We have seen a lot of them going the wrong way through some of the cones and we had our first actual issue this morning. Im behind tazmin drive. A vta train was clearly stuck for about 35 minutes. A supervisor declined to comment. It appears it scraped along a barrier. Rectified that situation about five minutes ago. We are going to find out real fast if today is going to run smoothly or going to be a traffic and logistical headache as the first 49ers game here at levis stadium kicks off at 1 00, niners broncos about 70,000 fans are expected today, an increase over the 40,000 fans weeks ago for the earthquakes game. Their fans complained about long waits and terrible traffic but today officials have promised more trains, officers and buses to direct traffic. We will see if all of that offset the increased amount of fans. What you cant do is go into a neighborhood and park on the private streets and we spoke to some neighbors concerned about that. Im worried we are going to have a lot of traffic on my street right here. I think the traffic is a small price to pay for the amount of money that it would bring to santa clara and i definitely am glad that the 49ers are here. I do want to see what the traffic is going to be like on the first 49 game and then we are going to go from there. Other news this morning, the Sonoma County sheriffs deputy who fatally shot a 13 yearold young man, andy lopez, is scheduled to return to duty in just a couple of days. Saturday people took to the streets of santa rosa to protest his reinstatement. The Group Carried signs telling eric gellhouse to stay off the streets. Deputy gellhouse shots lopez when shot lopez when he mistook the knowing the deputy is back on duty will put the communitys children on edge. They are going to be wondering if thats gellhouse in that car, what areas, is it going to be close to their houses, you know, when they are walking to school or coming home from school. Gellhouse was placed on administrative leave after the shooting last october. In july the District Attorney announced that no criminal charges would be filed against the deputy. Oakland fire crews battled more than six different fires in the brush near the freeway yesterday. Crews had to shut down two lanes of i580 in order to get the flames under control. The marin county Sheriffs Office says the boy was injured after he and his father tried to use a combustible powder to break up concrete fence supports. Fire Officials Say the blaze broke out just before 3 00 yesterday afternoon inside the gudalajara bakery and market. Gauge boucher is a store clerk and a week ago he saw an elderly man whose shoe was untied. Boucher stepped in and helped tie the mans shoe. Shoppers saw the act and took a photo of it. The picture says that the person who took the picture says he did so because he was touched by bouchers kindness. I have never seen that in a long, long time, other than opening the door for someone, and i was touched. I actually physically got a little emotional and in my fumble for my camera i was like please let me get this shot. Boucher said the elderly man offered him money in return for tying his shoe but he declined and went ahead and finished his shift for the night. Sharks were spotted swimming in the waters off of manhattan beach. Lifeguards were alerted to about four or five sharks swimming south of the pier. The lifeguards didnt clear the water but kept a close eye on the sharks. They say the predators have been coming closer to shore more often in recent years. Its been a common sighting around here for the last three years or so to see juvenile white sharks in the area, those are nonaggressive. The sharks swam back out to deeper water after about an hour close to shore. Experts say that juvenile sharks typically do not attack humans. All of the cloud cover will pull back to the coastline by the early afternoon and with that said its going to be a cooler day. Although we will see sunshine, temperatures are on the cooler side of normal. Looking ahead, we will see a more pronounced cooldown as we head into early next week but looks like all chances for rain have been removed from the forecast. Happening today, the first 49ers game at the new levis stadium, the first preseason game for the miles niners at home. Crews setting up there several hours ahead of kickoff. Everyone wondering if we are going to see a repeat of the traffic problems from earlier this month at levis stadium. Kron4s mike pelton is standing by outside the stadium with the latest. Good morning, mike. Reporter good morning, marty. Parking lots open up at 9 00 this morning, kickoff is set for 1 00, but already we have seen a lot of stadium employees start to show up here at levis stadium. Theres a lot of activity and a little bit of confusion. We have seen a little bit of confusion with tazmin drive on the northeast side of the stadium is closed for game day activity so you cannot use that if youre trying to drive from one end of the stadium to the other. We have seen a lot of drivers have issues with that this morning but here today we are expected to see