you're watching cbs 5 eyewitness news in high definition. he wants to go back to business as usual, but the mayor says not so fast. what's next for the bay area sheriff who took a plea deal. >> nuclear meltdown. one year later. for the first time, we go inside the no-go zone in japan. well, you know it's not good for you. but there's new information tonight. soda is bad for your heart. how much you can drink before it harms you. good evening, i'm ken bastida. >> and i'm dana king. it's a deal that stunned san francisco's mayor. ross mirkarimi entered a plea bargain in his domestic violence case. >> he has the power to stay on the job, but the mayor may play his own trump card. >> in one court, sheriff mirkarimi's wife was battling to block a jury from viewing cell phone video of her injury. in another, the sheriff was battling to move his case out of san francisco. but out of court, the sheriff and the da were working a deal. >> unfortunately, based on the constraint of the processing process, i'm not allowed to say too much more. >> but we are, mirkarimi agreed to a 236, a monoconsensual confinement of a person. it's false imprisonment usually confined to shoplifters. met the legal requirement by grabbing her arm. it does not carry a ten year firearm arm ban, so we asked the sheriff, will you stay on the job? >> yes. i mean, that's my intention. absolutely. >> at city hall -- >> i was surprised to hear that this morning. i immediately went to work. >> mayor ed lee says neither he nor anyone in city government was aware false imprisonment was offered to the sheriff. >> you know, the gut feel handgun you say something like false imprisonment, you immediately ask, doesn't that have something to do with the sheriff's office if. >> the mayor is considering a possible ethics investigation. it could call for mirkarimi to immediately step down. similar to the ethics investigation that led to former city supervisor, ed jew's resignation. >> i called a number of people, like the mayor, like sheriff hennessey, and other people to inform them of what i was going to do. >> irrelevant to the mayor. in fact, mayor lee points to the day cbs 5 captured mirkarimi running from his office and away from our cameras. on that day, the mayor called mirkarimi a distraction. >> i still have felt the same way because i just felt it would be so distractive to opt rations of that office. >> he didn't ask me. he asked me during this process if i wanted to step aside during it. that was the nature of the conversation. it wasn't a need to. because i think i have been able to demonstrate, things are going well. >> reporter: so, does the mayor have the authority to suspend or effectively terminate an elected official? i pit that question to his office tonight, i am told yes, with a caveat. i am told he has to present to the board of supervisors. they must vote on whether to reject or accept that plan. live in san francisco, i'm robert lyles, cbs 5. now the latest on that u.s. soldier accused of killing 16 civilians in afghanistan. tonight, we've learned that he is a trained sniper and recently sustained a head injury while on duty in iraq. elizabeth cook on the outrage from afghanistan to the bay area. >> fled afghanistan with her family when she was just three months old. but her connection to her home land runs deep. >> other countless of people that have died throughout the ten years of war, there's hundreds and thousands of stories. not just like this, but similar. and we don't hear about it. >> she just got back from visiting afghanistan and tonight she led a vigil in the plaza to honor the victims of the weekend massacre. >> we are not trying to make a political statement. we are not taking sides. we are afghan and american. we don't want innocent afghan lives or innocent american lives to be wasted. >> a distraught woman described what happened when the u.s. army sergeant went on a cold-blooded killing spree. he dragged the boys by their hair and shot them in the mouth. the sergeant tried to burn some of the bodies and then walked back to his base and turned hums in. the 38-year-old was a veteran of three tours in iraq and was assigned to train local villagers to fend for themselves. he may have known some of the victims. >> it's a very hands on effort that means interacting with villagers 24 hours a day. >> the soldier likely knew these people? >> it's possible. in most cases, a soldier would be extremely well acquainted with villagers. >> taliban is promising revenge. afghan president karzai is demanding an explanation by u.s. forces on how the attack could have happened. calling the incident an assassination. neil pucket says the soldier could be charged with premeditated murder. >> based on the facts we know now, this could be a case where the army would seek the death penalty and refer it as a capital