The yellow cab, it hit the side of the newspaper stand and then had it hit the shoe shine and then it hit the shoe shine stand and the pole went over. He went flying up the air. Of course his dad, he was still on the ground. He had a bunch of debris on top of him. Reporter she is just hoping and praying that those two people pull through. Theyre at the hospital right now. Also at the hospital is the taxicab driver. If you take another live look, i dont know if you can pan down to see it, but it is so sad to look at this as you can see the shoes lying on the sidewalk. You can see empty bottles of shoe shine polish as well. The shoe shine stand itself, it is just completely tilted over their side and that taxicab is completely ruined on the hood there. This must have been an intense crash as we dont know how fast that driver was speeding. Police have not said whether or not that speed was a factor or something that they will be looking into at this point and of course that we will try to find out more information about those three people and bring you an update as soon as we get it. Such a busy area in that time of the day. So did the woman say that 67 yearold man and the younger man who were hit and are now in critical condition, were they both working at that shoe shine stand . Reporter yeah, she says they were working at the shoe shine stand, they were standing nearby, but no customers were getting their shoes shined at that time. They were just standing nearby. Thankfully it was empty. Had there been other people getting their shoes shined we could have had more victims in this case. But the two shoe shine vendors and the taxicab driver, all three of them were in critical condition. Hopefully they will pull through as we will, of course, bring you an update. I know you have just gotten down there a short time ago. Were you able to learn more about that cab driver . Reporter we have not. We have tried to ask police for information about his age. We do appear to know that he works for yellow taxicab, but we dont know his age, we dont know his name, and we dont know where he was headed. We do know that no one was in the backseat. He was by himself. He wasnt transporting anyone. All right, cristina, we will let you work to get more information for us down there. Thanks very much. Well a mother and her two children were injured in a rollover accident in the vallejo area this morning. A white sedan hit another car, ran off of interstate 80 and flipped onto magazine street. The mother was taken to the hospital. The chp says that the baby in the car was injured, but was secured in a car seat. Another child was also hurt, but fortunately none of the injuries appears to be life threatening. We should know by friday whether the judge in the sierra lamar murder trial will move it out of santa clara county. A change of venue wrapped up today for the 25yearold antonin torres. The judge said that they would have a written decision by the end of the week. Torres is accused of kidnapping and killing this woman 15year old morgan, the 15yearold sierra lamar from morgan hill back in 2012 even though her body has never been found. Defense attorneys say more than 82 of perspective jurors in the south bay know about the case and that Garcia Torres wont get a fair trial unless it is moved out of the county. Well it sounds like something out of a movie. A phone call from a hidden number, your child on the other end screaming. But it is a scam and it is happening here in the bay area. A woman was the victim just a few days ago. Ktvu south bay reporter jesse gary is live now with more on what officials are calling virtual kidnapping. Jesse . Reporter julie, the fbi found sounded the alarm about this type of scam a little less than a year ago. In that time they have moved across the country like a virus from dc to texas, nevada, now here to california. And the Officials Say that in this state the crime usually involves some kind of a criminal tie to the organization down in mexico. That guy is trying to create new ways to get your money or sucker people, good people out of their hard earned money. He says that is exactly what happened to the resident a few days ago. That the unidentified woman received a call from the blocked number saying that her daughter was being held for ransom. The fema voice, which sounded like the victims daughter was in the background screaming for help. The woman was instructed to go to an area walmart and wire an undisclosed amount of cash from the bay area to mexico. During the time the male caller would continue to threaten the mother that her daughter would be harmed if she did not comply and the caller stayed on the phone the whole time. Then periodically the mother could hear a female screaming in the background. It wasnt until after the money was sent that the victim was told she was scammed. The daughter was fine at home in another state. In response to a rash of cases like this one, federal agents compiled a tip list for victims, including to try to slow down the situation and ask to speak to the presumed victim. Listen carefully to the kidnapped victims voice. Is it really your loved one . Try