about 70,000 fans for the first 49ers game here at levis stadium and that is a big increase over the 48,000 fans here weeks ago for the earthquakes game. And then we heard from a lot of fans complaining about traffic and long waits for public transit. Officials today are adding more buses, more trains and more officers to help direct traffic. The Great America parking lot is also available. The fans will have a learning curve with how this is going to work and so are those living nearby. Im worried that we are going to have a lot of traffic on my street right here. I think the traffic is a small price to pay for the amount of money that it would bring to santa clara and i definitely am glad that the 49ers are here. I do want to see what the traffic is going to be like on the first 49er game and then we are going to go from there. Reporter and we had one issue this morning as a vta train along tazmin drive hit a concrete planter parked too close to the track. That caused a 20 minute delay and has since been fixed. A vta rep says they will add an additional express line to help with traffic and that representative tells me it will take a look at how everything works today and make tweaks to future game day activity as needed. This is still a full hour before the parking lots open but we do see some cones behind you where the road one of the roads in front of the stadium is closed. Reporter yeah, tazmin drive here on the northeast side, theres a lot of game day activities there. That road is closed to vehicle traffic so you cant use that if youre trying to drive from, say, the north end of the stadium to the south end. That is causing a lot of confusion this morning. But primarily the crowds youre seeing behind me are stadium employees, theres a Stadium Parking lot behind the camera here so we havent seen really any fans yet but expecting them here very shortly. To san jose is out of jail this morning. The l. A. County Sheriffs Office saying Marilyn Hartman was released early because of jail overcrowding. On wednesday a judge sentenced hartman to 177 days in jail for returning to l. A. X. After she was told not to. Hartman has tried to sneak onto more than a dozen flights, most of them at sfo. A small memorial near mission and fourth streets in San Francisco marks where 2 yearold miana gregory lost her life. About 10 30 friday night she was with her twin brother and an aunt returning from a movie. Police say that she was in the crosswalk when she was hit by a car that never stopped. The little girls family is understandably devastated and they are pleading for the person responsible to come forward. Whoever did this, please have the heart to come forward. We shouldnt have to go through pictures and cameras and try to find you. You turn yourself in. You know what you did last night. This is a baby and its tearing the family up as it is. Police responded to the death by writing citations where miana died to try and help bring awareness to Pedestrian Safety on that street. They are still looking for a white sedan with multicolored bumpers and dark rims. The Sonoma County sheriffs deputy who fatally shot 13year old andy lopez is returning to duty in just a few days. Saturday police people, rather, took to the streets of santa rosa to protest his reinstatement. The Group Carried signs telling eric gelhaus to stay off the street. Deputy gelhaus shot lopez when he mistook the teenagers replica pellett rifle for an ak7 assault rifle. Protesters say knowing the deputy is back in the community will put the communitys kids on edge. When they see the patrol house they are going to be wondering if thats gelhaus in that car. What areas . Is it going to be close to their houses, you know, when they are walking to school or coming home from school . Gelhaus was placed on administrative leave after the shooting last october but then last month the District Attorney announced that no criminal charges would be filed against the deputy. Police in ferguson, missouri using smoke canisters, then tear gas, all of this in response to a shooting just minutes into a five hour curfew early sunday morning. Officials say the Police Departments show of force was triggered by a man with a gun. One man was shot and critically wounded. Police are now looking for the shooter. I can tell you that i was disappointed in the actions of tonight, as many of you know, the crowds were the crowds we have had for the last two nights. All of this comes after missouris governor issued the overnight clampdown and declared a state of emergency on saturday, this one week after a white Patrol Officer with the Ferguson Police department fatally shot an unarmed black teenager. Michael browns killing has sparked protests and incidents of looting since then. Authorities say an officer was briefly hospitalized after being assaulted during demonstrations in the east bay over the ferguson demonstrations and shooting. This is video from berkeley. Officials say the officer was injured friday night. He was taken to the hospital and later released. Authorities say two other officers were pepper sprayed as well. At