Reporter businesses were boarded up and closed to be sure. Four Southern School districts closed. The second time this week. Several stir crazy students took to the streets to keep themselves busy. Reporter they dump truck and driver at the heart of this accident were cleaning up a mudslide that still has the northbound lanes on highway 17 blocked but the work there came grinding to a halt after something went wrong during our noon news. The shock, sadness and concern with on the faces of the coworkers who watched as firefighters and paramedics tended to the friends. They came out like a whirlwind jumping into action. Reporter one construction work deader and another seriously injured. It happened on live tv. There are a lot of chp crews out here. Reporter kpix 5s maria medina was reporting live in our noon broadcast when the honking horn of a passing driver alerted her something went very wrong. Reporter a woman on 17 was yelling and she just wouldnt stop. Unfortunately, she was trying to get the attention of a chp officer. Reporter the driver who was too shaken up by what she had witnessed to talk on camera told me that she was driving past the mudslide when she saw a construction worker who was crushed under a dump truck. That was only part of the story. There was a second worker trapped injured but very much alive. Trying to clear out the landslide they are trying to make it easier and then Something Like this happens. Its very, very heartbreaking for all of us. Reporter officers and firefighters pulled him from under the truck. The workers around them shaken. So a very sad thing. Reporter the injured man was rushed to the hospital. Investigators try to figure out what happened. The workerss company said granite rock is devastated and cooperating with authorities to help figure out what happened. From the mudslides to flooding to downed trees Santa Cruz County leaders say storm from december up to this point have caused an estimated 25 million in damage to roads, businesses, schools and homes. Chief meteorologist paul deanno joins us and paul, folks are wondering when it will stop. Coming soon but right now, on the radar the one spot getting the heaviest rainfall would be the Santa Cruz Mountains. Working its way from north to south clearing most of the bay area but the last spot to get the heavy rainfall right now is right along highway 17. The bulls eye and the report you just saw its also raining in milpitas, san jose, morgan hill, gilroy but its cleared fremont and palo alto. So slowly working its way south and east. On the other side of the boundary we still have lighter scattered showers along highway 24 through lafayette. 680 through danville and san ramon stretching to antioch and light rain in Sonoma County. Numerous flash flood warnings continue including the sonoma creek in southeastern Sonoma County. Flash flooding has been occurring there. Glen ellen, all afternoon long that will expire in about 20 minutes. And we also still have a Winter Weather advisory in the sierra foothills and a winter storm warning continuing at the top of the sierra where we can see an additional 36 inches of snow and the Russian River will have a second crest of 38. 7 feet at lunchtime tomorrow. But the rain finally is winding down. Well talk about what happens for the weekend and when the next chance of rain will happen coming up. Crews are looking for trash looking over the san fransesquito creek using drones. How clearing the debris could save residents from serious dark. Mark sayre reports. Reporter right now were on west Bayshore Road next to highway 101 on the palo alto border. Caltrans is out here dipping over the side into san fransesquito creek and pulling out extremely large pieces of wood and debris. We have seen entire tree trunks up here in the past halfhour that we have been watching and this all is a culmination of an allday effort to carefully watch this creek. This worker is one of many routinely keeping an eye on san fransesquito creek throughout the day crews rotating through to monitor potential debris buildup at the drainage culvert under 101. I was just looking for the water level and the debris in the water. You know, we have had a lot of tree debris lots of branches and twigs and then full trees coming down the creek this week. Reporter caltrans has stationed a crane here ready to pull out any heavy debris this threatens water under the highway into the bay on the other side of highway 101, this auto garage worker has been keeping track of the rising water. Every halfhour, 45 minutes, just to get an idea where we are at. Reporter crews with the menlo park Fire Protection district are using drones to fly key areas of concern along the creek. The drones allow a realtime perspective that would otherwise not be possible. Work to improve this particular floodprone area is under way with caltrans adding a culvert under 101. The Regional Group that manages flood risk in the creek its a very narrow creek and steep in many locations so the water rises quickly. Reporter back to a live picture here along west bayshore, caltrans working. It takes a few hours for the rain to accumulate to come down to the bay. So the concern here is going to ramp up. The rain is subsiding but that doesnt mean this particular known problem area is out of the woods just yet. They will monitor it as the evening goes on. Im mark sayre, kpix 5. This evening the Russian River is rising and our Elizabeth Cook says guerneville residents are keeping a nervous eye on it. They are. Reporter the rain has been relentless. No one is out of the woods. Anyone near a creek or stream leading into the Russian River is also seeing flooding on their properties. You can see the Mark West Creek here normally about 4 deep right now is approaching 10 feet in some parts. Now its going over river road in guerneville this evening stranding at least one home. You can see it here in this live picture. The Mark West Creek connects to the Russian River just up the road from there and as you can see, this area will need a while to dry. Another concern this evening is those sagging hillsides around guerneville. The mountains and hillside is a little concerning seeing all the coverage on the landslides and traveling