A Supreme Court decision that has impact all across the land. They dealt a blow to affirmative action. They voted in favor of a michigan law. Several other states including california have similar bans. The cheryl hurd is live where the decision is not going over well. Reporter uc berkley students tell me that they know what its like to have a ban on affirmative action. Its been a reality here on campus for almost two decades, and many students tell me that they just dont like it. Gabi has been a student on uc berkleys campus for two years. She knows what its like to attend a school that bans affirmative action when it comes to admitting students of color. Being the only black student in your class is like walking every place and not seeing anybody black. Its really isolating. And it can be detrimental to your college experience. Reporter edwards believes thats the way students will soon feel in michigan because of todays Supreme Court decision on affirmative action. She was very young when proposition 209 became law in california. 209 amended californias state constitution making it illegal for public universities to use race for a reason for admission. This is a spokesperson for the California Republican party. She believes todays Supreme Court decision was the right decision. Anytime you have a quota that advantages one group it disadvantages another group. The groups are not just white people but minorities as well. A lot of students who are underprivileged who do not have money or Economic Resource to become successful in society are denied entry into universities, and it is not because they are not prepared, it is because they are not given those exact resources. Reporter as you just heard, members of the gop believe that the Supreme Court got it right. But some students tell me tonight that they want affirmative action back. Berkleys mayor proposed that cities band together to come up with a regional minimum wage. The plan comes about a week before the Berkley City Council holds a meeting on a citywide minimum wage plan. Oakland city council has already made proposals. Oaklands plan calls for a minimum wage of 9 to increase gradually by 2016. And hes got the backing of organized labor. Number two, City Council Member sam luccardo. He has a bank thats very important. Hes got his finger on the pulse of the business side of the city. And movers and shakers, and that gives some gravitas to his position. And then this is the story that we know about that resonates so well. Shes promoted infrastructure improvements, particularly in the transportation area and street repair areas. Those things resonate with the voters so well. Shes also the only woman in the top three. And historically as we saw in that first story, women do well in san jose elections. You said i had to be patient because i wasnt seeing enough excitement. What should we be looking for in the closing weeks of this primary complain . Get ready. Any gaffs or scandals wont go well. They will wipe out a candidate. Also, whether the two candidates on the bubble, we talked about them. Whether they siphon off enough votes from the top to squeeze in. Also, which candidates will motivate their base the most. Well, authorities have told us that not only did this boy from santa clara hop the fence at Santa Clara International airport, but then he remained out on the airfield for more than six hours before he was able to stow away on a flight to hawaii. The 15yearold boy who stowed away in a Hawaii Airlines plane lives in this santa clara home. His classmates describe him as shy and say they are stunned he took such a risk. He didnt really like to talk to anybody else. Reporter the boy was flu to this school and started his freshman year here at this school in oak grove. The boy was from africa and was in english as a second language class in fall. After issues in that class the boy was transferred to santa clara high school. He is a student in our district, and we will be providing counseling and Psychological Services for him upon his return. Reporter the teen apparently scaled a fence, climbed into a wheel well of a boeing 768 and survived the five and a half hour flight to maui with little oxygen and estimated temperatures colder than 50 below. Anthony fer rare row was a p passenger on this flight. Whether we landed there was nothing on the tarmac, nothing that would seem out of the ordinary. Reporter the department of Human Services says the boy is now resting comfortably at a local hospital in hawaii and issued a statement saying Child WelfareServices Officials continue to work with the appropriate agencies to ensure the youths safe return to his home in california. According to our nbc affiliate in hawaii the boy told authorities he was trying to get back to africa to be reunited with his blolg cal mother. Now his father here in santa clara is waiting for his son to return home from a dangerous trip to maui. This is where the boy lives. Neighbors tell us that the family moved in about three months ago. Meanwhile, the san jose mayor says he is waiting to hear from the tsa to find out how that teen gained access to the airport. Its all subject to tsa and their protocols. We need to review that and figure out if theres something additional to be done or if we just failed to do something correctly. I dont think we know the answer to that yet. Surely we dont want people entering our airport illegally, whether its over the fence or under the fence is a bad thing. Mayor reid says he has