What's happening in Polk County involving the casino is confusing to say the least we've got the local folks there that have voted and said that they didn't want to do and then you've got the judge ruling that said that what they voted on isn't constitutional maybe you can get us up to speed on what's going on the constitutional amendment that we passed in 2018 in Arkansas. Allow those for casinos and it awards for licenses one to Oak Lawn one to Southland one down in Pine Bluff and then the one in Polk County now all the other casino licenses there was a lot of local somewhere in Polk County that wasn't true in Polk County a substantial majority of the people in the county voted against the constitutional amendment that was giving their county a casino license so that the people then didn't initiated. The equivalent of an initiated act at the local level and initiated act as like a statute passed by the people and they did it at the local level rather than the statewide level so it's more County regulation type of law and that regulation said that the county leadership the county board could not provide what was required by the amendment a letter of support to any casino licensed applicant without the people 1st voting on it that's what the ordinance as they're called requires that people have to approve that 2 things happen one county board itself overturn the ordinance because it wasn't the equivalent of a constitutional amendment it was like normal legislation the county board overturned the ordinance and then a day later a judge ruled the ordinance was unconstitutional that the Constitution only required permission from the county board itself to give a license not also permission from the people. Legal expert Josh Silverstein Josh since the Simpson your vote has gotten thrown out what kind of rights do the people in Polk County have or maybe even the people in Russellville Dardanelle have if they don't want to see no there so the ruling by the judge could be appealed and the attorneys indicated they're going to appeal Unfortunately the last 2 May not have a lot of impact anymore because the county board itself has overturned the ordinance now they could possibly challenge that in court as well but right now the options for the opponents of a casino in Polk County their options are quickly diminishing All right there was another casino company that I guess filed originally and they got bumped out because of what took place there locally now they have filed a lawsuit to that says wait a minute we were overlooked we want back in basically Van Susteren All right so here's how that works again in order to get the license specifically so that we know the license goes to Polk County but for a particular casino operator to get the license they have to get a letter of support from the county board now the Arkansas State Government gaming commission decided that in order for the letter of support to be valid it has to be from current leadership to the current county board the problem is that the 1st company that got a license approval letter got a letter from the county board leadership that was outgoing That was leaving after the $28.00 election so the Arkansas agency in charge of the casino situation said that letter of support is no valid Well the recipient of that 1st letter thinks that the government didn't have the authority to reject that letter that nothing in the constitutional amendment said it had to be from the current county board so they are suing to. Forced the government to accept their approval letter and grant them to life doesn't have legs or is it hard enough it's hard to know I think the better argument is that that lawsuit should fail because even though the Constitutional Amendment doesn't say which county board has to approve the current or the old one generally when you've got broad language like that a government agency is allowed to adopt implementing regulations that in a pretty.
