The chancellor said the constitution does not allow him to restrict free speech and thats not true. They restrict free speech all the time for educational security reasons. Reporter last month yiannopoulos planned appearance at uc davis was cancelled at the last minute due to security concerns. Were confident that we have the plans and the pieces in place. Reporter uc berkeley officials told us they will bring in outside Police Agencies if necessary to keep the same thing from happening here. The law and press kent is that this event is fully protected by the first amendment. Reporter were back live here on the uc berkeley campus. You can see there are Police Officers. These look like campus Uc Berkeley Police officers lining the front of the building. They have actually locked the doors to this building already ahead of this 8 00 speech. They will start letting folks in around 7 00 were told, and only those that can show their passes. A silver car was still surrounded by yellow tape hours afterwards. This happened on buena vista avenue not far from grand street. Abc 7 news anchor eric thomas is there live for us tonight. Eric. Reporter and as you can see, police are still on the scene six hours after they were first called out here. Detectives going back and forth, crime scene technicians as well gathering evidence all under the watchful eye of neighbors who are shocked by what happened. This is the police department. The place is surrounded. Come out the front door with your hands up. Reporter thats the sound that neighbors heard as Police Officers converged on a buena vista avenue home looking for additional suspects in an apparent breakin. Only one suspect was found. I heard a series of gunshots. And i then there was a pause and then there were more gunshots, some yelling. There was an offduty Law Enforcement officer involved in a shooting. Reporter an offduty contra costa sheriffs deputy was asleep inside the house when the man apparently tried to break in. The deputy woke up, grabbed the gun and fired several shots. Its not clear whether the intruder was shot inside or outside the house, but he ended up collapsing in the driveway. This witness spoke through a translator. Translator there was an africanamerican male that was on the ground. They did first aid on him and they took him away. He wasnt moving at all. Next thing we knew, we seen them taking him away in the ambulance. Reporter Police Officers went door to door this afternoon looking for information as to what happened and why. The dead mans name has not been released, nor has the identity of the deputy. But for the people who live here, its been a trying day. Its kind of unnerving when the s. W. A. T. Was here, you know, and theyre telling us im getting on my cell phone from the alert system, you know, shelter in place. Is this going to change anything about your behavior now . The deputies who processed key evidence in the sierra lamar murder case are on the hot seat as the trial enters its third day now. Abc 7 News Reporter david louie is live at Santa Clara County superior court with the story. Reporter dan, you know this is an unusual case because there is no body and there is no crime scene. That means the district attorneys case hinges on convincing the jury that dna evidence will link Garcia Torres to the murder of sierra lamar. That also means that those who collected the evidence and did the dna analysis will be closely scrutinized. The sheriffs volunteer search and rescue team did what they called a tight grid of a field where it was believed sierras cell phone was located. Signals coming from the phone enabled technicians to triangulate its position. The phone was found a day later wet and muddy from the rain. The deputy who logged it into evidence explained how he took it apart and air dried it with an electric fan in an effort to preserve the contents. That was the start of a series of questions by the prosecutor, david boyd, over how deputies used latex gloves and procedures to preserve the integrity of the evidence. The attorney for the defendant accused the deputies and the crime lab of contaminating dna from evidence that prosecutors say will link Garcia Torres to the crime. Legal analyst Stephen Clark says thats influencing the prosecutor to ensure the jury that protocol was followed. Jurors have heard about mistakes that have been made in prosecutions because of mishandling of evidence, particularly dna evidence. If this jury feels that the evidence wasnt handled right, thats going to hurt the prosecution case. Reporter as part of that process, a deputy explained how he would change latex gloves each time he touched contents of a bag that contained sierras sweatshirt, jeans and school books. Its anticipated that a host of experts will take the stand in the weeks ahead to talk about dna and the risks of contamination. A Santa Clara County parks employee was hurt after a maintenance vehicle caught fire. The San Jose Fire Department posted this video on twitter. Organi organizers have filed for bankruptcy. The best surfers from around the world compete in this event near Half Moon Bay this year. Kate larson is in that area live with more on the story. Kate. Reporter lets start with a little good news. The waves are here to stay, so there will likely always be surfers at mavericks, which is right over the bluffs behind us. However, there is a lot of concern about when the mavericks competition will return to this area because of both the bankruptcy and also the surfing conditions this season. In the peak of Half Moon Bays surf season, a bankruptcy case likely wiped out the famed mavericks surf contest. I just cant see any way there will be an event at all. I cant see it happening at all. Why is that . Because the people that are supposed to pay for the event just filed bankruptcy. Reporter Brian Overfeld is one of three Board Members of mavericks invitational. He said the board brought on Los Angeles Based Cartel Management four years ago to handle branding, sponsors, tv and marketing. Late last night cartel filed for chapter 11 bankruptcy. Overfeld says he and the other Board Members have not heard from Cartel Management since december. We knew absolutely nothing about this at all, so its like a shot in the heart. Its certainly a disappointment. Its hard to really find other words for it. Reporter collin dwyer is one of 24 surfers invited to compete in the mavericks competition this year. He grew up surfing mavericks and says there are usually only one or two days a season with weather and surf appropriate for the big wave contest. He says last thursday was that day. Even surf line published an article about the great conditions called as good as it gets with photos and videos of the enormous swell. But a source close to the competition tells me top management at cartel said they were not going to run the contest thursday because of the conditions. One City Council Member says this is about more than just rent. The group found onethird of all wrappers tested positive for a chlorine known as pfc, the chemical is like teflon, it stops food from sticking. Pfc is also linked to some types of cancer and thyroid problems. The study found pfc in 38 of sandwiches and burger wrappers and 57 of dessert wrappers. The Consumer Financial Protection Bureau today slapped a 13 million fine on two companies for cutting off customers funds.
