Reporter thats what we heard over and over again this morning, kris. His family pulled up in a car this morning and immediately they got out. And it just seemed like they were here visiting the site where his life was taken just 24 hours ago as he was working on a mural. I talked to his younger sister who was on crutches. And she was telling me shed been here last night for a vigil but couldnt stay very long through tears. She was absolutely emotional. More than 100 people packed this area under the 580 overpass. This is on west street here for a candle light vigil to remember antonio ramos. Oakland police say this is where he was shot while Painting Part of a 4,000squarefoot mural part of a project to beautify oakland. His parents, older brother and younger sister were among the family members here this morning. Again, very emotional. They were constantly in embrace with other family members and friends. The 27yearold remembered by people he knew and fellow artists as a smiling man. Witnesses saying yesterday morning a man walking by got into a brief but Heated Exchange with ramos, pulled out a gun and fired it once hitting the young artist who died shortly after at highland hospital. We spoke up with a friend growing up with antonio calling him as tony. Also knew him as a good kid at emery high. You know, i knew what he did, i knew what he was doing. I talked to him a little over a month ago. I talk to his parents. I see his sister all the time. Its just not fair. Not fair. Somebody took this life. This man was inspire sglg and what happened yesterday was thoughtless and senseless. And i cant imagine an argument important enough to take someones life. Reporter a lot of neighbors and artists were here this morning. It is a very tightknit community. Ramos has just rejoined the oak lantd superheroes project for the third mural in the series of six. The attitude in healing connection is a local nonprofit Empowerment Group dedicated to art here sponsoring a project which aims to involve more than 100 local kids and teens, students who envision the design of these murals and also a project thats trying to create more than 30 jobs. Trying to do a lot of good here in oakland. Police have not released a description of the suspect. They are hoping to get more information from witnesses who were here in this area yesterday morning. But i will tell you that the message we heard over and over again this morning was that as senseless as this was, as tragic as this was that this killing would not stop the art in this community but strengthen the people here in this neighborhood. September 16th we had some rain in the north bay but did not make it south of San Francisco. So this time were getting some south bay rain, some rain in the city and also towards the east bay. So a welcome sight on this last day of the month that has been so dry all month long. And finally getting some rain that may equal the average amount we should get during the entire month of september. This is the reason why. Weve had some clusters of rain moving in that have been a little bit heavier in spots. I dont think this will be letting up any time soon. Even if youre not seeing the rain right now, you may see that as we go into the afternoon to evening hours, especially in the south bay as this moisture continues to stream in across the bay area. And im seeing more Energy Offshore that promises to bring in more rain for a lot more of the bay area. Here we are futurecast still at 9 30 tonight and it is covered with rain. Members issued a memo to city leaders asking what can be done to improve safety. 99. 96 of the people are lawabiding. Reporter Santa Clara Police chief Michael Sellers says despite the disturbing video, he believes its a safe venue. He generated a report for the authority. It says more than 830,000 fans have attended 13 nfl Football Games at levis. During those games Police Responded to more than 1,800 calls for service. And arrested 319 people. Most of the arrests were for being drunk in public. The chief says focusing on alcoholrelated issues will improve safety. Make sure the security thats at the manetometers, people that are obviously intoxicated dont allow them to come in. I think the people serving the alcohol need to Pay Attention and not serve people obviously intoxicated. I think we need to cut off alcohol sales at the appropriate time. Two Hayward School Board Members filed a Police Report after the incident involving superintendent stanley daus two weeks ago. The weather is getting it right finally. Here in the last day of the month were getting some rain. And its been so dry all month long with not even getting the average amount of rain. A welcome sight in San Francisco, a few raindrops on the lens. As we take a live look at sunol you see the cloud cover and it is much cooler there. A few drops. We havent seen much rain in the east bay or at least over towards sunol and up toward belvedere little bit of light showers coming down. This is what it looks like on radar. And were seeing some amounts of rain here maybe a little bit heavier than what is actually hitting the ground. But still our atmospheres getting primed for some of that rain to continue to make it down to the surface. So were seeing that rain moving over toward brentwood and danville right now. Also concord and farther off towards the north and east. A closer look at whats been happening for the pags hour so as you go towards San Francisco, youre not seeing as much rain right now. In fact, kind of in a hole. But you may see some more of that moving in as we go into the next couple of hours. The rain kind of shifts towards the south bay and farther to the north. But look at the timeframe here in the futurecast. All of this green shows what the radar could look like. And it shows by 9 30 at night we could still have active weather going on in the bay area. And it continues for at least a few more hours. The amount of rain we could see, the possibility of at least. 