I hate having to even say that out loud, but it shows the severity of what you did. I envy those who can forgive others who commit crimes against our loved ones. Reporter the family says everyone, especially his two Young Children have suffered unimaginable pain. And even as bryans sister fought back tears, she acknowledged that hers isnt the only family that suffered. I feel sad. I feel sad for us, and i feel sad for your families. Reporter and speaking of those families, both norwood and sanchez have children of their own. As for the stows, on the family website, the family says that they recently shaved bryans head and were taken aback by how visible the damage was still in that area. But bryan said yeah, im the one who could still be this goodlooking. The family saying thats the signature humor of his that helped not just bryan but his entire family and friends get through an extremely trying time. Nbc bay area news. Thank you. It has been a trying time for the family and the community. This all happened nearly three years ago in the parking lot at dodgers stadium. The dodgers releasing this statement today. We are pleased that the culpable partying have finally accepted responsibility for their actions and have been sentenced for their crimes. Now the last time we saw bryan stow in public was in september. The crowd greeted him with a standing ovation. [ applause ] stow also showed up on the big screen smiling and waving to the crowd. The giants donated a portion of the ticket sales from that game to help pay for his longterm care. Even strangers are saying that the sentence wasnt enough. We talk more about that. And steven, its hard to understand why the prosecutors didnt go for more time and how they got off so easy. This was a brutal, vicious attack. And it wasnt an accident. This was planned. And so i can understand why many in the public are saying this isnt enough time, but you cant fault the judge. He was obviously very angry with these two and handed out a stiff sentence for what they were charged with, but the prosecutors the one that gave these charge, and some are saying why they didnt charge them with more serious crimes which could have carried a life sentence, at the end of the day they did get harsh sentences for what they were charged with. Okay. Now the fact that there is a conviction, how does this change the liability that sporting teams might have Going Forward and the type of security theyll need to provide to keep fans safe . Thats really important. If theres any light as a result of this tragedy, it may be that sports venues become safer. So theyre going to be looking at the civil case the stow family has brought against the dodgers to say that their security was inadequate and they didnt protect people like bryan stow. I think this case combined with the civil case is going to resonate throughout the nation and is going to make sports venues more safer. The dodgers are front and center in this case. And their security is going to be at issue here. And this is a multimillion case to recover for bryan stows medical bills and the pain and suffering hes suffered here. Very, very quickly. Why did it take so long to get to this point . Did the d. A. Think they didnt have a Strong Enough case . They wanted to stall this case. They knew their clients were going to have to do some time, and they wanted their clients to do time in county jail as opposed to state prison. And one of these clients is going to be walking out of county jail. They wanted their clients to do eegsier time. The one gentleman la be going to state prison after this, and both of them face federal firearms charges which could be tagged on to the end of these sentences. Thank you for all that clarity. Two workers were seriously hurt late this afternoon after scaffolding collapsed beneath them at ha construction site in san francisco. This happened right near the embarcadero. One worker fell 40 feet, the other 30 feechlt cal osha is on the scene investigating what happened. A suspect is on the run after robbing a bank in fremont. He walked into a credit union shortly before 2 00 this afternoon. Hes accused of handing a letter to an employee and demanding money. The employee handed over cash and the suspect ran off. Someone struck it rich after buying a lotto ticket. Were live at the lucky store. We dont know who got the ticket yet, right . Reporter we dont know yet. And the fact of the matter is this gas station is located right off of 880. It could be anyone in the bay area or possibly someone passing through. But the store who sold the Winning Ticket also gets a reward. They were given that reward this morning. The son of the stores owner said he found out that the Winning Ticket was sold from this store early this morning from a text from a friend. The ticket sold from this store and didnt believe it at first and is still reeling from all the excitement. The chances of winning the power ball jackpot is one in 175 million. Were talking about the plan to raise the minimum wage. President obama has been pushing for increase for more than a year. But it has been dealt a crushing blow. One agency says thousands of americans would lose their jobs if the minimum wage was raised. We put that statement to the test. This isnt a thinks tank coming out with this report. Were talking about the Congressional Budget Office. A nonpartisan, independent agency, hired specifically to look at how future policies would impact you, and its not the reports findings that we quibble with, its how those findings are being interpreted. The Congressional Budget Office carries plenty of weight in washington, enough to give flight to policies or make them dead on arrival. So imagine the hoopla. A fair wage of at least 10. 