top cop two. officers shot to death, a seattle parole about stopping and questioning him about paying muni fair. officers say kenneth harding opened fire on them as he ran and they fired back but many was picked up came from a member of the bay view community. the video of the chase is off the bay view opera house itself. the forensics examinations that have been done are objective and without officers began making arests on powell street near market. 43 were arrested. police say only one was from the bay view. 16 from other san francisco neighborhoods. and most were from other cities. bodies because the current could be carrying them far down the merced river. two men and a woman fell after crossing a barricade to pose for photos near the top of the 317 foot vernal falls. >> they were on the other side of the railing. just standing in the water and playing around in the water. and unfortunately they slipped and all three of them went into the water and over the water fall. witness reports say one of them slipped, and next one tried to rescue the first one z then, third one tried to rescue the second and first one. >> all three ended up going over vernal falls. a few minutes ago there were pictures of two of the victims, a 27-year-old and 21-year-old. she is a nursing student at usf. the third victim is a 22-year-old from modesto and turlock. >> the federal reserve crack down hard on san francisco based wells fargo bank today over subprime lending. wells fargo will pay an $85 million penalty but did not admit wrong doing. and some customers will now be getting compensation. >> reporter: debbie says she's been fighting with wells fargo for a loan modification. >> it's been really frustrating. they don't seem to want to work with us. >> wells fargo is the first lender to face a penalty by the federal reserve over a list of allegations that it steered potential prime borrowers into costly subprime loans and falsified income information and applications as a result of incentive pay and sales quotas and a lack of controls. anna is the leader of lions for california a group critical of wells fargo. >> $85 million is not enough what. we've lost in homes and our communities are suffer sog much. >> the $85 million penalty is spelled out in an agreement with the fed. the bank no longer operates the targeted loan unit and does not admit customers harmed. the federal reserve estimates up to 10,000 borrowers might be eligible fwor compensation ranging from 1,000ses today $20,000 but they had to have taken out loans between 2004 and accusations it's forged signatures on insurance checks. the story we've been following closely. >> castro valley-based vanderbilt construction filed for bankruptcy last mochl we've been calling the lawyer two days and have not heard back from them. we've heard a lot from angry homeowners who say they're now left with unfinished work and no way to pay for it. the owners of this home tell abc 7 news they're insurance company recommended vanderbilt construction after a fire about a year ago. but vanderbilt didn't finish the work. the homeowner called usaa, vanderbilt owner just filed bankruptcy they discovered the insurance checks had been cashed at fremont bank and claim it was gun a forged signature, homeowners now have no way to recover insurance money because he's protected by the bankruptcy. >> he's protected civilly f he has forged a signature for some of these, that is forgery. and he's stolen money. i don't know whether the district attorney will do something about it. but they will look into this. >> paul chang says vanderbilt cashed $72,000 worth of checks at fremont bank without required endorsement of wells fargo. another homeowner says vanderbilt did the same thing for her check, $259,000. there are $60,000 worth of work left on chang's roof. they and their four girls are living with friends. at the bankruptcy hearing chang asked how he can cash check was out signatures. >> he claimed power of attorney in the contract. but according to the contract they do have a limited power of attorney and they canf-ñ casñ checks for work and they didn't have power of attorney over wells fargo. >> he didn't have power of attorney for the mortgage company. >> san francisco real estate attorney says the homeowners should be tibl recover money from fremont bank. >> if the homeowner's signature is there, legitimate or illegal legit but not the mortgage company's, thenw no notation indicating the mortgage company, the bank should be held liable. they did not pick up the required two signatures. >> the contractor's state license board says requesting or receiving a down payment more than 10% or a thousand is illegal. and fines as high as 5,000s skpdz could be a prime minister with -- misdemeanor with finesç and are up to a year in jail. we asked fremont bank about its practices and it responded with a statement saying privacy regulations prohibit disclosure of that information. the homeowners might have been able to get at least some money back through the required licensing board bond but because he didn't pay it, the board says it was cancelled on july helicopter pilot pointed out the plants surrounded by light brown dirt. >> it's said it's almost cleared. >> these show what it looks like at ground level. agents say they seized 20,000 plants worth estimated $25 million to $30 million. there is evidence people were guarding and tending to the crop autos these are not medical marijuana grow sites. these are illegal, large drug trafficking organizations responsible for the sites, today. >> the state campaign against marijuana planting hoisted agents into remote locations to chop down the plants two. gardens were on mount madonna county park land. and tw on private report. the effort runs from july to october. this is the first camp operation this season in santa clara county. the sheriff's department has is its own marijuana native american tribes are celebrating an agreement with the city of vallejo protecting a sacred burial ground. for 98 days there has within a prayer vigil to prevent stit from putting up rest rooms in a parking lot and say the area has been used for 3500 years as a sacred place. the agreement not only relocates the lot but gives tribes a bigger voice in decisions that affect their land. >> and the clorox company based in oakland today confirmed it's received new buyout from billionaire investor carl icon for $80 a share, or about $10.7 billion, that is a previous offer rejected on monday. icon is the clorox company's biggest stockholder and said the rest of the stock holders should be allowed to decide whether to accept his bid. clorox released a statement acknowledging the offer is a dominant feature bringing us nice, warm weather that will hold inland tomorrow. with this b-52 a dip beginning to develop in the jet stream, there is low pressure system developing north that will take just enough of a bite out of the ridge to produce a sea breeze that we're seeing now to bring a little bit of cooling to the coastal areas and around the bay. overnight tonight, fog returns, to some areas, not the entire bay area, low temperatures on the mild side, mainly mid to upper 50s and low 60s at antioch and concord. and on we go to the summer cast. our animation here at 5:00 in them. >> this is very important. investigators for the state senate found california is one of just a handful of states that doesn't bother regulating the home care industry. efforts to change that are now underway. 93-year-old rose michael cherishes visits from her daughter. rose has dementia living in a residential senior home. four years ago being cared for by a convicted felon. he stole as much as $30,000 from rose. she was hired by the family, but they were unaware of the criminal past. now, rose's family wants greater oversight of the home care industry. >> i don't want to be a victim of something like this happening to me. i don't want to see elders a victim and they're most susceptible group. >> the state senate office of oversight now z.outcome conducted an investigation into home elder care using our 7 on your side investigation as evidence. >> number one, we found that there were people currently advertising services on craig's list who do have criminal back grounds. we found many people who have been convicted of care giver crimes have previous rap sheets, about 25% of them. >> the investigation found many in home care agencies claimed to do checks, but this can range from a thorough screening to a $19 instant check that experts say yields almost nothing of value. the home care agency used like rose's family said it conducted a background check on the care taker but that failed to find a drug conviction, numerous parole violations and a 2008 restraining order, keeping tanubo away from her own children. >> i think one of the most important of findings of the report is that californians under current law can do their own background checking. >> john hill is with the senate office of oversight and outcome and says families can use an inexpensive service scanning the fingerprints of perspective workers for a background check but few take advantage of it. and she says her family didn't know bit. >> it's more of an oversight. elderly are forgoten people. they're in the a priority. >> a bill making its way through would require licensing of home care providers to make checks mandatory. and list certified providers on a web site. >> owner of wide spread. you got that from across the political spectrum. >> now a software upgrade seeks to quiet concerns by letting a computer look at the naked imagine stead of a person. all security screener sees is a generic outline with yellow dots on it goitsing to show if there is an october that needs further investigation f there is nothing it will just show okay on the screen. software, theç naked
