Shot taken last night. He was arrested at an antioch apartment complex. About two hours ago on twitter, robert handa broke the news that he was hiding in his sisters attic and was found as he crashed through the ceiling. This morning that sister, marcaysha alexander, is also locked up. Nbc bay areas bob redell spoke with investigators as they released new information about the arrest. The sheriff says the man has been an around the clock operation for a week but there is still another escapee out there. Reporter correct. Good morning to you. In the News Conference that took place here at the Sheriffs Office 90 minutes ago the office expressed confidence that they would be able to capture Rogelio Chavez based on the help theyve been receiving from the public. Its that kind of help that led Law Enforcement to capture laron desean campbell. On monday, november 28th, detectives received a tip with a he was hiding in a drens in antioch. We were able to determine the location of the residence and determined that campbell was staying with his sister, marcaysha alexander, in the 1000block of don lynn avenue in antioch. Detectives contacted the u. S. Marshal service and they began physical surveillance of the residence. After several hours of constant surveillance the marshals were able to see that campbell was indeed at the residence. On november 29th at approximately 10 00 p. M. , the United States Marshal Service and the Antioch Police department served a warrant at the residence. Upon entering the residence, they determined that campbell was hiding in the attic. Campbell then crashed through the ceiling, onto the floor, where the Marshal Service and Antioch Police took him into custody without further incident. U. S. Marshal service transported campbell to the Santa Clara County main jail, where he was booked into custody. Our detectives then interviewed campbells sister and eventually arrested her for harboring a fugitive. She, too, was booked into the main jail. Reporter how confident are you that youll catch chavez . We are very confident. We are following up on the tips that are coming in. We are narrowing, we believe, the locations where he may be, and we are working around the clock to take him back into custody. Reporter can you address the breakdown that took place last wednesday night in the jail that allowed these people to escape and talk about who if anybody may be held responsible in the department. I cant answer that at this time. I can tell you that we have launched an investigation into the root and the cause of the escape. And the sheriff and i have reviewed a number of documents, and those documents tend to suggest that there were no significant policy violations, and the fact is that its an aging jail facility that is very noisy, and leaky at times. And we are very happy that the board of supervisors has approved the construction of a new jail. We eagerly await the new jail. Reporter have you found the cutting tool or whatever it was they were using . We have not located the tool used to cut the bars. Reporter [ inaudible question ] we have not found that person. Reporter laron campbell, rog chavez and another suspect escaped and rappelled down with a bed sheet. Early monday morning departments raised a days in motel in gilroy. There was no chavez but deputies arrested a woman. They searched a home on inman way in san jose after receiving more information that chavez could be there but again came up empty. The Sheriffs Office tells us theyve received numerous tips from the public on chavezs whereabouts ever since the sheriff announced a 20,000 reward for their recapture this past friday. As you can see or could have seen on the mug shot, chavez does stick out. He has a tattoo that extends above and below his left eye. Reporting live here in san jose, bob redell, nbc bay area news. There were a number of Police Vehicles here not too long ago. They just cleared out. We were able to speak to sfpd. There goes a van coming up right now, guys. They say there was a shooting that took place on 25th and vermont at 8 00 a. M. This morning. Thats what you guys were seeing there. They have not identified the victim that we are talking about, but there were some family members here, and theyre telling us that he was a worker with the public works department. He had been working there for a year or two, just getting his life together, getting it back on track, cleaning the streets in the area. Has two kids. They are saying he was the one who was shot. Were waiting to get more information from sfpd. We just got on the scene. We can confirm it was a worker who worked with the citys public works department. We have some family members here who weve talked to off camera who say he was a good guy and they dont know why this happened to him. He was getting his life back together. In the last hour we confirmed that a 15yearold High School Football player is under arrest accused of sexually assaulting a teenaged girl on the campus. She attends the high school next door. Police say the alleged assault happened on campus after a Football Game almost two weeks ago. Investigators believe the incident was an isolated case and that there are not other victims. A technician was struck by a lift hours before the show. San francisco fire crews transported the man to sf general, and thats where he died. As for where this happened, the cirque de soleil show was setting up basically in parking lot a of the ballpark. We have no word on the identity of the man. Showgoers were promised refunds. New this morning, harsh words and consequences for the Construction Company behind the deadly balcony collapse in berkeley. The state board in charge of contractors licenses says that segue construction willfully ignored standards for good construction and for that should lose its license. The board opinion says, had they built the balcony properly it would have easily held the 13 students. Instead, six of them were killed when the balcony collapsed in 2015. Five were visiting students from