case. >> the u.s. can play a good role in afghanistan, but -- >> we need to try a different tactic. what we are doing is not helping. innocent people are dying day by day. so i don't think that's the point of us being over there is to help, not have innocent people dying. >> as for the mental health history of the sergeant, he passed the psychological test to qualify as a sniper and in 2010, he was evaluated for mild traumatic brain injury, but was cleared for active duty. his wife and two children have been moved on to his home base in tacoma, washington, for their safety. dana. >> elizabeth cook, thank you. pg and e announced another $70 million for the city of san bruno. it's a settlement that killed eight people and leveled a neighborhood. the mayor says the deal emerged after long and tense negotiations with the utility. the payment will come out of shareholder's payer's pockets. >> i would like to see some sort of memorial put up. small. nothing anything too big. maybe expand the park. >> the settlement is in addition to the $50 million pg and e already pledged to help rebuild the neighborhood. hundreds of bay area teachers say they deserve more money. 200 teachers in blue packed tonight's school board member of the unified school district. they are demanding a one-time payment of 3% of their salary. payback for furlough days they took last year to save the budget. but with so many people having a tough time these days, sharon chin asked, is this the right time to ask for more? >> in this economy where unemployment is nearly 11%. people are losing their jobs. people are losing their homes and there could be cuts in state funding for education. is it fair for teachers to be asking for more money? >> yes. >> why? >> because we have been without for six years since our last pay raise. >> the district says its teachers make an average of $62,000 a year and wants to give them more, but for now, both sides are at an impasse. they are agreeing to bring in a state mediator. from many bay area commuters, there's light at the end of the tunnel. hard to believe, but it's now official. bart will go to san jose. the extension project adds ten miles of track. kit was with some very happy bart riders tonight. >> reporter: to all the nay sayers and critics of bart to san jose, today's celebration put an end to all the if's, and's, and maybes. >> instead of fighting each other, we fought together. >> with a stroke of the pen, the transit administration approve funding, $900 million. the new station will be built on the rail line right next to the flee market in san jose. >> the real people, we will always thank are the visionaries of silicon valley. not once, but twice in 2000 and 2008 said yes to their future with 2/3 votes to bring bart to silicon valley. you are the hero. >> reporter: the reaction from passengers, relief. emily is coming home from the airport, but has to get off in fremont. it will take another hour to load up in a car, fight traffic home. >> my mom is picking me up. and it's really a hassle because fremont is far from san jose. so it would be nice if we went straight to san jose. >> the doctor is an economics professor who lives in berkeley, but works at santa clara university. the project will shave more than 20 minutes off his commute every day. >> i'm sure it's costly to the state, but good news for me. >> the extension should be done by 2016. and they are talking about the next phase, the next big challenge. that's getting the funding to dig a tunnel five miles all the way into downtown san jose. cbs 5. coming up, a trip into no man's land. one year after the meltdown of japan's nuclear reactor. we'll see what is left and meet one family who refused to leave. >> look out from above the popular hiking trail where a dive bombing owl has put bay area dog owners on alert. and you've heard it said, soda isn't very good for you. but tonight comes word on how many sugary drinks you can have before it causes real harm to your heart. ,, leaving 12 miles around the plant a no-man's land. bill one year ago tonight, japan's nuclear plant exploded, leaving 12 miles around that plant a no man's land. bill whitticker put on a radiation suit to get inside the radiation zone to show us what it's like. >> reporter: the area is totally off limits without a government pass. not something handed out to journalists. we went in with volunteers preapproved to monitor radiation levels. >> we are now approaching the check point. we have to get through this before we can go into the no go zone. we are now in. we safely got through the check point. we are now in the no go zone. >> dead zone is more apt. this area was hit by a tragic trifectament earthquake, tsunami, radiation. the first town we entered was odocka. a year ago, 13,000 people lived here. today zero. there are signs of happier times. now