04 over around oakland, union city. 03 and also for the santa cruz mountains. Some trace amounts, the average amount of rain we get during this month in san jose is close to. 20 so hopefully we can get something closer to that before we start the new month. And look at the rain were expecting. This is the average amount about. 3 and then an inch and a half. And in december on average we get over two inches of rain, which would be great if we could get that at least some time soon. As we go into the next seven days ive been looking at the models and looks like our next chance of rain will once again be next wednesday. So we could have another storm system moving in. Our temperatures much cooler in the mid70s there palo alto 73 degrees, Diamond Heights 66 degrees. Youve seen the raindrops in San Francisco. Were looking to see how much well actually be measured as we go through the day. Belvedere 65 degrees. Oakland 71. And livermore 77 degrees. Deputy was responding to a big rig crash along a busy highway yesterday and the rig was carrying thousands of honey bees. All of the bees spilled out of the truck and as you can see many of them covered the deputys cruisers. Trapping him inside. He eventually did get out. And was not hurt. Is well, should a schools response to classroom problems involve the police . This morning we investigate one Bay Area School district that called the police more than any other district in the bay area, and more than nearly every School District in the country. We showed you yesterday how a schools discipline plan can leave your child with a criminal record before they even hit puberty. Now Investigative Reporter bigad shaban digs deeper boo whats behind those numbers. Youve probably heard school to prison pipeline, its a trend where certain discipline policies in school hurt students long term especially minors. Tonight we investigate how its happening and what schools should be doing to stop it. Hi. Good afternoon. Reporter ada is trying to erase what she spent the last two years hoping to forget. How would i go about doing that, sir . Reporter shes on the phone with the juvenile Probation Department to request an application to have her sons criminal record sealed. Adrian crosby is her 15yearold son. Two years ago he used a rock to scribble his initials onto a school sidewalk. Adrian is autistic and thought if other students recognized his name on the ground theyd like him more. They thought i was doing something in public, but i just wanted to be a legend, you know. The crime is vandalism. Reporter this School Resource officer handed adrian a juvenile citation which put an arrest on his criminal record. They made me feel fear. They made me feel like i was getting betrayed by the school. Reporter the u. S. Department of education requires every School District in the country to keep track of how often students are referred to Law Enforcement. We sorted through the most recent data. Thousands of pages worth. And discovered that one Bay Area School district was among the top in the nation for how often it called the police on its students. Out of more than 16,000 School Districts east Side Union High School District in san jose ranked 14th. It referred students to police 1,745 times in the 20112012 school year. Chris funk is the district superintendent. Can you justify why Police Officers were used so often . Well, i think if a student had a knife on campus, the default because of zero tolerance was to automatically have the student cited. If they found a bag of marijuana, they automatically have the student cited. Are you saying theres more than 1,700 incidents either involved drugs or a weapon . Well, back in 2011 we had approximately 24,000 students. Reporter the u. S. Department of education doesnt require schools to release why students were referred to police. But much larger School Districts didnt even come close to east side union. For the same time period oakland unified enrolled nearly 15,000 more students than east side union by only referred 12 students to Law Enforcement. Remember, east side union referred over 1,700. I think that we had a practice here where we were relying too much on having the officer do the facilitation and the lay work versus the add mrks doing the lay work. Reporter funk was named superintendent in 2012. The district has since doubled the number of its counselors. Social workers on every campus. And those more than 1,700 referrals to police dropped to 214 during the 20132014 school year. Those lower rates are still among the highest in the bay area. And just like in 2011 minorities and students with disabilities were sent to police at d disproportionately high rates. Children with disabilities made up 10 of the population but totalled 25 of all students referred to Law Enforcement. Hispanic children represented 47 of the population, but 73 of all students referred to police. Thats an issue. Youve got to solve that. Reporter the district