And this city has been facing some chronic problems. Reporter george thugs and misguided people have hijack eded what was largely peaceful protests. There were other forces at work. Some of those years, half of those homicides did not get solved. The Police Department has had a difficult relationship with the people of the town. Millions paid out for Excessive Force and right now its a witchs brew. James holmes pleading not guilty by reason of insanity. But prosecutors say he knew exactly what he was doing. Abcs Clayton Sandell has the story. Reporter this morning, the first witnesses take the stand against james holmes. I got seven down in theater nine. Seven down reporter during opening arguments, prosecutors said the 27yearold former neuroscience student, his appearance changing dramatically over time, knew exactly what he was doing when he opened fire in a crowded Movie Theater. And im going to come right here and ask you to hold him accountable for murdering 12 people and trying to murder 70 others. Reporter holmes admits he was the gunman but claims he was insane. You take him down and give him absolutely no power over you ever again. Reporter eventually, the jury must decide if holmes will face life in prison, a mental hospital, or a death sentence. For good morning america, Clayton Sandell, abc news, centennial, colorado. Thanks to clayton for that. Lets bring in dan abrams. Dan, usually insanity defenses are pretty tough but in colorado, a bit of a different standard. The law helps him to some degree. Its still going to be really tough for him, but colorado is one of the few states where the prosecution actually has to prove he was sane as opposed to the defendant proving hes insane. Now, how much do burdens in a case like this matter . Im not sure. Hes still going to have a really really tough time, but this has been a case where they have been going now for literally years before the trial trying to figure out the ultimate question of who is an objective expert to determine that. You had one expert come from the Court Appointed by the court, and then there was a big fight over whether this person was objective. The Court Appoints someone new and then there are months and months of delays and more examinations so this is definitely going to come down to a quote unquote battle of the experts but an insanity defense is almost impossible. Especially because there is so much evidence of real planning here. Well, absolutely. Thats going to be crucial, but even in addition to that, you have the fact that its been decades since someone was found not guilty by reason of insanity in a mass shooting. Its almost impossible these days to win. Okay, dan abrams, thanks very much. Were going to turn to dan harris right now for todays other top stories and another big trial. The Boston Marathon bombing trial. Indeed. Good morning. Witnesses will return to the stand today as jurors decide whether the convicted boston bomber, dzhokhar tsarnaev, should spend life in prison or be put to death. Tsarnaevs attorneys opened their case asking for life in prison saying that would be worse than death because it would not allow tsarnaev to become a martyr. The captain of the ferry that sank off the coast of south korea last year killing more than 300 people, he has been sentenced to life in prison. An Appeals Court found him guilty on murder charging citing willful negligence. Many of the victims were teenagers on a school trip. His tshirt reads, warning, i do dumb things. This apparently is a bit of a fashion trend. Heres a mug shot of a guy in texas arrested on his ninth drunk driving charge. Same tshirt. I guess if you want to be charitable, you could call it a useful Early Warning system. Yeah. I dont know. We have had lots of dumb criminals but none with signage explaining. Yeah, exactly. I thought those were the tshirts the cops gave them after they arrested them. Yeah, its a parting gift. Exactly. Thank you, dan. Now, lets go back to ginger. What is that behind you . Well a lot of people thought that this photo was real, but it isnt. I just want to show it to you. It made the rounds on the internet. And they said, oh look at that hailstone. Its like a volleyball.
