Janine is live where happened. And we understand that you are not from far from a school . Reporter yes, its actually right across the street from Christa Mcauliffe school. It is right here just off of prospect road. The principal who is just saw says that the school will remain open. They are just trying to figure out how to get access to get them inside of the school. Right now, they are still inside of a home collecting evidence. Authorities are not saying much but we know that deputies were called to titus avenue just before 8 pm. For unknown reasons, the deputy opened fire on a person inside of the home. They are not saying the circumstances of the shooting. The condition of the suspect has not been released, but we are being told that no officers were hurt. They came up and they just stopped here in the neighborhood and you start thinking whats going on . Thats when we saw all of the cars along the street and two ambulances. My wife and i came out and we saw someone being taken out on a stretcher. Reporter we are told that the deputy who opened fire is a veteran of the department. Their name has not been released. It is normal protocol to have that deputy be interviewed on what happened, and to be put on leave. This is the first officer involved shooting for the Sheriffs Department this year. We do have a spokesperson from the Sheriffs Department on the scene, and they are waiting to get an update from detectives. We are hoping to get an update on the condition of the person who was shot and hopefully, details about what sparked this whole thing. Thank you. Just hours ago, just before 1 am there was an earthquake in piedmont. So far, we have no reports of damage but a lot of people called us here at ktvu or reached out on social media. They recorded a magnitude 3. 5 quake just east of piedmont at 12 50 am. You may have felt it. The map shows the seismic activity was mainly and Alameda County. Police are investigating three separate Sexual Assaults at a weekend concert. It happened during the soldout Block Party Saturday night. In the first case they say in 18 girl student met a man in line for a portal potty inside she later and said that he assaulted her. The salts are disappointing, but shes not surprised the assaults are disappointing, but she is not surprised. Everyone is taking substances, it is crowded, its easier to get away with it. A lot of that stuff would go unnoticed. Police say during larger even when people are drinking a lot of alcohol Sexual Assault are not uncommon. They are looking into those attacks. So far they say there are no similarities other than the happened at that concert. The attacker in the second case is latino, 21, 57 tall with a medium build so far there is no description on the third attacker. Happening now, a group of female janitors are continuing a Hunger Strike trying to get governor. Jerry brown to sign legislation that can protect them from rape. The 18 women involved begin their strike yesterday began their strike yesterday. They will only be Drinking Water as they bring awareness of Sexual Assault during the late night jobs. They have been victims of rape or Sexual Assault by men who do the same job. It has happened at late nights and empty holdings. And one of them includes requiring reservations or selling tickets. Charging tolls to both pedestrians and drivers. And restricting access to the seat street. And, possible using rideshare to take people down lombard and a car or using control officers. Its not just the crowd, some tell me that vandalism, car breakins, trash and even drones are becoming a much bigger nuisance. And a lot of people have been complaining about that. And then we go to the south they were all of that traffic is slow. And, we have had some so traffic and is always crowded but all you had to do was mix and a couple of sprinkles. Lets go back to that cast. They beat the la rams last night, 28 to nothing its all about defense and rushing right there. And they ran for 88 yards, they had two touchdowns and a 49ers defense had two interceptions. The quarterback was 22 of 35 he had an 8 yard touchdown pass and early in the fourth quarter, they only had two penalties in the whole game. There are a lot of things that they need to build on. Now Colin Kaepernicks controversial protest started during the preseason as he tried to draw attention. And, despite the backlash that he faced, initially his protest clearly is spreading during the first weekend of the nfl regular season. We have seen a number of players kneeling are raising their fists. So a lot of those players are following his lead. Yes, and it says something, the niners did well last night. Yes. As a footnote. Absolutely. Its for all these nfl games. And Something Else to point out, is that the players that are taking the stand are doing so at the risk of losing endorsement deals we have all ready seen that in one case a dental bronc desha Denver Broncos player who lost to endorsement deals after he knelt in the National Anthem. There were reports that some Police Officers would not work at levi stadium because of the protest. The Police Officers association sent a letter to the 49ers saying his comment were insulting and that the pig police socks that he was wearing were derogatory. And, they say that there were no problems getting officers for security duty. Response has been fabulous. And, a lot of people have gotten those staffing events. We did ask, but they said for security reasons he could not say how many officers were at the games. There are not enough Police Officers that will volunteer to work again. Police on security details inasmuch is 65 an hour. The stadium pays that money off the city of santa clara. For the first time, the father every threeyearold boy killed in an alleged dui crash is speaking out. The teenager at the center of a sex scandal could return to the bay area. The 19yearold who goes by the name the last is currently celeste is currently in jail. A Prosecutor Says that she has been offered a plea deal. And, have not said if they will accept the offer. And she is the key witness in the case of seven current or former local officers who Face Criminal Charges in an Alameda County sex scandal. New this morning the annual College Rankings from the news and world report are out now. Several bay area schools made that list. It names princeton as the top, harvards number two, there is a tie between yale and the university of chicago. And, stanford is tied with columbia for fifth. And uc berkeley ranks 20th overall. Now, on the regional risk list, santa clara is number two in the west. Mills college is number five, st. Marys is number nine. And san jose state and sonoma state both made the top 10 best public universities in the west. A lot to be proud of. We have just confirmed a person who was shot has died. A Program Designed to help the homeless find work is expanding and San Francisco. The program called