least two people were arrested on suspicion of resisting or obstructing a Police Officer. Now that we are going to talk with political analyst michael yaki about the situation in ferguson, missouri, and, michael, overnight more problems there. The governor yesterday declared a state of emergency and things seem to be escalating and ratcheting up as we go through the days. We will see. This is interesting. One of the first statements made after the first night of looting and after the first wave of tear gas was that a congressman very familiar with the civil rights movement, john lewis said this, we should send in the National Guard and impose marshal law and did that for two reasons, one, because National Guard will provide security for everyone and two, it will get everyone off the streets. It took them a long time to get to the point where people were wondering what was really going on, who was in control in ferguson and they finally did that with the curfew and with the Highway Patrol and also with other police last night. I think it was to be expected there was going to be some violence and certainly ron johnson, the captain from the Highway Patrol who is from ferguson said that they credited all intelligence and it was actually from people who live in ferguson that there were some trouble makers with guns on a roof of a building and thats what caused him to go up from his no tear gas to, okay, we are going to do targeted tear gas at this particular building and secure it because of allegedly people there had weapons and they said they saw people who had weapons who fled after the tear gas was shot. The question is going to be what happens tonight. And i think what you can see a lot from this morning, this morning you have a lot of residents of ferguson working together to clean up the mess from last night and you have a community that understands that they have a problem and but part of the problem is one they can help fix themselves, they are working together, the africanamerican residents are trying to work, you saw the other night that a number of people went to protect the stores after they had been looted and we will see how this goes on. I predict it will probably be even less tonight and even less more so until finally they can do it but i think the only thing that is going to break this is going to be some kind of a show of an indictment of the officer involved. Is that next on the docket in terms of where this investigation goes . Do you see it heading in that direction . Well, certainly you know have 40 fbi agents on the ground interviewing everyone in ferguson, you have the attorney general this morning, just this morning announcing that they are going to request that an independent forensic pathologist come in to do an autopsy of mike brown, to determine for their point of view whether what position he was in, where the shots were fired from, et cetera, to help them in their investigation but this is not going to happen anytime soon. Right. It is going to take some time and time, of course, continues to have this fester away on the residents of ferguson so it behooves everyone to try to move quickly but you dont want to rush to justice. For whatever people may think about darren wilson, has due press and due process and has the full protection of law that mike brown should have also had at that time. Lets turn our attention now to whats going on in texas with governor rick perry. Pure politics going on here . Well its interesting. The only person the only possible benefit anyone has ever anyone could say they had from whats happening in ferguson is rick perry because ferguson has dominated the news and normally Something Like an indictment of a sitting governor would get a lot of yeah. When you go underneath it, two narratives on this indictment. First is simply its politics as usual and youre dealing with a prosecutor, Rosemary Lehmberg who was arrested roaring drunk, theres a video out there. I have seen the video, yeah. That you can see where its clear she is not just nine sheets to the wind but probably 27 sheets to the wind, is that the kind of conduct that a District Attorney should resign for . You know, theres a good case for most people would say yes. Yes. And he asked for her to resign, she said no. She also heads up the states Public Integrity unit which does investigations about political corruption, et cetera, misbehavior and he said youve got to resign. She said no. He said well im going to cut your budget to the bone unless you resign. She said no. He said okay, i am going to cut your budget to the bone and he vetoed a lot of funding for that and because of that, they are indicting him for abuse of power and other sorts of things. The only narrative that makes this not ridiculous is to look at it from the point of view of the u. S. Attorney during the Bush Administration who were all removed summarily because they are investigating republicans or they were not investigating democrats. There is some merit to the idea that when you are trying to prevent someone from doing their official duty, that there can be some