10 an hour. Reporter over the agencys latest report on the federal minimum wage hike pushed by the president finds that 500,000 workers could lose their jobs under one scenario, but what you might not have heard about this report, the cbo seeing many different scenarios. What the range of what this might mean is a twothirds probability it lies somewhere between a million fewer employed versus negligible. Reporter zero. He say theres a whole pendulum of outcomes. The likeliest is that job losses are in the range of 500,000. Then the cbo says theres a one third chance the effect will lie outside the pendulum. But thats not how these findings were found by some of our elected representatives. Mitch mcconnell said todays cbo report shows that raising the minimum wage could destroy as many as one million job, a devastating blow to the people who need help the most. Democratic senator Barbara Boxer at an event about the minimum wage didnt even mention the cbo report in her remarks wednesday, but she did say this. Raising the minimum wage is a winwin, because it will increase our Gross Domestic Product by 22 billion, and according to one study, create 84,000 jobs. Reporter boxer appears to be cherry picking the stud free a leftleaning think tank. The reality is that the cbo looked at more than 60 different studies. Leading this man to qualify the groups findings. An increase in the minimum wage would probably have a small, negative effect on employment. But there are substantial uncertainties around that estimate as we reported. Reporter theyre talking about uncertainties. They say there are other reasons for uncertainty as well. They might not have calculated the correct number of low wage earners. So bottom line, the cbo is saying take these numbers with a grain of salt. Right down to the north bay, currently 59 degrees there. Were setting up for Colder Weather tonight. A beautiful array of color. Little bit of pollution in the atmosphere. And lets take you into that forecast as we head throughout our friday. Its almost here, folks. As you can see, as we get into that forecast for friday, we will weigh see numbers getting one to two degrees warmer. Low 70s for the east bay. And generally warmer as we head throughout the next 24 hour period. As we get a look at the next several days well mainly stay with this warmer trend through about sunday with temperatures in the low 70s. Then by monday, you can see well see numbers going down just by a few degrees. Thats a sign of larger changes coming next week. Numbers starting to drop down into the 60s by wednesday, thursday, and friday as we get our storm system moving back into the bay area. So, again, we are talking about the chance of rain, and i want to wind things up on what we know about those rain chances for next week. By wednesday night it looks like heavy rain is possible. Also by thursday morning into the evening hours we would see rainfall totals from a half inch to one and a quarter inch. So this is what we know right now. We still could see this change. Up next, the teenager caught in a lawsuit talks about her role in that fight. These people are being hunted down by somebody so they can bring some false, frivolous action. Im telling you, that is bull. Strong emotions on both sides of the issue, but are disability lawsuits going too far . The astonishing numbers, and why some are saying these ada lawsuits are more about money than equal rights. In tonights class action, teachers tenure on trial. A high profile lawsuit that could radically alter Public Education in california. At its heart is a longstanding debate over job protection for teachers. Do laws meant to protect teachers sometimes end up hurting students . One student at the center of the lawsuit says yes, she thinks they do. Reporter this High School Senior is looking forward to college, but its middle school thats on her mind these days. In 8th grade she says she had a teacher who wasnt doing her job. We were coming to class watching youtube videos or coloring. And it felt like the teacher didnt really care about our education. Reporter kates big brother had had the name science teacher, so she knew what to expect. Coloring is ridiculous. Reporter she says her fellow students, parents and other teachers knew this one bad teacher was hurting the school. It stinks to go to class every day when you have a teacher that doesnt care and youre not doing anything. Reporter its been four years now, but kate is getting her day in court. Shes one of nine students suing the state saying teacher statutes violate their rights to equal education. Teachers are really unique among Public Employees in that they have what we sometimes call superduper rights. Reporter its those job protections at the center of a major lawsuit filed by a nonprofit called students matter, founded by david welch. Theyre targeting three statutes, teacher tenure earned after two years on the job. Last in, first out rules, which the last hired are the first fired, and a dismissal process they say is overly complex and too expensive. It would cost the district hundreds of thousands of dollars and take two, three, four years or longer. The issue is not how do we get rid of bat teachers. The issue is how do we get more funding. Reporter this oakland teacher says the lawsuit is a high profile diversion from the real issue. Years and years of budget cuts. It has to do with the cycle of underfunding, lack of resources and lack of support for new teachers. Reporter he is also skeptical, she says of the source of the lawsuit. I do believe that there are some really big money interests that want to kind of coop this issue, call it a civil rights issue, when in fact, getting rid of these statuting is not going to improve the teachers. Now just a few hours ago, the state filed a motion to dismiss the case. And the president of the california teachers associate says that the trial is an effort to legislate from the bench. The judge did Adjourn Court today, and we will find out in early march if that trial will indeed go forward. Coming up at 6 00. Caught on camera. The mayor has been a target of critics as hes been trying to cope with some of san joses tough issues, among them, a pension reform thats being watched nationwide. Whats the goal for the mayor tonight . Reporter he will tell the crowd that in ten months he will leave the city in Better Financial Health than when he first took the helm, even through that great recession. Now it has been a bumpy ride, one we will sure hear about tonight. The mayor spent the morning fine tuning the speech he would give for the last time, the state of the city. The crux of his message tonight. The citys pretty good. Reporter hes expected to talk about economic development. Were in a position where the budget is stable. We can, again, afford to restore a little bit of the services and a little bit of the pay cuts that our employees took. Reporter then theres public safety. A political analyst wonders if the mayor will talk about the nonfinancial costs of pension reform. Mainly the bloody battle with police and fire unions, the seeming exodus of police and firefighters and the rising crime rate. He came in as mayor at a really difficult time. Hes provided some courageous leadership, really taking on the pension and the Health Benefits that really were saddling the city. Reporter its a rift he isnt