Its important to understand and try to identify the particular individuals who are culpable and really stamp them out from our greek community. Theres no place for that in greek life. On any campus. Especially not uc berkeley. Reporter Campus Police sent an alert on social media to make stude students aware of the situation but unless a specific fraternity or victim come forward they have little to investigate. Berkeley police say they will be stepping up patrols, especially in the hours after tomorrows Football Game at memorial stadium. Were going to have a number of people out tomorrow night after the game doing both education and enforcement. Last night we had some educational efforts. Weve made contact this week with a number if not all of the fraternities, reminding them that if youre going to party, to try and do it in a safe manner. Were urging the students go out if theyre going to go out, be out with friends. Pay attention to whats in their drinks. Reporter Campus Police will patrol the South Campus Area along Fraternity Row tomorrow evening. That is despite the fact that it is Berkeley Police departments jurisdiction. This by the way is the first such incident reported this school year. There were five alleged incidents last october. The gun shot wound excuse me, the gunshot was accidental but the charges are very real. A san jose man is in legal trouble tonight after firing his rifle inside of his apartment. The bullet hit a 9yearold boy. Eric smith has now been officially charged with negligently firing his gun and being a felon in possession of a firearm and ammunition. Police say he accidentally shot himself in the foot. The bullet went through the floor, striking a little boy in the apartment below. That child is still hospitalized this evening but is recovering. A model rocket sparked a pressure fire behind a school not far from the playground where a halloween carnival was in full swing. It happened just before 2 00 this afternoon near Lagunitas School in marin county. At one point several homes were threatened. Fire grew to about five acres but 80 contained. Dozens of firefighters are still there tonight making sure the fire doesnt grow any bigger. At this point its not clear where the rocket came from but School Officials insist that it did not come from anyone on campus. New at 6 00, a valuable piece of land in the south bay. But its been empty and abandoned for years. Some of the neighbors there have been battling city hall with no luck. Now theyre stepping up their fight. They want a piece of they want this abandoned piece of land in their community turned into a park. Something they say is lacking on the east side of san jose. This empty parcel runs an entire block on south 31st street just off 101 in san jose. Damian trujillo is there with the explanation, a story youll see only on nbc bay area. Reporter there used to be homes around me but then cal trans bought this property to expand 101 via eminent domain. But then this arrived and the locals say theyve had enough. She plays in her small yard. Not allowed to wander outside the fence surrounding her home. I dont let her come out. Reporter this is why. The large piece of land across the street has been this way for years. People use it as a dumping ground. And the homeless have moved in. Sick and tired of it. Like i said, nobody needs to come in their neighborhood and see all this trash being around every day. Reporter three generations of the family have begged the city to clean up the property and turn it into a park. Something their neighborhood desperately needs. But nothings changed. In fact, police were on the property just the other day, questioning some of the homeless and looking for stolen property in a burglary case. Im very upset. Very upset. Reporter this week the city said it is listening. Theyre moving forward. Reporter councilwoman carrasco said the city is hoping to buy the property from cal trans and turn it into something the residents can use. The park, she says, would be perfect since parks are few and far between on the east side. If you look at the city as a whole, East San Jose has very few parks that serve its residents. Reporter residents on south 31st street say until they see the cleanup crews, theyll keep harassing city hall. The cal trans representative in the south bay is off for a couple of weeks so he was not able to respond to the possible sale of this land. The residents hope that sale happens soon. California prosecutors are coming together in los angeles with a firm message speed up executions for murderers sentenced to death. Theyre launching a ballot measure to restart the Death Penalty and shorten the time from conviction to execution. The position is getting support from former 49ers player kermit alexander. He was at todays gathering in los angeles. His mother, sister, and two nephews were murdered 30 years ago and the convicted killer is still on death row. Well, it is very frustrating. But its one thats worthwhile. So you keep fighting. What you try to do is try to outlast your enemies, as we put it. And if we keep pushing and keep pushing and keep pushing, eventually well get it done. The measure targeted for next year would appoint attorneys for death row inmates immediately, and now it can take years. California has only executed 13 inmates since 1979 and nearly 750 are still on death row. Most of them die of suicide or just illness. Heres your warning. If it smells funky or tastes a little off, its okay. Your Drinking Water is safe. Thats the message from the santa clara water district. The agency says its trying to minimize a dirtlike taste and smell in san joses tap water. The water again is safe to drink, but with less water in our local reservoirs the shallower water warms up more easily and that means more algae growth. That leads to the different taste and smell. Earlier this year we first reported people in the east bay experienced a similar issue. Again, Officials Say the water is safe to drink. 