element of coercion but in the case because lehmberg has all this other baggage attached to her, it makes it a little bit less clear. What impact do you think this will have on rick perrys president ial he wants to run for president in 2016. In terms of other republican candidates they are saying we think this is ridiculous. On the other hand they are going to say that a lot because they want people to think about it as well. So it will have some impact on it in the long run. Do i think anything will come of it . The south jordan Police Department and the Salt Lake County Health Department investigating how this happened. The Franchise Owner of the restaurant says they are fully cooperating with the investigation. This was the scene after a deadly tanker truck accident in tennessee. It happened early friday morning along interstate 65. The truck was hauling gasoline when the driver hit a concrete support structure and the truck erupted into flames. The driver was killed in the accident. The overpass was so damaged that crews had to tear it down but the freeways expected to reopen by tomorrow afternoon. The marine layer right now at about 1500 feet so that is translating into pretty overcast conditions throughout much of the bay area, low lying cloud cover, however, closer to the Golden Gate Bridge. As a result temperatures havent budged much. We are still in the upper 50s in concord in San Francisco, but where we are seeing the sunshine already, thats where temperatures are slowly starting to warm up. Antioch, 66 there, 60 degrees in sunnyvale, livermore at 61 and 61 in san jose. We will see sunny skies into the afternoon, the fog will pull back to the coastline, temperatures from the low 60s coast side to perhaps the upper 80s inland. A more pronounced cooldown slated for early next week with a deepening of the marine layer and that onshore push so that sea breeze is going to kick in and its going to drop down our temperatures. I spoke with one fan who tells me he got down here so early because he was not sure what to expect with traffic and with public transportation. The game kicks off at 1 00 this afternoon and if youre getting in the car shortly, we want to point out that a small stretch of tazmin drive on the northeast side of the stadium, which is on the right side of your screen is closed to vehicle traffic for game day activities so youre going to want to make sure you know exactly where youre going before you get in the car. To san jose is out of jail this morning. The l. A. County Sheriffs Office says that Marilyn Hartman was released early because of jail overcrowding. On wednesday a judge sentenced hartman to 177 days in jail for returning to l. A. X. After she was told not to. Hartman has tried to sneak onto more than a dozen flights, most of them at sfo. Developing story this morning, the small memorial near mission and 4th streets in San Francisco marks where 2 yearold Miyana Gregory lost her life. About 10 30 friday night mi yana was with her twin brother and an aunt, they were returning from a movie. Police say the family was in the crosswalk when she was hit by a car that never stopped. The little girls family understandably devastated and they are pleading for the person responsible to come forward. Whoever did this, please have the heart to come forward. We shouldnt have to go through pictures and cameras and try to find, like you turn yourself in, you know what you did last night. This was a baby and its tearing the family up as it is. Police responded to the death by writing citations where miyana died in an effort to bring awareness to Pedestrian Safety in that neighborhood. They are still looking for a white sedan with multicolored bumper and dark rims. A memorial website has also been set up in honor of the little girl an to the link thats seen on your screen. The Sonoma County sheriffs deputy who fatally shot 13year old andy lopez is returning to duty in just a few days. On saturday people took to the streets of santa rosa to protest his reinstatement. The Group Carried signs telling eric gelhaus to stay off the streets. Deputy gelhaus shot lopez when he mistook the teens replica pellet rifle for an ak47 assault rifle. Protesters say knowing the deputy is back on duty will put the communitys kids on edge. You know, they see the patrol cars, they are going to be wondering if thats gelhaus in that car, what areas, is it going to be close to their houses, you know, when they are walking to school or coming home from school. Gelhaus was placed on administrative leave after the shooting last october. Then last month the District Attorney announced no criminal charges would be filed against the deputy. All of this came down after missouris governor issued the overnight clampdown and declared a state of emergency saturday. Thats one week after a white Police Officer with the Ferguson Department fatally shot an unarmed black teenager. Michael browns killing has sparked protests and incidents of looting since then. Authorities say an officer was briefly hospitalized after being assaulted during demonstrations in the east bay over