7 00 this Tuesday Morning, august 22nd. Im gasia mikaelian. And good morning. Im dave clark. Lets talk about our weather. You saw clouds coming in. For sure. As you came in this morning. Steve paulson is right here. A lot coming across from the sierra. Also a little earthquake there. Not everybody felt it. From about pacifica, daly city, parts of the city. Not so much in marin county. There is also low clouds in place. I felt it in San Francisco haze valley at 6 35. A lightly sharp jolt. It looks like if it wasnt on the san andreas, it was on the san gorgonioa fault. Kathy known as the napa valley chick, gorgeous sunrise in napa this morning. After yesterdays foggy, foggy day. Right back into napa county. That is the source of that. That is coming in from east actually east southeast and heading north. Head bay and areas up to the north. Some of that has produced light rain up into lake county. Underneath is the fog bank. Yesterday it never burned off for some up around santa rosa. It did on the peninsula in the south bay. It was a strange pattern yesterday. Over the sierra, continues to be a lot of cloud cover. Just like that, the delta breeze is cranked up and awake. Gusts up to 25. Very quiet this morning. 50s and 60s here. Temperatures similar to yesterday. We will see the fog burn off sooner for some. Might hold on for a little bit. It varies to the north, coming around the low, sending the cloud cover off of the sierra. 80s for those away from the coast. Alex, you have been issue. An issue on the bay bridge. Is that better now. There is a crash unfortunately. So all of the folks trying to get across the toll plaza and across the bay bridge have to get past a hit and run accident. I will give you details in a moment. I want talk about getting over into the area. This will be the ride trying to get out of walnut creek. If youre in that part of the east bay, it is a slow ride on this part of highway 24 in the westbound direction. But it eventually frees up once you get a little bit closer to the tunnel. Now, further west from there, this is a live look at the macarthur maze. You can see that we now have a backup that extend through the mazon to interstate 80 in the westbound direction there. And we are also showing the chp is showing on their maps, they are showing a hit and run crash that is just east of the toll plaza there. So they are investigating. You may see some officers on the side of the road. So that could sort of compound the problems here. A pretty significant backup getting into San Francisco. And finally i will get you a look here at the situation in the south bay. Not much better there. Because we still have showing a crash northbound 101 at oakland road. That is just before the 880 interchange. And you can see a pretty solid backup northbound on 101. And we have several miles of backup in that area. If there is any way to get around that part of the south bay commute, i would suggest maybe choosing an alternate freeway. 7 04 is the time right now. Back to the desk. Thank you, alex. The National Park service may announce today whether or not it will grant a permit for a right wing rally in San Francisco. Two hours from now, east bay leaders will gather and condemn a right wing event in berkeley. Allie rasmus is in berkeley now. A lot of people are worried these two rallies could cause problems. Alley. Al allie. Reporter yes. Youre seeing response from both sides. The leaders who will be meeting here in berkeley at 9 00 are describing it as a way to condemn bigotry in the east bay. They will be talking about a rally that is supposed to happen on sunday in berkeley. You will recall that Berkeley Civic Center park has been the scene of clashes before. In april, fights broke out between people who supported and opposed President Trump. 20 people were arrested that day. 11 people injured. Now there are renewed concerns about the potential for violence on both sides. A right wing group called for a Patriot Prayer rale nissan fran to be held this saturday at chrissy field. They issued a permit to hold the rally. The National Park service was urged to revoke the permit. We remain opposed to the National Park service issuing this permit to the Patriot Prayer group along with their friends. We think it is ill advised. We dont believe theyre ready. Reporter even if a final permit is not granted, there is concern that the right wing group will show autopsy at chrissy crissy field on saturday. They have made every officer to work that available. In the meantime, San Francisco city leaders have planned counter events for saturday to promote peace and tolerance. The first will be held at noon at city hall. The day of the event on saturday, they will have a block party to counter act that right wing rally. Were hoping to learn this morning from berkeley and east bay city leaders if they plan to have similar counter protest events to promote peace and tolerance like they are doing in San Francisco. We hope to get more information from the News Conference that is scheduled at 9 00 a. M. It included a swastika and a drawing of a muslim woman and there was a message of hate. The neighbor who found them found the flyers on the sidewalk near his home at two different times. He says he doesnt consider himself the target, but called the police because he was alarmed. Alarmed. That symbol, that swastika has such connotations. I mean, it is aligned with nazi ism. It is a truly evil group of people doing truly evil things. Detectives want to know if the flyers are connected to the vandalism at a jewish temple last week. The six of them were looking down as they saw the moons shadow over the united states. The shadow is in the middle of your screen. The view had some of the crew members surprised and all were feeling lucky to see it from above. Just a few hundred years ago, human beings wouldnt have known that the eclipse was coming. Youre looking up and the sun is disappearing. And what are the thoughts for all of human existence where everybody is looking up saying the gods must be angry at us. Now we have the ability to not only know it is coming but people travel to be under the umbra and make it an event, a celestial event. For us to be able to witness it from above was really special. It represented how far we have come with the technology that we have. Were on the International Space station. At one point photographers watched the International Space station pass the sun. The result for us is clouds and rain. There has been some up into lake county. Around east bay and napa and lake county and mendocino county. Yesterday and last night it was focused on areas to the south. Even though the fog cleared out much sooner than for others. You see good thunderstorm