500 a day. That is the fine for california cities and water districts not saving enough water. And all four of them are in southern california. Beverly hills, indio, red lands, the Coachella Valley are being charged 61,000 a day. Governor brown says all of them have been overusing the mandatory water cuts which went into effect in june. Beverly hills is about 175 million gallons off target. The problem is worse in Coachella Valley, 1. 4 billion gallons more than its supposed to. The bay area barely made the mark when it comes to conserving water. We save 25 , which is the statewide goal. Some cities and water districts are doing better than others. One of the best is menlo park. The city saved there nearly 50 in september. Meanwhile, bay area startups are fighting the drought with innovation. In a story youll see only on nbc bay area, our Business Tech reporter scott budman is live in the south bay with some of the innovations they were showing off today. Theyre hoping they can solve this problem. Reporter theyre using technology to fight the drought, raising money to try and tackle a problem facing the entire state. Its the latest target of the Tech Industry our drought. Now its selfevident that waters the new crisis. Reporter the search for new ways to find water took center stage at mountain views singularity university. Startups pitching even through robots. Due to exponential growth reporter tech entrepreneurs selling their startups to big firms and the lieutenant governor, trying to get money to fund waterrelated companies. We would be mimicking the spider web in the morning that captures the water droplets that are suspended in the air. Thats what composes fog. Youll find entrepreneurs, corporate, government, other academic institutions, nonprofits, all coming together to work on this problem. Reporter if it works money will flow to help water flow. Its incumbent upon us to think sustainably and to invest our time and energy in supporting the startups and the ingenuity you see behind me. Our nbc chopper was overhead during our 11 00 a. M. Newscast. The crash ended up clogging southbound 880 as well. Tonight everything has reopened. New at 6 00, one of the nicest suburbs in the bay area is battling a growing problem. As the weather gets cooler walnut creek is turning into a controversial new homeless shelter. Alise kirschner is in walnut creek. This is common around the bay area, not in my backyard. Whats the plan where you are . Reporter this is a controversial plan that the city has shot down several times. Part of the reason is the location of this shelter that will house homeless overnight. Its a few blocks from the downtown here. And its right next to a park and right next to many homes. Just blocks from walnut creeks busy downtown, new neighbors are arriving. The same complaint anyone would have. It could bring more crime. Reporter the homeless will be housed overnight in the National Guard armory near city park. Whats your concern with having them there at night . Vandalism. Theyre already here so what were doing is were taking people out of the park, off the street. Were making it safer. Were working with people. Reporter the citys Trinity Center will run the shelter at the armory. Homeless will stay at trinity during the day and will be bussed to the armory at night. Executive director donna columbo says the 30 people allowed in each night will register, undergo medical and mental exams, and must be clean and sober. Walnut creeks becoming an urban center. So with all of the good things that our tremendous growth brings more shops, more restaurants it also displaces people. Reporter like zach, who has been homeless for several years. I was excited about it, yeah. Really excited about it. Reporter he believes the overnight shelter will help address a growing problem. People trying to get their life together, yeah. And this gives people a better chance to be able to do that. Reporter and to help ease some of the concern here in the community, the shelter tells me theyve hired some guards to accompany the homeless to the shelter overnight. They also will have staff there. The shelter opens in december, will be open for about three months. In an apparent case of road rage taken to a new level, two men, one stabbing, a 5yearold boy watching it all happen. A quiet and usually safe south san jose neighborhood. Last night we told you about a stabbing at around 7 30 in the evening on mojave drive. It wasnt until today please revealed that fight escalated from verbal encounter on the road to a stabbing in the streets. Police say a man with his 5yearold son in the car followed this man, 21yearold travis painter, home. Then they say painter