Out of public view and soon enough they come back and they announce we're going to consider another motion we're going to send it to the floor of the Senate but we're going to consider a motion to recommend an f.b.i. Investigation of the thing they just heard hours of testimony about from the only 2 people you could really expect to have anything to say about it in other words the same people that the f.b.i. Is going to have to go off and talk to again they were testifying under oath yesterday not just in front of the Senate Judiciary Committee but in front of the whole country people watched on the web people watched on cable t.v. People listened on the radio we ran a good portion of it on the program and what didn't determine Christine Ford the college professor from California who says that Brett Kavanaugh assaulted her 36 years ago when she was 15 and he was 17 he says he was and there doesn't remember any such gathering doesn't remember meeting her but she says he was there and her accusation was given in a very hard felt teary way it was very compelling very sympathetic you had to feel for anybody who gave that kind of testimony she must truly believe that this happened the only problem is her best female friend who was there does not remember it the 3 teenage boys who were there do not remember it and she can't remember major parts of the story how did she get there doesn't know how did she get home doesn't know where did it happen which house doesn't know which street was the house on in the community you lived in for years and intended I school and don't know I know the general area it's near the Country Club but I don't know an event that happened that she says has gripped her life for the last 36 years one that is as she put it seared into or memory. And she says this is seared into her memory except she can't remember who what when where and why about many of the details about what happened except for the fact that she says Brett Kavanaugh did the dirty deed lay on top of her put his hand over her mouth tried to reach under her clothes and then Mark judge was there too and he turned up the music so nobody could hear her scream she was not raped but she feared being raped she was not killed but she says she feared being killed and as I said it was a very persuasive telling of a story followed by Judge Brad Kavanagh whose statement yesterday if you didn't see it if you didn't hear it if you only heard a part of it on display Graham Do yourself a favor and watch it and if you wonder why is that man getting so mad just mentally take yourself and put yourself in his shoes or put yourself in the shoes of your son or your brother or your father or any other male figure in your family and imagine that they have been falsely accused of terrible things and that they're about to watch their entire career that they have spent 40 years building they're going to watch it all go away on the basis of a very flimsy accusation brought more than a 3rd of a century later and then ask me if it was your son and you're a mom and your son was being accused and you knew it was fault but how do you prove what you didn't do I mean there's been a conundrum I've talked about on the show 100 times in the last 20 years saying if somebody accuses you of doing something you didn't do how do you prove you didn't do something there are lots of things you can prove you did do I graduated high school I can prove it I've got a diploma and there are records that show that I did I can prove on the radio we've got recordings of thousands of hours of yours truly talking into a microphone I can prove I did that. If I flew somewhere I can prove that I have an airline ticket and the t.s.a. Will tell you it was Lars Larson got on that airplane and it was Lars Larson who flew back as we checked his id but how do you prove you didn't do something if somebody accused your father or your brother or your son or your nephew or another male in your family of doing something truly wrong 36 years ago who could you find who could remember enough of what happened a 3rd of a century ago to say no and I'm dead sure that never happened that's a hard thing to do so what happened after that the committee voted to recommend an f.b.i. Investigation of Donald Trump he said it's up to the committee and he's truly like not happen unlike Obama who is constantly getting frustrated by what Congress won't do it's all just I'll do it illegally I'll do it unconstitutionally Trump said Ok fine I've authorized the f.b.i. So they'll go out and they'll probably talk to the magic mark judge who will tell them I wasn't there don't remember the party you have no recollection of it whatsoever they're probably talk to Judge Kavanaugh again who they have f.b.i. Background checked how many times 6 different times before and meanwhile it bears mentioning that for all of the people who feel sympathy for Christie Ford Christie Blasi back in the high school days. She is now the toast of Democrat circles and will be for the rest of her life she now has a Go Fund Me account that totals over $700000.00 right now and I would imagine by the end of next week it's probably going to be more Jeff flakes motion that they spend an extra week and allow the f.b.i. In one week this will be faster than the Anthony Weiner investigation that they go out and talk to as many people as they can find although as I said before teenage boys who were there don't remember it the teenage girl who is her best friend doesn't remember it and I'll leave you with this conundrum too I know that many victims of sexual abuse and we've had many of them on the program I know victims of sexual abuse they will tell you we don't want to report it but I'd ask you this when Christine Blasi left that house that night she was anxious to get out the door she says she had just been assaulted and maybe she was by someone not Brett Kavanaugh But over the next 30 years her best friend Leland Kaiser she never told her friends stay away from those boys they're dangerous they assaulted me she never warned them she never told the parents of the police or teachers or anyone else until it came at a very convenient political time it is the 1st Amendment Friday and you've got the Lars Larson Show. And New York Times bestselling author most recently of Thomas Jefferson revolutionary Dr Goodman good advice on the program happy to be here Lars one of the things that was mentioned I think by Orrin Hatch was that in the past many Supreme Court justices never went through a confirmation hearing process that they were simply nominated by President and folks said yeah and looked Ok and then they were voted on by the sudden boom done why have we gone to a process out that seem so fraught with opportunities for pure partisan politics like what we've seen over the last 2 weeks Well it's really actually didn't ever have such a hearing until 925 so all the people George Washington put on the Supreme Court Jefferson Abraham Lincoln in general their names were just sent to the Senate many of them were confirmed for their points were confirmed on the same day as our only gun converts Yeah it was actually the 1st question. The 1st couple of times we had these kinds of hearings one was about supposed corruption and the other one was because the nominee was Jewish and there was resistance to having a Jewish fellow on the Supreme Court and then we've had various times when they made a lot of flack about it when again there was an idea