind bars in connection with the burglary and the death of an alleged accomplice. Police arrested tyler richard. He was taken into custody after police found Michael Thorton a the scene of the crime. It happened at chiropractic college. Authorities found a damaged truck that was damaged when they tried to burglarize the school. Thornton died of blunt force trauma. Were learning more about a father and son who lost their lives when their canoe capsized. They had gone fishing north of sfo with the younger mans girlfriend. The young woman is the only person who survived. Reporter the bay draws fishermen of all kinds to its shore and deep into its waters. Monday afternoon, three people set off from oyster point in their canoe only one made it back alive. We bare heavy hearts right now. Our thoughts and prayers go out to the family. Reporter just before 9 00 this morning the coast guard found the body of 22yearold luis rubalcaba. Overnight they launched a search for rubalcaba and larissa castaneda, the sole survivor. She told her sister the boot took in water. They couldnt get back on the boat. Thats all she remembers. Reporter castaneda is in the hospital lucky to be alive. There were reports that they heard cries for help. Reporter the older rubalcaba was found half an hour later and died at the hospital. Thats terrible. Very sad. Reporter al salchi owned the waterfront restaurant in San Francisco where the elder rubalcaba work in the kitchen for the last year. Theres a lot of grief. When you work with somebody and you enjoy having them around you for eight hours a day, its a big difference. Reporter what a difference a day has made in the lives of two families. Everybody is devastated right now. And really upset and sad. You know. Its very sad what happened. Reporter the three were wearing life vests but it wasnt enough. Were learning more about a Police Shooting in oakland of a man who officers say was armed with a gun. Authorities released this picture of a gun today. They said the man was holding it in the a threatening manner when the officer opened fire. He was hospitalized in critical condition. Relatives have identified him as 29yearold cory power the father of three. Police say powers mother had called for help saying her son had bipolar disorder and wanted to commit suicide by Getting Police officers to shoot him. One of the officers fired after they said pollock launched at his mother and officers. Police plan to release more information in the coming days. And from san jose we obtained this Surveillance Video of a robbery at a liquor store that led to a Security Guard being shot and killed. You see a man walk into the store, grab a box of cigars, stumble and run away. About a minute later a shot is visible in the upper right hand corner. The store owner says he thinks that is one of the shots that rang out outside. Friends say zuniga didnt have to help but thats the kind of guy he was. At this point, no arrests have been made. A woman in her 20s who was shot during an Armed Robbery at a little cesars pizza restaurant in el cerrito is home from the hospital. Police are looking for help identifying the people who shot her. Officers released this Surveillance Video of the crime. It happened at 8 20 last night. You can see the man holding a gun. This picture was one of six surveillance cameras all pointed toward the cash register. While the cameras dont show the robbers faces the weapon is clearly visible in the video. If you have seen that weapon in the possession of someone you know. Its not a very common firearm. We believe if someone has recognized it. They may be able to help us solve the crime of whoever did this. Reporter the gun looks to be a break action pistol or shortened shotgun, says police. It captured their attention because its not typically the type of gun used in a robbery. Its the new hot topic for lawmakers and regulators. What to do about drones. Through makers at the state capital said our laws in particular are laws not keeping up with our technology. Ken pritchett is live with how this may change. Also in San Francisco, police say they are increasing patrols at dolores park after vandals caused tens of thousands of dollars. The vandals hot wired a construction cart and did donuts on a newly sodded field. They also damaged a newly placed irrigation system and lit a campfire to make s mores. Need less to say, park workers are not happy. We want people to enjoy it but dont trash it. Dont vandalize it. Dont demolish it. Dont disrespect it. Reporter the city plans to remove plastic sheets that cover a chain linked fence to make it easier to see if anybody is causing trouble. Police in San Francisco are asking for a couples help asking for help to find an elderly man. He was last seen on february 11th, he is described as black and has white hair and a gold front tooth. He stands 510 tall and weighs 180 pounds. Investigators say smart is not familiar with San Francisco and has medical issues that could cause him to become disoriented. Calfire is getting ready for an early fire season by launching an aggressive hiring campaign. Azenith smith went to calfire headquarters where hundreds showed up hoping to be hired. If it looks anything like last year i would say yes its going to be a very active year. Reporter active given the combination of warm sunny days. Possibly ignite larger drier field. Calfire says a dry spring also means fires could spark sooner ahead of the