around seeing the landslides all overtown. That resident also says she is worried about the Russian River blocking off parts of niely road which would stranding several residents there. And further west in Sonoma County along highway 1 People Living near the town of jenner could see major delays if they need emergency services. Highway 1 is down to one lane and deputies fear the whole thing will soon have to be shut down. Now, if highway 1 does have to be fully closed, deputies say every medical call could require a helicopter to get in. Thank you. We are just getting word highway 92 has reopened. There really isnt a place for the water to go so anytime theres any water thats falling on the ground its trying to find its fastest way towards the ocean and to the bay and for us here in marin county that means going through our local creeks and streams,s thats where the problems occur. And as the rain continues to collect in lowlying areas, many businesses in downtown san anselmo are closed down today. The merchants have a big burden and many of them have moved out. Water flooded the lanes in both directions between atherton avenue and 101. Use an alternate. A terrifying experience for an east bay man. He was inside his home when a mudslide came barreling through. The mud flowed down the hill behind his house on van tassle lane in orinda. The slide is massive several hundred yards high and hundreds of feet wide. The homeowner says he is lucky to be alive. I was hiding in the bathroom and, in fact, in the back of it and i realized i might be trapped. There was no window or way out. So i went ahead and ran over the slide and out the door. No one was hurt in the slide but the rear of the house is crushed. And the mud is still slowly moving. The home has been redtagged and no one is allowed to go inside. In butte county engineers working around the clock to try to figure out a fix for this gaping hole thats getting bigger in the oroville dam spillway. Ken bastida tells us in the meantime they have no choice, right, ken . They have to keep using that . Reporter they do, allen. Its scary to even look at this thing. That crater has more than doubled in size since it was first discovered tuesday. And this is why. Chunks of concrete went flying yesterday when engineers tested it. Those tests made the erosion damage even worse. But with the reservoir rising by six inches an hour, they have to keep dumping water into the Feather River below it keep it from overflowing. They are monitoring the spill bay continuously. We have engineers dam safety engineers at various points in the area around the spillway. We have cameras stationed in various locations. We are also using drones and other technology to monitor the spillway. And this is a 24hour operation. People are freaked out by this thing. State officials insist there is no threat to communities downstream. And no evacuations or flooding are expected. There is an emergency spillway right next to the damaged one but as you can see from this map, it opens right on to the bare hillside. So they want to avoid using that at all costs. The concern, flooding the river with mud and debris if that were to come down endangering the baby salmon in a hatchery just downstream. Earlier today, though the hatchery workers trucked about 4 million of those hatchlings to safer water to get them out of the way in case. Thank you. Unprecedented, paul. It is. So a reservoir that we couldnt fill two years ago and now the spillway because we have to get the water out is broken. Exactly. Thats unprecedented. I dont know what to do. Now the front is hung up over the south bay which will mean even more problems for the Santa Cruz Mountains as the rain is falling at a clip of about half inch of rain per hour. Thats fast. So seattle pretty wet place in the winter, right . Yeah. Lived there for a while. I can confirm it. San francisco has 50 more rainfall than seattle so far this winter. And look at santa rosa. Santa rosa has received 3 times as much rain as the Pacific Northwest has this winter. Santa rosa coming up on 28 inches of rain just this calendar year. Its february 9 how about the weekend . Reporter flooding is a problem here am i just got word from napa county roads a couple of minutes ago that the river has jumped its banks again up in saint helena and thats to be expected here. Its just the frequency of the flooding thats unfamiliar. For the second time this week, the napa river jumped its banks flooding roads. Linda walked down to the riverside herself to see if evacuating would be necessary. Just to see if it might be flooding, if should leave my house go stay with my daughter since its so close. Reporter wine country just cant seem to catch a break with Mother Nature this year. City leaders keep watching the bypass fill up, thankful that water isnt downtown. This is the fourth time we have seen it in a matter of a month and a half. Going into action we close the gates and its done what it should and we have been able to get in there after the waters recede, open it up back to the public. Reporter this is big ranch road in napa which has flooded today due to the storm. It doesnt ordinarily have trouble with flooding. But residents say this type of flooding is common. This seems to be a little lighter than what we experience the a couple of weeks ago. Reporter the real problem is up in the mountains. Mount veeder saw multiple slides cracking roads and crushing power lines. 