Bike shop across the street from me when he heard the crash and came out. Around 3 00, 3 30ish or so i heard a loud thud and knew something happened that was not good. Park managers says he saw two badly damaged vehicles across the road in an empty field. He says he drove toward the white toyota and saw the driver getting out. I said where are you going. He said i want to go and get police. I said youre not going any where. Reporter a coworker and a customer helped him keep the driver of the white vehicle on the scene. He was identified as james toliver. He was struggling a bit. Reporter the driver was unconscious and died at the hospital. The passenger was on the floor of the vehicle bleeding. Firefighters had to use the jaws of life to get out the two men. It appears toliver was drunk and speeding when he hit the white nissan who was trying to get away from the accident scene. As you can see right here the red paint. Also you have the scuff marks. People say you dont walk away instinctively you dont do that. Reporter the two people in the red nissan have not yet been identified. The passenger underwent surgery tonight and were told hes in serious condition. Drunk driving is such a serious problem. Its interesting because you and your photographer saw what appeared to be a drunk driving on your way to cover this story. We were driving on interstate 80 when my photographer mendoza saw a vehicle almost hit us from behind. He started weaving in front of us and we call 911. They told us he is now in jail. Tonight two people are dead after a car drove on to a sidewalk. It happened just after 8 00 at 2nd street and north gate. Heres a live look now at the scene. We want to show you the damaged car, that white crown vic. The victims were sleeping on a mattress beneath an underpath when they were struck by a vehicle that went up on to the sidewalk. Police confirmed the victim or transients one died at the scene. The other died at the hospital. They say the driver did stop and is now cooperating with police. But up first, republicans in congress challenging the president on Immigration Reform. And we talked to a law professor to find out if the president s executive actions are pressing the limits of the law. A legal debate is brewing over whether the executive actions on immigration taken by president obama today are lawful. Jana katsuyama has been tracking down the facts and she joins us now live from uc berkeleys law school. Reporter julie, the gop is considering whether to sue president obama over his immigration actions and they are accusing him of overreaching his executive authority. So tonight we consulted with the legal expert to figure out exactly where the constitution draws the line. President obama appeared at a Las Vegas High School before a latino rally. The president s executive actions signed on rout to nevada raise a question on how far executive powers can legally reach. At the center of the controversy is his plan to defer deportation for up to 5 million immigrants. Mostly children brought to the u. S. President obama says he is using executive authority because House Republicans stalledded the Immigration Law bill that passed the senate over a year ago. The only thing thats standing in the way is a simple yes or no vote. Reporter Republican Leaders who will take control, says the president s use of executive powers is unconstitutional. We will not stand idle as the president under mines rules of law. The actions im taking are not only lawful but they are the type of moves used by former president s for the last century. Reporter uc berkeley law professor connell says that legal opinion does site previous executive action by president reagan and george w. Bush deferring deportation of immigrants. Actions which drew no congressional objects and set a president. The statutes from congress do give the president in a variety of circumstances discretion in terms of enforcement and thats what president obama is relying on. Reporter and the gop is showing theyre not afraid to take president obama to court. They filed a lawsuit, House Republicans did just today accusing the president of overreaching his executive authority in the Affordable Care act. So well see if they follow suit with another lawsuit against the president on this immigration issue. A long way to go on this issue. Jana, thank you. Parishioners at a monthly mass for Immigration Reform say they are being cautiously optimistic about the president s authority. Members of San Franciscos church said they welcome the president s announcement but they are still going to keep fighting for relief for all immigrants. This is just the beginning and we need to fight for a broader inclusion relief. Reporter the obligation process for president obamas plan to defer deportations will likely start next spring. The new leader of the California State Senate layed off thousands of employees today. Senate president de leon blames budget control. He had no choice but eliminate 40 positions to save money as part of a reorganization. The lay offs include staffers involved with policy research and workers in the Office Services department. More jobs are expected to be eliminated through attrition. New information now about a threat that shut down a high school in santa cruz. Police say they are now looking at a trail of tweets and e mails from someone who claims to be responsible and also wants to apologize. Ann rubin has the story. Reporter his threats to santa cruz for days, but he is now releasing an apology. Steven baxter says hes been communicating with someone who takes responsibility for the threats. The information that he did it for a sick thrill but that he meant no harm. This person did send apology e mails to officers and the school so they cant say for sure hes the suspect. We cant rule it out. But i cant validate this is the actual person. Reporter the person claims to be a 16yearold honor student with an interest in technology. Someone who sames someone who says hes never even seen a gun. If all of the information in the tweets is true, that really helps us narrow the field. Reporter police have interviews two persons of interest. So they say theyre pursuing other leads now. In the meantime students and their families are trying to focus on school. People are feeling like really scared. It concerns me a lot that were living in the unknown really. Were going to do it in an aggressive way because they failed to take advantage of the opportunity to peacefully turn themselves in. A 4foot high wall of mud and debris slid down from an area that burned in a wildfire last january. The mud got into one home, four others were damaged. An alert had been issued for possible flooding and slides because vegetation on the hills had not yet grown back enough to keep all the soil in place. Work began on one of the most famous hills in San Francisco in hopes of keeping history from repeating itself. Crews are stabilizing the cliff below coit tower. Over the next six months they plan to remove lose rock, install 30foot anchors into the cliffs face. Huge boulders came down in january of 2012 and there have been other similar slides in the past. Caltrans says it cant control the weather thats the explanation for why there was flooding in the bay bridge tunnel during yesterdays rainstorm. A ktvu crew shot this video showing all that water in the eastbound lanes in the tunnel that caused long back ups for the evening commute. Caltrans says heavy rain between 6 00 and 8 00 last night is to blame. We cant control Mother Nature. So if there is a significant downpour in a very quick period of time, we cant absolutely be sure as to what that amount of rain will do. Reporter caltrans says by the time crews got there the water had subsided and they say they checked to make sure everything was draining properly. Crews say they did clear a build up of dirt and pine needles near yerba buena island. The European Union is about to call for the break up or unbundling of google. A nonbinding resolution would call for google to split its Search Engine from the rest of its website. Many are concerned that Google Searchs favor googles own interest. Google is also under fire for its policy and tax policies. Google executives are reported to be furious about this resolution. Angler fish are among the rarest of all sea creatures. The Monterey Bay Aquarium posted a picture of the fish to its facebook page. Look at the jaw there. It drew such an overwhelming response they made a video about the fish then posted it to you tube. Angler fish are also known as the black sea devil.