ireland. To antioch. A story breaking this morning. Police tell us the person who was shot in a home there was in fact an intruder. This is video from the scene at the home on winding way, not far from hill crest avenue. Police say that when officers arrived they found a 21yearold man suffering from several gunshot wounds. He died at the scene. His identity has not been released but police are saying that man was an intruder, but he was known to the residents and that theyre all cooperating with the investigation. Well, no charges will be filed for a North Carolina Police Officer that shot and killed an unarmed black man. That shooting set off protests and riots. The bystanders dramatic cellphone video last year showed walter scott being shot in the back multiple times. This happened in south carolina. The District Attorney says that charlotte Police Officer brently vincent was justified in using deadly force and adds that scott was armed when the shooting happened. Scare for movie goers in San Francisco. Police evacuated the metreon after aman pulled a gun in the theater. Police swarmed the theater. The chronicle reports that a witness reported the suspect was yelling and behaving erratically just as the previews wrapped up before a showing of allied. Another witness says, after the suspect pulled the gun, the man stayed seated as other people were running out. One patron who had been hoping to see the late show instead, felt lucky he wasnt inside when this went down. Scary. Glad i wasnt there. Yeah. I mean, with everything thats going on now in the world or in the United States, its a terrible thing. Police arrived on the scene quickly and detained the man. The theater, though, was closed for the rest of the night. Emergency crews on the peninsula responded to an accident early this morning, and it appears to have involved a car and a pedestrian. For a while that shut down traffic at El Camino Real in san bruno near the Golden Gate National cemetery. Witnesses say there were clear signs that a pedestrian had been struck and no real indication that the driver had actually stayed on the scene. So far San Bruno Police have not issued any kind of statement about it. Authorities arrested two suspects after a chaotic earlymorning highspeed chase on interstate 280. The chp says the chase started during a traffic stop just a little before 2 30 this morning. It went about seven miles before the car pulled over at farm hill boulevard in woodside. Chp says the suspects ran across freeway lanes and into a nearby caltrans yard. Thats where officers nabbed the pair. One of the suspects is said to be a parolee at large. Prayers continue this morning for a local Police Officer who was injured on the job. Now the man accused of critically injuring him with a skateboard last week is expected to enter a plea in court today. San francisco officer robby chon suffered major head injuries after being hit with a skateboard on thanksgiving day. The good news is doctors say hes showing signs of recovery. Chon had been responding to reports of man acting irate. Investigators say the suspect struck chon with the skateboard during the pursuit. Caltrans is launching today what it hopes will be a potentially lifesaving move addressing a difficult subject, suicides along a corridor thats seen more than its share. In some cases suicides along the peninsula tracks have received national attention. Its announcing a partnership with a nonprofit called crisis te text line. Details on the partnership will be laid out at a News Conference later today. All this video shows the devastation left behind after a tornado that swept through alabama overnight. At least five people were killed in all of that destruction. Four children at a Day Care Center were critically injured in the storm. Two other deaths have been reported in tennessee. The same storm system caused damage and injuries in mississippi as well. Nbcs tim phan has more. Reporter a tornado ripped through the southeast destroying many homes and businesses. Right now we are in a community that is at a standstill. Power is out everywhere in benton, tennessee, where this Convenience Store was hit hard. Power lines were ripped down, the roof was torn off and thrown across the parking lot. Debris is blocking roads and shutting down several major highways. We spoke with the chief of police in benton. He tells us the majority of the damage is near the ocoee river. He tells us there are a few fatalities. A shelter is open for those displaced from the tornado at the local high school. The National Weather service says they expect the Flood Warning to last through early afternoon. Happening right now, a cold weather warning in the south bay. We have seen the temperatures dip in recent days. Inclement weather episode has been declared officially by the Santa Clara Office of supportive housing. Temperatures could drop into the 30s in some areas. County officials are expanding the number of shelters that are available for people. The weather warning lasts through at least saturday. Being out there reporting starting at 3 30 in the morning, i cannot imagine that people can sleep outside and be okay. Its so cold out there. Weve had a lot of these mornings recently. It didnt just now start. Well have more of the cold air going into next week. In fact, i think we may have the coldest temperatures of the season by monday and tuesday. Well talk about that. Lets get a live look outside in san jose. A lot of clouds, as we havent seen much in the way of rain. We have had some spotty showers moving through. Here is a look at the golden gate bridge. You can only see part of the span. Well have light rain off and on. Getting a look at the temperature. Its been cool but feeling milder now. 55 degrees heading up to 57. And the rain will continue to move on through once again. Not a lot to the system. This is about what we expected with rain thats kind of fizzling out as it moves through. But still bringing cloudy skies and a slight chance of a quick sprinkle or two before