got out of his car and stabbed the father several times as the boy watched. One neighbor said she was horrified. Road rage is tragic. So many innocent people can be harmed by somebody elses rage that they bring into our neighborhood. Its kind of scary. Now this man painter posted bail, he was released. His mother said the Police Version of the incident is inaccurate but declined to elaborate. Police say the victim, the dad, was treated for nonlife threatening injuries. Hes accused of stealing a police car, leading police on a highspeed chase, injuring officers and virtually shutting down the bay bridge. Today he pleaded not guilty. We covered the story last weekend when it happened. Police responding to a report of a man with a knife on the eastern edge of the presidio. Police say thats when randall maykopet jumped into a vehicle and sped away, hitting several cars. The suspect was arrested after police say he crashed on the bay bridge then jumped 40 feet from the upper deck to the lower deck. Today he pleaded not guilty to nine felonies and three experience. Animal rescues in one east bay city, worried somebody is trying to trap and harm feral cats this weekend because of a threatening flier that went out. Christie smith is live in the antioch where the citys Animal Service division says it doesnt know anything about this flier. Reporter yeah, thats right. Animal services here in antioch says they dont know where this flier came from. Only one has been brought to their attention. But they would like to know if there are more out there. Animal advocates here in antioch that work with cats, theyre concerned that neighbors say it also brings up an important point. I actually had two fighting last week in that palm tree. Driving my dogs crazy. I could not get them to stop. Reporter Doug Williams says there are too many wildcats in his antioch neighborhood. Some in the city are wondering if someone is taking their own steps to try and fix that. Maria thinks she may have gotten a mysterious flier in her mailbox. The mail, the letter from the city, like you get with the water or whatever, gas from the city. Reporter it claimed to be from City Animal Services department saying it would be trapping feral cats through saturday and warning people to bring their cats indoors if they didnt want them trapped. The problem is Animal Services says it didnt come from them. Im thinking maybe somebody wants to say aim trapping and trying to be courtesy to their neighbors saying, keep your cats in. Maybe they put our information on it just to be more make it more legit. Reporter susan smith is with Homeless Animal Response Program a group working in antioch. Shes concerned about the fliers and the cats safety, especially so close to halloween. Its very serious when they dont identify or out doing trap, newter and return. Reporter neighbors are concerned with what it means and whether someone really plans to trap cats. My concern is what are they going to do . Reporter were told trapping cats on your own property is not illegal. Of course you cant dump or harm them, you have to make sure theyre taken to a proper place like a shelter. Two native american tribes are taking on cal trans. The construction project they say disrespects a sacred barrur ground. Fed up with a lack of parking one man creates his own space. Two local tribes are suing cal trans for damaging a sacred burial ground. Cal trans said its blind sided by this lawsuit. It stems from a controversial construction project near the small town of will lites in mendocino county. The tribes claim the project is desecrating these burial grounds. Its as if cal trans was going to bull doze your church and then come afterwards and ask permission from you. Cal trans has our own environmental experts and archeological experts. And they are doing truly they are doing what they feel is best. Cal trans questions the timing of the lawsuit saying just yesterday it had sent out a final Draft Agreement to all the parties that its been negotiating with on this project. Fed up and creating his own parking. A San Francisco homeowner is doing something radical about the citys lack of parking. It could cost him. The owner of this home in a sunnyside neighborhood bought it for about 700,000. No garage, no parking spot. So he met with the citys Planning Department about the possibility of digging out a space on the sloped lot. He was told the plan posed challenges because of existing city code. But as you can see, he went ahead and he did it anyway. Well, city inspectors found out and now he has two weeks to get a permit or he may have to put all that dirt back and go back to looking for parking. Coming up at 6 00, we investigate. I dont understand why this happened and why they let it go on over and over. Distraught foster parents tried to do the right thing. We expose the failures to protect a little girl and what saved her. Colin kaepernick continues to sit on the hot seat as the 49ers prepare for a trip to st. Louis for a Division Matchup against the rams. Reports have surfaced kaep is losing his teammates faith in his ability to run the offense. Wide receiver tory smith stated its tough, its frustrating, but its not dividing the team at all. System that many say is right now at 6 30 a rare behind the scenes look at a system many say is failing our community. We