Smashed windows, damaged cars on broadways auto row. Many Business Owners are wondering why there wasnt more done to keep protestors from vandalizing their businesses. This violence followed a day of peaceful protests outside of Oakland City Hall over issues like income inequality, racism and police brutality. A very small group of people with rocks in their pockets and malice in their hearts disturbed what was otherwise a very positive day in oakland. The mayor says she is intent on holding anyone who commits violence in the city accountable. The police are walking a fine line trying to keep the peace and stop property damage. It seems like an impossible job. If you come down too hard on protestors they can come back harder. I have to harken back on my conversation with the mayor. They have been very professional. Weve still seen a lot of Business Owners standing by watching the police watch people brake their windows. That has been unacceptable and that part of the performance from opd i have been disappointed in. The response to this protest was very similar to what she was criticizing in the past. It is. We have to remember that the Oakland Police department is under the scrutiny of a federal Oversight Group which is raising questions about how they handle demonstrations as well. Are they being too hard on the demonstrations r. Civil rights being violated. Opened is walking two tight ropes at the same time. It will be interesting to see how the mayor handles this when it happens. A statewide soda tax is up for vote. We heard about these proposals in independent cities. This would make it more expensive to buy sugary drinks anywhere in california. The Assembly Bill would impose a 0. 02 per ounce fee on any beverage sweetened with sugar. The money would be used for health and Education Programs to counter act sugars negative effects. We want the public to be able to differentiate between sugar sweetened beverages which are toxic and the other beverages which to this point are relatively benign. That is a berkeley city councilman. Berkeley already passed this sugary drink fee. The police have a lot of trouble implementing it. Stores werent charging the fees at all, and then there was confusion over where the money was going. Other cities have said no and its got a shaky stand in sacramento. You can already get a preview of the possibility of the future of this sugar tax. This past week a bill to require warning labels on sugary drinks failed to make it out of committee. This is the second time in two years it hit aground. It is interesting, especially when it comes to the political move. Voters in several cities have rejected this proposal. As a politician why are you trying to force it. Because youre making a point and trying to get the issue out there. Theres also a debate whether sugar is the lead cause for diabetes in children or if there are other factors. This debate is going to go on for a while as is the debate about water in this state. If were in such a dire drought why are we building more housing for people to eventually suck up more water. One bay area city is thinking of putting the brakes on a big housing project. It was slated to be the Biggest Development in pleasanton history. 13,000 new homes on this eastern stretch of the town. It would house 3200 new people but it would also use about 260 milliongallons of water a year. This at a time when people in the town are already being asked to conserve 25 . If were so short on water why are we putting more people here. I think the development is fine. People need places to live. Pleasanton city Officials Say its likely they will put the brakes on the project at their meeting next month. The developer cannot be pleased about this. Its interesting. There were concerns about traffic, schools and a lot of other things but it looks like its the water thats tipping the point. Right next door in dublin same Water District, same drought concerns theyre building a 35, 36 million swimming park. Water park. The question is whether theyre going to be filling it. Meanwhile the governor is proposing enormous fines for the states biggest water wasters, hes talking about 10,000. Thats a lot of dough. Hes also supporting legislation to ramp up enforcement of water restrictions, beef up the penalty structure for water wasters and empower water agencies to issue fines. Thats the kind of fine that would trigger or the kind of water wasting that would trigger those 10,000 penalties is still being worked out. Money troubles for b. A. R. T. The Transit Agency needs billions of dollars to keep the trains on the tracks. According to a new state audit, it needs a jaw dropping 9. 6 billion overhaul on its tracks and trains just to keep running. This comes at the same time that b. A. R. T. Is expanding to san jose. After putting in that 500 million connector into the oakland airport. We need to replace the entire guts of our system, not sexy stuff. Were talking about structures, our communication system, our train control system. The trouble is they only have about half the money. One plan is to ask bay area voters to approve a possible 4. 8 million bond to be paid back for property taxes. Thats going to be a tough sell to voters. We also see fare increases almost every year. And other tax increases and education and other things. One of the things that b. A. R. T. And other transportation agencies fall victim to is that they have to sell their packages to the voters, and to do that oftentimes they have to add new things, b. A. R. T. Extension into your neighborhood or various other amenities to get your vote. The problem is the main core service is the behind from years of neglect. They dont have the money to take care of the core but theyre selling you new at the same time. Thats one of b. A. R. T. s big problems. Bay area fire stations are closing just as the fire season is about to start. Two east contra costa firehouses will have to go. This comes after voters rejected a plan to save them. It looks like station 54 in brentwood and the station 94. They will eventually have to cut a quarter of the firefighting