Morning we will have some of the scattered showers continuing to move through. But you can see the activity here on the radar. And its been moving from the southwest to the northeast. Some more of that activity possible as we go into the next couple of hours, but if youre not seeing that rain now, well you may be missing out. Looking at the south bay and how much rain weve had, about a quarter of an inch in morgan hill and gilroy. You had a nice little downpour there recently. And also in san jose. But weve only measured about. 04 in halls valley, about. 06 in cambria neighborhood. If youre not livermore, you havent seen much of the showers moving through. Youve had about. 04 about the same in san jose. And the rest of the bay area still looking out the window like where is it. Well, as we go into the rest of the afternoon we will have some clearing, some breaks in the clouds. And still a slight chance that we could see some of those showers developing especially in the east bay hills. But the rest of us seeing those rain chances going down and seeing some clearing in the skies as our temperatures will be cooler than average thanks to all of the clouds and the nearby rain. Unfortunately i dont think youll see much more of this rain as we head through the rest of the day. Well have another chance on sunday. So ill talk more about that coming up in a few minutes. All right. Thank you very much, kari. Well, eight Santa Clara County correctional deputies are now on leave from their jobs as the sheriff investigates multiple issues at the Santa Clara County jail. Three of those deputies face murder charges in the alleged beating death of this man, inmate Michael Tyree back in august. Another five deputies have been put on leave, but the sheriff has not said why. At the same time we are learning that a preliminary autopsy report shows no definitive cause of death for another inmate 33yearold walter ro found dead in his cell on monday. That autopsy showed no sign of foul play nor acute injury but could not specify the exact cause of death. It could be weeks before that is determined. Three teenagers and two d t adults charged in connection to a vicious Home Invasion in brentwood. Heres a look at the crime scene from back in july. A brentwood couple was sleeping when three people broke into their home and assaulted them. The husband is still in the hospital. Meantime, investigators say the attackers were two adult men and a 17yearold girl all of whom were from pitts burg. Theyre facing attempted robbery and Home Invasion. Two other teens were arrested on conspiracy charges. All told five suspects will be tried as adults. Only on nbc bay area, Santa Clara County is considering replacing its troubled ambulance provider rural metro. While this goes on, cities and Fire Departments across the county say they want to be at the table making this decision putting in their own input on any new contract. But the county says no plan can work unless the San Jose Fire Department improves its response times first. The department standard requires firefighters to get to a call in less than eight minutes. Right now the county says firefighters are missing that mark 30 of the time. Only having 70 responsive time puts the citizens of san jose at risk. And thats not good. Firefighters say they need more boots on the ground if theyre going to improve their response times. The county says the board of supervisors will listen to all sides at a meeting. Some call it y2k day this morning for the health care department. Doctors and hospitals switching over to a new computerized system of tracking what ails their patients. Thats right. Nbc bay areas bob redell is live in san jose. Bob, you got a closer look at this process. We were talking earlier about some of the kind of quirky codes for ailments, but theres a serious reason for this change too. Reporter well, kris and sam, whenever you visit the hospital or medical office, your doctor enters a billing code for your injury or illness so the Insurance Company knows how much to pay your medical provider. So for the past 20 something years the Health Profession has relied on a list of 14,000 codes socalled icd9s, icd being International Classification of diseases. Well, starting today and rolling out as we speak the government is requiring the Health Care Industry work off the new icd10s. Thats a list of 68,000 codes. So lets say yesterday you walked in with a broken arm, theres basically one code for that injury. Today there are codes that specify which arm is broken, whether its the upper or lower, whether or not the bone broke through the skin. Is this your first, second, third time, whatever. Its much, much more specific. The more specific you get, the better information were going to have about the particular problem you may be experiencing. And also by sort of coding the sequencing like how many times youre coming back for that particular problem, is going to allow us to evaluate the type of care and the quality of care that youre getting over time. Reporter and, kris, as youve been reporting this morning, the government believes this longer set of codes will help identify epidemics, pandemics like an outbreak of the flu or even ebola that updates the icd10 is also intended to reduce fraud and will improve the accuracy of payments. Now, critics say having 68,000 codes could actually result in billing mistakes. And they see this as a very large extra layer of red tape especially when you consider some of the more unusual codes. Based in San Francisco says demonstrations will be held all at the same time in at least nine cities including San Francisco, oakland, san jose, redwood city and fremont. Now, critics are outraged over unfair rent hikes, they say. And in some cases the illegal evictions leaving