Happening today a concord teacher who is accused of child molestation is due back in court for his retrial. Joseph martin is talking to the media about his case. Tara moriarty is joining us live from the courthouse with his exclusive jailhouse interview. Reporter martin says now martin has been in jail for about a year and a half. We spoke to him a couple days ago. He did appear relaxed and confident. Did you ever mom lest any of these students . Absolutely, never at all, whatsoever. Reporter the 46yearold spent nearly two decades teaching in concord until his arrest last year. That is when a former fifth Grade Student accused him of molestation. Martin taught at wood side elementary. The initial complaint was just a misconstrued affection which i do in front of my whole class. Which consists of pats on the shoulder, or hugs that are given to students if they are comfortable with that. Reporter martin initially faced 150 counts involving 14 boys. His Attorney Says prosecutors told him 73 of the 95 outstanding counts are expected to be dismissed today. That means 22 counts will remain. His first trial ended in august. The jury acquitted him of charges involving three students. Jurors were split on the other counts. A bay area native who sparked a National Debate about the right to die has taken her own life. 29yearold Brittany Maynard who was facing a terminal illness died over the weekend. Alex savidge is live in our newsroom with more on how maynards life ended on her own terms. Reporter maynard fulfilled her final wish surrounded by friends and family at her home in portland, oregon. She moved there from california because oregon is one of just a handful of states that allows terminally ill patients to end their lives with drugs prescribed by a doctor. I cant even tell you the amount of relief it provides me to know that i dont have to die the way that its been described to me. Reporter diagnosissed with an inoperatable brain tumor, maynard decided november 1st was the day she would take her life. Maynard became the face of the death with dignity movement. She says she died peacefully on saturday after taking a fatal dose of medication that was given to her several months ago. After her diagnosis she spent her months traveling to alaska and the grand canyon. Her family describes her as independent and determined which is why she planned how it would end. I will die upstairs in my bedroom that i share with my husband. With my mother and my husband by my side and pass peacefully with music that i like in the background. Reporter maynard grew up here in california and attended uc irvine but she moved to oregon after being diagnosissed with terminal brain cancer. Oregon has a death with dignity law while california does not. Right now there is a push to get a similar law passed here in california. Similar efforts though in this state have failed numerous times over the past 2425 years. Also new this morning just hours ago a burning garage in concord forced a family out of their home. It happened at about 3 30 this morning on san carlos avenue near clayton road. This photo of the garage was tweeted by one of the Contra Costa County Fire Department members. Three people lived in the home. No one was hurt. Investigators are still searching for the cause of this fire. Time is 5 06. A chp officer accused of sharing nude photos taken off the cell phones of women that he arrested. He is expected to turn himself in this morning at the detention facility in martinez. Officer shawn hairington has and reportedly there may be a third accuser. Prosecutors are investigating all of his traffic stops for more incidents. Danny oliver and Placer County sheriffs detective Michael Davis junior were both killed october 24th during a shooting rampage. Many who attended the fundraiser they just wanted to show their support for the families of those two officers. People care here and its just that you know our hearts go out to the family and to be here with them and to show us our love and support is very important. Now the service for Deputy Oliver is today 10 00 a. M. At the Adventure Christian Church in roseville. Services for detective david will be the the same church tomorrow. The new bay bridge project will likely end up with a 35 million deficit or more. Projects manager says that there is still plenty of unbudgeted work that needs to be done on the new span and tearing down the old bridge could cost much more than originally estimated. Cal tran says it is shifting money from other bridge projects to make up the difference. Earlier it had predicted that the massive project would cost less than the budgeted 6. 4 billion. The ntsb is slowly piecing together what may have caused Virgin Galactic to break midnight. Investigators say the ship has tail booms known as feathers which are meant to create drag when the ship is re when the ship is reentering the atmosphere. The copilot unlocked the system but the second step occurred on its own. It was not necessarily the cause of the crash and that the investigation could take up to a year. Four crab fishermen were killed off the coast over the weekend. Two men from bodega bay and an identified woman all died after the boat capsized. A fifth man survived and recovering. The coast guard says they were not wearing life jackets but professional fishermen say that is pretty common since life jackets can get in the way of fishing. Family members of the fishermen killed say they are beginning the process of planning memorial services. Time is 5 34. This morning Oakland Police investigating the latest homicide in a very violent weekend in the city. It happened late yesterday near a Catholic Middle School on tenth street. Not far from interstate 880. Is a 54yearold man was fatally shot. At this point we have no information on suspects or a possible motive. Another person was killed and three others wounded in separate shootings during one five hour period late saturday night and early saturday morning. Still no word of arrests in any of these shootings. Duopeople were two people were taken to the hospital after a Hazardous Materials team was called to a San Francisco neighborhood. The Fire Department says two people were taken to the hospital as a precaution but no one was seriously hurt. Dispatchers did not have information on what prompted the hazmat team to respond. A pleasant surprise for bay area drivers. Gas prices are down. I mean way down over the past month. People we have been speaking to are pleased. It costs you 2. 97 a gallon here if you pay cash. And there is another gas station on the same street. Where gas is selling for 2. 90 a gallon for regular unleaded. The National Average for a gallon is below 3. The first time in four years. Several reasons behind it a drop in oil prices, drillers are tapping new sources of oil in the u. S. , and americans are driving more efficient vehicles. When they ordered her to surrender they say she drove off. She finally surrendered in South Danville after smashing head on into a patrol car. Officers say they found meth, syringers and stolen items in the car. Happening today the new World Trade Center tower is opening for business. More than 13 years after the september 11th attacks. The first group of Office Workers from the publishing giant they are move into the building today. One World Trade Center replaces the original World Trade Center towers.
