Get to think there is 10 I would like to wish everybody a happy Washington's birthday I know you are calling it Presidents Day But officially the name is never changed it is still Washington's birthday we've celebrated Washington's birthday cents. I forget 17 Sutton 1787 or something like that with we've been celebrating as though it is a national holiday and I hope everybody had a great weekend and I hope you're enjoying today I know a lot of people are not working today I am Kim is Jason is Chris Hernandez is so we're all working today yeah you can work and out way so listen can I want to ask you 1st a quick question we're going to talk a bit about the impeachment trial but before we do I want to ask you a quick question about the deficit with these the vaccination site that's opening up the big one the mass vaccination site that's opening up that's in Oakland right is that one that is a federal. Vaccine. Program I don't know if it's federal I know that you can there they're opening up the online reservations for it starting today and I don't know if you've been while you probably have because you have an appointment scheduled but a lot of people have been going online trying to register right for these appointments and they're just you can't yet and so you don't turn to other cities and see well is there anything available here or there so this is a big deal that they're opening up the reservation system today will library dot ca dot gov will they allow other cities to I mean people who are not residents of Oakland will they allow them to come to that that you can live I believe you can mute can make an appointment. Ok because I want if you had to go in your own city are Kanno own county I don't believe so as long as you meet the requirements as far as what the specifications are for the vaccine your age your you know it's not a 1st. Emergency worker right that type of thing yeah so last week we had the California surgeon general on a dean Burke Harris she was on here and she said that the 2 huge vaccination sites the mass vaccination site to one in Los Angeles and I thought. He said one in Oakland I could be mistaken were actually federal which I thought was great I'm hoping that that's something that the federal government is doing you know they are . There was there were sending out the National Guard troops to help run the vaccination site so there are federal There is federal help on the way yeah that's fantastic So what I did was I went to live in Marin County so I went to the Marine a Department of Health and Morin had been really slow by the way it had been super slow so I went there I don't know week and a half maybe 2 weeks ago and I just registered that when I'm eligible I want to be notified and last week it was just before I went on the air I got the notification so I'm frantically doing this now when I went to the they gave you like 5 different sites that you could register at the one I thought would be the biggest would be at the Civic Center so I go to that one you just can't get in you have to wait wait wait and so then I picked another one it happened to be a Safeway Ok and I got in right away immediately the appointments the ones that I got it was at $1045.00 start at 1045 so yes so I got an appointment and it was a pretty easy I had to give them a lot of information but it was pretty easy to do now sit I did not sign my husband up to get one and so I went back there on either Thursday or Friday and of course all the appointments had been taken but I signed him up for the same notification so hopefully early this week they're going to have more vaccines because of course they run out they'll have more vaccines and then we'll be able to do that now I don't have my 2nd vaccination scheduled yet the wording was a little confusing to me it's said you can you can get your point for the 2nd faxing after the 1st vaccine I don't know if that means after the appointment or after I've actually been vaccinated. I'm going to go back after my vaccinations if I can sign up for that I read that most of the remaining back seem at this point is being held for 2nd appointments Yeah yeah so they really do want sugar shots yeah they want you to get both of those so it's exciting and of course the by administration has purchased 200000000 more vaccinations so you know we're we're pretty confident that we're taken this sucker down where you know we're getting control of this virus it's still bad super bad it's not the worst that it has been and so that's a good sign like the numbers are coming down but where the numbers are are still ridiculously high and so in comparison with say 6 or 8 months ago it's really really high but it's coming down from the peak and that is very very encouraging They're also telling us that the new variants these you know horrible mutations that seem to run amuck and in some cases they may even be more deadly that they are responding to the vaccinations so the vaccinations are working to resist those mutations as well so all of this is good I think was found she who said that children you know kids under 16 years old that those trials will be concluded sometime in the summer and that by September he believes that those vaccinations will be available for children so I I thought I would look around in Sonoma County and I don't meet the requirements at all but I was just you know curious poking around to see what it looked like yeah and everywhere I checked all over the all of the links to appointments in Sonoma County they say there is nothing available for the next 2 months and that's as far as I said that is exactly what Moran said and so I signed up to be notified anyway then I got notified fairly quickly so I could what's happening is that they're afraid to count on you know getting the vaccine and so they're giving themselves a lot of. Way And then when the vaccine is released and they actually have it then they're contacting us and within short order you go in I mean you know for me to receive the notice it was either Thursday or Friday and I have an appointment on Tuesday that's really good bye mom house had the vaccine and she is a Kaiser patient but they would they will send you to another city so what they do is call she had to wait on hold for a couple of hours and then when they got her on my and they said Ok well your area is booked solid there's nothing available here we're in the North Bay She said they said you can go to Santa Clara County that's the 1st available or you can go to full a.o. On this state she picked that because it was closer to us yeah a lot. So you know but they will send you to other places they just kind of look for the 1st available and whatever they're not going to do it well then shut my mouth I thought to I run out you had to do it in the county of your residence or I would have tried to get into San Francisco to get it because it seemed like they were doing much better than Moran was early on you know not now. Oh I just got word that Ralph Nader is going to join us at 1 o'clock this afternoon and I am absolutely delighted by that you know maybe what will do because I was planning to do a start of a just section of the of the trial of the. Impeachment of Donald Trump but I may just put that off and not do that right now instead I'll tell you what I want to do I want to talk about something else there was there's so much great stuff to read right now about what's going on in the country that may give us some insights and also give us some hope about things that we've been worried about and I'll tell you that one of them has to do with the rise of extremism you know I don't know I think you and I have probably talked about this before Kim about how can people swallow these q. And on their theories what's going on with these people how does he have this control over people it turns out there's a great story Marc Fisher wrote a story about lots of experts that he confided in here in The Washington Post and the headline on it. Oh I just also got a note about where I can get a vaccine are I'll do this in just a minute let me let me just continue what I was so many things happening all at once. So Marc Fisher wrote this he quoted a lot of experts in the headline is eroding trust spreading fear the historical ties between pandemics and extremism Well how about that interesting Did we really even consider this you know this this is really quite something the historical ties between pandemics and extremism according to this piece and according to experts who were consulted since ancient times pandemics have spurred sharp turns and political beliefs spawning extremist movements waves of mistrust and wholesale rejection of authority I have to tell you this sounds so true to me more true than a lot of things that I've seen there's a lot of people who they speak to in here and some of them happen to be Evan Jellicoe Christians or leaders Evan Jellicoe Christian leaders one is Richard Land He's the president of Southern Evan Jellicoe seminary outside Charlotte he's a long time Evan Jellicoe leader and he said that some of the insecurities that people face predated the pandemic you know a lot of the people who were arrested in the riots. Are people who lost their businesses maybe small business owners or they lost white collar jobs a Washington Post analysis of public records found that nearly 60 percent of the people facing charges had prior money troubles including bankruptcies an unpaid taxes so that's you know painful a lot of these people got involved in politics only after virus related shutdowns clobbered their personal finances which had to be means they didn't have much to lose. Well and they felt desperate it increased their distrust and so this Evan Jellicoe leader he said between that wallop and the diseases punch you know how lethal it was he said it reminded Americans of their own mortality He said it created a sense of social dislocation and a loss of confidence in all institutions you know that that can happen here he said The result is a surge of extremism on the right and the left including widespread embrace of counterfactual versions of current events he said in a healthy society the government and the church would say this is nonsense and people would believe that but during the pandemic that check on extremist impulses has failed for some people who crave connection with others he said God created us as social creatures when we isolate from other human beings we tend to malfunction he talked about religiosity and you know the importance of people you know the faith the importance of faith in people's lives and he said this was one of the real contributing factors that people wanted the government to leave them alone when they felt this threatened this desperate they wanted to deny that they personally were actually being threatened they wanted to believe that God would watch over them that God would take care of them and when the government got involved in especially when the government was telling churches