staff. A fema grant which helped the district operate five stations ended last year. The final draw is when voters rejected a property tax assessment to close the 4 million shortfall. When we think about fire stations, lets not forget its not just fires. They help with medical emergencies if somebody has a heart attack, those would be the first people on scene. In that area one of the big issues is pensions and pay for the firefighters. Its not as great as other districts but because of so many other stories about other districts voters had a question about where the money was going. Tuesday ised expected to be a milestone day for the Silicon Valley. The population will hit 3 million according to the south bank think tank joint venture. And as the population increases so does the cost of living. One east bay city may be taking an unprecedented step to stop rapidly rising rents. Lafayette city leaders proposing a moratorium on rent hikes after some tenants reported increases of nearly 90 in a year. Its really sad and its having an impact on some of the people in our communities. A moratorium would be a first in Contra Costa County and possible First Step Towards rent control. The council will consider it on may 11th coming up next, problems with resisting arrest in the bay. Africanamericans in San Francisco are cited for resisting arrest eight times more often than whites. Arrests and incarceration rates for blacks are also disproportionately higher in a city that prides itself on diversity. Whats behind these numbers and do they tell the whole story. Joining us now is San Franciscos public defender who just recently held a seminar on this. Jeff, your statistics show higher resistance of arrest, also higher incarceration rates for africanamericans correct . Where is it in San Francisco . Its 56 for African Americans for resisting arrest. The stars we showed is that for africanamerican females theyre nine times as likely as their white counter parts to be arrested for that particular crime. What is it you infer from it . What do you take out of that . It depends on the crime and who reported it. In the case of resisting arrest its always the Police Officer who makes the determination as to whether someones resisting arrest. Because its very subjective sometimes what constitutes resisting arrest. The officer is making judgments about africanamerican females that theyre not making about white females. So this would be something where a camera on the Police Officer would tell the story one way or the other . Yeah, body cameras would be instrumental. If you have an interaction with a Police Officer on video, then youre not going to get into the he said she said. Okay. Between this and the incarceration rates, do you feel that africanamericans are being racially profiled and given a different standard of judgment initially by police in the city . Yes. One thing we find commonly is africanamericans are detained and arrested more often, and one might think is it because they are committing more crime. In the case of drugs ons for example, all the statistics show that africanamericans use and sell drugs at the same rates of whites. In fact, the whites its a little higher, but African Americans are seven times as likely to be arrested for drugs ons. So you have to look at both enforcement, whos committing the crime and whos being arrested. Now someone would counter, possibly police would say one of the differences that African Americans, the blacks tend to sell openly in the tenderloin or in the bay view, theyre out in front and theyre creating a situation where theyre likely to be caught whereas whites might do it behind closed doors and more subtly. Another statistic i took a look at, when it comes to climbing i think we have some stats we can put up. In San Francisco when police interviewed crime victims, they found that 43 of them said that the percent that robbed them or whatever was African American, and meanwhile and when we looked at arrest statistics, we found that 43 were arrested were African American as well. So there was a matchup there, pretty much an equal matchup on white, 31 , 19 and 7. So while its disproportionate to the population in terms of crime reported, crime arrested, it seems pretty equal. It is definitely true in certain categories of crime because if you look at, for example, cell phone theft. Weve seen in the juvenile system that the persons arrested are usually young africanamericans and that number is very high. But in other categories, you know, thats definitely not the case, and so you have to really look at what crime is being committed, who is, you know, reported to commit the crime. Certainly if you have a situation where a persons saying, oh n oh, this is the person whos committed a crime theres less discretion by the police. That still leaves 60 of the crime where the police are making the determination who should i stop. If we get into racial profiling, one of the questions that comes in is if blacks are being victimized by crime, and they are disproportionately, more blacks are victims of crime and the perpetrators are africanamerican as well, if we are questioning the arrest rate, are we saying arrest less, stop less, will that in turn em bolden people to do more crime . Yeah, and i think Everyone Wants perpetrators of crime to be arrested, and whether its an africanamerican or an asian who commits a crime or a white person, that person should be apprehended. Remember as well, though, that our system has a bias against arresting certain people. You havent heard of any person being arrested in any of these huge real estate scandals or financial scandals. Instead youre going to find people who are arrested for street crimes. Again, its an enforcement issue. You know, certainly if you look at the, you know, crime rates and who is committing the crimes, you know, Sexual Assault for example on college campuses. Thats a huge crime thats happening, yet we find the enforcement is not there. Thank you for joining us. I think thats going to be a subject for another debate down the line. Thank you. Over in the east bay oakland 65, berkeley 