activity. It continues to filter in off of the low off of Southern California. There are possibilities today. I would say lake county, napa, possibility of an isolated shower or two. The moisture streaming around that low. As long as the low is here, it will be here for a day or two. We have a pattern where were stuck. But it has disrupted the fog bank for some, not all. You get some of that cloud cover and it might be on the muggy side for a few. Temperatures will bump up for some that were held in check by the fog. Temperatures have been a little below average for the fall. They will go above average by the end of the weekend. Thanks, steve. You bet. Brandnew to the south bay but already sparking controversy. Speaking of, on the santa cruz coast and mountains yesterday at this time they were socked up to the summit. It is circling the wagons. It is trying but it will retreat quick here. Morgan hill and gilroy and san jose which had an early burn off yesterday. That helped some by 10 00 from san jose up to sfo. The fog retreating a bit. It hasnt necessarily been that weve had an unusually high number of crashes. Its just been a lot more people on the roads. It is very clear, summer break has come to an end. Folks are heading back to work and back to school. We know this is the case. When you see the car, the traffic on the roadways, you know it is true. Im going to take you outside and show you this is a live look at the san mateo bridge. And we are seeing very slow traffic westbound all the way across the span. And it is because of an earlier crash that was westbound on highway 92 in the foster city area. It looks like chp has it out of the way. It is out of the lanes. Really the damage is done here and a lot of folks sitting in this mess as they try to get over towards the peninsula. Lets go to the east bay now. And i will show you a live look at some slow traffic, especially northbound coming up past oracle arena on 880. Slow from 238 into the downtown oakland area this morning. As i put up the maps here, i will show you that 880 is a tough ride. 580, if youre trying to use 580 westbound, it is not much better in terms of an option. Very slow traffic from san leandro west all the way over to the downtown oakland area. And finally here, i will also show you that we still have a very slow commute on westbound highway 4 coming up out of the pittsburgh bay point area into concord. 8 32 is the time. Mike, back over to you. Thank you, alex. The nfls regular season is about to get underway. The 49ers may have a different battle off the field this season. Rob malcolm is joining us live from santa clara. This is about a recent audit done. Reporter yeah. Thats right. Its been a bitter relationship since levis stadium was built three years ago between the 49ers and the city. According to the audit released yesterday, the 49ers owe them about 115,000. And it goes much deeper than that. They are looking for transparency and to fix what they called a broken relationship. So here is a breakdown. The city is looking to be reimbursed for the staffing of police and firefighters during stadium event. That bill as i said could be higher to the mayor, lisa gillmor. The 49ers owed the city 2 million in unpaid parking fees, and city staff time. The 49ers say this is a pr stunt to make the headlines and the city simply failed to bill 115,000 in expenses. And we talked with the mayor this morning and she broke down the numbers. About a million eight and a half. There is about 900,000 that should be used to pay down the debt service. That has to be repaid. Over 700,000 is owed because the 49ers used our golf course for parking. And the third year was not paid. That has to be repaid. During the audit period, there were 230,000 in unreimbursed staff costs during the audit period. After that, the audit period, it looks like about 100,000 was repaid. So we will have to verify how that was repaid to make sure it was done properly. Reporter and back here live, a beautiful stadium but not without his headaches. They stand by the findings in the audit which which the way cost the city 200 which, by the way, cost the city 200,000. They say if the 49ers do not produce the documents needed, they will pursue legal action. Thank you, rob. Turner is the former Stanford University athlete who served three months in jail after being convicted of sexually assaulting a woman three years ago. Jessie is joining us live in san jose with more on the story. Good morning. Reporter good morning. Right now attorneys representing the attorney general are waiting in the hallway inside of the old courthouse here in san jose getting ready to file papers that will try to block the judges lawsuit against the committee trying to remove him from office. Im joined by Michelle Dauber who heads the effort to remove the judge. From what i understand, this is maybe a little bit of a slowdown tactic. It could have adverse effects. Yes . Yes. Absolutely. Judge persky hired Donald Trumps Arizona State chair to run his campaign. Everything that you need to know good b. Judge perskys attitude against women and Sexual Assault is summed up in the fact that he is working with the trump campaign. This is a classic move out of the trump play book to file a frivolous lawsuit to zap resources and it wont work. You are trying to raise 96,000 signatures in Santa Clara Valley to have him removed from the ben how does the paperwork impact that . As i said, judge persky filed a frivolous lawsuit after the county approved our petition last week. Right now the attorney general, the secretary of state, the register tar of voter registrar of voters agree with us and think that the signature drive should go forward. We have the right under the First Amendment to collect the signatures. This injunction that the judge has obtained is a violation of our First Amendment rights. It is an insult to the voters of the county. If the injunction is not upheld, the signature collection moves forward. Yes . Absolutely. If it is upheld,. Then were going to the appeals court. Judge persky wants to tie us in court and prevent us from collecting signatures. He knows he will not win this election if it goes to the voters. Speaking of tying you up in court, from what i understand, the judges in Santa Clara County has rescued themselves from hearing the case. Once the paperwork is filed, which judge would it go before. Yes, the judges in Santa Clara County have all properly recused themselves because they are judge perskys coworkers. So that has created additional complications. And, you know, this is a classic trump move, to go to court, to file frivolous lawsuits, to try to tie up the other side in paperwork. Its not going to work. We are going to go forward.