that they had to restrict their activities in some places churches were told they couldn't even open up when there were other businesses that were opening up I thought that was terribly wrong but they were told that they when they do open up they have to have certain restrictions only a certain number of people within that they have to be socially distance that they're not within the same family unit that they had to wear masks all of these things even. That they had to curb. Prayer out loud and singing and chanting that these were things that could spread the virus and people were present that the government was interfering with their relationship with God and of course their relationship with God is something that's protected in the Constitution but they took it a step further and believe that the government's interference meant that the government didn't like God The government wanted to interfere with their relationship with God and that they had to show their faith by relying on God to protect them so that's you know that's one of the things there's a whole bunch of things in this story it's a very long story about the pandemics creating insecurity that it streaming offers a form of certainty that the numbers of people who searched and then became part of extremist groups extremist ideology and bought into the nonsensical conspiracy theories like the Q anon stuff that it just skyrocketed as the virus got worse and worse and worse as we progress through last year so it's fascinating and it's horrifying but I found some some encouragement in that. That if that's the case they tell us that these extremist periods in time when they talk about the Black Plague they talk about the 1900 flu pandemic they talk about this huge upheaval in social issues and in pentameter and that it always results in an increase in extremism but what they tell us too is that it dies out as that threat wanes as the pandemic is brought under control then those people who sought some sort of comfort in those groups they pull away it doesn't happen in one fell swoop it happens gradually and the way to. Make it happen more quickly hasten the pulling away from those groups the lessening of the power that they have over people especially now is what Joe Biden is to that he's providing people assistance he's helping to improve their individual lives that the vaccines are going to help that the numbers are going down that people see hope on the horizon that he's got all of these things that he wants to do in order to beef up the economy so people can go back to work and feel their own self-worth and ability to take care of one another in the meantime to put some money in their pocket so they can take care of some of the very basic needs that they have you know creating jobs the whole infrastructure think all of these things go into helping people to realize that they're not as desperate as they feel there's light at the end of the tunnel and then that will help them bring them back into a sense of reality so I wonder you know do people buy that I do and I think that's the only way to do it you can't ridicule them into it you can't sit him down and say but these are the facts and that's not according to the facts because they're going to tell you that is fake news I really do think that the way to get them into their. Minds is through their hearts and through their souls and through supporting them through the things that have given them so much insecurity and so much feeling of desperation is not going to help the people who are the racists the bigots you know that the real yahoos out there they're going to be there forever but other people out of normal society who somehow joined hands with those individuals when no one would have thought that could have happened it could have been because of their disparate do you buy it the telephone number is 88818080810 stick with me you are listening to. I don't think Nixon posed that kind of a threat at that time I also don't think that Nixon had cult followers I think that Republicans actually had specific ideals and were willing to wield their own power to winter storm system stalls and there was several states Texas one of them with icing in very cold temperatures in spots more than 2800000 without power in the state more than a 1000000 of them in the Houston area alone and used in Mayor Sylvester Turner says it is even possible with the weather getting colder. Atlee following the 1918 flu pandemic for example areas of Germany that experienced the highest death toll from the pandemic saw dramatic increases in voting for the Nazi party that's just a recent analysis that was done for some reason by the Federal Reserve Bank of New York of course there was also that pesky World War one so like pandemics spasms of extremism eventually end those endings don't necessarily arrive instantaneously. They say that the process of easing away from extremism begins with the approach that the Biden and ministration is pursuing cooling down the temperature attending to the issue and bringing concrete visible results now look haters going to hate We know that we've always had those people who are Nazi sympathizers Nazis America Nazis we've you know who just hate everybody everybody unless you're you know some white guy like them with a lot of tattoos and then of course there are the bigots the people who carry the Confederate flag you know those and we know haters going to hate We know that unfortunately they're not going to be cured because we finally get a vaccine because the pandemic goes away but the people who were not extract to begin with who joined their ranks out of desperation you know that's what's being alleged here is that there are a lot of normal people who actually join the ranks of extremists and participate in their extremist activities because they're scared because they are so desperate and they're looking for. People to blame. They're looking for people to give them answers even if the answers are ridiculously far fetched like you would not do buy it I do I think that it really makes sense you tell me and do you think there's any way that we could maybe hurry along the end of the extremism I'd like to see the demise of extremism as soon as possible thank you very much 8810 is the telephone number we go to Charles in Sebastopol Hey Charles welcome to. Hype and very glad you brought this up this is of a well known phenomenon called The Madness of Crowds syndrome and you can trace this back to ancient Roman times or even before that quite often it was a pandemic but not always but usually the ideal is that in some enormous event it was rippling the way through society through population a given area and people did not understand or could not correlate with what was happening versus what they were aware of they would immediately retreat into ever more extreme religious beliefs or other kind of you know ceremony and so forth a writer believing in things ignored of and believe and that of course now we seem to replicate in a much larger scale much faster I think their rate of acceleration is what I make note of here because now a social media things that may have taken years to propagate happen in a matter of days even hours sometimes the most unjust and part of it but doesn't it seem as if if if the spread is that rapid and if a lot of it is because of the pandemic then doesn't it seem that the police are not that well in grained in these people that they were looking for something they found something but that you can eliminate that something by eliminating the desperation which was caused by the pandemic and it happened answer for you as well people are already primed to go into Suresh part of that and this is going to sound a little odd but just bear with me to divide we have between now and started for the slave but he had a sort of like all the kind of political correctness mindset and that's just a term that people use versus the more you know a conservative mindset and the crafting for terms here. But that is why it's already been happening for a while that which has been growing ever sounds too because of people like Trump who want to magnify take advantage of politically right let me have an audience already trained in that direction know you sir into it like you know get out to a fire just in coming pandemic and all the economic consequences exactly absolutely pushes people already have who may not ordinarily look my 1st term and he saw the Nazi rise as a see young child he knows this well I mean even there at 10 am society that would be normally more intelligent I think right quickly we're drawn into the snow we see even more streamers and again amplified by social media and other things like this bright anything that alerts popular sort of Prime Minister action and you push a bit further with some larger than life you know thread tend and I think that example combined with economic crash of the Slayer Yeah that's a perfect opportunity for it's not just President Yeah and there's so much so many different things that cause people to fear that may cause them to to embrace you know some q. And on for example and one of them really is religion in that the 1918 flu pandemic for example people were also encouraged to wear masks it was you know they've recognized Are they thought they recognized that maybe this was going to be carried through the air and that if you wear a mask you may be having some sort of protection for yourself so the government encouraged everybody to wear masks at that point in time to the people who were religious I don't want to say religious extremist per se but who were very very religious individuals a large part of those people were afraid to wear masks because they thought if they wore those masks it would show a lack of faith in God because they believe that God was watching over them and that God would help them so if they put on a mask because science tells them this could help to protect you then they're telling God I'm going to get my protection from science because I can't count on you and it put literally the fear of God. It was a it was very very difficult for them 88 tennis the telephone and I'm so glad that these are not brand new studies are some brand new studies but these are some older studies that now you and I are becoming more aware of and I'm I'm so glad that they are it gives us some answers to some of the things that we've been wondering about how can seemingly intelligent people fall for this kooky stuff maybe this is part of the reason they're desperate and don't don't sell short those economic consequences you know if you don't have money have do you live in the United States of America today 808810 is the telephone number let's go to eighty's in Berkeley Hey eat Welcome to. What you said the right word economy economy economy you know if you look at the economy of this cancer is uncertain time and economy the Wall Street is not Kaname the suffering we would have been going through fighting or $15.00 an