Reporter now in response to this study, the San Francisco Police Department said in a statement our officers charge individuals based on the elements of the crime present. The standard for an arrest is based upon probable cause. Because of these findings the public defender has decided to form a pretrial unit to examine cases early on in the process and figure out whether the charges are being brought is warranted.
