Tomorrow in San Francisco, activists will deliver about 1 million signatures to the California Commission on Judicial Performance demanding the commissioner remove judge aaron persky from the bench. But as kpix 5 reporter devin fehely tells us, a powerful voice in Santa Clara County is coming to the judges defense. Reporter thats right. The Santa Clara County public defender has a reputation as both a feminist and as a fierce defender of the people who her office represents. And she says even though judge persky has been widely criticized, she is now coming to his defense. I think the sentence is fair. Reporter public defender molly oneil may be one of very few peel to believe that. Judge aaron persky is facing backlash against his decision to sentence former stanford swimmer brock turner to six months in county jail for Sexual Assaulting a drunk unconscious woman at a party last year. She says it was the right call. This was a rough decision to make for judge persky but mr. Turner is in fact going to go to jail. He is a convicted felon. He will have to register as a sex offender for his entire life. Reporter it was the victims letter to the court and her attacker which has been read and shared millions of times online that ignited the social media firestorm. Since then the judge has received Death Threats and blasted as biased. Tens of thousands have signed online petitions demanding he be recalled from office and removed from the bench. But even one of his most outspoken critics believes that is simply taking things too far. He is neutral in the trial. I dont think the fact that he went to stanford had anything to do with it. Reporter while big attention is focused on how much time turner will spend in jail, likely three months of a sixmonth sentence, oneil says the judge almost certainly considered the lifetime implications of having to register as a sex offender. I think judge persky heard all the testimony weighed all the considerations, he is required to by law and arrived at the sentence through a fair process. There are several avenues by winning the judge could be reprimanded or removed from the bench although most legal experts seem to agree three outcome is unlikely and they question the fairness based on one controversial decision. In palo alto, devin fehely, kpix 5. The anger over the stanford sex assault case is leading to other problems for judge persky. Sources tell kpix 5 that up to 20 potential jurors on a poll of about in a pool of 90 refused to serve. They were let go. It happened yesterday during jury selection for an unrelated misdemeanor case. Potential jurors cited disagreements with the judge over the stanford case. I have never heard of potential jurors, people in the jury pool, boycotting a judge. Refusing to go in a courtroom saying they just couldnt be fair. I have never, ever heard of this before. Judge persky eventually seated a jury of 12 and 2 alternates. Not all potential jurors requesting excuse al probably just wanted to get out of jury duty. We are learning it is likely that brock turner will serve just half of his six months. He is scheduled to be released from jail on september 2. Theres three months after being admitted. The former stanford swimmer will not have a future with usa swimming. The organization has banned turner for life. It released a statement in part reading, usa swimming condemns the crime and actions committed by brock turner and all acts of sexual misconduct. This case is sparking a range of emotions across the country. And now were seeing responses from hollywood to the nations capital. Coming up at 6 30, how Vice President joe biden and Actress Lena Dunham are reaching out to the victim. Dramatic end to a Pleasanton Police chase. Take a look at this. Police eventually arrested the suspect. Nobody was injured. Were learning of another arrest and additional rescues in a kidnapping case in oakland. Investigators now confirm they rescued three teenaged girls ages 14, 15 and 16. The officers arrested a man and a woman. Detectives believe the suspects wanted to force those girls into prostitution. Reporter the bart board today unanimously sent the bond to the november ballot. It requires twothirds voter approval. It would add on average 35 to 55 a year to peoples property taxes. Most of the money would fix the aging infrastructure. Things like the electrical system and rails. No dispute, bart needs the money. But some elected leaders worry bart directors will misuse it. Maybe its a labor contract maybe if the labor contracts were more reasonable and the system were better managed perhaps we wouldnt need as much money in the bond. I oppose giving them any more money until they make reforms. Reporter last month phil matier exposed some bart workers who made excessive overtime amounts. Salary of 77,000 made an extra 139,000 in overtime. Reporter bart directors say theres no mismanagement. So far, oakland and San Francisco mayors are on board. These decisions that patients and their families are making at the end of life are intensely personal. Reporter dr. Steven lockhart says the process is well described in the law. It includes two verbal requests of their primary care physician, or their attending physician, um, which is separated by 15 days at a minimum. In addition a written request which must be witnessed and the patient also needs to be, um, found to be of sound mind. Mentally capable of making such a decision. And the clinical diagnosis has to be verified by an independent physician as well. Reporter sutter provided extensive training for its doctors and caregivers as well as support for those who dont want to prescribe this medication recognizing the law says any medical provider can opt out. The strength of this legislation is that if there are those who are opposed, they would simply never apply for it. Reporter its a position dan diaz says he respects. Patients who qualify and get the lethal prescription filled have the leeway to take the drug whenever they want. Another law that takes effect today, smokers have to be at least 21 to buy Tobacco Products in california. The idea is to prevent addiction before it starts. Ridge of High Pressure to our south area of low pressure to the southwest. Both giving us a southwest to northeast flow. Same latitude which means the same sun angle at the beach here we are in the 60s going about 105 miles to the east we are above 100 degrees. So the ocean influence is worth about 40 degrees. Thats how much cooling the Pacific Ocean can provide. On the weekend a change for saturday and sunday. Not a northwest wind which is one version of an onshore flow like we first thought. Instead, a north or northeast wind just for two days. Those two days are saturday and sunday. Minimizing the ocean influence which with that strong sun angle will mean temperatures making it well into the 80s away from the water. So out of the next seven days, there are only two that look to be above average saturday and sunday, both warmer than normal. Low cloud cover, fog, drizzle back again tonight anywhere near the water. But the clouds will spread just about everywhere. Another cool to mild day tomorrow and not just breezy. It will be windy in a few spots. So Even Stronger winds from the ocean tomorrow compared to today. And that warmup will be brief but its going to take both your weekend days. Highs tomorrow below average. Concord normal is 81.