61, and the north bay mill valley youre going to get to 66 degrees today. So this cooling trend continues both today and into tomorrow. Next our Political Insiders on the racial tensions in baltimore and cities around the country following accusations all of the six officers who were charged in freddie grays death in baltimore are out on bond. Here are their mug shots. Greg died last month in Police Custody from a spine injury from head trauma. We asked our Political Insider what made the incident in baltimore different than other cases around the country. Heres their take. Its because black police chief or commissioner, a black mayor, and apparently the arresting officers involved were black and the victim was black, so you get a dialogue about Police Conduct period, not Police Conduct based on race. But this case is brought up a whole range of issues that one, that young African American men have a 21 times greater chance of being shot fatally by the cops. Freddie gray, trayvon martin, oscar grant, theyre no longer anonymous victims. These are now burned in our memory. We now know the range of problems that have been created. Its health. Its education. Its poverty. And for the first time you dont get demonstrations based on race. The demonstrations in baltimore around the issues of people being mistreated period without reference to race because when you look at the scene all of a sudden it is not the white activists with multicolor hair. That woman that did her son in by telling him you are not supposed to be on the streets and then the age of the demonstrators in this case, school aged demonstrators, all black, all protesting every aspect of their total living condition, not just what the cops did to them. Okay. And were going to talk about this whole crime situation. We have to also talk about the victims of crime. Africanamericans are disproportionately arrested but theyre also disproportionately victims of crime as well if you look at the stats. The numbers are just staggering. Even, you know, we only have 6 of the population of San Francisco are African Americans. In my conversations with jeff adache our public defender a couple of days ago, more than 50 of the people arrested in San Francisco are African Americans. Think about that. Only 6 of the pop lakes and youre more than 50 percent of the persons who are arrested. You take a look at the School District, and suddenly you see. We make up almost, you know, maybe 8, 9 of the school population, and the dropout rate as well as the nongraduating rate is all above 70 . All those things says were not doing something in america correctly about black people. What we learned in baltimore was the Life Expectancy in the poorest communities is greater in syria than it is in some of these poorer communities where africanamericans are living in this country, and thats an issue where i mean n is so complex, its going to be hard to get our arms around all the different aspects of what has created the situation. But carla, this may be for the first time the opportunity where you dont worry about what sharpton thinks. You dont worry about what cornell west thinks, you dont worry about what any of that crowd that normally represents inspiration and protest in racial situations, now maybe we can get america focused on the idea that we really do need to do something about poverty in this country, period. That city is considering making it over 14 bucks an hour. The council is holding a public hearing on tuesday. If it passes, the new minimum wage would go into effect on july 1st. San franciscos minimum wage just went from 11. 05 to 12. 25 an hour. Voters approved the hike last november. This is the first in a set of increases by 2018. The minimum wage will be 15 an hour. Emeryvilles proposal is interesting why emeryville. Its a city that really relies mainly on commerce. Thats one question. The other question is what bay area city is going to be next because weve seen it sort of go from city to city to cities. Its been on the ballot in San Francisco, oakland, berkeley, emeryville. Whos going to come up with the next one. Meanwhile former Hewlett Packard ceo carly fee rena is about to throw her hat in the president ial race. Shes expected to make the announcement that shes running for the republican nomination. Shes been spending time talking in iowa and attempting to distance herself from hillary clinton. Its going to be make it interesting for the republicans because shes a new voice in that mix. Speaking of hillary clinton, shes going to be back in the bay area this week. Her first appearance is wednesday in San Francisco. Clinton also has a lunch scheduled for friday at Silicon Valley home of ceo john donohue and also for tickets for these events are expected to be 2700 per person. The maximum donation for the 216 president ial primary. Wind power versus birds. Theyre going to make their case on tuesday. Its all about the Wind Turbines in the area around altamont pass. They kill thousands of birds each year. The east Bay Regional Park District and the Audubon Society are urging county officials to support more bird friendly Wind Turbines. And the number of birds that theyve killed, that has to be stopped. It providers 100 million in economic business, 40 high skilled jobs. Supervisors granted a lease extension to the company that runs the turbines for another three years. The supervisors defied recommendations by the state Attorney Generals Office and the u. S. Fish and wildlife service. It is interesting. Its one of those environmental choices that you have to make. Birds versus clean energy in this case wind. Lets not forget jobs as well. Thats a job issue there in the altamonte area as well. They just want new they want new turbines. Theyre not trying to take them out. Wind powers not going away. Weve got to figure this out. Right. And lets not forget in other areas like solar down in the south in the desert theyre talking about putting huge solar panels up and environmentalists are concerned that would change the desert habitat. More people in the south bay may soon be Drinking Water that went drown the