expose the foster care system where kids are abused and victimized by the very people who are supposed to protect them. Investigative reporter vicky nguyen dug into the department of social services to ask whos watching out for these kids . We have to tell you some of the images in the story may be a bit hard to see. Reporter we reveal a broken system few have seen up close. Youll meet people who open their homes to children in need, but youll also hear their frustrations about how they tried to do the right thing for a 4yearold girl only to have the reports go nowhere. We also want to warn you some of the pictures in this story are very hard to see. But we are showing you these images that reveal the abuse that so many people tried to report. Signs are everywhere in the house. Theyre all good kids. Reporter what was built as a retirement home for two turned into a crowded situation. We had them going on for three i years. Reporter four growing children. It changed our lives totally. These are my four kids. Reporter after raising her own family ysabel wanted to give back. She and al went through the process to become emergency foster care parents. When asked to take in two kids they did. Eventually ending up with two more of their siblings. The fifth, a 4yearold girl, lived in another home. The brothers and sisters met often for visits. She was the normal child. Very active. Reporter but then something changed. Shed run out of the car with her arms open. Gradually that changed to the point she didnt say hello, nothing. Reporter ysabel noticed the first bruises and scratches on the girls face in january of 2014 during a visit at the library. I went in there and i said, oh my god, what happened . She looked like somebody hit her in the face. The two boys took her scarf off and she had black markingings around her neck. Reporter two weeks later al saw signs of abuse. Her lip was turned inside out like she was punched. Reporter after both incidents, they reported their concerns to the department of social services, worried that the girl was being abused by her Foster Guardian and halfsister crystal peretas. The 21yearold, seen here in facebook photos, lived in san jose with her brother jerry peretes and their mother deann arabaso. Nobody did anything until it was too late. Reporter they were in touch with the girls mother. She lost custody after her husband was accused of physically abusing one of the children. But she was granted regular visits. And it was during those visits that she too began to suspect abuse. She took these photos to document her daughters injuries. This is what social workers ignored they say. The mom constantly on every visit, she would pull the gloves off and take pictures and then come back and show us the pictures. I go, oh my god, this couldnt be happening. Reporter records obtained by the Investigative Unit reveal how social workers responded to the reports of abuse. The concerns range from two black eyes and a big burn on the girls cheekbones to a bruise underneath her right eye and the tip of her right index finger appeared smashed. Reports show crystal always had an explanation for the wounds. She said the burns were an accident from a curling iron. When asked why it appeared there was makeup on the girls face as if trying to conceal marks or bruises crystal said she took the girl to a princess party. Police records show she provided 13 doctors notes to explain the injuries and lengthy absences from school between january and june. In these three cases, social workers saw the girl, talked to her, and determined the allegations of abuse were unfounded. What did you think the first time you got the report back and they said theres no findings . I was i started crying. Reporter leslie high mark is the executive director of the Childrens Law Center of california and a Child Welfare specialist who also served for years as a social worker. When i read the various reports, the first thing that struck me was that the little girl was not interviewed privately by the social worker. That right there is a big red flag. Reporter we asked her to review this case. She says while it can be difficult to detect abuse, social workers missed multiple signs and failed to verify the doctors notes. There were many bruises and bite marks and various injuries all over her body. Those were not discovered until she got to the hospital but they would have been readily visible to the naked eye had somebody looked. Just reading the words on paper, its heartbreaking. She was hurt and no one came to rescue her. Reading those words, no one came to rescue her, even after 25 years in this field its heartbreaking. Reporter at the same time others reported abuse. Police records show the girls preschoolteacher also called dss about deep cuts on the girls face and bruises on her head. The teacher suspected the child was frequently absent because crystal was trying to give the injuries time to heal. She reported bizarre behavior that included dressing the girl in longsleeved sweaters and jackets even in the heat of summer. But it wasnt until june, five months after the familys first report, that the girls mother convinced a social worker to check on her. These are photos taken the same day the girl was found bruised, eyes swollen shut, bite marks and scars covering her body. Police records show