sure will get better. I dont know how much he wants to build bridges. I dont know how much he wants to mend fences, only because notice waning months of his administration, i doubt if theres going to be any kind of come to gjesus meeting. Reporter which is why hell probably limp through the rest of his term as the mayor of the bay areas biggest city. In attendance tonight will be former mayors gonzales and mchenry. Nbc bay area news. Today marks the somber note in history for thousands of japanese americans on the west coast. It was on this day in 1942 that Franklin Roosevelt signed the order sending japanese americans to internment camps. Today several former detainees spoke about their experiences. They were among thousands of japanese americans from the bay area sent to those remote camps behind barbed wire. After years in the camps, many came back to the bay area to rebuild their lives. What that incarceration experience did was from 1945, 1946, everyone of japanese ancestry on the west coast were starting from zero. Now the saturday day of remembrance will be held at the kabuki theater in japan town. Is the lobbying being abused . One thing is clear. The number of lawsuits related to the rights of disabled people is the subject of a heated debate. We looked at whats behind the lawsuits and why they outpace lawsuits in any other state. California courts see more ada lawsuits than new york, florida and texas combined. Unlike many laws, the ada is not enforced by police or inspectors. Its enforced by citizens through lawsuits. But now some are asking whether these suits are more about money or justice. Many of us take for granted how easy it is to get around. Whether its stepping into a store or closing a bathroom door. So when the americans with disabilities act passed in 1990, few disagreed with the intention. Every man, woman, and child with a disability can now passion through once closed doors. Reporter the ada provides guides for everything, from door handles to doormats to ensure equal access. Sgllts idea behind it was a good and noble one. Reporter kim stone leads the Civil Justice association of california. She says while the ada has led to improvement, many are left open for dubious lawsuits. Its different than your parking lot being the wrong shade of blue. Reporter we reviewed records for ad the lawsuits in the high elgs disability population states. California led the group. Many of these stories tell a story of embarrassment and inequality. One are less obvious, like this violation for hanging a dressing room mirror 1. 5 inches higher than the legal limit, or one on a regular room door thats not at the correct height. Zero of the cases that we bring are frivolous. Reporter disability rights attorney randy moore and his firm have filed many cases. This myth thats being foisted is that how these people are being hunted down by somebody so that they can bring some false, frivolous action. Im telling you, that is bull. Reporter he believes that every action acts as a barrier for the disabled. As their advocate, im here, and its not a minor detail. This is ridiculous. This is money hunger for the lawyers. Reporter she says shes never had any trouble getting around her shop. Thats why she was stunned when one of moores clients sued for discrimination against the disabled. You have a sign that says it was uni sex bathroom. But it was a circle, not a square. Correct. The ada is a great thing if its used in the right way. Right now, its not being used in the right way. Reporter a closer look at the records indicates that more than half of the lawsuits filed in california are filed by just a few people. Its only a few people that take the step to go forward and fight for the rights of everyone. Reporter how easy or difficult is it to be in compliance. Its virtually impossible. Reporter she is a certified access specialist. Its a rule that was created to help businesses spot their violations. She showed us major retailers who followed many ada codes but still werent perfect. So this is off by a few inches. Right. So technically, its not in compliance. Reporter from the alignment of these parking places to the bumps that are the wrong color. Violating the ada in california carries a minimum of 4,000 in penalties in addition to legal fees. This laws been around for 20 years. Yes, it has been 20 years. And it has changed many times. Im not asking for leniency, im asking for fairness. Reporter experts say businesses should hire an access specialist to do a site survey. They get one of these certificates. And while it doesnt guarantee you wont get sued, it is letting people know you are aware of ada issues and that you are working on them. Right now clear across the bay area, right into san francisco. We did have a few high clouds earlier, but even thats starting to push out. Winds out of the west at 15 miles per hour. May have a little bit of fog, but not expecting a fog storm for tomorrow morning. The reason why is were starting to see a shift in the wind pattern. Were seeing this area of High Pressure set up in just the right spot. So the circulation around this, again, will help to lead us to the offshore winds. Its going to mean this warming trend right on track. Friday, saturday, and sunday inland numbers that will range anywhere from 69 to 74 degrees. Lets preview some of these temperatures. A lot of you do like these 70s. What youre going to find is as we head throughout tomorrows forecast those numbers will range in the low 70s for san jose, also into livermore. As we head throughout saturday, possibly the warmest throughout this threeday stretch. Well have 72 in livermore, 73 in san jose, walnut creek, we could have potentially 74 degrees. Then by sunday, napa with a high of 70, you can see possibly a high in the 70s in the east bay, but enjoyable weather through the weekend. Then through next week, some changes coming. For friday well have fullon sunshine across the bay area. 71 in palo alto, also in san francisco, getting real close to that 70 degree mark. Little bit cooler in Pacific Heights with 66 degrees. 71 degrees in santa rosa, sausalito with a little bit of an ocean breeze at 68. One of the warmest will be livermore at 72 and pleasanton at 71. Possibly the rainfall still on the charts here as we head throughout tuesday night. Storm system develops offshore and we do think it will scoot in as we head into wednesdays forecast. That looks to be one of possibly two storms next week. And it could mean anywhere from one to three inches of rain the way it looks right now.