the ferguson shooting. Youre taking a look at video from berkeley. Joining me now is our political analyst michael yaki and last hour we talked with the continuing situation in ferguson, missouri, still a lot to talk about when we cover the developments there, especially, one topic that is fascinating is the militarization of the police not only from ferguson but in Police Forces around the country. I think the images of the Ferguson Police force in full camouflage outfit, personnel carriers, snipers on the roof is something that really struck home with people because this is an image you normally dont associate with the united states, you associate with tahrir square, tiananmen square, moscow, baghdad, fallujah. This is not what you see in america and it comes about because essentially of a Regifting Program from the 1990s when the military started to contract and they had all these excess things they needed to get rid of so with grants from Homeland Security and others and quite frankly steeply discounted rates, local Police Enforcement across the country have been able to avail themselves of billions of dollars of military hardware to add to their own equipment. So they have they have these tools now to use and you were telling me during the break that you did a Little Research into this and some of the organizations that are buying this military equipment, is mindboggling. Youve got to ask yourself, theres this one particular vehicle called an armored mine resistant vehicle, essentially something you would take into fallujah, into iraq, that would be very strong and Ohio State University bought one and you have to you have to scratch your head and go why . Are students getting really rowdy . Are frat parties getting out of hand . Thats one ridiculous example but just take the example of full body armored camouflage, night vision goggles. The difficult is that the difficulty is that its not so much what they have because obviously if youre dealing with like a well armored drug den, if youre going after a drug deal or a meth lab that you know is heavily armored thousand you want armored, you want our police to be protected but do you really need them raiding a nightclub looking for underaged drinkers, which has happened . Or do you want a full s. W. A. T. Team in Para Military uniforms parachuting into your back yard looking for medical marijuana that you may be growing. These are things that have occurred and the question is, you know, once you give people essentially these toys, do they feel a need to have to use them . Armored carriers. And restraint is really important and d. O. D. Is confirming they gave apcs to the Ferguson Police department. Wow. And, you know, its one of those questions that has gained a lot of heat in congress right now about whether they need to look at this program more or look more at how the guidelines for how Police Departments deploy them because you dont want these images of combat troops essentially on the streets of america. Yet another factor that comes up with what we have been watching in ferguson. To switch gears completely, i know that you wanted to share some thoughts that you had on the sudden passing of Robin Williams. Thank you. And thank you very much. Normally im your political analyst but also someone who as a resident in the bay area deeply affected by the passing of Robin Williams. I cant say i knew robin well. For the most part i was another of a million of his fans across the world. Good morning vietnam was one of the most profound films i saw, the idea you have to stand up for something, it had a deep impact on my growth professionally but i was lucky enough to meet him on several occasions even talked to him and like everyone who knew him in his quiet and offstage moments he was genuine, he was sweet and he was gentle. I do remember waiting at city hall for a parade to begin and things were running late as usual, the room was full of politicians and dignitaries and it began to get and they all began to get cranky so suddenly, a voice cut through the crowd like a fresh breeze, a breeze filled with laughing gas calling out donner party of 30, sorry, no, donner, party of 20, now donner, party of five. It was Robin Williams and in five minutes the room had completely relaxed. He was one of us. Robin williams moved here as a young boy, went to school here, cut his comedy teeth in the smoky clubs here, even in the Richmond District where i used to live. He was discovered here by hollywood but when he became famous, we didnt have to worry about Robin Williams forgetting where he came from because he never left. No matter his fame or success, no matter where he was filming a movie, he still returned here. I remember his longtime home in the seacliff neighborhood of San Francisco. It had a topiary shaped like a dinosaur that he would light up for the holidays. I was fortunate enough to see him at fundraisers for the causes he believed in. He would often contribute money but sometimes, sometimes if you were lucky, he was asked to say a few words and those few words and i was there to witness it, would