calling, texting, contacting the victim via social media to see if they are in danger. And couldnt challenge or argue with the unknown caller, remain calm and keep your voice low and steady. Somehow the suspects were able to have personal information about the daughter, about the mother, and to have somebody sound like her daughter. Reporter federal agents say that it was likely through the internet where they would put so much of their personal life through victories and videos. They say that the suspect likely found an accomplice that could imitate the victim of imitate the voice of the victims daughter. Police say if you are a victim of this kind of crime or if somebody supplies it on you that it does not work. Either way they would like to hear from you guys. And jesse, is there any way that they could get the money back that you said or in any way to at least try to track it . Well, the money is unfortunately gone, but once it is transferred from the bay area down to mexico that the person, they would take that money to control it a bit and that federal Officials Say it will be very difficult to give them hope that perhaps they could track to where the money was sent, wired down in mexico and maybe, just maybe that store has some kind of surveillance cameras to work it that way. But that these crooks, they would change their phones a lot and change their numbers to call it a blocked number where it will be very difficult to track them. All right jesse, thank you. Two young girls would die today after the track they were in crashed into the Russian River near jenner. Sky fox was over the river where the pickup truck was pulled out of the water. The two girls were just four and seven years old. They were riding to school with their mom this morning when their truck fish tailed going right into the river. Now here is where it happened on highway one right near jenner. The highway was closed in both directions for much of the day. Jenner is right along the coast there in sonoma county. Ktvu tom vacar is talking to chp about what happened here. Tom . Reporter well frank, ive covered a lot of stories, but they dont get any sadder than this. There is a way that it could have been prevented. Here is the story. Shortly after 8 00 this morning on a foggy and damp highway 1 beside the Russian River on the jenner coast, a pickup truck plunged 40 feet into highway 1 plunged 40 feet into the Russian River from highway 1. I said oh my goodness, there is a big boat in there. Then i looked again and said oh no its a car or a truck. Before i could recognize a boat or a truck, it went down. A bunch of bubbles came up to the surface and then a woman came up shortly after that screaming, my babies, my babies. Reporter the driver a jenner mother was able to get out of the vehicle, but two others were trapped and they could not. Divers recovered the girls bodies from the vehicle. The coroner was called to the scene. Officials closed highway 1 in both directions. A tow truck needing more than 330 feet of cable were called to the scene. We were looking at a tragic accident. When we got out there, we spoke to some witnesses that saw her driving maybe 25 to 30 miles per hour. It was just unusually slick conditions on highway 1 this morning. This small Seaside Community is in shock. We are very close, all of us. Those little girls play with my granddaughter. And they are all around. They were frolicking, playing yesterday. We are just going to circle around the family and do whatever we need to help them get through this. It is just a horrible tragedy. But again its the community that will come together. The one thing that could make all the difference in the world is not here, all along here there are no guardrails. I think that they need to put those barriers on that side all the way around. It makes no sense that they dont have barriers. Reporter one woman told us in recent years that there have been several river plungeddeaths as people fail to negotiate the unforgiving narrow road and these tall cliffs. Chp says they cannot and will not release the names of the victims until all the next of kin have been notified. That has yet to be done as everyone in the town of jenner is painfully aware of who is gone and what has happened. Tom vacar ktvu fox 2 news. Yeah tom it is interesting that you mentioned the guardrail. I have driven on that road before. The speeds quite honestly are 45, 50, 55 miles an hour. You make one small mistake and youre going right into that river. Is there any reason why there isnt a guardrail there . Reporter well i think one of the reasons is that on the weekend if you ever go up to jenner you notice all the people parked along the side of the road. The guardrail would take up a lot of space. But sometimes a tragedy like this is what gets it done. There are plenty of places along the ocean with no guardrails where you could plunge hundreds of feet. It just so happens that the tragic dent took place there. It happened so quickly and in deep enough water that they couldnt do anything about it. Kenny, we cannot begin to imagine what the mother and the rest of the family are going through. Tom vacar in