So we just wait. Reporter the wait, excruciating for the families of students hunkered down inside the school. I just want to see him to make sure hes okay, you know . Just personally see him. It scares me. Everyones upset, theres a lot of fear here. Reporter the school was immediately put on lockdown, while outside, a massive show of force from Law Enforcement. Students were methodically evacuated as s. W. A. T. Teams went from room to room, to clear the school. The number of parents seeking word on their kids grew into the hundreds as the wait dragged on. I am panicking. I dont know how this could have happened. Reporter now as parents are reunited with their children, there is shock and disbelief in another Community Reeling from another shooting. Detectives are now saying this mother, accused of kidnapping her three children, is also a suspect in their fathers homicide. Nbc bay areas stephanie troung is live in san pablo. Stephanie, youre telling us this morning that shes not the only person that police have in custody. Reporter thats right. Good morning, chris. Police here have a second person in custody, in connection with the killing, someone theyre calling the mothers male companion. They are both being questioned, still here at the San Pablo Police department. But, again, investigators saying the important part, the kids, all three of them, found safe. They say that yesterday was all about finding them, and now starts part ii. Piece everything together and trying to figure out what may have led to this. A good friend. Thats how manuel describes the man whos become san pablos fifth homicide victim this year, oscar antiago. Inside his black audi, you can see a car seat and a Pink Princess backpack. Neighbors tell nbc bay area offcamera that he had just moved into an inlaw unit behind this house on the 1600 block of 15th street just a few months ago. Another neighbor saying a couple nights ago, he saw who he believed was alicia ortez, arguing with him while the kids, ages 2, 6, and 12 hung on to her. And then heard what he later realized were a couple of gunshots sunday night. Police found him dead in the backyard, just before 8 00 monday morning. And thats when they realized the kids were missing and issued an amber alert. Obviously, we felt that there was some suspicious activity related to the mother, as we werent able to find her or the children. Reporter at 11 30 last night, San Pablo Police found the children, ortez, and a man they have only identified as a friend, in a house on the 400 block of south eighth street in richmond, about three miles from where angiano was killed. Investigators say they made the arrest without incident, but wont release any details squb including how they found them or where the children are now. I can tell you, theyre in good hands, theyre in good spirits, and we will definitely make sure that they receive the proper needs, that we are looking into their health and mental wellbeing. Reporter police say the father had custody of all three kids, they lived with him, and that the mother, ortez, was a transient or is a transient, spending much of her time in san pablo. When police are done questioning her, they will be taken to martinez to the detention center. And in addition to homicide, they could face additional charges related to the kidnapping. Investigators are not releasing the specific circumstances surrounding that shooting, but they say a woman in her 20s and a little boy were shot near international boulevard and 81st street. They have not said how old that child is. Investigators say they expect the woman and the child to survive. Police say they have a possible suspect, but that person is not yet under arrest. Another shooting came just hours after a 3yearold boy was graced by a bullet, about 2 1 2 miles away, also on international boulevard. Five american soldiers are dead, likely victims of friendly fire. Defense and military officials tell nbc news the five were working with Afghan Military in the southern part of the country. Thats where they were doing security sweeps, so polling places ahead of this weekends Runoff Election when they were suddenly attacked by taliban forces. The americans called in an air strike for backup and according to u. S. Officials, b1 stealth bombers attack accidentally hill the american forces. Meanwhile, in neighboring pakistan, the taliban is claiming responsibility for a Second Attack on the countrys biggest airport. Nbcs jim maceda has more from london. Reporter the Pakistani Taliban, known as the ttp, which operates independently from its afghan allies over the border, claimed responsibility for its second assault in less than 48 hours on karachis airport. This one more of a hitandrun attack by a group of gunmen on motor bikes, firing on a Security Training center and then driving off. There were no casualties, but it was enough to trigger panic once again at the airport, after sundays allnight siege. In that attack, about a dozen militants fired rocketpropelled grenades and set off suicide vests, killing 34 people and trailer shutting down pakistans largest and busiest airport. At least 25 militants were killed according to the pakistani military. The taliban claim these were revenge attacks for continuing air attacks on hideouts. While regional experts are saying that the Pakistani Taliban which had appeared divided and on its back foot is hitting back now, to show its still a force to be reckoned with and can still strike at will. Moments ago, a Southern California judge ruled teacher tenure laws are unconstitutional. Tenure allows for two years of evaluation before teachers hired permanently. Before todays ruling, the judge heard from rather, heard two months of testimony from students who claim the states tenure rules keep them from getting a good education. The lawsuit claims the system makes it almost impossible to fire bad teachers. A federal report shows an alarming trend at american universities, reported sex crimes went up in the last decade, even as overall campus crime went down. The Education Department says 3300 forcible sex offenses were reported on College Campuses in 2011, kcompare that with just 2,200 in 2001. That is a 51 increase. This new report comes as more women are calling