quickly evolve into a spontaneous Tour De Force that only ended when you were essentially literally on the floor physically exhausted from laughing. Its that local generosity along with his National Fame that made him to us all the more endearing and more beloved so when he won his Academy Award for good will hunting it felt like the entire bay area had won, he was our guy, our neighbor, our friend and thats why i believe we in the bay area feel his death even more personally, more painfully and more painfully. Everyone wondering if we are going to see a repeat of those traffic issues. Reporter stadium employees have been showing up over the past several hours and now we are starting to see ns arrive here at levis stadium as you take a live look outside the Southeast Side of the stadium. In youre just getting in the car, if youre coming down here today, we want to know that tazmin drive which along the northeast side of the stadium on the right side of your screen here, you can see is closed to vehicle traffic for game day activities so keep that in mind if youre coming down here, perhaps its best if you know exactly where youre going before you even get in the car. But so far this morning, fans are already making their way here to levis stadium, they tell me they are pumped up for the first niners game. She tells me that they have added an express bus line and they are supplementing Train Service at their downtown and tazmin stations with buses to help keep fans moving but this is a first for all of us, the fans and ages working the games so she tells me the vta will take a look at how everything goes today and make changes to future game day schedules as needed. Kron4s dan rubin reports that the devastated family is calling on the driver to turn himself in. A candle, flowers and a card left at a crosswalk near fourth and Mission Streets, the same place where 2yearold Miyana Gregory lost her life. She was the darling little girl, cute as she wanted to be. Reporter around 10 30 on friday evening miyana was with her twoyearold twin brother mikey and their aunt. After seeing a movie, police say she was hit by this car that never stopped. A citywide unit is looking for a fourdoor white sedan with multicolored bumpers and black rims. I dont know how youre sitting at home with yourself knowing you killed my niece. Whoever did this, please have the heart to come forward. We are learning about a private plane that crashed in placerville, the El Dorado County Sheriffs Office says the crash happened about 7 00 last night. Two people were on the plane at the time. One was airlifted to a nearby hospital, the other was pronounced dead at the scene. The faa is investigating the cause of the crash. A woman in jail after allegedly leading san diego Police Officers on a wild chase in a stolen patrol car. Youre taking a look at video from that chase. Officers say the 22yearold stole the police car late friday night, it was parked and they say they spiked the cars tires but it kept going. Police say the woman then tried to use the vehicle as a weapon. She intentionally rammed three police vehicles, two chp vehicles and one san diego vehicle, that ultimately disabled her vehicle and she was taken into custody. Police say she was able to steal the parked car because the keys were left inside and the officer who drove it was out of sight momentarily. The woman is now facing multiple felony charges including grand theft. Beachgoers in Southern California got a bit of a scare last week as sharks were spotted swimming in the waters off of manhattan beach. Lifeguards were alerted to about four or five sharks who were swimming just south of the pier there. Lifeguards didnt clear the water but they did keep a close eye on the sharks. Lifeguards say the predators have been coming closer to shore more often in recent years. Its been a common sighting around here for the last three years or so to see juvenile white sharks in the area and those were determined to be nonaggressive. The sharks swam back out to deeper water after about an hour. Experts say that juvenile sharks typically do not attack humans. And we will be right back. The accident happened friday night when the young girl and family members were on a crosswalk on Mission Street between 4th and 5th streets when the accident happened. The young girl has been identified as 2yearold mi yana gregory. Police are asking for anyone with any information to please come forward. And last night marked the first night of a state imposed curfew in ferguson, missouri, it ended with tear gas and arrests of some protesters, some protesters actually position themselves on a restaurant rooftop and that created a safety risk for approaching officers in armored vehicles. Those protesters were arrested, one man was shot last night, all of this in response to the Fatal Shooting of an unarmed teenager last saturday in ferguson. The ninth annual gay games has wrapped up in ohio. Hundreds of people gathering for the closing ceremonies saturday in cleveland. The event attracted 9000 athletes and some 20,000 spectators from around the world.