runner park. Democratic president ial nominee Hillary Clinton arrived in the bay area today. She is set to appear at the fundraiser tonight in piedmont. Her website called the event a dinner conversation. The victims husband is accused of killing his wife. New tonight, what will impact any possible prison sentence. Also ahead it is probably not too surprising that the bay area city has the fastest rising rent and home prices in the country. But it may surprise you that the city is oakland. Coming up next, we take a look at the factors drawing so many people to this east bay city. Im tracking the weather out there. Another pretty cool day, right . A lot of fog out there. Tomorrow will be the warmest day of the week. Ill let you know how long it will be. Right now rent and home prices are rising faster in oakland than in any other u. S. City. Home prices in oakland, listen to this they have nearly tripled in the last five years. Ktvus Leigh Martinez looks at why so many people want to move to oakland despite all the long standing questions about crime and protests. Oakland has crimes and an embattled sex scandal in their Police Department. But people are fighting to live here. There is a bidding war depending on the property and the location. Reporter while their housing markets are cooling off, the east bay city is soaring and people are paying more than their listing price. And what i have been seeing is a 5 to 10 over the asking price depending on the property. Reporter visit oakland says that the citys appeal is obvious. You get more for your money and Better Weather than San Francisco. As we are standing out in the beautiful sunshine, thats the key. Thats not new. Weve had that for many years. The restaurants, the art scene, the lively music, the entertainment scene. We have the urban wine trail in oakland now. Reporter oakland realtors say that at any given time there are only a little more than 300 properties for sale in oakland. That means that when there are, they dont last for too long. Thats also making the market rough for renters. R. G. Wilkin has tried to find an apartment before his fall semester begins at cal. I still havent found a place. Me and my roommatestobe are on craigslist every day trying to find places. Im just living at my parents house. Reporter Bloomberg News reports that oaklands rent prices increased 15 . Now affordable rents go fast. Yes, they are there for an hour and gone. Reporter visit oakland says that the high housing cost comes with the citys renaissance. But unlike San Francisco, oakland has a plan for more housing. Oakland has very specific plans, impact fees that have been set. So when you are looking to build new projects, they know exactly what the price tag is to begin to make those long term plans to build those housing. Reporter in oakland Leigh Martinez ktvu fox 2 news. Oaklands mayor, they will be on mornings on 2 tomorrow to discuss their citys renaissance and also their concern that the rising housing crisis will make the city unaffordable for their long time residents. Here is a look at some of those home prices along the east bay according to altos research. The median price of the single home in berkeley is 995,500. In oakland it is 579,000. In san leandro, 588,500. In hayward, 624,500. More than 10,000 firefighters are working on wildfires up and down california. In san bernardino, they have 100 containment now on the blue cut fire that started one week ago today. The fire burned more than 36,000 acres, destroying 105 homes. The investigators are still trying to figure out what caused it. The soberanes fire burning north has burned 87,000 acres, destroys 57 homes. A bulldozer operator died fighting the fire. Four other peoples have been injured. Officials say that the wildfire was sparked by the illegal campfire on july 22. Tonight containment remains at 60 . The chimney fire continues to threaten the historic hurst castle. Right now nearly 1,900 structures are threatened. Seven air tankers, 17 helicopters, and 107 fire crews are battling the flames. The fire started august 13 and has burned more than 37,000 acres so far. Cal fire says it is 35 contained. Well lets bring in our chief meteorologist bill martin. Thank god they are keeping those flames away from the castle. Imagine that being destroyed. At last thought it was an hour and a half away. It is scary because so much history was made. As we talked about it before, its on a ridgeline as you never want to be on a ridgeline. Yes. If it is on a ridgeline, that would be bad. The firefighters down there, they have been to a lot of the southwest, but they are waiting for it to burn over the castle. They would need that north, northeast wind. Were not seeing that. We looked out over the last couple of days. The winds are forecasted to stay on the west southwesterly trajectory, which is good. And the country right now, they would get the heavy showers in the inner mountain region. Some lightning and thunder south in that four corners area, down through albuquerque and up through phoenix. Thats pretty typically for this time of the year and then up in minnesota by minneapolis right now, some pretty strong