The public defender pointed the finger today at San Francisco police who initially recommend charges after an arrest and District Attorneys Office which decides whether to move forward with the case. Today the public defenderrers office looked at a case of Leslie Elliott charged with mayhem for spilling coffee on another woman during a dispute. Elliott who was facing serious prison time eventually was acquitted on that very serious charge. It was like nobody saw or evaluated the charges, once they put the mayhem on it no attorney, no da would negotiate or say anything reasonable. Leslie was just dubbed somebody who caused serious Bodily Injury so all the offers came in very high. Reporter now in response to this study, the San Francisco Police Department said in a statement our officers charge individuals based on the elements of the crime present. The standard for an arrest is based upon probable cause. Because of these findings the public defender has decided to form a pretrial unit to examine cases early on in the process and figure out whether the charges are being brought is warranted. There will be a joint task force set up including members of the das office and members of the San Francisco Police Department, they will work in tandem to address this dispairity.