it moves on. Its feeling cool in parts of the south bay. Look at morgan hill. Its only 51 degrees. San jose is 57. And 52 in palo alto. Low 50s also in parts of the north bay with the high today only reaching 58 in the peninsula, and the trivalley, 57 degrees. North bay, 59, and still a chance of some spotty showers. In oakland right now we have some rain moving through there earlier. Its 53. A high expected to reach 59 degrees. As we go through the temperature trend through the rest of the afternoon, the clouds stay with us, and even tonight were not going to see much clearing until the system moves on. By 8 30 well still see the clouds, and into tomorrow morning it will be clearing out but still very cool. We have been talking about how cool its going to be as we go into the next several days. That will mostly be during the morning hours. Over the next ten days after this slight chance of rain moves through, it will be dry for the next several days. And the cold fronts will continue to pass, but their next significant chance of rain wont be until about thursday. So, until then, well have some fairly dry weather. Over the next seven days in San Francisco, light rain today, highs in the upper 50s to low 60s. This weekend is looking so nice but then that all changes early next week. Much colder air settles in, and we could be talking about some freezing temperatures for next monday into tuesday. Highs only in the 50s. But this weekend, a big difference with some mid 60s, something we havent seen in quite a while, along with some sunshine. So it is looking like a nice one. All of the victims ate thanksgiving dinner at the American Legion hall organized by the Golden Hills Community church. This parish has been serving holiday meals there for decades. In the east bay toxic wild mushrooms are sprouting in parks and open spaces because of the recent rain. The parks district issued a warning to visitors to watch out for mushrooms like these and to not collect them or let your dogs near them. Two specific ones to avoid, the death cap, and the other, the western destroying angel. Highly toxic. Both cause kidney and liver failure. Park officials warn that people who harvest mushrooms elsewhere should learn which of these two deadly species are before picking them and serving them. Upscale palo alto has a decidedly lowbrow problem. Pigeons are leaving behind a mess. The problem is so bad the city is shutting down part of embarcadero road to try and fix it. Reporter pigeons hanging out in the rafters of this embarcadero road underpass in palo alto have left behind quite a smelly mess. And now some neighbors are crying foul. Reporter the stench was so bad Pauline Thomas and her neighbors complained to the city. Now palo alto will shut down this road for seven nights to clean up the area. Cleanliness is important. I think there is risk of disease when you have pigeon pop on the bridge. I think its a great idea. Coming up next, a very serious allegation at a north bay high school. Teammates accused of attacking another football player. The allegations of hazing that have parents there concerned. A north bay Football Team is under investigation was it a hazing or a strange sexual assault, a north bay Football Team is under investigation after an alleged teammate on teammate attack. Police say one student was singled out and manhandled by fellow players at napa high school. Nbc bay areas sheryl hurd has more on the questions the parents are now asking. We should have been notified. Reporter a parent feeling stressed out after finding out that an alleged assault involving Football Players happened at her daughters school. There was an assault in the parking lot, on park avenue, at napa high. And that they were touching his private areas. Reporter this parent believes she knows why. A freshman was moved up to jv, other kids were jealous. Reporter police put out a press release on the alleged assault. A member from the team grabbed onto another member and had grabbed at them. Had hit and grabbed at them. Reporter because the students are juveniles, there wasnt much more police could say. The school is handling their own investigation. Reporter School Officials say the districts concern is that students are safe. Thats exactly the concern this parent has. Of course, keep the boys name private. When it comes to remaining a sanctuary city, San Francisco is showing no signs of backing down from possible friction with the donald trump presidency. San francisco supervisors joined immigrant rights supporters on the steps of the city hall ahead of the meeting there. The board member called for 5 million in new Legal Assistance funding for undocumented immigrants. President elect donald trump has promised to take away funding from cities that do not follow federal immigration law. Our Investigative Unit has spent years looking into the problem with the u. S. Immigration courts. We found that, whether or not a person has an attorney has a major impact on the outcome of their case. A Study Released by track immigration, a nonpartisan Research Organization at Syracuse University says that 73 of all undocumented women and children who have appeared in Immigration Court appeared without an attorney. Nearly all of those people were deported. Meanwhile, 33 of people who did have an attorney were allowed to stay in the u. S. The Investigative Unit has also been covering the backlog in the u. S. Immigration court in San Francisco. The numbers have grown significantly in the past decade. In 2007, the Immigration Court had about 8,000 pending cases, just in San Francisco alone. So far this year the backlog has claimed to more than 36,000 cases that are pending. We have new details from south america after tragedy struck earlier this week. Crash investigators in colombia are analyzing data on flight recorders, the black boxes, from the charter plane that went down in the mountains killing 71 people, including most members of a brazilian soccer team. Quite the gesture. At least three people have died because of a wildfire thats burning in the Great Smokey Mountain National park in tennessee. The images are humbling to say the least. This is the most visited National Park in the country. 