storms. Not severe yet, but it will be right on the edge of being severe. Travel plans tomorrow, they will include thundershowers across the middle mississippi and ohio valley. But the fog is at the coast. We knew that. Temperatures today about the same or a little warmer or it will be a few degrees cooler and warm nor some places as youll see what were talking about with the fog. Tomorrow will be the warmest day of the week with a little less fog tomorrow. You can see where all the fog is now with a bunch of it up there. There are the temperatures right now. 82 in livermore. Turns out thats five degrees warmer than yesterday at this time. But then look, santa rosa is 4 degrees cooler, 2 degrees cooler in napa. Five degrees warmer in san jose. Kind of splitting the difference, kind of a wash. But tomorrow i suspect all these inland numbers will be plus five. So we will see some upper 80s, maybe a couple of low 90s. The fog is deep about 2,000 feet. It is shooting over the city and on its way into the east bay. So the fog forecast for tomorrow morning is indicative of that as it stretches out. The fog bank and the marine layer, you can see how they are this morning. They will burn off in the order for the day for most of us the mid70s, the upper 70s in the warmest bay spots. Then youll find these 80s. We may find the lower 90s in eastern fairfield by vacaville and those areas. Tomorrow morning in San Francisco it will be cloudy. Itll clear off just a little bit. Partly sunny. Then there is your afternoon with the high of 65 degrees in San Francisco for the day time highs. 90 in antioch tomorrow. And your fiveday forecast tomorrow is the warmest day of the week. Good news though as the fire danger, i mean that it is nothing. That it is just great for us and it is like a spring forecast there. It is nothing in terms of heat and fire dangers. We will take a little break in terms of being on pins and needles, with no spare the air. Thanks, phil. The democrats say that Congress Needs to pass funding to fight the zika outbreak saying that it is already impacting tourism in the state. Still to come here hes accused of killing his wife inside their home in their exclusive neighborhood of the east bay area. Up next, what changed in the investigation to drop the possibility of the Death Penalty. Plus the search goes on for a new police chief in San Francisco. Coming up, top city officials are now denying accusations that this search is not legitimate or even rigged. Plus, criminal allegations against the company that operates several Charter Schools in the east bay. What they are accused of and what hundreds are parents are now deciding to do. So our Crime Reporter henry lee is here with updates on several stories. Henry, first we heard today from the woman in that police sex exploitation case involving several departments that she is now going to rehab . Reporter thats right. Celeste guap, thats her name, not her real name, but she is headed east to florida on friday. Now, celeste guap is a self described call girl at a center of a sex exploitation scandal. The woman confirmed in a text to me today that she will undergo treatment near west palm beach, florida for Substance Abuse and sex addiction. She also as that Richmond Police are paying for the rehab, but the department is not commenting. She told me today, im bettering myself. Now guap is the teenage sex worker who claims to have sex with Police Officers from alameda and contra costa sheriff offices. She turns 19 this month, but some of the alleged interaction happened while she was under age. Several officers involved in the case have resigned, but no criminal cases have been filed. I have so many questions here henry. First of all why would the richmond city, or the Richmond Police department, i know theyre not confirming this, but why would they pay for her to go to rehab and why would they pick a rehab center all the way in florida as opposed to one here in california . Reporter that is a good question. Celeste guap lives in richmond, i believe the city is treating her, considering her as a victim in need of help and in their words healing. Now it is unclear why not, you know, a rehab closer to here, closer to home. But by doing that, sending her to a rehab facility, doesnt that or could that kind of imply that maybe she wasnt as much of a victim as people say she was in the sense that she has this sex addiction and this Substance Abuse problem . That it doesnt look good to me for the Police Department to be paying for Something Like that. That it looks like it could serve their purposes. Reporter right. This offer for rehab in florida first came more than a month ago. Since that time she said no, i dont want to go and there were allegations that they were trying to hide her. But as far as this is concerned, yeah. I have no idea why she is accepting that now. But one thing to note that she is turning 19. She does post on facebook quite often, so we will see if she will be there. I believe her mom works as a dispatcher for the oakland Police Department. She would no longer be on her moms Health Insurance, but that would be my first thought. Why wouldnt the