Including a text message september through a thirdparty app suggesting pictures from that night may have been taken on turners phone but no pictures were ever recovered. The documents also show turner had a prior arrest for underage drinking as well as an encounter with another woman who said she had an uncomfortable encounter with turn tear week before that assault. The documents also included pictures recovered from turners phone that appear to show him and his friends smoking marijuana. They also included Text Messages of turner talking about drug use and drinking while he was still in high school. Prosecutors used the evidence to try to contradict turners statement that the assault happened in part because of his inexperience with the College Party culture. And after his conviction the Deputy District Attorney pushed for a longer sentence saying, quote, they did not believe the story because his story was outrageous and was not supported by the plethora evidence of against him. They did not believe him because his story was a lie. That was a quote. New at 6 00, ktvus Cristina Rendon in the newsroom with the continued backlash that includes jurors refusing to serve in the courtroom of the judge who sentenced brock turner. Reporter thats right, frank. Judge perskys controversial sixmonth sentence for Sexual Assault has a lot of people fired up. The woman we spoke with said she didnt want her First Experience in jury duty to be with a judge she felt was dishonorable. She had no idea it wasnt until they said to please rise for the honorable judge aaron persky that it finally clicked that i was in his courthouse. Reporter persky is under a firestorm for sentencing brock turner to six months after he was convicted for sexually assaulting an unconscious woman. The maximum sentence was 14 years. It wasnt long before the woman told potential jurors he was recently part of a highprofile case. He said if there was anybody in the potential jury who had some feelings about him to raise their hand. Thats when i did it. It was like his tone. Reporter the 19yearold said she and four other people were required to give a reason for raising their hand. She says she told persky she didnt feel comfortable being in front of a judge who she thought favored turner instead of the victim in that unrelated case. And she told perski he made her blood boil. The fact that a judge decided to give the defendant who was a rapist, more feelings towards him and wanted him to be okay instead of the actual real victim, i think thats actually what made me speak out the most. Reporter she says persky remained calm, thanked potential jurors and dismissed them. She said she was so focused on persky being on the bench than the case she was supposed to be there. I was more focused on the fact that he was in his courtroom doing his thing as if nothing had happened. Reporter we reached out to a spokesperson for the Santa Clara Court to find out just how many people had been dismissed due to three feelings about persky but we have not received a call back. Cristina rendon, thank you. The growing demands to recall judge persky brought protesters to the state building in San Francisco today. They came to present the state council on Judicial Performance a petition with a million signatures including the names of 11 state lawmakers. Theyre calling for an investigation into the judge Aaron Perskys sixmonth jail sentence for brock turner. This case has ignited a spark that hat because of the powerful voice of the young survivor of a horrific attack who only wanted justice. The activists say they will also collect sings and file a separate petition in Santa Clara County for judge perskys recall. Now to new developments from the Oakland Police department as the mayor announces chief sean whent has been replaced. In a News Conference today mayor libby schaaf stressed this was the chiefs decision to step down. The sources are telling ktvu fox 2 that the chief was forced to quit, and Crime Reporter henry lee has been looking into this all day. Henry what did you find out . Julie, ive learned that it all came down to a rift between chief whent and the federal monitor overseeing reforms. The two started out on good terms but that all changed when the Oakland Police became involved in one scandal after another. Good morning, everyone. After three years as Oakland Police chief sean whent is out, and according to mayor libby schaaf it was whents choice. The chiefs resignation was a personal decision and i respect it tremendously. This is an incredibly difficult job for anyone and for their family. But multiple sources close to the department tell ktvu that whent was caught off guard, forced to resign over his handling of recent misconduct scandals involve off Duty Officers including allegations that some officers had improper sexual contact with the daughter of a police dispatcher. Sources also tell ktvu that whent had fallen out of favor with robert warsaw, the federal monitor overseeing is opd reforms. In fact, the federal judge was so angry over alleged irregularities in the internal affairs probe that he transferred that investigation over to warsaw, sources say. And from there heads quickly rolled. Four cops were put on lead two, resigned, including one who was investigated but never charged with trying to sexually assault that dispatchers daughter. And warsaw what didnt respond to requests for comment, certainly didnt fight to keep whent. Again, all of the decisions that were made in this matter were the chiefs and ours. The monitor has concurred with those decisions. Oakland city councilman reid says the mayor has had all wrong. Reid says he spoke to the chief after the decision. No, i dont think he is being forthright when he says the chief resigned. The chief was he wasnt happy. And if i was the chief, i wouldnt be happy, given that all the hard work of trying to bring this Police Department into compliance with the negotiated settlement agreement. I will reach out to him and congratulate him and thank him, but i want to kind of also get the, why did he leave so abruptly. I mean, you just dont get up and leave the next day. Reporter mayor schaaf did say shes been frustrated over the Sexual Misconduct allegations involving officers. One allegedly assaulted a woman while showing up drunk at the wrong house. Another officer is accused of pulling a gun on a painter in emeryville. I am extremely angry about the alleged misconduct in this department. So, chief whents resignation comes as the department is at a crossroads still struggling with court order reforms, young cops accused of misconduct, and it remains to be seen whether the department can find stability. Henry, were you able to talk to any Police Officers today . Oakland, when it comes to violent crime, appears to be turning a corner with the police here. What do officers think of this . Do they look at this as a set back or as, well, a new opportunity. I did talk to some line officers off the record, and theyre just day in and day out trying to do the best job they cap, frank, reducing crime, trying to respond to one call after another, and they just cant seem to get a break. The leader changes every so often, and morale is down. Theyre down officers. Just trying to catch up with all the calls. What can you tell us about the interim chief some.
