Breaking news this morning near Portola Valley where one man is dead in that crash of that small party bus that liza just told you about. Chp says the bus was headed northbound on interstate 280 just before 11 00 last night when it went off the road and hit a tree. The driver fled the scene. Officers are trying to determine if he is the driver. All lanes were reopened a short time ago. Another bart crisis is averted. Negotiations are at a standstill again. The bad news for bart and its two unions, talks are at a standstill. The unions left last night claiming nothing was accomplished in 5 1 2 hours of talks yesterday. Bart says the unions walked out on the latest proposal. The agency made a couple of adjustments late saturday night. They are now offering bart workers a 10 wage increase over four years and reduced employee contribution to their pensions. Unions say barts proposal does not cover all the major points including safety. There is insufficient lighting in the tracks, tunnels and stations. Theres human excrement and urine all over the system. I believe it was a fair package for the union for the riders and for barts long term investment. Reporter yesterday a San Francisco superior court judge granted the governors request for a 60day coolingoff period. That means no strike no lockout until midnight october 10. Fire and Public Works Department have managed to shut that water off. Smoke is pouring into the sky as wildfires burn through hundreds of acres in placer county. The american fire is burning in a heavily forested area at the Tahoe National forest. It started around 4 30 on saturday. The terrain is difficult making it difficult for firefighters to access. Its already charred 800 acres but the large amount of smoke prevents officials from determining the exact acreage. Close to the canyon so were watching the smoke. Were always concerned about arson. Were also concerned about human cause. Multiple engines, bulldozers, air tankers and helicopters are fighting the fire. The cause is under investigation. The silver fire has done a lot of damage since it started wednesday but firefighters in Riverside County say they are gaining a little ground on it. They say these flames have stopped advancing and are now 90 contained. The fire is expected to be fully contained later today. Silver fire has burned 26 homes and threatened more than 500 others. Hannah anderson is safe and with her father after she was held captive for a week. The San Diego County teen was rescued in the idaho backcountry on saturday. Law enforcement shot and killed this man, james dimaggio, who was suspected of kidnapping her. Investigators were tipped off by horseback riders who saw anderson and dimaggio and thought they were peculiar. They were just like a square peg into a round hole. He might have been an outdoorsman in california but he was not an outdoorsman in idaho and he didnt fit. Mark john says when he got home he saw the amber alert and called police. Reporter im at stanford hospital where we are now here because a man believed to be the driver is being treated and the chp says he is not being cooperative. Lets back up a little bit until about 11 00 last night where the accident happened on 280 near the alpine road exit. This was going northbound on 280. The driver apparently lost control hit a tree and rolled down an embankment. When the chp arrived, a very they arrived to a very gory scene. They saw the party bus apparently mangled the front ride side passenger still belted in was dead on scene. There was nobody he is on the bus at the time except one man found lingering around the area. He was uncooperative. Chp believes he may be the driver. He was brought to stanford hospital to be checked out. This was a chevy e3500. There is a cab in the front and passenger area in the back. So commonly known as a party bus. But the wreckage was just so mangled, the chp has not been able to determine at this time what bus company may have been involved or any other details. There were no other people, they believe, involved in the crash. They surveyed the area to see if there was anyone ejected. They did not believe that there was anybody else involved. The victim is a man who is described as latino from San Francisco age 37 or 38 years old. Dui is not expected to be a is not at this point under investigation. But speed and driving under the influence intoxication is not expected to be a factor at this point. And, uhm, so the scene is still ongoing. This again is on 280 for drivers coming up the area theres quite a bit of debris and glass on the road but chp is clearing that area right now. So slow down near alpine road on 280. Sue, wasnt there another deadly party bus crash in the Santa Cruz Mountains last year . Reporter thats right. In july of 2012, there was a santa cruz woman who died when she was ejected from the rolled out of the back of the door that flew open on a party bus there. That was on highway 17. They are going from a concert near shoreline back up to santa cruz. One thing to note, frank, is that as more attention is called to limousine fires and accidents and party bus accidents, the call for regulation and more oversight into this area into this industry is being highlighted.
