The tanker cars are owned or leased by Oil Companies that dont want to pay. There are alternatives they can afford them. Reporter he says fracked bakken crude isnt the only threat. Trains are now also hauling tar sand oil. The dirtiest kind of crude. It sinks to the bottom when it gets into water body like the bay or bay delta and this has happened in other parts of the country already. Reporter meanwhile, seven months after the quebec disaster trains just started to roll through town again. The first thing that they rebuilt was the railroad. Okay . Reporter no tankers yet. She says this time her town wont allow it. We are thousands of people. So if everybody stands up, im sure that this is hope. Reporter now, she formed a Grassroots Committee in quebec and now is working with groups right here in the bay area to try to keep these kinds of crude by rail accidents from happening here next. Her words, we are thousands of people. Were millions of people here. This has the potential to be going through neighborhoods with millions of homes, schools, hospitals. Reporter thats why its so important that these activists are talking about not having these rail lines go through heavily populated areas. So well see what happens here. All right. Christin ayers, thank you. Two of the countrys largest Supermarket Chains are merging. The investment term that owns albertsons announced today it is closing a 9 billion deal to buy safeway. But before that deal was reported, julie watts tells us there was another major announcement about the food store. Julie. Reporter yeah, liz. This announcement may be the one that matters most to consumers. We have been investigating complaints that safeway is overcharging customers. Today the retailer reached a settlement. With d. A. S from across the state and that settlement was on charges of false advertising and unfair competition related to various price discrepancies. My sister shops here. She has had the same problem. A friend of hers has had the same problem. Reporter and so have we. I didnt get my savings on this. You did. Reporter over the past year and a half our undercover investigations have revealed safeway repeatedly overcharged customers. So thats the wrong sign . Charging more at the register than the posted or advertised price. In one day we were overcharged five times at five stores and were not alone. 2012 statewide records revealed county inspectors were overcharged on one out of every 50 items and consumer after consumer complained the overcharges continue in spite of the fact that safeway and Southern California von stores have been sued by the state three times. Today marks the fourth. Why should we believe that safeway will change its ways this time. Its two parts, making sure they are punished for the past deeds but making sure that Going Forward there is enough bite in the judgment to make it stick. Reporter Deputy District Attorney andy perez says in addition to safeways 2. 2 million fine, the settlement requires the grocer to hire third party price accuracy auditors. And on your next trip to safeway youll likely notice these new signs outlining its price accuracy policy. As a result of previous lawsuits, safeway was already required to give you overcharged items for free or a 5 gift card depending on the price. One of the other issues that we saw especially with your reports was that people were claiming they had no knowledge of the policy. Reporter shouldnt i get it for free because i was overcharged . No. I never seen that. Reporter following this most recent settlement, store employees will be retrained on the policy but at the end of the day, its still up to consumers to check their receipts and hold the retailer accountable. This is supposed to be 30 off. Reporter now, safeway has always contended its price accuracy rates were consistent with the industry norm. But tonight it tells us in a statement that the settlement was due to, quote, inconsistency in communicating its scan accuracy guarantee to its customers. The lowincome housing complex rents here are a fraction of the going rate for san jose, one of the least affordable cities in the nation. Norah, her sister and mother just moved in. Reporter liz, a lot of people here in stockton certainly hope it is some sort of a boost of for them, although theyre not really sure what it could be or when that will happen. But i can tell you that up until about 3 30, i was standing on that side of the river. About 60 feet away from the barge, when we first drove up i laughed because here they had kept us so far away from the barge when it was docked at Treasure Island. And then we come to stockton and i can almost reach out and touch it. But we first reported that stockton was its intended destination once the barge was getting kicked out of San Francisco bay for lack of proper permits. After 7. 5 hours up river, here it is. Reporter unless google could cover the barge with harry potters cloak of invisibility, there was no way to slip it away undetected from its dock at Treasure Island even under the cover of darkness. As kpix 5 first confirmed a week and a half ago, it was headed to its new home in stockton. Anytime you put the name stockton and google in the same sentence, its got to be good. As chopper 5 followed its progress up river, 80 miles from San Francisco, it was moving out of reach of the jurisdiction of the bay conservation and development commission. Bcdc said google lacked the proper permits to build the barge. Official word at the port of stockton was, we didnt know the barge was coming until 2 00 this morning. And its not unusual for many people to look at port facilities and not necessarily disclose what their project is. Im fairly certain that probably happened in this case. Reporter really . Well, somebody had enough notice to have this welcome banner made and put up before the barges arrival. Forewarned or not, the ports happy to add google to its list of clients. Googles statement about the relocation did allow the company to place tongue firmly in cheek saying, our barge has grown tired of all the attention. So we are moving it to stockton where it can have a break, enjoy the citys delicious asparagus and warmer climate. It will be here for six months. Google is paying the port 12,000 a month to moor the barge. But bcdc will be watching for the barges return to the bay for which it will need permits. If google were to moor the barge here, then google and whoever controls this land from which people are going to go into the barge, will probably jointly apply for a permit because there will be a change of