hour who can live on $1515.00 an hour even if you live by yourself that this this endemic came 1st what it was a 1st and magazine Well after that we had. That virus he chances wouldn't have that magnitude of Trumbull was not in charge he was it's a you know I believe I believe you're absolutely right about that you know the United States didn't take the lead that in it at any other time the United States would have taken the lead to really do our right thing here and we didn't we pulled out of the World Health Organization ignored and I heard on the yeah I saw down there McDermott saying you know the whole thing we have to talk about right now very important by the way is your to about almost more than 3rd of this country you only have like 7 is the 9000 deaths compared to almost half 1000000 you know listen let's talk about the economy this is a problem and this was a poll or it yet still follow the moron. And so forth from there would be to knob by his group but super rich but the billionaires but all see it but you know pick on pick up an immigrant Nicolas build his country pick up in the blacks because in the midst of all this because this guys see who's your enemy your enemy is on Wall Street your enemy are this billionaires by the way the only way to solve this problem right now we need to have ceiling and Wells why people like the government is on with a guy from billions while a $100000000.00 plus Americans don't have enough money to eat when have to face it I mean it's and that's and that's been an ongoing issue in the United States for decades now where we've moved away from the idea of the wealthiest Americans that you know that we recognize that they gained their wealth because of all other Americans because of everything that contributed to it and sure they had to be brilliant they had to be able to make these companies there were sacrifices along the way but they also benefited from all of the infrastructure in the public education and all of the workers and we used to recognize that and so that's why we had the kind of income tax schedule that we had but the amount of money that the wealthiest pay and the loopholes that have been provided and their ability to just take their money off shore and of evade taxes altogether it's become utterly ridiculous and it has harmed us as a result and people have gotten used to that and you know Morse the pity right now let's talk about the extremists and how it may be directly associated with a pandemic and with people's insecurities extreme insecurities seem to be leading to extremism 8810 is the telephone number 8080 $810.00 calling from Saratoga Hey Don welcome to. I don't know I said there might be some moderation with the new administration but I see 2 things I see Asians getting attacked like crazy and you know some. So Scott other environs but I also saw the elimination by Biden the talent project and that was to get rid of people that are here that have had you know sexual you know that if attacked people sexually they're here illegally but now they can't be declared it in other words we're going to be letting people stay here that are you know predators and I don't know how that's going to help I think this is going to you know I it makes me upset I don't want to see more people you know hurt because there's people coming here illegally that shouldn't be here they've committed major currents and he's changing that he's going to let them stay here and they're doing catch and release and a lot of these some of these people just don't show up the I mean already and the vast majority of the people do show up it's over 90 percent of the people who are you know who are released when they're waiting for their asylum hearings they do go back and a great number of the people who don't they are then picked up and they are deported I don't know about this Talon project you're talking about I don't know anything about how do you spell that Alan so I can look I think it's th like be able to tell and I think Ok Hello and I will look at absolute 0 that I can answer intelligently on others but I'll tell you that I believe that the people who are here undocumented any of them who have perpetrated violent crimes it especially of course they shouldn't be here of course should be deported but I haven't I haven't I don't know enough about it to comment on what the buy ministration is doing right now my understanding is that they just stop deportations as they do an analysis of what is going on who's being deported who's in the pipeline why they are in the pipeline and what the trumpet ministration had done before so it could be that this is simply a temporary effort not that it is policy that has been established that they will not be deported but I will look into it and then we will talk about it because maybe you're right I just want to you know can. After. Real quick I looked at the operation talent ice officials canceled operation Talon it was a nationwide operation targeting sex offender subject to deportation it had been planned in the final weeks of the Trump administration a senior ice official said the by good ministration had nothing to do with that decision that it was they said career staffers planned it and set it aside while awaiting new instructions from the Biden team. The hope the official noted that Homeland Security Investigations which is a separate wing of ice that conducts criminal investigations has continued investigating sex offenses involving u.s. Citizens and non-citizens and yes sex offenders are subject to deportation under the Biden and ministration so that should put your mind at ease there 8810 is the telephone number we go to Walter in San Jose Hi Walter welcome to he had Are you done today doing well thank you Walter So you know for the gentleman who just called I was going to mention to you that the Taliban have been suspended and that it will suspend that undercover ministration like you said but it was interesting yeah that gentleman called in for us to talk about Biden and then he talked about. This is the 1st in show. You can now listen at all by simply saying. Here's tab. 13 grand is joining us Ralph Nader I think all of you know he's America's leading public interest lawyer and consumer advocate you may not know that the Atlantic named him as one of the 100 most influential figures in American history because he is in his book his 1st book was called Unsafe at Any Speed that book was responsible for u.s. Auto safety standards shown to have saved 3 and a half 1000000 lives over 50 years he's a remarkable individual a remarkable person who advocates for you and me his most recent book which he penned with Mark Green is called a wrecking America how trumps lawbreaking and lies be tray all and Ralph if you would just allow me to do something here in this book there's a chapter that begins on page 250 it's called Who's America question mark and if you go through there there's a deadly interregnum is the chapter and Ralph lists some of the dangers that Donald Trump could unleash if. Something wasn't done about him and they included destroyed tons of documents and e-mail records under his control that incriminate his lawless regime this is as he's leaving office by the way as he's as he's. Evading law enforcement in the verdicts of history pardon large numbers of family staff members starting with a vodka Jarrett and Bill bar or commute their sentences to satisfy whatever nefarious motives he harbors such as preempting any mid-level staffer just to rat on him one of his favorite gangland words give the Medal of Freedom to odious characters either for Hush purposes or future commercial advantages make it a living hell for the Joe Biden transition team to do its work in inventory what's going on in agencies and perhaps worst of all because it'd be irreversible and last for decades hurriedly nominate and confirm a new Supreme Court justice within weeks or days where there are no opening anyone doubt that pack the courts McConnell wouldn't try this book was published long before those things happened and there are many other things that are listed in here as well Ralph Nader thank you so much for being with us here welcome to let's talk about the impeachment Ralph there the trial ended not with a bang but with a whimper I was excited when I heard that the senators were planning to bring in witnesses they were negotiating 5 witnesses for each side and then suddenly nothing simply a stipulation from one of the potential witnesses why Ralph why not call witnesses it would not change the outcome but it would have created an historical record what happened 1st we heard and there's a procedure presented to the House managers from the get go from demanding what misses it was going to be a video show trial very gripping video but no live witnesses from the families of the bereaved from the police from Mike Pence from acting attorney general dear frozen from Georgia. Official Matt Ruffins verger and all the other people that had a lot to say about what was beneath the tip of the iceberg in terms of not just threatening phone calls but actually sending people around in Georgia and bullying the Justice Department more than just a call to the acting attorney general to turn around and reverse election yeah now . The Democrats had a 2nd opportunity which you just pointed out by a vote of 5545 surprised everybody near the end of the trial on Saturday they voted to ask for witnesses and that included a few Republicans who voted on the side of the Democrats we all thought wow finally a 2nd window afforded by the courageous outspoken new member of Congress Congresswoman Jamie hero Butler from the state of Washington and then within minutes Senator Ben Cardin went on n.p.r. And he said the trial would be postponed for 2 weeks and the only question is whether the 5 witnesses allotted to both sides were going to be named and now or identified later so he thought that they were going to be witnesses Yeah a senior senior senator from Maryland Ben Cardin he was completely misled what happened was that the White House and Majority Leader Schumer Senator Schumer from New York and center Coons from Delaware basically told the House managers this trial must stop now we're going to finish it now there's not going to be a new postponement we got a week's vacation coming up and no more witnesses and so they house managers huddled with. The defense attorneys for Trump for a half hour or so and they agreed that if they would meekly put the statement of Congresswoman Butler in to the record no deposition under oath or in a sting so this was a terrible terrible disaster because they've now unleashed president ex-president Trump to run again he is not the titular leader of the party he controls the state Republican committees all over the country which in turn allows him to control the Republican National Committee that's the architecture of the Republican Party he can raise tons of money he can speak to huge crowds and he's got supporters