typical fire season that starts in april. Statewide weve had 160 fires already since the first of the year. Typically were looking at half of that normally. Reporter thats why calfire started interviewing 300 firefighter candidate candidates a few weeks sooner than normal. A competitive process, calfire says to ensure they hire quality firefighters. Every fire season they say its going to be the worse fire season of all time. So i guess well see. Reporter calfire plans to hire 100 new firefighters, 20 of them here in the bay area. They hope to have these firefighters trained and ready to go by the beginning of may. Theres no rain in the five day forecast this week. You can kind of see the fall footprint here. This is all the coastal stuff thats pushed inland. We have the valley fog trying to form right now and the two shall merge. It set us up with a pattern that we kind of had this morning that is kind of her kind of murky and cool. All right, only a few places cooled off today. You can see the coastal fog. Theres the valley fog. And they merge up. This pattern is often tough to break up. We didnt have really horrible visibilities today but it was slow to burn off. Watch what the model does. 6 00a. M. , 7 00, 8 00. It burns off pretty quick. By lunchtime looks most of the fog will be gone. Highs tomorrow will warm just a few degree. Mid50s, maybe some upper 60s. Maybe low 70s south toward morgan hill as well. When i come back. The video shows burglars arriving in a van outside an audio store on moffet boulevard on february 9. They break the door with a sledge hammer. Pull apart several display cases and steal equipment. Several people drove by that store during the robbery. They want to hear from anyone who may have seen the van or the burglars. A student at Santa Clara University is behind bars tonight. Hes accused of stabbing his roommate several times at their on campus. They arrested dillan kim this afternoon. They say the victim is suffering from several knife wounds but is expected to recover. Kim is also being treated for selfinflicted wounds. Its unclear at this point what led up to the incident. Kim is due in court for arraignment on thursday in santa clara. A Major Development in an unusual case involving a Police Officer in the east bay. A prostitute in reno and the officers gun. Shortly after the department of labor issued a statement saying american businesses have millions of billions of the dollars at stake and quote secretary perez stressed that its imperative that the two sides come to an agreement to prevent further damage to our economy. Harley shaken says that the secretary of labor could make a big difference. Hes a labor attorney whos been in tough negotiations before. So hes going to bring the power of his office, the power of the president. And some real skills to reach some compromise. The compromise has been sitting for years without a compromise. The Sticking Point is arbitrators. Theyre like judges during the life of the contract interpreting differences between management and labor. Jana, thank you. Attorneys for former state senator leland yee are asking for more time to prepare before his case goes to trial in june. The San Francisco democrat is facing federal corruption and racketeering charges. Yee was forced to withdraw his bid for secretary of state after his arrest last year. Hes accused of accepting bribes in exchange for political favors. Attorney james lacer filed papers asking that the trial be pushed back to midaugust. San Jose International Airport is looking at several options to improve security following a number of security breeches in the last year. A man scaled a fence at about midnight on january 29th. Ive already got fog pretty much in all bay area counties and that fog is going to spread its way into the Central Valley. Here you can see these dark edges. Its not real dense. The fog is not right down on the deck. But theres high clouds spreading into vallejo and up into the davis area now. And those are coming from the valley and from the coast. So these winds blowing on shore they had been blowing offshore right. So the winds were coming northeast. Now theyre coming out of the west. That is with transporting all that moist cool air inland. And i guess its better for air quality right. You get air quality out of this and its going to help out with people who have been suffering with hay fever and allergies a little bit. Dry pattern continues as we head into the bay area weekend. So its just more of the same. Heres the model. Theres all that fog. It will burn off more rapidly as we see here. Youre going to see a warmer day tomorrow. In oakland you will find temperatures in the upper 50s. You start off the morning cloudy. Youre partly cloudy by lunchtime and late in the day you get mostly sunny. 2 00 or 3 00 you get mostly sunny. San francisco is cloudy all morning and 1 00 or 2 00 you see more sunshine. Thats the way its going to go tomorrow. 67 in santa rosa. Warmer tomorrow by five to 8 degrees. 69 in livermore and 69 in gilmore. Youre going to see fog and sun tomorrow. Less of it thursday and friday as the winds start to come the other way a little bit and temperatures start to come up a bit. Youre looking at temperatures back in the low 70s for the bay area weekend. Right now theres a chance for showers as we head down toward late in the weekend and early or pardon me late next week and early into next weekend. Hopefully that transpires.