families with no place to live. A multimillion dollar discrimination lawsuit filed by thme all new at 11 00, a multimillion dollar discrimination lawsuit filed by the women kicked off of a Napa Valley Wine Train. But in the past hour the group of mostly africanamerican women kicked off the train back in august renounced that lawsuit. They were allegedly being loud and disruptive, but now theyre suing the trains owners for racial discrimination. Nbc bay areas kim live this morning. Kim, these women are asking for 11 million in damages. Reporter this was a very emotional press conference. The 11 women who are involved in this say the humiliation is ongoing and has changed their lives. They want this lawsuit to send a message that in this day and age theres just no room for racism. An 11 million civil suit was filed in federal court this morning claiming these 11 women were racially discriminated against when they were kicked off the Napa Valley Wine Train in august. They were told they were unruly and too loud, and subsequently marched through the train to waiting police officers. Two of the women say theyve lost their jobs because of this incident. And all of them say they continue to endure abuse through social media and the general public as people question their claims. Standing before you is humiliating to me because i just dont live my life that way. This is 2015. And this just cannot happen again. You know, there are things that are happening to us that people on the outside dont see. This is our life. You know, people contacting us and just assuming that all the things that were said about us in the media that are true. And they absolutely are not. Reporter officials with the Napa Valley Wine Train issued a statement in part stating that they, quote, taken the allegations of discrimination very seriously. We are conducting our own investigation into this matter. They also go onto say that theyve hired an outside agency which includes a former fbi agent to investigate this incident. Now, besides monetary compensati compensation, these 11 women are asking this company to increase sensitivity training with their employees. Or two or three, and you have not been able to drive because you didnt pay it. Thats not you. I do know that part. Today could be your lucky day. Youre going to get a chance to have your suspended license reinstated. At a discount no less. Nbc bay areas Stephanie Chuang tells us about this ticket Amnesty Program. This is for traffic tickets like if you sped or ran a red light. Its also for nontraffic tickets or infractions like if you didnt leash your dog. This program runs through march of 2017. So were talking about 18 months really for those who may be struggling to pay those overdue fines. Now, take a look at who is eligible for this. If you have an unpaid ticket with a deadline to pay on or before january 1st of 2013, and you have not made a payment after june 24th of this year, you are eligible for two things to possibly happen. You get 50 or 80 off your debt. That depends on your income. You can also have your drivers license reinstated. But there are some exceptions here. This does not apply for those of you who got a parking ticket or for reckless driving, duis, if you owe a victim restitution or if you have outstanding misdemeanor or felony warrants. Governor browns move in pushing this forward in this Amnesty Program means a break in what some say is a very problematic trickledown effect. Without a drivers license they cant get to work. They lose their job. They cant get another job. So they cant pay the debt back. The dmv says since 2006 california has suspended 4. 8 million drivers licenses after people either failed to pay their tickets or failed to show up in court. And of those millions only about 83,000 people got their licenses reinstated. And the fines were talking about are steep. For instance, if you ran a red light 20 years ago, you had to pay a fine of 103. Today that starts at 500 which then jumps to more than 800 as soon as you fail to pay or show up in court. This move would also help the state collect at least some of the estimated 10 billion in overdue fines. If you think you may be eligible, just check with the superior court where you got your ticket in that county or the area. If you are eligible, the court will process your application without you having to see a judge. In our San Francisco newsroom, Stephanie Chuang, nbc bay area news. If you dont pay those tickets on time, the back payments that start to grow and grow and grow, youre talking about thousands of dollars. Right. If youre talking about somebody who makes minimum wage the reason they dont pay it is not always because they dont want to. Its because they cant. So way to get folks back in their car. On the road. Hurricane joaquin strengthened once again today packing 120mileanhour winds as it powered toward the bahamas. Nbcs Kerry Sanders now reports from nassau, bahamas on the very latest. Reporter here in nassau it looks like its only going to be Tropical Force Winds from joaquin. And thats very lucky because people here went to bed last night hearing that it was a category 1 and now its a major storm at a category 3, 120plusmileanhour wind. As we go to the east, however, because there are 700 islands in the bahamas, its a different story. This is a major storm with major storm surge. And its going to cause some serious damage and potentially could be a deadly storm. Now, when it gets over the open area here once it passes the bahamas forecasters say it could actually turn into a category 4 storm. It could intensify. The cone of uncertainty is just that, uncertain. But a lot of attention being paid in the virginia washington, d. C. Area. And a lot of people on the east coast north of North Carolina should be