all over the country so that that's what happens when Speaker Pelosi once again after the Ukraine impeachment effort she doesn't move with a full hand or is a say in bridge he doesn't move with the ace of spades and more specifically Pat the concentration on the physical attack on Congress was very important. But he has for 4 years institutionally attacked Congress I invite listen to the Constitution again and again and again he defied over 130 subpoenas no president has ever come close to that Nixon was about to be convicted for defining one so do you know one obstruction of justice he turned the White House into a crime scene with serial violations of the x.x. Using federal property you know he he or you served a congressional part of tax and spend he appointed cabinet officials that were supposed to be confirmed by the Senate put him in office without confirmation violating new appointments because he had violated the letter and spirit of the Foreign and Domestic monuments clauses enriching themselves he flouted his obligation to take care that the laws be faithfully executed so he had a whole nother powerful article to send over and have the Republicans try to respond and he didn't do it but at least one had several that she could have done and she didn't neither in the Ukraine impeachment nor in this impeachment and also Congress does have the power to subpoena they asked Donald Trump to testify why didn't they subpoena him to testify why didn't they subpoena Mike Pence they talked about him enough why didn't they subpoena Mike Pence why didn't they subpoena some of the people in the administration who quit on that day including Betty to Vos who in her resignation letter cited Donald Trump's response to the insert rection as the reason for her leaving Mitch McConnell's wife resigned on that day those are cabinet secretaries it's astonishing that they didn't think it was necessary or important to bring in witnesses I mean there are so many Ralph I could name 30 that I think would be appropriate to be hard for me to narrow it down to 5 well the only answer were given by Speaker Pelosi. And House manager Jamie Raskin is that they had enough to prove their case well they did but but but but when you have 10 times more fruits your case you're doing 2 things you're educating new American people about the horrendous nature of this in other words more than the tip of the iceberg was involved and number 2 you're increasing the likelihood some more Republicans would be. Going across and joining the Democrats and there are 7 fellow Republican senators because not all of 40 and not on the 40 plus Republicans were like Ted Cruz or Rand Paul some of whom were wavering some of them were leaning and if they saw on the stand. Pence and Jeffrey Rosen and William Barr former attorney general and John Bolton who is eager to testify about obstruction of justice and his words quote Being a way of life in the White House and quot things might have changed they didn't call any Republican witnesses this was a Republican attack they didn't call any Republican when this is so you know in the old days they would say they threw the case you know and you know it's in there in the 1st impeachment trial the Democrats make quite a show of indicating that a trial isn't a trial if there are no witnesses and so this time they're just going to turn around and I get it that they didn't think that there were going to be any Republicans who went along I mean one of the big arguments and we see that was statements from Republicans when they came out of the trial so many of them including Mitch McConnell talked about the jurisdictional issue it was unconstitutional Well that issue was resolved at the beginning of the trial they weren't supposed to then use that as an excuse not to pay attention to the facts in the case they were then supposed to make their decision based on the merits but they got cover and it would have been harder for them to do that Ralph if they had done what you're saying bring those witnesses in and make it incontrovertibly you know how shameful to let somebody get away with us they also acted as if they didn't understand the Constitution the difference between a criminal trial and an impeachment trial that was a force it was not a criminal trial there were no fines no potential of incarceration it was a civil proceeding and the only sanction worse a disqualified from from running again right that's all and secondly you put your finger on it that you really didn't. Provide an understanding of what was a stake here and what's at stake here an assault a physical saw on the Congress and the groundwork laid for months before as the House managers point out so graphically and he gets away with what is akin to mean for future wannabe Trump dictatorial presidents and vice presidents and other high officials that's one the 2nd is that there are a lot of disagreements about the meaning of the Constitution among republican and democratic constitutional law experts and law professors this one Pat is like 99 percent sane Of course you can. Convict a former president after leaving office haven't impeached him while he's in office because otherwise as you know the president could do some 34 days before leaving office and get an away with it and so you had 200 law professors many of them supporting republicans or democrats No agree of course so this is just a phony excuse by Mitch McConnell who doesn't have an ounce of courage in his political brain and he denounced Trump for doing what he did and then made it certain that Trump got away with it again and again but the worst deception I think is when the Democrats let the press believe falsely that subpoena witness would only end up in the courts and it would drag on forever I know the Supreme Court has ruled in the case of Nixon vs the us that when it comes to Pietschmann the Us Senate is totally in control there is no judicial review they are totally and controlled so if they subpoenaed they could enforce a subpoena cite them for contempt if. There's subpoenaed officials thumb their nose it can just say Ok that's an end. Rinse of guilt as a possible influence of go right so you know it's just this is tragic to see Nancy Pelosi twice in teaching him and twice sending over a one legged stool. Twice sending over a finger instead of the full hand of evidence and impeachable offenses and went misses that she had you know impeachment doesn't happen very often in our history it's happened. 3 times in my lifetime and it's it. To with a to a trump and run with Clinton Nixon was never impeached it's so serious it's such a big deal that the Congress and the Senate need to take the time and they need to do it right and because it's also a civics lesson it's an important lesson for our people to understand that this is how we make sure that the people who ascend to that high office are still in check that we have a system of checks and balances and that when they abuse their power they lose that power and they lose any future office of public trust that they may be you know have their eyes set on really important and we fell down on that people now people because we have really shoddy education when it comes to teaching civics anymore in school this was an opportunity to really help the American people understand the importance of holding the president to account to precisely and one might add 2 more an important points and 11 is how close we came in this country to electoral dictatorial disaster less than 100000 votes out of over 150000000 votes Lesson 100000 votes in swing states like Arizona Wisconsin Georgia. Less than 100000 votes switched would have put Trump in for 4 more years the 2nd point I want to make is is if any person stood on the Mall and did what Trump did in goading and encouraging this riot and this storming of the Capitol and had a history of doing and prior months and under criminal law on us you'd be arrested indicted convicted and sent to jail all the Democrats were asking was it he'd be disqualified from office and over 40 Republican senators said no so that they bear a very serious burden here themselves such as the Democrats losing their great opportunity you know you when you talked about the number of votes that made the difference that's because we still ascribe to the racist electoral college and you know when are we going to finally get rid of it I don't think we're going to be able to do it you know through one man well well you're right but when it's when you and other media put Steve Silberstein from San Francisco on the radio to explain that he's over halfway there was a marvelous citizen movement that has. States passing laws in California Illinois Marilyn New York Connecticut that say that if we reach 270 Electoral College votes and now they've reached about 195 they will throw the Electoral College votes to whomever wins the presidential popular vote throughout the country which in effect neutralizes the Electoral College and avoids having to go through an arduous and almost impossible constitutional amendment because under the Constitution not only is the Electoral College there but there's a clear provision to 2 states are in charge of elect for rules and they could do that and it's called National Popular Vote dot com or dot org can't remember which national popular vote you'll see exactly what you can do in your state to get a law to get the 195 electoral votes over to 270 and never again will people witness a candidate for president going into office after losing the popular vote to the person who won the popular vote but lost Electoral College vote and I am certain that c.n.c. Or question it's a great citizen movement he started it in San Francisco he has about 7 or so staff I understand and they go and sit calmly was state legislate tours and they're making great progress on Democrats have lost 2 presidential contests 2216 they wonder popular vote last electoral college vote and the Democratic Party nationally will not get behind fully the national popular vote movement we will get still the Silverstein on the air will contact him and get him on the air and we'll see what we can do to educate the people in this area anyway Ralph it's been delightful and frustrating thank you so much for being with pass thank you Pat It's why we wrote the book wrecking America is. It's a less we forget because it's coming back to wrecking America how trumps lawbreaking and lies be trade Oh Ralph Nader wrote that book with Mark Green Ralph Nader thank you I can't wait for the next time thank you very much but thank you good audience front page hero. Going to. Think we have heard the breaking news tonight so I want to talk a little bit more about impeachment these recent done it's over it's. There is no appeal to an impeachment there's no redo of an impeachment it is done and Donald Trump was acquitted However it's important to point out that in the history of impeachment in the United States of America and there haven't been that many