traffic lights flash, but no traffic. the only sound, the ticking of our guide's counter. he found a hot spot. big towns and small towns all ghost towns. houses left in haste. only a few unfortunate cows roam empty streets. we're now a mile from the fukushima nuclear plant and listen to the counter. it's going crazy. at one point, it got up to 30.8. anything above 3.8 is considered unsafe. we got out of there quickly. about ten miles down the road, we met nauko. despite threats of radiation and government warnings, they refuse to leave. who is 63, grew up here. for 12 years, she has been caring with her mother who said she wants to die in this house. >> you are right down the road from the fukushima nuclear plant. >> she told us wherever you go, there are nuke nuclear power plants. there are 54 in this country. it could take decades to dismantel the nuclear plant. how long will it take for the surrounding dead zone to come back to life? nobody has set a time for that. bill whitticker, cbs news, in the no-go zone around the fukushima nuclear plant. park visitors in the east bay are being warned, watch out for the dive bombing owl. i went out there earlier today with our mobile 5 camera and found the owl late this afternoon snoozing. quiet, peaceful. hikers say the bird has been dive bombing dogs walking by its tree on the clairemonte canyon tree. >> one of the owls clipped the dog in the rear end. took off. made a screeching sound. >> the dog is okay. park rangers ask that dogs be kept on leash in the area. the owl is nested in the same tree that a family of owls called home a few years ago. if you can't get enough of the sweet stuff, doctors have something that may change your mind. cutting out just 12-ounces a day can reduce the risk of heart disease by 20%. researchers from the harvard school of public health found it followed more than 42,000 men age 40 to 75 for twenty years and kept records of their food intake. >> sugared sweetened beverages increases inflammation. and inflammation might be the culprit in what leads to heart disease. >> now it's not a matter of all or nothing. researchers found having sugary drinks twice a week or twice a month did not increase the risk. neither did artificially sweetened beverages. click on the health tab. we'll be right back. ♪ [ male announcer ] aggressive new styling. a more fuel-efficient turbocharged engine. and a completely redesigned interior. ♪ the new c-class, with over 2,000 refinements. it's amazing...inside and out. the c-class starts at just $34,800. [ female announcer ] california pacific medical center and sutter health. welcome back to eyewitness news right here on cbs 5. our live weather camera. just a wash. honoring the girl scouts 100th year anniversary. that's not the only thing green. we're picking up green on the screen now. according to our high def doppler radar, we have rain fall through santa rosa. now banking up against the park and easterly direction and speaking of the east. east bay picking up light rain showers around moraga and also skyline boulevard. this is nothing. this is just a couple renegade cells in advancement of this area of low pressure to the north of the bay area. that is the frontal boundary. this is your morning commute and you'll notice all the rain is north of the golden gate bridge and watch what happens. kind of stalls. just hangs out over the north bay most of the day. by the evening commute, moves into the metropolitan area before slowly sagging in a southerly direction. rain fall amount will be healthy to the north. across the northern portion, which is slightly smaller amounts of heyward and union city. this area of low pressure is now banking up against the pacific northwest. the tail end of this system here wants to ride into the bay area and tap into another system. so we have three storms heading this way. tonight, partly cloudy. 6 inches of rain by friday night. temperatures 50s and 60s across the board and there you have it, the second system rolls in on thursday. a coarld one by the weekend. that's the pinpoint forecast. kim in sports next. ,,,,,,,,,,,,,,,,,,,, championship game.... today, it's straight cash for randy moss who gets a one-year deal after working out today. after for his quarterback, alex smith, he told me he's happy with the three-year deal the 49ers offered. >> they know i want to be back. i think they want me back and it's a matter of working out the details. i'm excited about it. i'm not thinking about anything else. just waiting for it to get done. >> sharks needed a win against the oilers. redirects the dan boyle for the go ahead goal. they win and are a point out of the playoff. celebrated another number one seed. they'll play hampton. plays iowa this weekend. and we'll be right back. ,,,,,,,,,,,, (car horn) paying with your smartphone instead of cash...