really paying attention to what happens to joaquin over the next 48 hours. In the bahamas in nassau, Kerry Sanders, nbc news. Well, from one kerry covering the weather to another kari covering the weather. I wish we were getting that kind of rain here though. Well, i dont know if we want that much because on the east coast theyre talking about, you know, 10, 11, 15 inches of rain. So hopefully they dont get that much. As we take a live look now from mt. Diablo you see these interesting looking clouds. Weve had such beautiful sky landscapes looking at the weather with all of this subtropical moisture moving in. Well, it looks like some of that is starting to cut off here. So the heavier showers moving off to the east. Im not seeing that connection over the pacific like i saw earlier today. That may mean the rain will be coming to an end over the bay area. But still a slight chance of some scattered showers as we go through the rest of the day. Heres the futurecast. This shows with the satellite and radar could look like. We start out here as we go through 1 30 in the afternoon. And then through the rest of the evening commutes we see some of these showers popping up in the east bay hills, possibly some heavy downpours there. Even some rain for the south bay were seeing earl afternoon some of the showers being picked up there about 3 30. Into the rest of the evening this weather will be clearing out. The rest of the bay area seeing a little bit more sunshine. But our temperatures will still be nice and cool for this time of year with highs in the 60s and 70s for the south bay. Though peninsula not expecting much rain there. And mostly cloudy skies for milbrae with a high of 61. 6 east bay in the low 70s. A mix of sun and clouds. And san ramon today high of 70 degrees. Heading into the weekend it will be warming up for tomorrow. And then by saturday and sunday our temperatures will be coming down. Were talking some upper 60s for San Francisco. Weve been keeping an eye on Hurricane Joaquin. And now this storm continues to strengthen. It is a category 4 hurricane. Wind speeds of 130 miles an hour. Just take a look at how large this is as it covers many islands as well as cuba, the Dominican Republic as well as haiti. This storm will be moving off towards the north over the next couple of days. And theres still a lot that could go into where this storm goes. But the possibility of it moving into the northeast near new york as we go into early next week. So a lot of eyes will be on this. And the rain potential with this will be very high, possibility of anywhere from six to ten inches. And this is what the current models show some of the heavier rainfall shifted farther off towards the midatlantic coast. So well be keeping an eye on that and some light rain in the bay area. A shooting occurred at a school in oregon, roseburg, oregon. Msnbc news confirmed after interviewing the Douglas County, oregon commissioner the shooting took place at a Community College in roseburg, oregon. All we can tell you definitively is that 20 people have been injured and that the shooter in that incident is in custody. At this point its not clear how many people have died but at least 20 have been injured. Again, we are going to find out more information roseburg, oregon. Well stay on top of this story and bring updates as soon as we have. The closest large city is eugene, still not large by our standards but a Community College there. So certainly lots of folks on campus. What we know right now is that there could be as many as 20 people injured and some of them perhaps have not survived. Now, at this point were still trying to piece together information. A lot of different reports going on. Heres what we have confirmed. Msnbc news has spoken to the Douglas County, oregon commissioner who tells us that a shooting at umpqua Community College in roseburg has injured 20 people. Thats what we know for a fact right now. This is about 180 miles due south of portland. We also know for a fact the shooter is in custody. Right now were awaiting a special report from nbc news. Well bring that to you as soon as it happens. Well, russia continues to launch air strikes inside syria despite criticism and skepticism from the u. S. On targets and the intent of the bombing campaign. Nbc keir simmons reports from moscow. Reporter 36 civilians were killed according to reports this morning. Targets russia selected without consulting washington. Its foreign minister defiant. Dont listen reporter russia says it struck isis ammunition depots and a command center that Syrian Rebels supported by the u. S. Fighting syrias president assad claim they were hit. Secretary kerry quickly met with his russian counterpart. Kerry insisting only isis should be targeted. Were concerned obviously if that is not what is happening. Reporter the russian air strikes included areas around the city of homs and hama. U. S. And allied air strikes have largely targeted northern syria. One fear is that americas allies will be sucked deeper into the crisis. This is saudi arabias former washington ambassador speaking to me as russia prepared to strike. Now putin has ratcheted up the pressure again. Right now among the multiple risks in syria, what does the u. S. We are getting word of another possible mass shooting this one at a Community College in southwest oregon. Umpqua Community College. Our nbc affiliate in portland, oregon reporting seven to ten dead. They are citing Oregon State Police for that number. As many as 20 wounded. There are also reports that a shooter has been detained or possibly down. Umpqua Community College is in Douglas County about 180 miles south of portland, oregon. There had been reports of an active shooter, but the latest indications are whatever has happened has ended