this is the only one that and Donald Trump's previous impeachment So Donald Trump is the only president who has faced impeachment you know from a bipartisan group when it comes to the trial the conviction in the trial Mitt Romney voted to convict on all Trump in the Ukraine impeachment trial so it was bipartisan because there was one Republican who crossed party lines and voted to convict in this impeachment there were 7 Republicans who voted to convict the President and the people who didn't I just kind of want to take a 2nd share with you what some of them said you probably heard Mitch McConnell I shared with you some of that too but not right now right now I want to share John Bozeman from Arizona while the former president Donald Trump bears some responsibility for what happened that day I maintain my belief that the constitutional constitutional legitimacy of this impeachment trial was lacking it's important because a lot of these guys are going to say that the constitutional legitimacy or the jurisdiction and that was something that was debated and resolved before anything else happened in this trial it was resolved they had jurisdiction there was there's precedent it's there's case law there is jurisdiction and constitutional law professors constitutional law experts pretty much all agree that there is jurisdiction for a former officeholder Shelley Moore Capito in West Virginia said our Constitution references that impeachment was designed to remove an office holder from public office not a private citizen given that. As a Trump no longer holds public office my no vote today is based solely on this constitutional belief the actions and reactions of President Trump or disgraceful and history will judge him harshly I mean these are people who are talking out of both sides of their mouth once the issue was resolved you had an obligation as a juror to make a decision based on the merits of the case they didn't instead they used an excuse to give them political cover because they're afraid of Donald Trump John Hoeven in North Dakota the Founding Fathers designed impeachment as a way to remove a president from office that's why I believe it is unconstitutional and voted against trying to apply impeachment to a former president after he has left office President Trump should not have encouraged the protest on January 6th but those rioters who broke the law are responsible for their actions. Sender Jerry Moran of Kansas President Trump was wrong to continue to spread allegations of widespread fraud and not immediately discourage the reprehensible and unpatriotic behavior I believe the impeachment process is intended to be used for considering whether or not the president should be removed from office I quit mc McConnell former president transactions that preceded the riot were a disgraceful disgraceful dereliction of duty there's no question none the President Trump is practically and morally responsible for provoking the events of the day there's no limiting principle in the constitutional text that would empower the Senate to convict and disqualify former officers that would also let them convict and disqualify any private citizen you're a buffoon the Senate's decision today does not condone anything that happened on or before that terrible day Rob Portman in Ohio this question I must answer is not whether President Trump said and did things that were reckless and encourage the mob I believe that happened the threshold question I must answer is whether a former president can be convicted by the Senate in the context of an impeachment this would be unprecedented and it's not I mean it is unprecedented in terms of a precedent it is not one president unprecedented in terms of public officials it has been down there is precedent for it and again it's kind of frustrating and a goes on like that I'm not going to read all of these it goes on like that and it is really astonishing to me that there were so many Republicans who acknowledged that his actions were what incited the crowd to threaten their lives to attack the capital of the United States of America the constitutional issue had been resolved and it is very frustrating that they didn't accept the their own decision coming out of the. I did state Senate that resolve that issue you wonder ery frustrating you have wonder if that if the insurrection at the capitol doesn't rise to the level of impeachment what ever could well see I think what they're saying what all these guys not all of them say this but the majority of these guys are saying is yeah it was really bad and he did it but I don't think you can impeach a president who's already out of this now he doesn't appear he was out with each state office that was a that was a convenient excuse Exactly yeah it really was his by the way I should mention his defense team because I think that the prosecutors the House managers did an astonishing job I mean absolutely astonishing including that woman that I had never really heard of before who is a delegate from the Virgin Islands Jamie Raskin was absolutely incredible all of them did an astonishing job of presenting the case against former President Donald Trump and remember he was impeached before he left office and it was Mitch McConnell who would not bring the Senate who had adjourned he wouldn't bring them back into session to conduct the trial before Donald Trump left office it was Mitch McConnell's decision now McConnell Interestingly in his little speech he blamed Nancy Pelosi for not not bringing the case to trial before Donald Trump had left office and that's not true they impeached him they did it expeditiously and they wanted to take it to the Senate and Mitch McConnell said no he was not going to bring the senators back he could have done that that was Mitch McConnell's decision because at that time he was the Senate majority leader and it is truly truly shameful that he wouldn't do that and the trial would have taken place now it would have resulted in the same decision there's I don't think there's any question of that but they wouldn't have had that argument. To give them any sort of political cover and that's what the argument is right now but the House managers did an incredible job the president's team just made silly arguments I mean one of the guys the guy who ended up being the lead lawyer not the guy who 1st made a complete ass of himself but the other guy he's a personal injury attorney he's not a constitutional law professor he's not even somebody who's an expert of constitutional law he says he's a personal injury attorney and they're important to help people who suffer slips and falls and other things where they have to bring civil litigation but it's not the same thing and he didn't seem to understand that one of the very very important aspects of an impeachment is that it is a separate entity you've got civil cases you've got criminal cases and you have impeachment impeachment is aside from that for example if a person is impeached and convicted there's no double jeopardy that doesn't preclude them from also being criminally charged and convicted and going to prison it's not double jeopardy even though it may well be exactly the same crime because it's not part of the criminal code it has nothing to do with that it has to do with protecting the people we're protecting the Republic from a person who has gone bad who has abused his authority who has no right to hold public office. 808810 is the telephone number 808810 Yeah I wanted to tell you that Congressman Eric Swalwell from the space was asked if it was worth it if the impeachment doing the impeachment trial was worth it given the outcome and he told a.b.c. 7 that it was very worth it to hold a president accountable until the last 2nd there in office and to show that Congress will never give a president a January exception where he. Said You can commit crimes and not be held accountable afterward and he also said that the country needs to see the president incited among our citizens to attack the Capitol and that because 7 Republicans broke rank he said it was the largest bipartisan impeachment vote ever and that it will be vindicated in history and the 2nd largest was his 1st impeachment trial 1st impeachment trial Yeah so you know it's Anyway they were silly they they didn't seem to know exactly what they were doing they showed a long video of Democrats saying the word fight as if these political metaphors were the same as months and years of Trump radicalizing his supporters and encouraging actual violence which culminated in his pretty and post election for her to stop the Steele and you know they made their case and I think it's evidence to in the statements of the Republicans who voted not to convict him but who did say Yeah he was responsible for this he was the guy who sicked them on the Capitol Those are my words you know not not his by the way they also talked about the 1st Amendment which again was pretty silly an impeachment trial is not about the government taking away your right to unpopular speech his 1st amendment rights have not been abridged that has nothing to do with an effort the 1st Amendment has limitations you know we've all heard you can't cry fire in a crowded theater unless there actually is one there are limitations to your 1st Amendment rights and true incitement to riot is one of those limitations but in an impeachment trial you don't have that same burden the president of the United States making the same statements that a citizen could not be convicted for can still be impeached for them for example. A private citizen could say I think out of Hitler is right. Private citizen could say I mean during World War 2 a private citizen could say you know I think. Germany Japan should attack us at Pearl Harbor because we're really vulnerable. A private citizen could say that if the president of the United States said that particularly at that point in time that would be an impeachable offense it would not be something that Hamilton said the subject of impeachments jurisdiction are those offenses which proceed from the misconduct of men or in other words from the of buse or violation of some public trust they are of a nature which may with peculiar propriety be denominated political as they relate chiefly to injuries immediately to the society itself and the president has an incredibly unique position a position where he gets followers who are incredibly loyal to him and because he's the president the most powerful man in the world they believe what he tells them so when he lies to them and when he incites them and when he tells them to you know go to the Capitol Building fight you've got to fight hard or you're going to lose your country they take him at his word and it was a real threat to this Republic it was a real threat to our democracy is the threat over we don't yet know I tend to think it is I tend to think that what we were talking about in the 1st hour about you know the relationship between. Pandemics and extremism