that for example Abe Fortas who was nominated for Lyndon Johnson by Lyndon Johnson be chief justice turned out was taking payola from a corporation through a champ speaking series he had of the d.c. Universe city while he was already on the Supreme Court Oh my God I am speaking arrangements that doesn't happen in politics you know like where somebody is in a high important office and then arranges for husband to give speeches and get paid a lot of money that would never imagine America what you really yeah you can imagine and you know or somebody who's got 30000 books published and they end up all being purchased and then they're later found in the warehouse controlled by a local branch of a union say that that never happens you know yeah well there have been there been some few cases like that but in general this is now the generated from trying to find out whether the guy really was corrupt trying to find out what exactly his judicial philosophy was just seeing whether you could accuse him of enough things that eventually some people would decide Well there are enough accusations against this guy this is kind of stinky Let's move on to the next person and my own feeling is why this doesn't as I'm as a routine matter doing this every time it doesn't really serve any any reasonable function and I think it ought to be discontinued I don't think there's any use in this well let me ask you if there's a constitutional way to insist on that and that is this this strange phrase that only gets used in this context that the Senate is to advise and consent Now that doesn't mean rubber stamp but on the other hand does it mean that you go in and try and find any possible reason to object to somebody that you don't like because of the person's politics which seems to be the case with Kavanagh. But was not the case with Ruth Bader Ginsburg confirmed by a 96 to 3 vote is it possible to say well the founders didn't intend for you to do this they intended for you to say is the person qualified to do the job and nothing more. Well there actually was argument about that question too because from the very beginning of the republic we've had people who took the Hamiltonian position as against people who take Jeffersonian position on how to read the Constitution so it seems to me that it's perfectly legitimate people to say I'm going to vote against this fellow's appointment because I think that his constitutional views are too much on like mine and I'm not going to support this but that's not the same as saying you know I don't like the fact that I think the dogma is strong and you know or that we're going to make up the idea that you know when you're a teenager you're in various rape gangs or this kind of craziness that's come up in recent proceedings it seems to me that 'd it's only going to get worse now we're going to have this kind of monkey business all the time and frankly why are we doing this so I think we ought to return to a situation in which the senators consider the record of the person as being appointed the nominated and then decide whether they think that person is fit for the office if they want to have an investigation conducted by the Judiciary Committee staff that's fine but they have the guy go up and sit there for 3 or 4 days and answer questions about you know whether he was on a boat in Rhode Island and that kind of thing I can't imagine anybody would say well yeah in the abstract That's a good idea well let me ask you something Dr Grossman because we could say well this might happen to the Democrats too except that even if you assume that Donald Trump was replaced in 2020 if Ginsburg goes out before trump the end of Trump's 1st term then the average age of the Supreme Court is going to go down dramatically and we might not actually see want another justice replaced absent some kind of mishap for quite a long time is that little window of time a possibility where you could say it's time to reform that whole process while we we don't know who's going to be president you know at some point in the future when the next replacement is going to come and do you think our system has the guts to actually address this issue and reform it while we're in between likely appointments. I think we could have a psych couple of cycles where we can't get anybody appointed that is the Democrats have now said that if they take control of the Senate they're not going to allow Trump to appoint anybody else to the Supreme Court maybe including to this current seat so we could end up with 2 or 3 vacancies and people might think well that's kind of far fetched that we actually used to have a system in which the senators were chosen by state legislatures and at one point Delaware had a Senate seat that was open for 8 years its 2 houses were controlled by the 2 parties and the 2 houses of the Delaware legislature couldn't agree on who their senator ought to be and I think we could have a similar situation here where the president a Republican in the Senate theoretically controlled by the Democrats aren't going to agree so just to hard for many seats come open will stay open it seems to me that that actually is a possibility do you think it's also I think Trump does trump currently hold the record for the greatest number of federal judicial appointments both made and confirmed so far on the federal bench while he holds the record for most Circuit Court appointments that is for the intermediate level appellate courts the ones like the one that Kavanagh sitting on the right level below the Supreme Court and that's what I'm talking about and yet he has what another $13140.00 that are do or are to be made. Well there pending there are openings especially for the district courts those are the trial courts we have at least one district in each state some states like Texas for example where I used to practice law have dozens and dozens of district court judges it depends on the population of the state one does that mean that if the Democrats take control of just the Senate just one voter or say 2 votes that at that point we see a 7 or 8 member court for now in part potentially a 7 of Ginsburg leaves in the next 2 years and that we have 100 over 100 federal judicial spots that remain unfilled for the last 2 years of this 1st term for Donald Trump Well there hasn't been talk I haven't heard any talk at least among Democrats of if we take control of the Senate will also prevent point of any lower court judges so I don't think that's in the cards but who knows you know is there does seem to be a feeling among some of them that this is the direction they want to go and I think people who practice in federal courts can tell you now that the dockets of some of the federal district courts are backed up because they're undermanned So that is actually a problem it's a practical problem yeah that's what I'm thinking of and I'm just wondering how Americans are going to react if they're told we're going to paralyze the president's ability to appoint federal judges for at least the next couple of years because these federal judicial decisions are fairly important in a lot you know and all across the country Kevin it's a great it's always great to have you on the program thanks so much for the time you're welcome That's Dr Kevin goods man from Western Connecticut State University author of Thomas Jefferson Jefferson revolutionary We'll be back in a moment on a 1st amendment Friday you've got the Lars Larson Show the Larson Show.
