The fbi dropped steele. He wasnt trusted anymore and thats because he blew his cover. He started talking to the media. They should have stopped relying on him at that point. Correct . Under fbi rules once you are close to you or closed. You need certain approvals to start reinitiating and reengaging. That is right. The fbi kept using him, correct . They met with him through bruce. Yes. They used him for information after he was cut off. They receive that information. 1 13 different times. Correct. Okay. Then we get this dossier, it is used as a big part of setting up this entire process for the fisa application. Christopher steele, the people at the fbi no Christopher Steele was untrustworthy, he was an untrustworthy foreign actor, he was a political hack, he didnt like trump, he was being paid by the clintons, but they still pushed forward with using him and exercised extremely poor judgment, correct . Certainly once they found out that they had decided to close him, they should have followed the rules if they wanted to reengage with him. They had plenty of information to question the validity and bona fides of some of those reporting. Should bruce be held criminally responsible for his misconduct . We make his. Let me ask you. A couple of times weve heard of lowerlevel fbi agents and lawyers who had generated some of these inaccuracies, these 17 inaccuracies. What is the process for supervisors factchecking . Under the procedure committees factual accuracy procedure is put into place in response to prior incidences found of failure to accurately relate information to the court, the first line supervisor is supposed to go through and recheck the process to make sure it was done. That did not happen here on multiple occasions. Right, why did nonna happen not these multiple occasions that this work was not checked . Because we were given explanations ranging from a lack of understanding of the proces process, they were trying to skirt not only the rules but the law . We got a lot of explanations that we didnt find particularly satisfying. They were skirting the law. I think that what they did to carter page, as you have heard, is just unbelievable. Let me ask you this, how many times, how often do you find mistakes enough ice application . This is the first time my office has done a deep dive into a particular application. Weve done higherlevel reviews in the fisa processes and found various issues at a higher level but this of the first time weve been able to delve in in this way. Its a fairly unusual occurrence. Let me put this, i would hope so. If its not an unusual occurrence there are more cultural problems than you know about at the fbi, correct . Thats correct. I would say so too. I want to touch on accountability in the short amount of time that i have left because i think it is absolutely just infuriating to the American People that those who executed this exercise, which should have been called operation takedown trump, because thats what they were doing. That they are still getting a taxpayerfunded paycheck, they are still getting taxpayerfunded benefits, and vacation time. When they take off for christmas, theyre going to be on the taxpayer dime. Around here, so from time to time you will hear about those that went after the late senator stevens. One of them is still working for the u. S. Attorneys office up in anchorage and another one is working in spokane. Senator stevens was found to be innocent and they are still getting a government paycheck. We want to make certain that disciplinary action is taken. I know you were asked about case agent number one. He is still there. What about fsa one did the security briefing, is he still employed . Thats my understanding. So you still using your money to fund his lifestyle. And the lawyer we know is going to face criminal referrals, correct . Im just going to stick with what we say here which as we reverted to the attorney general and the fbi director. Okay. The fbi, no i dont want to ask you that. I think we know the answer. Peter strzok approved the request to extricate the first device application then he along with lisa page pushed for the extradition of the first with doj officials, correct . Correct. Okay. We know that she was, in answer to whats hunter vick came to me ask you, she was involved in the line of communication in the set up of this, correct . She was involved in at least the one meeting we identify in the report. Okay. I found it curious in your report and this is the reason i ask it, you said that they had no role in the preparation of the approval of any of the four fisa warrant applications. I guess if you are saying not putting pen to paper and getting a nod up and down. They were not involved in pushing the department to get answers going forward. They were involved in the process but does not final approval. We are going to get you out of here maybe a few seconds early. I just want to think you and your team very much for the patients for being here for the report that youve given. When he takes up some of this i think its important to note also, this is not the first time something has happened like th this. The reaction when im at home in tennessee from people is they cannot believe the absolute maliciousness that took place with this. It is not unfortunate coincidences, it is a surveillance state. If i could think you also. We mentioned senator stevens and the bill that senator leahy has pending which you cosponsored, i appreciate your support for our luck. So did any whistleblowers come forward during their investigation with any concern that errors were made intentionally or out of pies against trump . For example, im looking at the footnote on page 339 of your report and it cites some of the very colorful protrump tweets that were made by some of the fbi agents. One would think that if they knew anything they wouldve contacted you in the 19 month investigation that you conducted. Did anybody come forward . We did not have any such evidence. No documents criminal testimony, no one coming forward to complain that would be another way of gauging the motive as he put it, correct . Correct. Nobody came forward, thank you so much. Thank you. I apologize for the Geneva Convention for having use it there for four hours and i giving a bathroom break. I really appreciate what all of you did. This is a welldocumented report. The blue team, red team view. To some extent but im sort of glad to see that all of us coming together like this should never happen again. The fisa system to survive has to be reformed to the court that the corrective action. If you dont thats going to be hurtful to the future of the court. I think all of us are now thinking differently about checks and balances in that regard. The country will be stronger. Let me just and with where i began, rather than debating whether or not there was a legal predicate, reasonable articulation, which is a very low standard to open up a preliminary investigation, dram will have his view of what really happened, he made no more than you. I dont know but i trust him to be fair. The fact that three lawyers disagree is okay. Nobody has ever suggested you all did a bad job. Youve done a great job, you can reach your conclusion about the legal predicate and you have. I respected. Im going to assume for a moment that that is the right conclusion. That doesnt matter at all to me. Because after it was opened, it became a nightmare. It became something that can never happen again if it came over time a criminal conspiracy to defraud the court, it became an