I mean that's what that has done it's given me some understanding of what may have happened to a large segment of our population but it also gives me some hope that as the Biden administration hopefully begins to help people to rebuild their lives after this pandemic that the extremism a way I'm I'm going to hold on to that Lee. I'm sensing you know my old question survey so. I'm sensing a sort of a period interest Sergeant Hoyt. Over the downfall and what would you alternately like to see happen to a lady execution would that be good enough for the Democrats is that what's going to unite us maybe execute the president so so you're just asking an idiotic question then you really don't want to contribute to the discussion and leave it his future to the courts we'll see what the courts decide to do with him I do hope that the g.o.p. Day care how you do and I'm well thank you. All right well you know I think. It's not over I heard Lindsey Graham this weekend and. Among other things he's saying he's in there winning you know he sounds like Trump's mini me years gone down there to play golf with him this weekend and. Gramm of solutions we will and he's he once he's got designs on becoming president he just interested in power for self and he's behind Laura Trump who's married went to Eric he wants her to become the next senator in North Carolina and his good friend did to him to convict Donald Trump. He's gramma's going to support a trump over his good friend and who he's always support is a good friend he's a good publican but he's going to support Laura Trump who has 0 experience you know I think but I think one strategy is is we need to get behind Liz Cheney and they need to she needs to develop a coalition with these few Republicans that voted to impeach and then to convict and they need to develop a coalition and. Develop a strategy to minimize these right wing fascists right what they're debating right now as I understand it is that some of the more powerful people within the Republican Party and it's going to be up to them I mean it's certainly not up to me it's going to be up to them what they decide to do but what they're trying to decide is whether they're going to make an effort to get their party into line to make them a serious party again to get them away from the conspiracy wacko nut jobs you know to be serious about legislating to stop demonizing fellow Americans if they're going to do that or if they're just going to completely break away and form their own political party and they're very serious about. It's not easy to do. You know it's very difficult to do and they'll lose a certain amount of power as they are in the process of accomplishing that but I know there are a lot of Republicans who are anxious to have something to completely breaks away from the legacy of you we're talking about we're talking about. Carpet dot com to the showroom nearest you or to have their mobile showroom come to you m Q McAlister. This is the 1st and. Here's Prime. Oh I caught myself singing I've got to tell you the. Access I like to have to do I'm Paterson you know what I'm going to move away from Donald Trump now because it's time for him Pietschmann is over and there's going to be plenty bed he's going to do that are going to cause us to go Oh my goodness what about that and when there are trials that come up and there there will be charges that are brought against him some are going to be criminal there are civil cases that are also pending against him some of the charges that are being made against all from a lot of them have to do with things that he did before he became the president of the United States some if there are charges that are brought as a result of the insurrection or his interfering. With the Georgia election officials or any other elections officials those are things that he would have done while he was in office and Kim said you think that you think that presents a problem if it's actions he committed while he was in office why I feel like I have to I just have questions about it so. Let's let's listen as you said step away from Donald Trump and look at other presidents right so Barack Obama ordered the. Execution of Osama bin Laden no one can deny that he was an enemy of the American people yet but he was saying but he would have tried as the president and he was acting in his official capacity as president he wasn't attempting to interfere with an election which isn't part of his presidential duties but what can you I mean how can you say that it wasn't his right eye cigar or his part of his duties as president to you know to get involved in the inside and I get to interfere with the Georgia election Ok No but I think you can make the argument that presidents in the past may have done things that are questionable whether you agree with them or not and that may open up you know other presidents to be charged with things that maybe give me a better example then then when you're actually doing I have your own duty as president people disagree bring up the execution of Osama bin Laden because bin Laden wasn't tried technically right or by a jury so could you then go back and say Well that was in an illegal action in Iraq Obama should be charged no other president No I just don't know that while you're in office something that you do what and what if the president of the United States got really mad because someone looked at his wife leering way and he got jealous and he shot the person dead while he's in office you would say that person should be prosecuted right for sure Ok why. But because murderous against the law as is interfering with elections officials and he didn't do that in the course of his presidential duties there was no self-defense motivation it was just a crime of passion that was perpetrated by a man who happen to be the president of the United States President Barack Obama and other presidents but George w. Bush you could make an argument and I have that George w. Bush illegally took us to war in Iraq I think it was illegal I think that the intelligence was. Was not just wrong I think that they just like the Downing Street memo said the intelligence was fixed around the policy that he wanted so it was a it was a big lie that was perpetrated George w. Bush deciding to invade Afghanistan was very controversial to go after Osama bin Laden when the Taliban wouldn't turn him over a lot of people objected to that a lot of people thought that that was an act of aggression by a president of the United States it was his official action as the president of the United States you might charge him with war crimes at the Hague you're not going to be able to charge him criminally in a court in the United States of America because he was exercising his presidential responsibilities and sometimes people are going to disagree with those things and sometimes there are going to be massive errors of judgment if you are the president of the United States and you try to interfere with a lawful election and try to pressure election officials to throw an election to you then that's that's criminal that is against the law and there's no way you can say that your presidential duties required you to pick up the phone and call the secretary of secretary of state and the state of Georgia to interfere with his election and ask him to come up with 11000 votes so you're totally right about that but I think there's an intellectual argument to be made. By prosecuting a president for crimes done or allegedly done while in office it really opens up a kind of muddy water situation where that anything can be hauled in and pointed to as a crime and I disagree wholeheartedly and Bernie when when you're talking about Ok so impeachment is one thing and we've talked about us house and that's the avenue right that's the avenue now but it's not the only avenue as you recall in the Constitution it says that the penalty for impeachment is removal from office and prohibition from holding public office again and then the next sentence and I'm paraphrasing here says but the impeachment doesn't preclude criminal charges being brought against that person if that's appropriate so impeachment doesn't necessarily require a criminal offense it doesn't it requires some sort of abuse of the public trust but if you committed a criminal offense and you are impeached and the evidence shows that you committed the criminal offense you are removed from office you may be prohibited from holding public office but that doesn't prevent Now the defense to arm I'm sorry the Justice Department or whatever jurisdiction it would be in to bring criminal charges against you for exactly the same charges they are stablished that specifically because it's not part of the criminal justice system it is impeachment and so it doesn't constitute double jeopardy but the even though he was in office if he perpetrated a crime he can be prosecuted for that crime when he leaves office. All right we'll see how it goes I mean I think they're already preparing charges and states I just. I just I'm concerned about it I have concerns about it but I understand what you're saying but if frankly I think if a president breaks the law while they're in office you know I do think that they should be charged if they break criminal law if they're criminal like any other person you know they have to abide by the laws too and if they don't they should be held accountable for that absolutely you're totally completely right but I think there's a you know a lot of gray areas where what you do wow you know while there it's your official duty versus what is your official duty there's a lot of you know leeway there I can't think of any. I read is share with really because I really can't maybe there are but I can't think of any area where if your You're either acting in your official capacity or you're not and you know this is your responsibility to you know protect the country do you know whatever or you're not like for example I believe he also broke the law criminal law when he tried to get the president of Ukraine to open a bogus investigation to give him political ammunition to use against Joe Biden you know he was asking this guy to do something that he had no intention of doing because he thought that would be good for him so that he could try to slime Biden with it and there was no there there so I think that's that was also illegal because it seems to me that he was attempting to extort the president of Ukraine and extortion is illegal will they bring criminal charges against him for that I think they should is that I am. No I feel like you for one this this round's this political argument and you've made your what are your convincingly but put thought to it can't because I'm just saying this you know I'm I'm pulling this right out of. My behind I don't know this is what I'm thinking I don't I don't see gray areas but you know think about it because maybe you'll come up with something and then it'll it'll go the other way you know but I think