We are learning new details about one of the suspects in the shooting and machete attack on two Novato High School students. 17yearold Juan Carlos Martinez is one of two students arrested in the may 25 homicide. A third is still a fugitive. Now we are learning that just a week earlier, martinez was arrested on suspicion of raping and sodomizing a 15yearold classmate. Two days later he was released. Five days after that, the two students were found shot in the open space area near the end of Fairway Drive in novatos country club neighborhood. Prosecutors refuse to say if there is a connection. Martinez and 16yearold edwin guevera are charged as adults in the homicide case. Martinez is due back in court on june 29. New at 5 00 civil rights Attorney John Burris is filing a claim against the city of San Francisco over the Fatal Shooting of a homeless man. This is Surveillance Video of the shooting. Luis gongora was shot and killed by officers in april. Police say gongora had been threatening people while waving a knife and then charged at officers. Today burris was joined by the mans family and called the shooting unlawful and reckless. The fact that he had a knife is a basis to use deadly force, thats fundamentally wrong and unconstitutional. And burris says the claim is just the first step toward filing a lawsuit in the case San Francisco police just released new video to catch a stabbing suspect. The incident happened last friday in the earlymorning hours outside a bar or irving street. Police say this is the man who approached another guy from behind and stabbed him in the back unprovoked. You can see him walking down a dark street with a phone in one hand and what appears to be a knife in the other. The victim had a punctured lung. He was at a bar, decided he wanted to step outside and was texting on his cell phone. He had his back against the suspect who was walking on the sidewalk when the suspect approached him from behind and stabbed him and continued to walk away. Unprovoked. There was no rhyme or reason for doing this. The suspect is described as an asian man about 56, 150 pounds, wearing glasses. Pretty close call for a couple of friends in santa clara.
