A bad combination that tonight has parents in East San Jose worried about the safety of their children after a shooting sent them running. That gunfire left a man dying in the street. It happened on grammercy place. Heres what we know about that investigation and the victim. Reporter San Jose Police are still here processing the scene. A season that is in the street and extends into several driveways here. One man was killed but parents here say with so many kids playing outside, it could have been much worse. San jose Police Officers in protective gear file into an apartment on grammercy place, investigating a deadly daylight shooting with no one inside, the search for the shooter continues. You dont even want to walk do you down the street. Reporter he lives around the corner from the shooting scene. He said the block seems to attract trouble. Every other night theres some kind of fighting, shooting, drinking, fireworks. Reporter it is crawling with kids. The street is their play ground. Gun fire sbrupd them. An hispanic man was killed. He appeared to be walking on the street. And were still trying to determine if the suspects arrived, suspect or suspects arrived either in a vehicle. A gun was found at the scene. Police say the area is known for gang activity. Officers called the Gang Task Force to help investigate the shooting. People who live here say graffiti marks the street as gang territory. Witnesses who didnt want to talk on camera say they saw a gray Sport Utility vehicle speed away after shots rang out. Police are being tight limited after what happened and who theyre shooting for but officers spent hours carefully looking for clues. Concerned families looked on. Some talking about wanting to move. Williams said it is time for someone to help the familiar lies are living in danger. Nobody seems to do anything about it. Reporter this is san jose 21st homicide of the year. So far the name of the victim has not been released. When we get more information about the suspects and their description, well pass it along to you. Reporting live, nbc bay area news. A tense situation at a san jose recycling plant. The bomb squad detonated a suspicious device that happened at the california waist Solutions Recycling plant. It turned out to be a home made bomb. People in nearby businesses. Police think it ended up in the trash. A south bay father will not be prosecuted after his baby died in a hot car. Thats the decision from the District Attorney. In april, the father left his home to drop off his children with baby sitters. He forgot his 9monthold son was sleeping in the back seat and left him sleeping in the car. The boy died. Prosecutors stay father had no history of child abuse, was very cooperative and remorseful so they ruled it an accident. In a statement the District Attorney said, quote, while we have prosecuted child endangerment cases in the past, there tragedy does not rise to the level of recklessness that both the law and justice require. Snlt were hearing details and denials in question, the case of a man arrested for impersonating a San Francisco Police Officer and kidnapping undocumented immigrant men for sex. How it started in 2008 and it is just now coming to liflt he is saying it is possible his client being prosecuted because of his very conservative views on immigration. Is your client a police impersonator. . He is not at all. Reporter hes heard a Police Officer testifying that mr. Bugai and an accomplice entered the bar in the Mission District in 2008 dress in the San Francisco police uniforms. They approached two hispanic men, told them they were under arrest for being drunk and proceeded to take them here to bugais residence. This is where he allegedly attempted to sexually assault them, threatening them with deportation if they ever reported it. The alleged victim in court identified only as luis r. Said he escaped after a struggle and never saw the other kidnap victim again. Which is pretty convenient. Reporter he is a Security Officer and wears a uniform. The testimony today suggested it looked a lot like a San Francisco Police Officers outfit. Nothing on his uniform that he wears says San Francisco police department. Nothing says sfpd. Reporter in court the press was only allowed to shoot the back of the defendants head. The scar there, according to the prosecution, is a result of being hit by luis r. During his escape. They said it is the rule of many assaults over the years while propositioning other men. The prosecution had no comment. As for that other accomplice, the person who was supposedly accommodated the suspect, the suspect in this case, the prosecution says they are looking for him. Police say theyre looking for him and the defense Attorney Says theyll never find him because he doesnt exist. Nbc bay area news. In the east bay, do you recognize this man . The suspect asked the homeowner ¿y on cars and whe that homeowner said no, the prowler left the company. Into our newsroom. Search parties are looking for a missing boy in Kings Canyon National park. It is in the Central Valley between fresno and death valley. Park rangers say a 13yearold, his name is austin shedd. He disappeared after getting separated from a group of hikers. He is 53 and weighs 110 pounds. He is missing in an area that saw highs in the 70s. The temperatures are in the 50s with a chance of thunderstorms. To a developing story in and around Yosemite National park. Thats where the wildfire has been burning. 2,600 acres since saturday so far. At least one home destroyed. Other structures threatened and two camp grounds evacuated. The fire is burning on the western edge of yosemite. The park is still open to visitors for highway 120 heading into and out of the park is now closed. At this point this afternoon, the fire was only 5 contained. Lets take you to the sand fire. Firefighters are getting bear handle on that one. It is burning 10 miles south of masserville. About 75 contained. The fire has destroyed 13 homes and about three dozen other structures since friday. 3,800 acres have burned. A followup to a story first reported on friday night.