that would be a good defense that they should mount should charges be brought that they should say that he was acting in his official capacity as the president of the United States therefore they can't bring charges against him you could you know we argue even the Muller report even Bob Muller said that while it's the judge. You know there was that office the legal counsel memo that said you can't indict a sitting president and they were abiding by that he said but there's nothing to stop criminal charges being brought after he leaves office I wonder why John Rothmann if any president has ever faced charges for crimes committed while in office I don't think the have after the fact I don't think they have but I don't think we've had a lot of criminals in office I don't I'm not back to that have to get to be impeached to have the well. Being impeached twice and then having charges brought against you afterward Ok let me let me correct what I just said. Richard Nixon. Had he not been pardoned by Gerald Ford after he left office likely would have faced criminal charges it's the reason Gerald Ford pardoned him right because he could have been charged after he left office so even though I don't know that we have charged anybody criminally for something that they did while they were in office it certainly could have happened to Richard Nixon and was prevented from happening because of Gerald Ford who thought it was more important that the country get past this long national nightmare I objected I still object I think he made the wrong decision because I do believe that no man is above the law and I do believe that if the president of the United States breaks the law that he should be held accountable for that and I resent that any president there's no pardon coming this time I really don't think so well there could well there could be he could he could have issued a pocket a pardon Harkat pardon but don't you think we would know about that right now new I mean he could have a problem but he wouldn't have to because he doesn't need to reveal that he did anything so unsavory unless the charges are filed against him and if the charges are filed against him then he can come out and say Your Honor these charges or as attorney these charges have to be dismissed because look here I have a pardon that was issued before he left office then the argument would be made that it's unconstitutional because you can't issue a pardon of yourself and then that would be litigated up to the Supreme Court and if the court held that he could then he wouldn't have to you know face these charges not in a federal court but of course that pardon is only good for federal charges the case coming out of Georgia there's a state charges and in New York. Those are state charges and in the District of Columbia those I think Chu are not subject to federal charges I think those are considered like state district charges on which. The District of Columbia Virginia those are going to be state charges so I just don't know but a lot of people believe that Merrick Garland as the attorney general of the United States would be willing to prosecute Donald Trump for the for the incitement you know I don't know we don't know what he's going to do at this point in time. I have another story that I want to get to. But I know people are still interested in this so let's get a couple phone calls here and plan to tell you about my other story that I'm hoping somebody who's really smart and innovative the can maybe find something here and help resolve a mystery I don't anticipate that's going to happen but who knows I mean you know we have an amazing audience let's go to the phones Martin is calling from Petaluma Hey Martin welcome to. I think I think and I hope I'm wrong he's going to get away with everything right because he looks Blimey Babs and. His lawyers are paid to do what they do which is to fight every possible player in every possible hoop and have its own merit to the nth degree I think he's going to get away from everything as he did and they have at least rented out for years and years and years. That I think I think he's there he's got the money to do it and that the provided back here is his trump and the call of. The money's no object because guys when you got the money you can stretch it out on if you want. And no I don't think you're wrong I think your friend and and the reason I think you're right is because his great mentor in life was Roy Cohn. H o n n for people who don't know Roy Cohn he was not only the lawyer to the mob and a very successful lawyer and an absolutely brilliant man he also worked with Joe McCarthy for the House Un-American Activities Committee and he's just as slimy and sleazy as they clam but he had alos he even said at one point during his presidency he said Where's my Roy Cohn exactly and Donald Trump is the best mob. I thought I had I'd buy I don't disagree with you Martin thank you let's see let me grab one more quick call before we take a break let's go to Karl he's in San Jose Hey Carl welcome to k.g. Out. That how you doing today well thank you Carl. Good There are a couple of things that I haven't really heard discussed and I've been curious about so we had all of these various high officials presented senators even the President who were winning and stoled take an oath of office to protect and defend the Constitution right and that protecting the then the prosecution blah blah blah blah blah you know were are these just words or is there any force behind them oh god and I've done is such a great question because you wondered about that especially when they were because if you take an oath and then you testify in a trial and you've sworn to tell the truth the whole truth and nothing but the truth if you lie there are massive consequences for you after you've taken that oath and it ends in this Senate trial you saw all of those senators not only take the oath that they were going to be you know they they were going to be try try yours a fact and they were not going to whatever the terminology was they were going to be fair and then they signed a book that also indicated that they understood that this was the oath that they were talking as they heard this case and then several of these senators ran to confer and to assist trumps defense team in presenting their case and they stated publicly before hearing the facts that they had already made their decision so they were not people who were unbiased judges of the fact that all they did defy their oath of. You know sitting on that impeachment trial but no nothing comes of it and you know what I've been told Karl is simply that it happens all the time and nothing comes of it I I'm sad by that because if it doesn't mean anything stop saying it Mitt Romney it meant something to Mitt Romney. And Mitt Romney and I probably agree on 2 percent of things politically and we disagree on 98 percent but in the 1st impeachment trial when he voted to convict he said that he took an oath before God and he had to live up to that because he is a very devout. Mormon he had to live up to his oath he did take it seriously so maybe you take the oath of office for those few people who are actually swearing to God who believe in God To the extent that Romney will be right back on. Back to the phones or Burt is calling from San Francisco hi Roberto welcome to k.g. Our. Very interesting you know what to say and stuff but I have 2 things I want to bring up Ok 1st when we were little new with no thievin a huge doze of pardons and stuck in his pocket you know being killed him out when he was a novice and the other thing is I thought he couldn't couldn't. I mean he could the president could. Cure don't get all tangled up here he could. Lose is his ability to issue a pardon once he is out of office Yeah he does but if he if he did the paperwork if he actually issued a pardon it doesn't have to be all the paperwork I mean a pardon can be pretty simple usually but he's not usual but. They go through a process in order to issue these pardons but they do not have to be made public apparently and so he could have issued but he could have issued pardons to his family members yes but he so critical you don't know he ponies out of his back you know not you know him no but he would have to I mean that there would have to be something would have to be filed that shows that these pardons exist at a time that he wants to present them in order to. To protect himself or his family members or whoever the secret pardons were issued for they would have to become un secret and they would have to be official he couldn't do it after he left office that would not be legal but he could issue a pardon that was held in secret until such time as it was needed and then he could present it to try to keep him and his family out of jail that adds he's still on the stand there I really don't know I thought for sure he he did oust all of his ability to pardon yourself once he was out although he did but if he already. Signed the pardon but it wasn't made public it would still be valid and so but but you know it shouldn't be that way I mean here's the thing that would resolve it is that all pardons should be a matter of public record there shouldn't be any such thing as a secret pardon if you issue a pardon it should become part of the public record immediately there should be no way to hide it I wonder if we can have a law passed that indicates that and if Donald Trump pulls one of these out of his pocket then there may be some people in the Congress who decided that might be the good way a good way to go to pass a bill because. We're going to change topics right now we've only got 15 minutes less than that before we check in with Chip Franklin the see what he's got coming up but there was this story that caught my attention it 1st I 1st saw it it at s.f. Gate San Francisco Chronicle but then they referenced mission local mission local so I went there and there was more information about a guy who's gone missing in San Francisco His name is Chris White. I t e l He's a 50 year old computer programmer he lives on Guerrero street and on January 9th he wrote a message to his niece just after 3 o'clock in the afternoon please tell Laura to check her messages it's urgent his sister try to call him back there was no answer that message is the last anyone has heard from him according to his friends and his family the search is on the police are looking for him they hired a private investigator the police just began their investigation apparently last week but it's been a month you know since this guy has gone missing He's 50 years old There's video surveillance video on the street of him walking into his building he lives in an apartment but it's a really nice looking Victorian 3 stories. And he lives on the top floor he lives on the 3rd floor. So there's video of him walking in on that day there's no video of him coming out there was also a rear exit to the. To the building there's a video camera there to that motion activated there's no video of him leaving the building nobody knows what happened to him it's really is hey I don't really have you heard about this story yes I have read the story and it's like where is he you can't you've got to be in there somewhere maybe I don't know I mean Ok so this family member said he was acting strange and he was acting paranoid that he was they say he was writing unusual post on Facebook obsessing over the d.c. Capital riots and asking for money to replace the lost cell phone but you know what I don't know if that was him because it included in this story apparently he sent a message to a homeless man that he had be friended and the man would come in stay with him listen some frequencies the guy disappears very very generous he would pay his phone bills and stuff and he was using the now disappeared man's Facebook and he posted things on Facebook and he got really angry the guy who's disappeared got really angry about it he said Ok so the night before he went missing. He message to the homeless guy on Facebook the homeless guy had been using the Disappeared man's account to send messages to people that the homeless man knew and sell the Disappeared man sends this message and I'm going to have to edit it. You f. Ing a hole done that it enough caps that part you are on your own you are far too much trouble phone number get your own I'm not paying for you to harass people you are an a hole don't ever come here again but the expletives were actually spelled out. Is so he goes missing. 