moms Health Insurance through the oakland Police Department do Something Like this . Reporter thats a good question as we have reached out to the dispatcher, but she is not commenting. Of course, i dont have any information on her insurance issues, but thats the question. Why is the city of richmond footing the bill . Is oakland not involved . Okay, you also have new information on the case of that woman from blackhawk. Who was killed allegedly by her husband. What is the new development there . Reporter the con cron da said that the the contra costa da said that the Death Penalty is off the table against John Tercheria in his wifes killing. Prosecutors say that tercheria hit his wife, linda in the head with a hammer more than 20 times. Police said that the crime happened in the couples home of blackhawk and he called 911 afterwards. They were married for 45 years. She had filed for a legal separation from him in april of 205. A motive for the killing is not yet known. Hes been charged with murder, torture, and elder abuse. But today the da removed a special circumstance, alleging that the killing was, especially heinous, cruel, or depraved. And that means that tercheria will no longer face the Death Penalty. In this particular situation the Death Penalty allegation was removed from the complaint. Because i think that the da realized that the language of the particular heinous killing didnt really make sense because all killing is heinous. And now tercheria will return to court on september 13, at which point hes expected to plead not guilty. For now hes being held in lieu of 2. 1 million bail. Just for my first reaction. You hit somebody in the head 20 times over the head with a hammer and killed them. Wouldnt that qualify as heinous . He still faces the torture charge, which, you know if convicted he could get life in prison without life parole. Or he could get 25 to life, the use of the hammer, a lot of enhancements that he could be facing. Just not the Death Penalty . Right. And now to mountain view, henry, a burglary suspect there took advantage of the airbnb user . Yes, he made a reservation on airbnb for an apartment on caldier avenue. After getting a key or access code, he canceled it according to police. He then broke into the apartment and stole items including the victims personal info. That resident later received a call saying that someone had opened up a credit account that it was time to pick up a new iphone. Thats when police went to the store and arrested the receiver. Now police say that airbnb renters can take several precautions to avoid being victimized. If you can meet with the individual who will be renting your home, get to know them a little bit. If in any way you feel uncomfortable, you are allowed as someone renting out your home to cancel the reservation yourself. And now police also say if possible dont keep any valuables or Sensitive Information at home. Very interesting updates. Thank you. You bet. Julie . In oakland a man is under arrest after taking a golf club and started smashing the windshield. It happened at 2 00 this afternoon. The bart spokesperson said that the man used a nine iron and broke dozens of windows. Bart service was interrupted as the incident caused major delays. There is no word tonight on a motive. Top city officials are denying accusations that the search for a new San Francisco police chief is not legitimate or even rigged. This comes after ktvus dave clark conducted an interview with mayor ed lee who called acting chief tony chaplain my chief. And after the examiner published a report that one candidate dropped out of the process saying that he did not believe that they were being conducted fairly. Ktvus Tara Moriarty has the story. Reporter in a Facebook Live interview with ktvus dave clark, San Francisco mayor ed lee praised acting police chief tony chaplain. He is my chief. While were looking and searching, ill do everything that i can to support chief chaplains management. Reporter upon lees comments, some are calling it an endorsement. Chaplain, however didnt see it that way. If you are in a position where you are the interim and you dont have the support of the mayor, you shouldnt be there. That is my philosophy. I dont see where the controversy is. Reporter today we spoke to lee who agreed. I am just without condition a support of the chief in every effort to lead these reforms to make sure they happen. Now the search is a separate question. The search, i have honored a process that the Police Commission is leading and conducting. Reporter according to the San Francisco examiner, one candidate former San Francisco Police Captain john pheney dropped out of the job race because he believes the process is fixed. I think it would be a mistake for someone to opt out at this point given that we have not even selected applicants and their interviews. Reporter they say that the city is committed to the nationwide search. I guess that they are putting the cart before everything else. We have the application open until august 31. We want great candidates to apply and then we will pass it on through the mayor. Reporter the search began after the former