never heard of a perimeter issue until now. Even if you didnt sign up for it, you may be feeling the pinch when calling your insurance company. The results are prices are skyrocketing and people find themselves unable to reach people at several agencies. In just the first month of this year, state regulators saw a 53 spike in the number of complaints from californians who need help with their insurance of the and as we found, the experience is not only stressful but costly for consumers trying to get answers. For some Health Insurance companies the influx of calls is so bad they dont give callers a chance to speak. Hanging up after a prerecorded message. Others put callers on hold indefinitely. Ive been put on hold anywhere from 15 to 40 minutes. Reporter he is a fulltime student working on his masters degree in public health. He also works in customer service. I gave it noir try. Reporter he was enrolled in an individual health plan with blue shield of california. He decided to switch to his employers plan. He thought it would be simple to cancel, but its been over a month and a half, i still havent been able to reach anybody. Reporter his story is a familiar one. We have seen the call volume go up quite a bit. Reporter she is with the agency that protects consumers. They received more than the 9300 requests for help with Health Insurance issues. Thats a 53 increase from last year. This is the first year they began tracking who couldnt even reach their plan. Of those roughly 1,000 complaints, one in ten people said they were trying to cancel or couldnt even reach their plan. What kind of consequences can these Companies Face for not being responsive to consumers . If a health plan is found to have violated the law they can force enforcement action which can be a monetary penalty, but it would depend on the specific case whether it was a violation of the law. Reporter is it a violation of the law not to answer phone calls in a timely manner . Theres no specific law related to wait time. Reporter this is a process that can take anywhere from a day to a month. Can you assure these people their complaint isnt going to go into a black hole . Oh, absolutely. Every complaint we receive is investigated. Reporter the tram took his complaint online, people are posting pictures of their wait time and where they are getting responses. We checked facebook pages for the Largest Companies and found new complaints almost daily eye. Keiser doesnt allow users to post directly to its page. Its also where callers were getting a dial tone when they called customer service. Tram said blue shield only responded after he posted several comments on social media but it took several emails before he reached anyone. Now nearly two months later he has his cancellation notice. The snag this time, how much the company owes him for not being able to reach anyone to can sale. He received a check but still not for the amount the Company Originally promised. Giving states the green light for discrimination. Is this true . You know, its a lightning rod issue. So no surprise that we saw demonstrations across the country, including at uc berkley where the group that pushed the michigan ban on affirmative action to the Supreme Court level now says the justices have undermined the policy and are endorsing racism. Affirmative action has had a profound effect on states like california as were about to show you. This decision by the u. S. Supreme court is a racist decision. Reporter there was no mincing of words at a uc berkley rally on tuesday. They accuse the Supreme Court of promoting segregation policies by upholding a michigan ban on affirmative action. Anthony kennedy wrote this case isnt about how the debate about racial preferences should be resolved but who should resolve it. States can pass bans, but affirmative action in principle is still constitutional. Its in fact broader than affirmative action. Its saying that any state can set up and create, let a majority white electorate vote away the equal opportunity of rights of an oppressed minority population. I wouldnt call it racism. I think this is an ongoing debate about the constitution, about the ability of individual institutions to make choices. Reporter Professor John douglas has studied affirmative action for years. While he dismisses the idea the court is discriminating against minorities he does lend credence to the second part of bams claim. Since 209 was passed, elite institutions like berkley have not been fully representing minority populations. Lets look behind the numbers. In 1990, hispanics made up about 35 of californias College Age Students and 23 of berkleys Incoming Freshman class. The affirmative action ban went into effect in 1998. Today hispanics make up 49 of the students and 11 of freshman. While the groups representation han has been consistent at 9 , berkleys black fresh men have dipped. At californias other flagship, ucla, its the same story. The other thing to remember is that this is really an argument about the most selective public universities. In other words, its a very small, important, but a very thin grouping of institutions. The professor has a point. The effect of affirmative action has been more pronounced at the most selective institutions, but for black and hispanic students, the overall numbers tell the exact same story. After affirmative action was banned, minority enrollment plummeted. These are the possible consequences. Thats todays reality check. Back to you. Very enlightening.