3 weeks later the homeless man writes on Facebook that he heard that the guy who went missing had been jumped and robbed for his computers and he added that he had been killed by people named Nigel Alonzo one c. And Eric he told a similar story to the private investigator. The homeless guy had the Disappeared guys cell phone. When he was asked about that he said that the Disappeared guy had sold it to him for a $100.00 when he visited him on January 7th friends and family believe that the homeless guy probably stole the phone or that the Disappeared guy lent it to him because he had lent it to him in the past. Yes so the phone the private detective said was debt dead and wet I don't know what that means dead and wet so when the private investigator asked the homeless guy what had happened to the Disappeared guy the homeless guy responded that quote He had strong psychic abilities and had seen in his mind that Christopher had been shot in the head and wrapped in plastic before his body was dumped in the water at the end of Mare oppose a street in San Francisco near an abandoned warehouse he blamed the killing on Alonzo and someone named William but the private investigator said that he was rambling nonsensical things at times would tell him again that he had been murdered in his apartment wrapped in plastic dumped in the bay at the end of history and when the private investigator asked him why they would do such a thing to Christopher he replied they robbed him for his computers. I mean you know this it's just and the people who know him said that he was such a generous guy but they didn't like that he had this homeless guy hanging around with him that they didn't really trust him and that he then began to. Also have people come into his house who were more sketchy speedball that they were really concerned about men that they described as funky and thugs from the underworld whatever that was and someone said it seems strange that he would have these friends they have speculated the people who knew him that maybe he was lying low and looking for a clean break if that was the case they say he sure did it in a spooky manner now I thought this is what my 1st thought was because I read a lot of detective novels I I'm into that. I thought you know we've all read stories about people who get stuck in their chimneys and so I thought oh you know it's covert he's home he doesn't like some of these people he's a little nervous he's getting a little paranoid and so he just wanted to stay in his house but he needed to clean the chimneys so he tried to clean the chimney and got stuck there and died in the chimney. But there are some pictures of the street view of the house and it doesn't look like there are any chimneys in the house so my theories out the window I'm lost I have no idea what happened to the guy what's your theory Santa theories out the window fan out there. And that's what we've heard Mostly it's people who are playing Santa and they try to go down the chimney and they get stuck in the chimney but there's been stories of people who try to clean their own chimneys and they go in there and they get stuck and they can't get out and if you live alone you're scream and you know people aren't necessarily going to hear you but I haven't heard anything about a foul smell so I mean who knows why they didn't. They didn't say anything about you know some type of disruption of the video right right or yes. 3 I said he went into the apartment and he said there was no evidence that anything within the apartment had been disturbed. Maybe he's on the roof maybe he's on the roof somewhere here's the other thing crosspiece adek his his bank accounts his bank account I guess he has one and his credit cards have not been used since that last day when he was heard from. So no transactions at all. Didn't have a lot of cash so you know you might think why hit the road well there's He wouldn't have any money if he hit the road because it does not using his credit cards where would have gone how do you feel is so weird I know it's really really weird now the police are asking for help if there's anybody who has any information about maybe what happened to this guy they're saying contact and they have a 24 hour tip line the numbers 41557544445754444 you can also send a text to Tip 411 start the text message with the s f p s so complicated just call the police department tell him that you think you know where this guy is if you have any information about it he's white male has brown hair and brown eyes he's 50 years old he's 510 and weighs about 200 pounds he's also known to frequent Emeryville and Sonora and to all in the county and there's very little known otherwise people are just asking where is what happened what happened. You know I don't I don't know does anybody have any idea of the phone lines tennis the telephone number we don't have a lot of time Ido 80810. I mean do you have any ideas about this mystery may be an avenue that has not yet been pursued and Kim I actually thought about the roof I thought about you know how that I would think that a p I would go up on the roof I would think that a p.r. I would be to go in the attic sometime maybe there's next and cranny is you know old houses and demand there could be crannies there could be old closet there could be a loose floorboard that he went inside maybe he's with a neighbor hiding out but they've been talking to the neighbors so I don't think that's a but I don't know maybe I mean it should be is should be pursued right everything should be pursued trying to find the guy but I have no clue because I thought he was stuck in the chimney and if they have the chimneys then that is not where he is I thought I was so clever oh I've solved this crime for you he got stuck in the chimney but apparently that is not what happened 88810 is the telephone number 808-0810 anybody have any ideas here that I've got some calls coming in but I don't know who's calling in so here we go. Dave who said super secret probation Hi Dave. Why are you doing this to me Oh that was so funny again I guess I have to have some information here Ok 1st floor 2nd floor 3rd floor 3rd floor Oh good that's even better Ok I'm going to go on that floor goes to the ground leads to a 2nd EEG rest such as an alley or another backyard. Window I haven't seen the back of the of the thing but given that he wrapped in plastic can be dropped out of window very easily and taken elsewhere with avoiding the front of the area where the camera but there's a camera in the back to you're sure yeah it's a it's a motion activated camera in the back and there's one in the front as well yeah and the the friend has us as a surveillance camera Yes Ok I'm still going through the window if they didn't come out the door they went out the window on the grass to some other exit another backyard possibly where they didn't have to go into the alley depending on upon the coverage of the camera they could have gone and think he's dead oh yeah he's dead yeah he's dead and that he was taken out and the other guy the guy who said he was shot in the head wrapped in plastic taken dumped in the water presumably had it with it otherwise why would you offer such a thing let's go to Paul he's in San Francisco Pa Hi welcome to. Science is a topic for access to the world more than anybody else and he made it out of there to another world not made it very far or made of quite Florida very afraid to crowbar Ok Listen that's that's interesting because if I'm looking at the front of the building. You know he's on the top floor you're right he would have access to the roof his building is right next to immediately next to all of these other buildings there like on top of each other and then on one of the ones that looks exactly like his building but goes pretty long there's a fire escape Well if there's a fire escape on the front there may be a fire escape on the back of depending on the angle you know that the camera is pointing you may have been able to go down the fire escape. And at night time which is are going to have. Some of those comments yeah absolutely Hey thank you so much I think you've come up with something very very good let's see let's do one more here and then I got a break because we got to talk with Chip Anthony in Livermore Hanson he welcome to . Take on how they go and. So I really can't say where he is that you know the fact that he never left the building it's pretty weird but honestly the 1st thing that comes to my mind Bernie here this is this guy was getting into trucks you know it's like he would start to hang around and shiftier and shift your people you know a lot of people coming up to its place and also at the end you said he was starting to get kind of paranoid yes and then he like somebody is going down the rabbit tracks rude that is that's good that's really good you met you and that's something that now the police hopefully will take into consideration because that could explain his change of behavior and it could explain those weird guys at the end that people were saying I can't believe that he was hanging out with people like that that they were really shifty looking characters so you may well beyond a something it's going to be fascinating when we finally do have this mystery solved I think it will happen Lord knows when we'll see if any of you are correct let's set let's take a break and when we come back we'll talk to chip and see what he's got going on this is.