hires local Police Officers to patrol nearly all of its schools. In fact, 76 of high schools across the country have officers or security right on campus. While the goal is to make school safer, some believe students can actually be harmed when schools decide to involve police in cases of minor misbehavior. Its tragic. Theyre tragic consequences. Reporter chief laura garnet heads the adult and juvenile and says when a child is put in the criminal Justice System at an early age, they begin to identify as a criminal and more likely to offend again, even as an adult. Our system is a system that its really easy to get into and really, really hard to get out. Reporter students can even get juvenile citations like the one adrian received which are equivalent to an arrest and go on a childs criminal record. Those students then have to meet with juvenile probation officers. I think we certainly see a lot of cases it was seriously. Reporter garnet says close to 70 of the time her probation officers decide the offense isnt actually serious enough to get referred to the District Attorney for criminal charges. But even in those cases much of the damage is already done. The child can still be left with a criminal record . Well, it will still show an arrest on their rap sheet, yes, absolutely. Theyve been arrested. I mean, if the case comes to us, theyve been arrested. Whether they were put in handcuffs and brought to us or just given a slip of paper by the police, theyve been arrested. Is that fair . Well, i mean, no. I dont think its fair. Reporter but its the reality for adrian. A 15yearold with autism. And a criminal record. It makes you want to collapse. And just stop being because of so much pain. You dont want to exist anymore. Reporter ada says her sons probation officer closed the case since it wasnt a serious offense. Adrian had even cleaned his initials with soap and water. But ada says the probation officer never mentioned adrian would have a criminal record. Ada didnt know until we told her. And thats when she called the Probation Department. I just found out right now two years later reporter a Juvenile Court judge can order that a childs criminal history be wiped clean, but there are no guarantees. And by law you cant start the process until the child turns 18. Ada says she often cries herself to sleep worrying about adrians future. Tears. Because you dont know whats going to happen with your baby. Carlos anderson is seen shoving a student back into his seat almost two weeks ago. Someone anonymously posted the video on twitter this week. The Football Team was headed back to oakland after a game when that altercation happened. Picture says a thousand words. A video says 10,000. And i think what weve seen here is extremely disturbing. And it requires immediate action and thats what were taking. Hes been placed on paid leave as School Officials investigate what happened in that incident. Some people in benecia are not too thrilled to hear about a plan to bring crude oil by rail through their city. That proposed route goes from roseville northeast of sacramento to benicia. If approved the route would bring 70,000 barrels of crude oil a day to the benicia refinery. Last night people in benicia came out in full force to confront city leaders about that plan. They pointed to crude oil explosions in north dakota and West Virginia to highlight their concerns. This happened in castleton, north dakota. And this stuff is so volatile and toxic they have to let it burn out. They cant put it out. Benicia residents can submit Public Comments online through the end of october. Levis stadium has been recognized as one of the most tech friendly stadiums in the world. And now were getting new details on how the stadiums stateoftheart Security System will be used to protect fans and players during super bowl 50. It allows us to share technology, security information across one basic platform. Reporter vta spokesperson says the new system is a collaboration between levis stadium, local Law Enforcement and san josebased company al allied telesis. Quicker, more efficient and ultimately safer for riders. Reporter its estimated millions will flood into the bay area for super bowl 50. Homeland security has now labeled the event a socalled level one threat triggering the highest classification for security agencies. Its really to provide safety for any event that happens at levis stadium. Reporter jennifer with the city of santa clara says with the new system if there were an emergency situation on a platform, an alert would notify all Law Enforcement agencies in the area and investigators in each office would have access to the same surveillance camera at exactly the same time. If there is anything that is out of the ordinary that the information is sent back. Involves a surprise reunion between a First Responder and a patient that brought a veteran captain to tears. Heres the heartwarming story. Santa clara fire captain brent rapport says medical privacy laws being what they are, he rarely knows what becomes of people he rescues once they drop them off at the hospital. They are often left to wonder what becomes of those people they work on. Often, but not always. Youd think after 20 years on the job Santa Clara County fire captain brent rapport would know a little bit about what to expect from a days work. Not so. No two calls he says are ever the same. Some though are better and more memorable than others. You know, i have