We are on Bentley Ridge drive, where San Jose Police say the accident occurred. With the permission of the homeowner we can show you the accident scene here where there is still evidence of the single car collision. Police say smith was the driver and the only occupant in the accident that took place at 7 00 this morning. The homeowner says the driver hit a tree and then hit the curb and ended up as you can see stuck on the driveway and lawn. She says she did not recognize smith but said the driver seemed asleep until a neighbor knocked on the car window. Working and then when the neighbor knocked the door wake him up and he turn off then in. So the driver looked like he was sleep at the wheel . I think so because the car is stopped, the engine is come out, smoke is come out but he didnt know. Now denton says the driver smith did not seem to be disoriented when talking with officers, the Sheriffs Department says he was already arrested for possession of marijuana, 49ers are monitoring the situation and may have comment later. Police are investigating a shooting outside a courthouse in pittsburgh, someone fired a single shot after 7 30 this morning there. The bullet did not hit anyone but a window was damaged, Pittsburgh Police dont know who or what the intended target was and so far no one has been arrested. A San Francisco man had a rude awaking this morning after a Bank Robbery Suspect crashed through the ceiling of his apartment. Police have identified the suspect as 33yearold John Franklin of San Francisco. They say he was going rooftop to rooftop to get away from officers after he had allegedly tried to use a crowbar to break into an atm at a nearby bank of america, police used a Fire Department ladder truck to help track him down. He was hiding and we werent eventually able to detect where he was hiding and as we gave him orders to give up the roof gave way and he fell through. He was arrested and did not appear to be hurt. New information at noon on an Early Morning south bay house fire. Police are now investigating after firefighters say they discovered about 70 Marijuana Plants inside the home on wigham court there. Firefighters arrived at 5 30 this morning to find a pile of garbage burning in one of the bedrooms. Police are trying to determine if the owner is responsible or if it was a renter. It doesnt appear to be sophisticated, however, there were plants inside so we are going to go ahead and seize those plants and book them into evidence. Neighbors say a marijuana grow operation was discovered at this same house several years ago. The cause is not yet known but firefighters are looking at the electrical wiring. The clock ticks toward another possible bart strike, there are now less than three weeks before the end of the coolingoff period ordered by governor brown, we have new information on the training underway in preparation for another possible strike. As we first reported on last nights 10 00 news bart managers are getting familiar with trains they may soon be driving. Today ktvus Claudine Wong got a first look at the facility being used for the training and new details on the type of training those managers are getting. Reporter this morning all was quiet there but outside we saw bart vehicles and inside there was a bart train. Those cars critical to training that we have learned have been underway for days. So it is sitting on top of a trailer, you can bring people in and have them check the train out and what do you do in this scenario, but absolutely no real power, no tracks no driving the train, nothing like that. A critical point because union rules prohibit nonunion employees from operateing a train while actually powered up on the tracks, those rules are enforce unless workers go on strike, so all of this training is in preparation for a possibility, but the plans and the training is ruffling featers. You javiers of experience dealing with all kind of situation that arise, so it is not just what you read in a book, you cant learn to play babble by reading a book. Bart says 12 managers are already certified to operate trains they as well as other nonunion employees considered veteran and or likely candidates are right now going through this off track training. But before the none certificated employees can actually operate a train they will need a lot more, the standard course is now about 15 weeks long. All this would simply be a lifeline. Consider the numbers, at the peak of the commute there are usually 56 trains running, with only 12 certificated drivers right now at most 12 trains could run. Keep in mind this is all just a contingency plan, even the bart managers who are certificated train operators could not operator them unless the board of directors votes on it and approves it. And no request has been made for a vote yet. They will probably seek their approval before a strike i would assume.