instead of calling 911 or taking custody of the girl, the social worker told crystal to take her to the hospital. When the worker called hours later, the girl was still at home. Police records show four hours passed before crystal finally took the girl to urgent care where she was rushed to the emergency room and given a blood transfusion. The doctor concluded she was a severely battered child and could have died from blood loss. Now crystal peretas faces felony charges of child abuse and child torture. Remember the doctors notes . Police determined at least seven of the 13 were forged. Crystals mother dean and brother jerry jr. Are out bail also facing felony charges of child abuse. All have pleaded not guilty. None of the accused abusers wants to answer questions about what happened. Im vicki with nbc bay area reporter robert medacucci, director of the department of social services. We were hoping to talk about how the county investigates child abuse cases. Im headed into a meeting right now. Can we set up time later . Reporter we caught up with him after the countys lawyer said no one from the agency would answer questions from its policy or training. How does the county handle reports of abuse . What are your social workers trained to do . We can set up some time to talk later about this. Reporter minutes later the county offered an oncamera interview with laurie medina, in charge of department of family and childrens services. Two days later the county canceled. I dont understand why this happened. Why they let it go on over and over. Here im practically screaming and yelling and telling everybody. Everybody i could think of. Reporter as for the little girl, found like this, shes now in a new foster home, still seeing her siblings. Now she comes over and hugs us and holds us and everything else. Reporter signs of a happier life returning for a girl whose life was almost lost. At an older age maybe we were meant to be here for just this case. Reporter we reached out to every social worker that was named in the reports. They are being sued in two lawsuits filed on behalf of the girl. No one wanted to speak. Coming up tonight at 11 00, a comprehensive audit reveals how many abuse calls go unanswered. Around 4 45 a. M. , the Sheriffs Department got calls about shots fired on karen road near montalvan drive. Deputies saw this, a car crashed into the house. The driver was slumped over suffering from several gunshot wounds. Investigators are urging anyone with any information to contact them. Chevron is eliminating 10 of its workforce. Chevron as you might know is the nations secondlargest oil company with employees around the world. Todays earnings report, chevron reveals as gas prices have plunged, so have profits. Nearly twothirds theyve lost. 7,000 positions will be eliminated. No word yet on how many layoffs specifically for bay area chevron employees. Dont be a clown this halloween. That is the message from Santa Cruz Police to people planning to spend tomorrow night in bars downtown. The city is tripling fines for people caught littering, spraying graffiti, Drinking Alcohol in public or parking illegally. Last year police took 400 calls, issued 36 fines, arrested 32 people. They launched a Media Campaign to cut those numbers. Party atmosphere, it can be intoxicating. Just make sure you arent. If youre drunk and causing trouble this halloween, the costume may not be the costume you end up in. More than 100 officers will patrol tomorrow night. Fire station 16 in san jose is now back open after being chosed down because of mold. City inspectors found Dangerous Levels in the building in december. Firefighters were forced to sleep in a trailer behind the fire hours during repairs. That caused some delays in calls for service on the east side because the fire truck had to respond from neighboring stations. Now the mold is gone and things are back to normal. Its a big deal. It improves our response times in this area. It puts the firefighters back where theyre familiar with the territory. And it gets us pack to normal operations. Fire truck carries heavy equipment to rescue people and rip into roofs when fighting a fire. In a few hours the Great Pumpkin will be whizzing by earth. Its an asteroid. Tonight we are geeking out. Michelle roberts tells us why this Great Pumpkin is creating a frenzy. Reporter when most of us are going to sleep i was up here last night tracking this asteroid. Reporter Gerald Mac Keegan is starting his work at the space and Science Center in oakland. Its moving pretty fast. You can see the asteroid moving across the sky. Reporter last night he took pictures of the Great Pumpkin. The asteroid first spotted three weeks ago estimated to be a bit larger than the oakland coliseum. Very exciting. Were going to watch for that tonight. Reporter exciting and a bit spooky since its going past the earth tonight. Scientists are calling the flyby a near miss. The asteroid is 30 farther than the moon. Its moving fast and heading in the earths direction. Had its orbital characteristics been slightly different it would have hit us. Reporter Scientists Say the Great Pumpkin isnt a threat but if it were, would a hollywoodstyle rescue mission and some dynamite be able to save sinus. If you blew it apart, it would just make lots of Little Things showering down all over the earth.