now. But again, we are hearing a number of reports of casualties. Again, kgw quoting Oregon State Police seven to ten. I will tell you we have heard other numbers and they are far higher, but we are working to confirm exactly what is happened and what the casualty situation is. Again, in that report there was as many as 20 wounded according to the state police as relayed by kgw television. This happening obviously late morning there at umpqua Community College. Its a small college, small town in roseburg, oregon, where this occurred. There had been reports, tweets by the local fire of an active shooter earlier. And then reports that the situation is contained and reports that the shooter has been detained or its possibly down. Thats what we have right now. Were putting this together as we speak right now with the numbers, but all indications this has been another mass shooting in the United States with a large number of people either dead or wounded. It is so sad to hear the despairty betwedespair disparity of the number who might be dead. Just the latest example of another campus shooting spree. Well see how this plays out and what might have caused it or what the total count is. But very disturbing information. As soon as we details well bring them to you. Meantime another black eye for the secret service, dozens of secret Service Personnel inappropriately accessed private information on a congressman who was conducting oversight of the agency. This is a devastating setback for the agency that says its working on trying to rebuild public trust. Peter alexander has the very late latest. Reporter hes been one of the most vocal critics of the secret service. The secret service has to abide by the law. They have serious concerns about the current leadership. This is whats so infuriating. Reporter republican jason chaffetz, chairman of the House Oversight committee, has aggressively pursued allegations of misconduct within the secret services ranks. And apparently that didnt sit well to some inside the agency. A new report released by the Homeland Security departments Inspector General shows 45 secret Service Employees improperly accessed the congressmans 2003 application to join the secret service where he applied to become an agent and was turned down. Chaffetz tells nbc news he was stunned. Shocked and surprised on how pervasive this was. And it takes its toll. It should have never happened. Reporter the report also contains an email from secret Service Assistant director edward lowry to a colleague writing back in march, some information that chaffetz might find embarrassing needs to get out. Just to be fair. Two days later chaffetzs rejected application was reported online in the daily beast. Lowry denied to investigators that he ordered the congressmans file to be leaked saying he was, quote, reflecting his stress and his anger. The secret service is entrusted with weapons and guns next to the president of the United States. And it scares me that they would act like this. Reporter its the latest damaging blow for an agency fighting to overcome a series of scandals and high profile embarrassments. This latest scandal comes just one day after the president publicly thanked the agency for its job protecting the pope. I wanted to make a special commendation of our secret service. Kris cu several people are dead and now to update that breaking news out of oregon this morning we now know that several people are dead following an active shooting at a Community College in oregon. This happened within the last hour at umpqua Community College, which is in roseburg. If you take a look at the map, to give you perspective its about 180 miles south of portland not too far from eugene either. Were getting reports of varying numbers in the number of people who were dead and injured in this incident. But we can confirm that at least seven people are dead. As many as ten people perhaps. And that 20 others are hurt. It appears that the shooting itself is now over and that the gunman is in custody or perhaps is also down that person as well. We are keeping an eye on this story. We will bring you updates as soon as we get them. Certainly thoughts and prayers go with everybody who might be involved somehow in that shooting incident. At 11 41 scientist haves now predicted a record el nino year. Thats the prediction. Some already think were experiencing the signs. Researchers who have been observing and documenting signs at sea are seeing things they can now share. Nbc bay areas joe risato jr. Takes us on a journey. Conditions fair. Reporter in the orange dawn of the bay area. Were going to go west a little bit further. Reporter a Research Boat heads out of sausalito. For ten days this group is cruising the gulfs of marine sanctuary taking a scientific snapshot of the ocean life. Our sampling effort looks at birds, mammals, kril, boat activity. Reporter this year researchers are witnessing signs of something unusual. The ocean has been really warm because of the presence of that the blob. Reporter the blob is a name scientists have given to the pockets of unusually warm water lingering along the west coast. Some believe its a sign of the coming el nino. Researchers and his team use nets to collect and study kril, a prime food source for birds and whales. So far the samples also point to el nino like conditions. Post of them while they were adults they were fairly small. Earlier this year when we should have been seeing a lot of kril, were really not. Reporter the teams research nets also turned up something quite unusual. This is a red crab. Reporter small red crab found in warm waters of Southern California. The last time i personally saw in this region red crabs was in the 198384 el nino. Reporter other Southern California residents making