drain and even the toilet. Thats right. San jose leaders are calling on state lawmakers to ease environmental restrictions that would allow them to fast track a major expansion of the recycling facility which turns wastewater into Drinking Water. The water is set to go through a series of hightech filters that remove even microscopic contaminant and get zapped with uv light to further sterilize it. Then it goes into ponds. We may be in a new normal of very dry conditions and weve got to move quickly to ensure we have the water to support our residents residents and to support the Economic Growth thats so essential here. The facility recycles up to 8 milliongallons of water a day. That is enough water in theory to supply more than 17,000 households. It will be interesting to see if the state approves this Expansion Plan and if people can get over the ick factor. In order to get over the ick factor they have to expand those facilities and there is a move in sacramento to fast track this. Like i said, new technology doesnt necessarily mean its going to happen quickly. The Golden State Warriors continue their post season run today at o. Co with their first game against the Memphis Grizzlies at 12 30. Theres another battle looming in the bay area over their new arena. A group of big donors for uca San Francisco has formed a fight that calls the plan flawed and say the mission bay plan needs to change. They claim the warriors games and giants games will create traffic parks that could hurt the new ucsf hospital. It was not designed for an 18,000 seat arena with 200 events annually to be right next to a hospital to be in the midst of Biosciences Research facilities. This is going to be something that kills decades worth of investment. Now the warriors coowner says its common for nba arenas to be near hospitals. There are 73nba arenas across the country within a mile of a hospital. This is a new push for opposition. It almost seemed like that arena was a done deal. This is a subject of your column. It did appear that the arena was a done deal. It is interesting to note theres big ucf private donors, people who contributed to the hospital and want it to be the preeminent Health Center in the world are raising questions. Now the issue and real questions going to be whether they want the plan modified, in other words cut down, scaled back in order to accommodate parking traffic in the neighborhood or if in fact, they want it stopped so that the hospital can take that land and grow on it itself. That is going to be something were going to see evolve in the next couple of weeks. Whats the next step in the process . Its the Environmental Impact report comes out in the next couple of weeks and theyre going to take a look at that and find out exactly what the warriors plan is and the what the opposition plans to do about it. Where we were talking about people using their cell phones to record if they saw any kind of misconduct by passengers, by anybody else, and the acl you was not happy with that. They said it would basically turn everybody into the eyes and the ears of the police. Why is it okay to record the police but not other crimes. Right, look theres a power imbalance. We understand that the absolute that power corrupts and absolute power corrupts absolutely. What weve seen time and time again with unfortunate Police Killings is that the police are able to hide behind a blue wall of silence, and this really brings resources back to a community that have again over policed and under resourced so that we can actually record whats happening and really bring some sunlight to the situation in ways that kind of breaks down that blue wall of silence. Its also interesting on these videos of Police Misconduct as well because im taking the other side, the devils advocate is sometimes they show the part of it and sometimes we see the full video and it tells a different story. Right. This gives us the broader the view the better chance we have to really fully understand whats going on. Everybody is Walking Around with a cell phone in their pocket, so lets have lots of eyes and ears on the interactions as a whole so as you said we can fully understand what happened. Where are you on Police Cameras cameras body cameras are you in favor of it . I am in favor of body cameras in the sense it gives us more information. It doesnt give us all the information. The Police Actually the view is recording you rather than really being able to also see what police are doing. Thats an interesting point because with a Police Body Cam which is being pushed all around the country now from the white house on down, it is recording you, and your conduct when a Police Officer approaches you which to be honest a lot of times you dont look too good. People dont look too good when the police show up in the senate. That is going how would you feel about that going public all the time . Sure. You know, i think that people understandably often have a lot of fear when their interactions with the police that make them act in ways that arent necessarily 100 rationale. Theres a power imbalance there, and so i think whats important is really understanding that we need lots of eyes and ears. This app is really the peoples body cam. If you have an incident with the police, you put up your app, or lets say didnt have misconduct but you had a bad day, how would you feel about it showing up me going in there and saying i want zacharys video of this encounter and put it up on youtube. What this app does is gives you the opportunity, gives you some of the power to be able to report it to the aclu, what you believe happened. They then have attorneys who are reviewing this and then can act on it as necessary. And that really gives us some democracyization of the process. More of us can be able to record and witness whats happening. The other cool function of the app is that you can actually get alerts. So if someone is having a Police Encounter and you subscribe to these alerts, then basically you can go and be an additional witness to make sure, again, that we have as much sunlight on whats happening as possible.
