Its a tragic. Its a loss for the community. Reporter yesterday the 41 yearold barbecue chef came to his old North Oakland neighborhood for a third consecutive weekend. He was here to cook and sell his popular ribs and other dishes. In the front yard of a friends home. His fiance says eric a caterer was trying to make some extra money for their wedding next year. Eric was a spiritual and loving person as he loved family, he loved to cook. He just loved to rejoice for everybody. Reporter his fiance says the shooting happened shortly after 7 00 p. M. As they have packed up their cooking ewe tinsels and utensils. Six shots rang out. They say that it was to get his attention and then after that they started shooting. Reporter the shooter did not demand money, nor did he take anything from them and she does not know why anyone would want to hurt him. That the shooter was on foot and got in to a car after the shooting. She called 911. I feel cheated, i feel loss. I feel anger, emotion, sadness. I lost my best friend. So i dont know how im going to cope with that. Reporter she said yesterday was a good day with family and friends to support their new business until the shooting. And they will pay. Today Governor Brown promoted the ballot measure at Sanford University saying more money needs to be invested over the next two decades to address the states water challenges. Officials are investigating three fatal crashes where the metal flew out of the air bags. Ranging from their 2000 to 2011 models. We called the federal agency, learning that ford, acura, chrysler, subaru are also impacted. Consumer advocates estimate they could end up affecting 25 million vehicles in the u. S. Thats terrible. Tonight were learning more about a man who was hit and killed bay car this morning while crossing the street right in front of his home in San Francisco. And that we would need to start with two cars. And police are also investigating two other crashes that critically injured someone and another at turk where a hit and run driver injured a man and a woman and then took off. They may have come up with a plan to deal with those steel plates that caused an epic traffic backup last friday morning. They also decided to pull the plates, but they still need to replace the expansion joints that they were recovering. Details expected tomorrow, but they report that they plan to use some temporary paving, smoothing out the approach to the edges of the steel plates, building sort of the mini ramp to ease the vehicles up and onto the plates. A Memorial Service will be scheduled for tomorrow to honor the cal fire pilot who died recently when they crashed near the yosemite. Jeffrey craig hunt was 62 years old. The service was out for 10 00 tomorrow morning at church on the hill in san jose. Officials say hunt was killed when one of the wings of his air tanker apparently clipped a tree. He was helping to fight the dog at that time. And a fallen war hero from the bay area will finally be buried in oakland 70 years after dying. He was a Fighter Pilot in world war ii when he was shot down in 1944 and the plane was never found until two years ago. For they tell us the story of the lieutenant william cook and how his plane and his remains were finally discovered. Reporter he was only 27 years old with plans of becoming a surgeon when his plane was shot down. And now 70 years later, the lieutenant could finally be laid to rest in that east bay where he grew up. I wish that my parents and grandparents could be here that it would mean the world for them. Reporter they grew up in this house in the 1930s, graduating from Alameda High School where he played scrooge in the play. He was the golden boy. And they got married in 1944 as the airman was sent out on the mission during the battle of the bulge, flying a twin engine with five other crewmen. There were some 27 planes that left belgium to destroy a bridge over the river which was the main artery of transport for german munitions and troops. Reporter the plane crashed near the woods of belgium remaining there undetected for 68 years. This is a military i. D. Today oakland city leaders announced that the new non profit is going to continue to work on their wildfire Prevention Assessment district. They fell 56 votes short last year, first created after the 1991 fire storm where more than 3,000 homes were lost and 25 people were killed when the fire that crews thought was out reignited. And there was fire on both sides of the road as they jumped up highway 24 burning on the other side of the lake. It is really hard to believe that the fire actually ever happened. Reporter the group says the key goal is to educate those that have moved in to the area since the fire, creating the defensive space around your home. It is easy, so why not. Last week they announced they received a permit to operate the first Ride Sharing Company to ink that deal. Those that use the Services Download the Smart Phone App to connect with drives until now that they were banned from the airport with police issuing a number of the citations. Traditional taxi and Limo Services fear that it would further cut into their bottom line. We are talking about kids in some cases that would need to rewrite and speak english just as well as many of their classmates. Whether the motivation is extra funding or just bureaucracy, that they found that they were lumped into a program with other children. I have never been so embarrassed in my entire life. Her mom asked us not to show her face. But all you have to do is just listen. And then someone started pounding on the bathroom door. Reporter somehow this 9 yearold fourth grader is considered an english learner, someone that needs help according to the unified school district. It is a label that her mother has been fighting for years. I feel like a hostage to the system. Because you really dont have an out once they are labeled, theyre labeled. Reporter this mom says it started with one answer on a Home Language survey before her two kids entered kindergarten. They asked if there saw second language, so if there is a second language, so we marked spanish. And their scores just low enough to qualify this brother and sister as English Learners. They found more than 93 of students who took the test had the same outcome. It makes me very furious. Reporter they are retested every year, but in the eyes of the state, they are still not as proficient even though that english is the only language they speak. How is your spanish . Well, i barely know anything. Reporter this girls School Assignments in english have come back with as, even a pluses, but take a look at her latest progress report. Down on the side her primary language is listed as spanish. And despite her parents objections. As a parent you feel disrespected like you have no rights. What are your thoughts that someone like that is labeled as an english learner . That happens a lot. Reporter lisa garcia, co authored a study that found School Districts were misidentifying large numbers of students as English Learners. Disturbing thing we found though that once a student gets triggered to take the test that it is very unlikely that the student is going to be found to be english proficient. Whats going on here . Follow the money. Districts receive 5 for every student tested. They received almost 54,000 last year. But 10,700 students tested ranked only behind San Francisco and oakland unify in the bay area. The district wants to do what is best for their student. And english language developed in its structure is important. Reporter but they offered us the districts director of communications. Saying that money isnt the issue. Does the district think they might be identifying too many kids as English Learners . That is something that the district doesnt have too much control over. Do districts have some control over what happens here . The district have quite a bit of control. It starts with relying more than a Home Language survey and getting input from parents before deciding which children to test. And an opportunity that this mother says that she did not receive. It is not right or ethical and it shouldnt happen. Reporter the states own study found a large number of englishonly students entering kindergarten would not be considered proficient either according to that self test. The test is being overhauled, developing their own master plan to try to better identify which students should be English Learners at the end of the day. What can parents do if they dont want their kids to take the test . The first thing to do is to speak up. However once they have identified a student as a possible english learner the law says that they cannot opt out of that state test. So believe it or not some parents are simply choosing not to tell districts if there is a second language spoken at the home to avoid getting to that point.