other surprise bay area appearances, sun fish and dolphins. Weve seen anywhere from 150 to 200 common dolphins. Its a good sign that the water is warmer than what we normally see. And thats a sign of el nino. Part of the teams research involves cruising set paths of ocean recording every bird, every mammal in sight. One california sea lion. Reporter and occasionally. Do you see whales there . Reporter occasionally comes the telltale spout of a whale. Whales have begun moving closer to shore to dine on fish. This has been basically the best restaurant on the west coast. And i recently saw some whales off the coast of capitola and dolphins there too. I dont know if thats normal, but were seeing it all over the bay area. We have to wait and see how that will effect our winter. Now our temperatures are in the 60s. Upper 60s there and highs today will be in the lower 70s. As get more clouds moving in, it was so nice to get that rain waking up to some raindrops hitting the roof early this morning. Well, since then a lot of that rain has now shifted off to the east. Now, if you didnt get in on that action, looks like a rain chances are going down. Let me show you the wind speeds today. Because as we go through the wind forecast at lunchtime our winds coming in on shore at about 5 miles an hour. It will be a breezy afternoon as the winds continue to pick up. And it will also keep our temperatures down at least for the rest of the day. As we go hour by hour in oakland at 1 00 were at 69 degrees, briefly hitting 70 degrees. But it looks like you could see a little bit more sun as we go into the 5 00 and 6 00 hours before the sun sets. And this evening mostly clear skies dropping back into the lower 60s. So weve had some mild nights. It looks like it will be cooling down. And the futurecast shows us with the radar and satellite could look like it shows there could be one last round of rain at least for the peninsula. And then some spotty showers for the south and east bay. Not expecting much more of rain, but it will be a welcome sight to just even for a few minutes get some light showers coming down. And then after today our rain chances going way down. The model showing maybe another tenth of an inch of rain in halfmoon bay with that last little cell that moves in the peninsula. And san jose an additional. 01, so once again not expecting much more measurement. Heading into the next few days well have another slight chance of rain on sunday. And then a more significant system moving in towards the middle of next week that could drop our temperatures down and also bring us another chance of showers. So that is yet to be seen. But at least our weather getting a little bit more active and some more rain in that forecast. As we do head deeper into the wetter months of the year. And our rain today will be once again very spotty, very hit or miss. We may not all see it. And highs today in the 60s and 70s. San francisco a little bit drier there as well as for the north bay and parts of the east bay with highs in the 60s and 70s. The trivalley highs near 70 degrees. After all of this clears out we get more sunshine tomorrow and highs topping out in the 70s and 80s. Saturday it comes down just a couple of degrees in a few spots. And sunday once again thats where we have a slight chance of showers in the forecast, more clouds and cooler air with highs in the 70s for most of the bay area. So making plans for the weekend saturday warmer, sunday more clouds and a slight chance of a sprinkle too. Well keep you updated on that and the rest of the weather. Some elderly residents in the north bay are fighting for the return of a feathered friend. So a duck raised at an assisted Living Center flew over the fence and landed in a Wild Care Center. Now red tape is preventing a reunion. Nbc bay areas jean elli has the tale. Reporter walter says a landscaper gave him a baby duck a year and a half ago. The cook at bellow gardens assisted living named the Mallard Juanita and raised it at work. He loves her and so do the residents. I fell in love with her. Reporter pictures show her spending time with residents in the backyard. Its not just a duck. Its a companion to a lot of older people. Reporter after a year and a half at belllo gardens, juanita flew off. Desperate to find her staff posted fliers in the neighborhood. Turns out a neighbor took the duck to a Wild Care Center in san rafael. Shes checked in as a patient, but bello gardens wants her back. Rita says its her home. Just very empty. And wishing that she could come back and fill her place here with us. Reporter that wish may not come true. Its absolutely heartbreaking to tell these people that they cant have the duck back. Reporter wild care Staff Members say under state and federal law its illegal to keep a wild animal. And returning juanita would lead to trouble. If we were to go against california fish and wildlife and give the duck back to the seniors at the home, that would jeopardize our license and that would mean wild care would no longer be here to treat and take care of 4,000 injured and orphaned wild animals every year. Reporter bello garpdens is circulating a petition asking the state for an exemption hoping juanita can come home. She gave us a lot of joy. We now know at least ten people are dead following a shooting at a Community College in oregon. This is about an hour ago at umpqua Community College in roseburg, about 180 miles south of portland. We are still getting varying numbers in the amount of people dead and injured, but we can confirm again that at least ten people are dead and about 20 others are hurt. Police tell nbc news they believe the shooter is now dead. We are keeping an eye on this story. We will keep you updated and bring you more information as soon as we can. Okay.