use for that land. Reporter any return of course to San Francisco bay still a ways off because they have to finish construction on the barge but we have seen a few people stop by here to take pictures, a couple of boats have cruised by in the channel. It also says that the cost savings from the merger will allow it to actually improve and remodel some of its stores and even lower prices for consumers. Safeway operates more than 1300 stores in 20 states and employs 138,000 people. But some analysts say that the concept of the one size fits all Grocery Store like safeway may be coming to an end as consumers flock to Specialty Stores and online sites like amazon. Com. She says oakland is on pace to build 7500 new units bringing 10,000 people into oakland, most of those young people and techies who are priced out of San Francisco. While some worry the plan will backfire and push out low income families, the mayor says not so. When we build here we dont necessarily have to tear down something and push people out. Mayor quan will face a crowded field as she runs for re election in november San Jose Police finally stopped two men they dubbed the cant stop wont stop bandits. Jesus beltran escobar and Angel Rodriguez leone have been linked to 20 armed robberies since december. The police say these two guys held up various Liquor Stores and small markets in san jose. They recently became even more brazen. You can see the suspect firing a shot at the ceiling during this Convenience Store robbery. The night of february 28th an officer spotted one of the suspects as he left the store, hopped into a getaway car. That officer called for backup. Helicopter video shows the officers chasing the suspect and eventually taking them down. Both men have now been booked into the Santa Clara County jail. Nearly four decades after the murder trial went cold, the the murder trail went cold, the fbi has a task force reinvestigating a series of serial killings. In the first four months of 1976, five young women were found stabbed to death in san mateo county. No suspect has ever been identified. But at a press Conference Today the fbi announced a new connection in those cases to a Nursing Student who was killed in reno around the same time. The fbi believes the suspect in the san mateo cases was an accomplice in the reno case. The main purpose is to ask people to reach back to their memories in 1976 and if there was anything unusual about an person in the area who traveled to reno back and forth had business there, we are just trying to jog peoples memories and potentially get some information from the public. All the victims are around 19 to 20 years old. Many had car problems around the time they were killed. Other bay area headlines tonight a teenaged driver died in a nasty wreck this morning along highway 24 in lafayette. The car badly mangled as you can see there. Chp says the driver drifted out of his lane and slammed into a traffic sign. The car wound up down an embankment. Investigators say the driver may have been speeding. San Francisco Mayor ed lee made those comments today during the announcement of a new effort to reduce deadly pedestrian accidents. The program is called, walk first. It includes 17 million to reengineer dangerous intersections and ramp up traffic enforcement. This huge tree knocked out power to a neighborhood in redwood city this morning. This happened on vera between hudson and king. No homes were damaged. No injuries. The crews spent most of the day cutting it up. Homes in san jose were evacuated for a gas leak today. It happened on artist drive this morning. No word on what caused the leak. Five more states now trying to scramble californias new egg law. You never thought you would have a segue from a muumuu but im standing in front of about 400 head of cattle. They are happy they have food there is food coming out of the ground and this right here in front of me, this low canopy of grass thats popped up over the past couple of weeks is such a wonderful sign. If you were out here, mount diablo, a month ago, it looked as brown as august or september. Then we finally got rain. And the ground responds pretty quickly. Nature will respond quickly when we get the rainfall and look at all the green in front of me. Of course the dead stuff from last year. We have a nice canopy of green beginning and hopefully well get some additional rainfall to make things get back to normal or as close as we can be. We had rain and thunder in the east bay lots of reports of thunder in lightning. Mount tam 2 of rainfall. Lesser amounts in fremont and San Francisco but well take about a third. Third in concord. Mount diablo about. 25 of rainfall. South bay the storm petered out by the time it made it to you. 02 in san jose and thats it. Kpix 5 hidef doppler has been tracking a few isolated showers in the north bay. We are talking just a few specks of green now. And they are moving out of sonoma out of napa and dancing off to the east. Overnight lows tonight partly cloudy skies so it wont be as mild. Mid40s in san rafael and concord. 48 san jose. Reporter but today his life is quiet in mendocino county. He completed nearly 50 triathlons and the founder of the Point Arena High School team the first of its kind. The first day in the pool they couldnt even swim one lap. Now they can swim a mile and a half in the ocean. Reporter triathlon was introduced in the olympics in 2000. Its becoming a division one ncaa sport for women in the fall and mason has talked 30 california high schools into joining a conference he created. Its great to see that little light go on in their heads that, wow, i can do this because the first day theyre like thinking, i mean, how can anybody do that, you know . Thats insane. Definitely has a passion for it. He will get stressed sometimes but he always is definitely supportive and excited to do it all. How come he gets stressed . Probably us, driving him nuts after a ten hour car drive. We all had our own bikes, freedom, baby, as kids. They dont have bikes. A lot of these kids never rode bikes before. Youre kids, what do you mean . Reporter he estimates he needs 1,000 to operate annually and some of the bikes are donated. Last month he organized the firstever triathlon hosted by a high school. And he hopes the cis will eventually sanction the sport. His crusade only strengthens with the numbers. We need about 60 high schools. My goal from day one is to make it a cif sport so when these kids have kids they go out for triathlon and like going out for football or baseball, no big deal. Life after the big stage. Very cool.