chief greg cirr resigned in may after several deadly officerinvolved shootings. The mayor and the Police Commission hope to have a new chief selected by the end of this fall. In San Francisco Tara Moriarty ktvu fox 2 news. Reporter more than 400 students have fled this kindergarten through 8th Grade Charter School and enrolled in regular Public Schools. In this district at least in the last two decades we have never seen an increase in such a short period of time. Reporter while the influx might be unprecedented, it has the space to absorb the children. But the district is concerned about what has been going on here at the Livermore Valley Charter School and the Livermore Valley prep school to make the parents take their kids out of those schools. The company that operates the schools is facing a criminal probe by the Alameda County district attorney. And among allegations of illegally transferring foreign students to an outoftown campus and financial mismanagement including failing to pay Retirement Benefits for teachers. They kept the money from the employees, but they did not put any in the retirement system, which is a concern for those people. There are a number of local vendors who have unpaid bills. Reporter the high school has lost their accreditation and appealing to get it back. Mismanagement of the Charter Schools the management of the Charter Schools did not return our calls. Parents and students remaining at the Charter School believe that it might straighten out. Really it comes down to my kids getting the best education that they can and i feel like he is. It has been a great experience. And it came under a recommendation. So if my friends really feel like its a great place for their kid to learn and grow then it will be a great place for my son as well. We are trying to get them to do things the right way and get their schools back into shape so that they can continue to run successfully. Thats our goal. Reporter administrators say that if the Charter Schools do end up shutting down they will absorb the extra children by reopening a now vacant school site. Live in livermore rob roth ktvu fox 2 news. The rap star e40 returned to his hometown today giving out thousands of dollars worth of highend backpacks to students. E40 visited Franklin Middle School today, the same school he attended when he was a kid. He brought with him 27,000 worth of backpacks and School Supplies to hand out to all the kids. E40 says that im just giving back, im just doing what im suppose to be doing. I feel like the kids are the future. You know, and school is very, very important. Especially these days. Back in the days people could drop out. But nowadays you need to have an education, you really do. E40 is giving back to the community over the years, including presenting a check to Hogan High School in vallejo where he was also a student. It is the ultimate underdog story. Coming up next the unusual path one oakland raider is taking to catch passes in the nfl. The warmest day of the week, we will let you how warm in your backyard. The extra crispy colonel. My extra crispy, twenty dollar fillup feeds a family of four. Its crunchy juicy and oh so tasty. Kfc. Its extra crispy good. A great story tonight involving the oakland raiders. They played their third pre season game at home on saturday against the tennessee titans. Joe fonzi has a story of a raider who has battled to make the team is a pretty good story in itself. Reporter most players in nfl Training Camps have a similar story of how they got there. They start with youth football, they play in high school, and then college. Raider receiver Johnny Holton fits none of those patterns. He had things other than football to take care of during his high school years. I wasnt playing High School Football because i was working to help support my mama, my auntie, and the kids. Reporter he might not have been playing football in any kind of a formal setting, but still had skills. One guy who knew about that was a younger kid from the neighborhood. He was pursuing a football career in a more traditional way. He actually told me one time that he saw me doing a good job in college. He knew we had the skills to do some of the same things, so it kind of motivated him. Reporter but it took more than that. A coach spotted holton playing flag football in a park. The main man was pete monzone who discovered me. Then he helped me get my ged and he helped me get into junior college. Reporter that lead to a transfer to cincinnati, but again, a path less taken. Holton is an undrafted free agent with the raiders means that the daily battle just to make the roster. But his coaches and teammates have taken notice. You are talking about a guy defying the odds. In america we like that. I told johnny that you are the most improved player this whole off season. I have never seen someone jump that much. It is fun for me to see and at the same time im rooting for him. Reporter rooting for him is one thing. Earning a spot on the roster is the the tougher part. Its not just the story, you know, he is out here making a lot of plays. If he keeps it up, he definitely deserves a spot on the team.