for changes to College Sexual assault policies. Just last week, stanford senior leah frances called for a review of the schools policies. She says earlier this year, she was assaulted offcampus by someone who also attends the university. That man was suspended and ordered to complete 40 hours of community service, but was still allowed to graduate on time and return to stanford for grad school. Stanford says it cannot comment on this issue. Right now, a search is underway for a uc berkeley student, who disappeared after going out for a hike alone. The chronicle reports 23yearold Vernon Cody Mathews went to his familys cabin in El Dorado County last wednesday. Police say matthews parents last heard from him friday before he left for a hike by himself. Now rescue crews are using horses, dogs, and helicopters to search the rugged forests. Police say all of matthews belongings were left at the cabin. His family says he has experience outdoors and they are hopeful he will be found alive. Administrators at one south Bay High School are trying to figure out what to do about a racist remark that somehow made it into the school yearbook. According to the mercury news, the yearbooks were distributed to students at Monte Vista High School in cupertino before it was discovered that one Photo Caption has an antisemitic slight this it. The last three letters of the persons name were intentionally changed. It will be hard to file hate crime charges, because there was no violent act. And this is in response to the fact that there has been little or no regulation of what some refer to as the wild west of new cigarette technology. So, just moments ago, within the past 15 minutes, the Santa Clara County board of supervisors set up new ground rules to be governing electronic cigarettes. In a unanimous vote, the board passed an ordinance that will essentially treat ecigs just like regular tobacco. So wherever regular tobacco use is prohibited by law, a restaurant, bar, motel, office, ecigs will be prohibited in those places as well, in unincorporated Santa Clara County. Except for in private units and apartment and condo complexes. The new ordinance will also require ecig retailers to obtain permits and follow the same requirements as regular tobacco retailers, again, with one exception. They would still be able to sell flavored products. Now, if youre not familiar with ecigarettes, what happens is, one uses a batteryoperated vaporizer to inhale flavored liquids that contain small amounts of nicotine. Whats exhaled is water vapor. Proponents of vapeing, they argued before the board this morning, saying that research has shown that ecigs are safe and have helped people kick the cigarette tobacco help. But the it helps people stop smoking regular cigarettes, thats great. But we also know that theres tremendous advertising about ecigarettes, particularly to youth. It sort of gets them to start smoking and it could certainly end up, then, that many of them go on to smoking regular cigarettes. These new restrictions on where you can use ezigs in unincorporated Santa Clara County go into effect in 30 days. The new rules for retailers, 30 days after that. That proposal includes office space, retail space, residential units, and hotel rooms. But the biggest change would be to the dirdon station itself, making it a hub for caltran, light rail, and even eventually b. A. R. T. The plan also includes the citys aspirations for a new Major League Baseball stadium. Medical marijuana regulations will take center stage once again at San Jose City hall, after lawmakers deadlocked on the issue last week. The city council will look at where pot shops could go, and how many the city should allow. Mayor chuck reeds proposal keeps clubs away from schools and homes, but does allow for more than 600 in the city limits. If the proposal passes, opponents say they are ready to submit a Voter Initiative to overturn it. For the first time, the faa is allowing a commercial company to use drones to fly over land. The Bp Energy Corporation and drone maker, aero environment, will be allowed to use pipelines, roads, and equipment in alaska. It is the latest effort by the faa to show it is loosening restrictions on commercial uses of unmanned spacecraft, rather, aircraft. Last week, the faa said it was considering allowing seven filmmaking companies to use drones for aerial photography. Starting next year, United Airlines passengers who pay the most for their tickets will also earn the most frequent flyer miles. The airplanes Loyalty Program is changing so that members will earn miles for every dollar that they spend on their tickets, not on the miles that they fly. That change will be significantly more rewarding to people who fly at least 25,000 miles a year on the airline. Its information that is now leading to change. The data has uncovered problems with officers failing to appear in court, costing the courts, cities, and counties more than 1 million last year alone. When you got these numbers, a bit of a wakeup call . I think for us, when we look here at the numbers that were provided to us, we recognize the fact that we need to do a better job. And we want to do a better job. Is missing a court trial 15 of the time acceptable . Im not going to tell you whats acceptable or not acceptable, until we take a good, hard look at everything. Well, facebook is gaining more ground this morning, physically. It just bought new land across the street from its current headquarters. It covers nearly 60 acres of property on constitution drive, right off highway 84. Thats kitty corner from facebooks main campus. In a statement, facebook confirmed the purchase, but would not say for how much or what they plan to do with that property. Its an investment in their future with no immediate plans for development. Incidentally, the land is next door to where facebook is building its socalled west campus, to accommodate several hundred more employees. Mountain views mayor will ask the city council to allow the proud flag to fly over city hall in honor of lbgt pride month. Chris lark is the citys first openly gay mayor. He says the Mountain View voice, since there is no pride parade in Mountain View, this would be a small way to show its tolerance and diversity.