341 people in napa are without power from the storms this week. This person from napa county roads will tell you when the rain stops damage will be done. We are going to be oversaturated soils for quite a while 30 to 45 days and thats what we do. Well continue to monitor our roads and keep them clean. Reporter he told me they will continue to monitor the roads and the river overnight. They are expecting some minor flooding in the usual places. But its those mudslides the unpredictable ones up in the hills that they are most concerned about. Live in napa, Susie Steimle, kpix 5. Despite one of the rainiest years many can remember, hundreds of thousands of people in the bay area are in for a big boost to their water bills. Kpix 5s da lin was at a protest to fight back against the hike. Reporter retired teacher sally morgan is on a fixed income. She found out her water agency wants to increase her water bill again, and she was outraged. Have this huge increase in one year, its just it will be hard for us. Reporter her water provider has increased her rates almost every year since 1999. In 2013, it went up by 100 . This time, the Alameda County Water District proposes to increase rates by 25 for 2017 and 5 for next year. The districts general manager says some of the money would go toward infrastructure. But most of it would go to employee salaries and unfunded pension an benefits liability. The Water District rates are still below the median of the 30 bay area agencies that we benchmark to. Reporter a lot of customers are upset because when they looked up, rain is falling at a record amount. Yet their water agency wants to charge more for water. But the agency says its not that simple. Very little of the districts expenses is actually associated with how much it rains. What we provide is a service. Reporter the small agency serves about 350,000 customers in fremont, newark and union city. Ratepayers have long complained of the agencys generous salaries and benefits. We have been disappointed and angered by an agency that seems out of control. Reporter sally says she cant afford it. She is going back to work as a sub so she can pay her bills. I like to travel as much as i can. But, you know, thats going to have to get cut back. Reporter the district directors will vote tonight on whether or not to increase the rates. Some customers say they will be here to speak up and protest. In fremont, im da lin, kpix 5. We have made major progress against the drought. We are not done yet. A federal Appeals Court in San Francisco ruling against president Donald Trumps travel ban. Kpix 5s melissa caen with more on what this ruling means for the administrations immigration policy. Reporter were live here at the ninth Circuit Court of appeals in San Francisco where earlier today, clerks handed out copies of a ruling that at least for now puts one of president Donald Trumps executive orders on hold. At around 3 00 today, three judges unanimously rejected mr. Trumps attempt to restart his ban on refugees and immigrants from certain countries. The feds argued that this is an emergency because the other court the one that stopped the executive order had overstepped its bounds in even weighing in on a matter of national security. The ninth circuit today disagreed ruling, courts are not powerless to review the political branchs actions with respect to national security. The ruling also pointed out that despite being asked over and over again, the government has pointed to no evidence that any alien from any of the countries named in the order has perpetrated a terror attack in the United States. Mr. Trumps lawyers argued that the 7 nations that were singled out in the executive order were identified by congress and the obama administration. So they shouldnt need any more proof. The court disagreed and at least one activist at the court today is thrilled. Im very pleased with this decision and i hope it sends a clear message to trump and steve bannon to respect the rule of law and to respect judges. Reporter he noted Donald Trumps sister marianne is a judge for the third circuit. That has not stopped mr. Trump from speaking out about this case. He tweeted this afternoon, see you in court, the security of our nation is at stake. That seems to indicate that he would like to appeal this decision to the United States supreme court. Which he can do. That would require five of the eight sitting justices to grow to hear the case. At least one expert we talked to today said thats unlikely. The u. S. Could decide to go to Justice Kennedy in washington, dc the circuit justice right now and ask him for a stay but he is likely to refer anything like that to the entire court and then it would require five votes to overturn what the ninth circuit did this afternoon. Thats not very likely. Reporter now, when the executive order was first released, there was some question about whether it applies to green cardholders. Well, later the White House Office of counsel issued a statement saying, it does not, that green cardholders are not banned. In todays ruling, the ninth circuit said not good enough. We are going to examine the executive order as it is written and if the president wants to change it with regard to green cardholders he will have to amend it himself. Melissa caen, kpix 5. Donna were sill the interim chair of the Democratic National committee had this to say lets be clear, this is a massive blow to the white house. The court upheld that we do not discriminate based on religion. We learned today that bart wants to protect undocumented immigrants by becoming what you might call a sanctuary transit system. Current bart policy says that officers may notify federal authorities after they arrest an undocumented immigrant but at the bart Board Meeting today two members called for the policy to be change. They want to prohibit bart police from cooperating with federal immigration agents. President trump is getting tough on crime with a new attorney general by his side. Department of just trial lawyer and partner in a big washington, dc law firm but he was arrested here in the lobby of the cupertino garden inn for allegedly trying to sell a copy of a sealed lawsuit against a sunnyvale Tech Security firm. He believeddest selling the documents to an employee of that tech firm for 310,000 in bitcoin. But instead, it was an fbi agent who arrested him on the spot. He is calling himself dan. He was in disguise wearing a wig at the time of the arrest while he was being hauled in, he allegedly told the agents, my life is over. He was fired by his law firm and he is now facing contempt of court charges. The tech firm is under investigation in a whistle blower lawsuit for allegedly bilking the government. In such cases, the Justice Department may investigate for months or years before the company ever knows. Its not clear how the wertkin got a copy of the lawsuit but its valuable information obviously that he thought he could sell. He tried to sell it to someone who called the fbi who set up the sting.