the downtown streets team launched and San Francisco civic center earlier this year. It extends to union square on thursday and the objective here is to help the homeless ease back into the workforce. And, they work in teams cleaning up the street and they get 140 a week for food and clothing along with Case Management and Employment Services. I tried to stay hidden, like invisible. I didnt tell anyone that i was homeless. It was a lonely way to be. We also focus on rebuilding selfconfidence and dignity because when that is rebuild then people flourish. It was founded in palo alto by the former ceo of master. They say that the program has transformed 1000 people into fulltime jobs or stable housing. You will see that the traffic here is backed up as you drive, its about a 25 minute delay. The east bay, i would call it the main part, because this is where the traffic is. That is where all of the action is. You have a lot of slow traffic here as you drive through the area. 580 is also slow. And, all the way up to oakland 880 s. Has some so traffic here. And, the entire commute here has been fun. I want to show you something i noticed, it used to be that fremont traffic would get better by about stephenson. Well now, you have an extra one or 2 miles of traffic going all the way down past the auto plant to almost 237 that has become kind of a normal occurrence. Lets bring stephen. Cambria park is getting some reports. And snow in the sierra tahoe. And National Weather service and they said if you are seeking out like us over this great snow. I am. This is great for september. I have been board for four months. They say, wipers are on full from Scotts Valley to los gatos. I know that. 05 has been reported at the summit. And thats the worst thing about a commute is when you are driving and it takes you a certain amount of time every day and then, you get something that throw that out. Throws that out. If that is your commute, add extra time. We begin with an officer involved shooting. They confirmed that the person who was shot has died. Janine is joining us live outside of that home. And, what are officials telling you right now . Reporter well, they are saying that the reason why they initially came to the neighborhood, was because that they were called to do a welfare check on a man who lives in one of these homes. Its just off the prospect road. They said that relatives were worried about somebody here and there was some sort of competition that happened between this man and police. And now the crime scene unit was here and they have been here for 12 hours. Lets go to some video that we took earlier in the night. They say that they arrived at the home on titus avenue near prospect last night. And they knocked on the door and they searched, and they did that for about 15 minutes because they 50 minutes because they were worried. They said the man finally appeared and heres what happened next. The suspect had a firearm in his hand. The deputies gave him several verbal commands and, a deputy shot the individual. He was later transported to a hospital and pronounced deceased. Reporter no officers were injured during the confrontation or that shooting. It is unknown at this time, as far as if there was an exchange of gunfire at the suspect actually fired at the deputies. We know that it is just one deputy that was involved. And we are told that he is a veteran with the department he is on paid leave because they are doing investigation. We do not have an identity on the suspect yet and it is unknown if it is the same person that the Sheriffs Department was initially called on to do that welfare check. We asked was this man who is involved under the influence of drugs or alcohol or was there some sort of Mental Illness and the spokesperson said we do not know yet. We are in the beginning of the investigation. I do want to mention, that this scene is just across the street from the kindergarten through eighth grade. They are still open. Classes start at 8 30 am. They wanted to get that message out even though they are deputies investigating, they will be open. Thank you. Viewers from from San Francisco reported feeling and overnight earthquake that was centered near piedmont. They recorded that earthquake just east of piedmont that hit at 12 50 am. They show the seismic activity was mainly in Alameda County. The was called us immediately saying that they felt the ground shaking. Here are some of their responses. I wish they wouldnt show him as much as they do. I dont know why they do it. Personally, i think that they should show other people who are representing our country more. Because it is a very complex issue but there is a lot of injury and death that results from what i believe an overabundance of firearms that can be found in peoples homes, garages, things of that nature and we need to try to do something since on the National Level nothing is being done and what we do is put out an effort to get people to think about what they have in their homes and keep them away from our kids, grandchildren, lets try to keep them out of homes because, often times they are not secured properly. And, it just becomes a very high danger risk. So, can you tell me about, were looking at video from those buyback before. How successful was it for you guys . Actually, it was more successful than we thought it was going to be. We had 856 firearms during that program. Those were both operable and interoperable weapons. We had semiautomatic assault weapons, types turned in during that program as well as thousands of rounds of ammunition. So, we felt that that did make some type of a showing that we could in fact do something to affect the gun violence. So, if it so successful why not do it every year . Well, i think as you know, realistically, if you keep repeating things over and over again are not going to get i think the same type of feedback that we got when we did it at the last time. And it is also an issue of you know, having to have funds to do this and be careful and marshall are funds carefully. How do you respond to critics who say that such gun buyback are just not taking the guns out of hand of people who would use them in a criminal way . Well, that is the criticism that you will hear. I am not naove enough to think that i will stop gun violence. Again, that has to be dealt with in a very complex and a national way. Not just any regionally. But nothing is happening there. So i think that it is symbolic and i think that it is important when we do have at the local level, the means to do something that we should step up into something and not ignore that problem. And what we want is just reasonable regulation. Were not trying to repeal the second amendment. So when you say that you dont think that they are doing their job . The call caltrans truck is there but that vehicle is unmovable and traffic is coming to a standstill until you approach that solid vehicle.