some great calls that ive been part of. And this clearly makes the top of my list. Reporter brent is talking about a call to a campbell home last september. Working as the engines paramedic that day, brent was rushed to a pregnant woman passed out. She was gray. She was so pale. I couldnt believe it. I looked at her and go that lady is big sick. Reporter brent correctly recognized it as a ruptured ek topic pregnancy. The baby he knew was lost, but the mom could still be saved if his team got her to the hospital fast. At one point were going to the hospital going as fast as we can and the only thing i can do is put my hand on her head and say im going to take good care of you, youre safe. Reporter brent handed the woman over to surgeons at Good Samaritan never knowing what became of her. That is until a year later when brent randomly decided to treat his crew to some starbucks after a hard day of training. And i look up and this womans sitting at me looking at me. Its she had tears in her eyes. Because i wouldnt have been alive without him. He saved my life. Reporter seeing sadie lowry alive was a pleasant surprise for brent, but not his only one that day. And she said i want you to meet my son. And i looked and there was a baby in the carriage. I didnt know she had twins. I thought she was just pregnant with one and lost the baby. And there was this beautiful baby boy. It was there. Hi, partner. Reporter not sure if theyd saved one life, brent now knows he and his crew saved two. Sadie brought the whole family by brents station recently to say thanks one more time. Brent says becoming a father himself almost a decade ago has made him a better firefighter. Better at understanding whats at stake on each call. Its why perhaps brent broke down in tears in the middle of that starbucks. Knowing he not only made the right choices that workday, but frankly all of his workdays. Brent is quick to point out that he was just one link in a chain of medical professionals who helped save sadie and her sons life. He just happens to be the one who was on the front line that day. And in line at starbucks the other day. Garvin thomas, nbc bay area news. Sometimes its just the second that youre there. Meteorologist kari hall is here with a look at the forecast. That is some hurricane. Oh, my goodness. Theres a lot going on as we look at this forecast. And of course this making big headlines for the east coast. Hurricane joaquin. And it is a large storm. It continues to gain strength. Now with wind speeds at 85 miles an hour. And the reason why its making big headlines, because this could be heading directly for the new york city area and then farther off towards the midatlantic coast as a category one hurricane over the next few days. Here in the bay area it has been so dry. And looking at the calendar i put a yellow box around the days that we were warmer than average and blues on days we were cooler than average. And you really cant tell just by looking at the map here, but on days when it was warmer than average, it was way above average by at least like ten degrees in some days. So when you average things out, we were over a degree warmer than the normal temperatures throughout the month of september. And we know we didnt get a lot of rain. Well, finally on the last day of the month weve got some rain in the forecast. Looking at these toemperatures now its in the upper 50s to lower 60s. We wont be warming up that much because of the clouds and rain. In some spots where the sun peeks out may be able to make it into the 70s. But looking at the radar now i dont think this rain will be letting up much, which is great news. We really do need this. And were also picking up on some spots where the rain is a little bit heavier. Now moving right into San Francisco right now. We see some yellows and some reds. That indicates some heavy rain moving in on the west side of the city. So well be watching that as it continues to move in. And also the loop of the radar shows more of that rain. Heres the futurecast. It gives us an idea of what the radar could look like as we go through the rest of the day. Well start it out right now and then continue as we go into the afternoon. So there may still be some breaks in the clouds and rain. And then well turn our focus to the south bay where the rain starts to get heavier later on this evening and still at 10 00 this night tonight, we still have some rain going on here. And it spreads all across the bay area. So some muchneeded rain. And the forecast brings us at least some trace amounts of rain for all of the bay area. Now, earlier just looked like it was just going to be San Francisco and south. But looking at the trend and all of the energy thats offshore it will continue to move in to the bay area and at least give us about. 04 for most of us. And looking at the temperature trend, well, its been cooler than average thanks to the rain. Tomorrow also a fairly cool day. And then once all of this clears out we just warm things right back up into the mid80s saturday also warm and then coming down with another system moving in by the end of the weekend. The weekend forecast you can start to make plans. It will be warm on friday. Saturday feeling much more comfortable and then sunday will be the coolest day of the weekend. Mostly some 60s and 70s all across the bay area with some breezy winds and a lot of sunshine to go along with that, kris. Thank you very much, kari. And we will be right back.