150 homes and businesses have burned so far around the resort city of gatlinburg. The fire erupted monday night and high winds helped fuel the flames. More than 14,000 had to evacuate. Investigators say that that fire might have been started by a person. The fbi is investigating that hack that shut down muni pay stations over the weekend. A spokesperson for muni says the ransom ware hack shut down the agencies email and payroll. The hacker demanded a ransom of 100bit coin or roughly 73,000 to release the computers. A spokesman from muni says the computers were compromised when someone clicked on a link delivered in an email. Dont do it oakland could be losing two of its teams. The fight is still on to keep the raiders, but the warriors are already on their way out. Cleared a major hurdle in their move to San Francisco. Yesterday the California State Appeals Court upheld a previous decision validating the Environmental Impact report for the teams proposed waterfront arena near at t park. A group called the Mission Bay Alliance who had argued the report was flawed released a statement saying, quote, we are deeply disappointed with the court ruling. Penalized on his proper. Nbc bay area responds to a San Francisco man who says he was wrongfully penalized on his property tax bill. For paying too much. Consumer investigator chris chmura joins us with the story and also a solution. Chris. Scott crawford inadvertently overpaid his property taxes by 20. Now, instead of applying the extra money to his next bill, the city sent the check back to scott. He then mailed in a new check for the correct amount. Problem solved. Problem created. Scott received a 586 fine, 10 of his bill, because the city didnt receive the correct amount within ten days of the due date. Scott didnt think that penalty was fair, so he reached out to us. We contacted the city. It dropped the fine. In a statement, the city apologized and told us its developing systems to ensure this doesnt happen again to other taxpayers. Cloudy skies. It feels very soggy there. In the north bay, a view of the mountain. You cant see much of it. In sunol, some breaks in the clouds as we have seen early showers moving through there. On the radar were only seeing a mostly cloudy sky and some mist and drizzle coming down as the weak storm system moves through. Temperatures have yet to rebound in livermore. They sarttarted in the mid 30s. Were near 50. Highs today reaching the upper 50s. Once we get the rain to clear out. Over the next couple days well get the clouds rolling out. Clear skies, school temperatures. Once again, at least during the mornings. But during the afternoon, with all of the sun, it will help to heat things up. Over the next ten days we are not seeing much action going on here. Even though there will be several cold fronts passing as we go into next week. It will usher in cold air but not a lot of rain. Next thursday well have a significant chance of rain in the forecast. In the meantime, it will be mostly dry with highs in San Francisco reaching the upper 50s, low 60s. Next week it will turn very cool. 65 degrees on saturday. Well focus on that because i know youre already looking forward to the weekend. But only 55 on monday. And maybe some freezing temperatures. Its why more than a thousand schools across the country are participating in no one eats alone day. The idea came from a north bay mom originally. Garvin thomas joins us with todays bay area proud. Reporter her daughter was born with a condition that made her look different from other children. Something that may have contributed to her social isolation in middle school. Laura wants to make sure now that doesnt happen to others, not just kids who are a little different, but everyone. I want you to know how pleased and how thrilled i am that lilys memory is being carried on by all of you. Reporter it is from the darkest day of laura talmus life that a Brighter Future may be in store for not only this group of middle School Students on a weekend retreat in petaluma but maybe tens of thousands of more. You will be the next generation of leaders in our society. Reporter thats how many students have been exposed in the past six years through at least one of their programs to the north baybased nonprofit, beyond differences. Each year we have grown and doubled and doubled and doubled in size. Reporter that dark time for laura was the sudden death at the age of 15 of her daughter lily. Lily had suffered in middle school from social isolation. Not feeling bullied per se, but something maybe just as painful. Feeling invisible. And alone. It used to break my heart because i would get calls from lily almost on a daily basis that she had finished lunch but she really didnt have anybody to eat with, so she was always hiding in the girls bathroom. Reporter it was at lilys funeral after some of her writings from that time were read that a group of her peers approached laura. Had they known that lily was feeling that left out in middle school they might have been more aware and might have done something different. Reporter it was the birth of beyond differences. Laura and her group of trained High School Ambassadors have since spoken to tens of thousands of middle schoolers, sharing their message of kindness and inclusion. Invite people. Reporter and their program, no one eats alone day has spread like wildfire across the country. As the organization has grown, though, laura says the focus has shifted away from lily. And she is okay with that. Laura never wanted it to be a static memorial for her daughter. She wanted a Dynamic Force for good in the world. And she thinks theyre well on their way. These children are going to grow up in the next 15 years and become parents, and my money is on them. Reporter no one eats alone day is scheduled each february around valentines day.