effort by lawyers to dr. Dr. Evidence. It became a conscious effort to deny the report exculpatory information about an american citizen. They should have stopped, at least in january 2017, when the russian sub source that everything in the dossier i disavow, poor carter page. Two more warrant renewals after they were on notice the dossier was unreliable. All i can say is why they did it you can make your own decision, its pretty clear to me that this was a lot of things, but it was not a counterintelligence investigation to protect donald trump. This was opened and it kept going and going and going after it should have stopped. Because the last thing on their mind was to protect donald trump. A lot of the key players here were upset with the outcome of the 2016 election. They had a lot of power. Thats what worries me the most. You may not like what the American People do, but you should honor their decision. The reason the investigation survived and kept going after so many stop signs is because people wanted it to keep going. The reason nobody briefed donald trump about you may have people working for you connected to russia, is they could give a about protecting him. Its kind of odd that in a counterintelligence investigation you never briefed the person thats the subject of the foreign influence. The bottom line is i hope we never have a defensive briefing, or an intelligence briefing, we send an fbi agent to do a 302 on the people you brief. This is some really scary stuff. I think i know what their motivation was but it doesnt matter. They did it. Hope somebody holds them accountable. I hope it never happens again to my democratic friends. This could happen to you one d day. Mr. Horowitz, do you believe every politician in america should be concerned . I believe every american should make sure this process wants to work the right way. Finally to those of us in politics, how easy it could be for someone to come into our lives and our campaign as volunteers, i hope the fbi would tell me hes got a reasonable suspicion is a bad actor. I can do something about it. What scares me the most is the power to hold a counterintelligence investigation is almost unlimited. The power to abuse it is exactly what your report tells us about. He says we are clearly influenced by bias but to the extent that it went up happened regardless, thats in the eye of beholder. He was saying the foreign Intelligence Surveillance act, the socalled fisa warrants work initially slapped on carter page, the trump advisor at the time. They were justified in part from the normal routine but did they go too far . Bias was in question. Can you say, as Lindsey Graham asked him, it wasnt because of political bias . Horowitz was saying i do not know. He also says hes not ruling it out regarding the possibility of bison flew these decisions. John roberts is at the white house where shortly we will be hearing from the president of the United States. Nothing from the president so far in terms of twitter or any kind of public statements. He did retreat a couple of items but no real thoughts other than singhs campaign was spied on. Last night at a Campaign Rally in hershey, pennsylvania, the president unloading on the findings of the horowitz report. The president did sidestep the findings that horowitz did not see any evidence of a political bias. Instead the president saying that the report detailed outrages and unprecedented abuses of power. Listen to what he said. Never happened before in the history of our country. We are really wise to it. We are wise to it. The Inspector General found that the fbis spying application contains 17 errors and omissions commonly known as lies and deceit, when the fbi uncovered evidence showing that we did absolutely nothing wrong, which was right at the beginning. They had that exonerating, you know that, they hated it so nobody could see it. He may hear from the president about the impeachment hearings at this white house event in the east room at this hour of the president is hosting a hanukkah event at which she will also be sending an executive order on antisemitism here the white house as the president s actions are in response to a dribbling rise in antisemitic acts in the United States since 2013, including money on College Campuses and theres also the possibility that antisemitism may have been at the root of the jersey city attack yesterday. According to the white house to executive order will in drawing the definition from the International HolocaustRemembrance Alliance into an executive order and clarified that title vi of the 1964 Civil Rights Act regarding discrimination applies to antisemitic acts. That definition of antisemitism is as followed, antisemitism is a certain perception of which may be asked that breath is hatred towards, rhetorical and physical manifestations of antisemitism i directed towards jewish or nonjewish individuals and their property and religious facilities. Heres where the executive order ways into controversy. Title vi of the Civil Rights Act prohibits discrimination based on race, color, or National Origins but does not mention religion. The executive order would effectively define judaism as a nationality. The Antidefamation League is applauding the leak in a statement with Jonathan Greenblatt saying in a climate of rising antisemitism this executive order provides valuable guidance on antisemitism, giving Law Enforcement and campus officials important additional tools to help identify and fight this pernicious hate. There are concerns that the effect of the executive order will be to limit freedom of speech. Richard blumenthal singh earlier today that he is very wary as a of labeling judaism is a nationality. It smacks not only of what happened in the soviet union but also of nazi germany. He thinks that there are other tools to fight discrimination. The white house and the adl insist that this executive order will do nothing to limit free speech. Hes too saying that its not a legal move, its more of a directive to federal agencies. It could affect funding, federal funding at College Campuses if they are found to not be in line with the executive order. All of this coming at them the next few minutes. Neal, ive watched more hours of hearings over the past two weeks on a character. One thing that came to the four again is that a lot of questions were asked again and again and again by both sides. Knowing that they had been asked before. Democrats focusing on the determination that there was no political bias and the launching of the investigation. Republicans saying wait a second, theres no political bias . Can you say that . Horowitz saying no we didnt find any document terry or testimonial evidence and parsing these words. The bottom line is that there are major egregious problems in the depths of this ig report. There were Confidential Sources that were wired up to listen to members of the Trump Campaign or people tied to it that were recording them. Democrat side while they didnt insert spies into the campaign, now there were tangential to it but they were recording people that were tied to it. The cross fire Hurricane Team was picked out by andrew mccabe, the former deputy of the fbi. All of the members, they oversaw this effort. Ill tell you at the end of this day, both sides of the aisle admitted that there are Serious Problems in the fisa court system and once that they have to address quickly. Neil you are right to point out that theyre getting inconsistency in terms of panel coverage. Im curious where you think all of this goes whether it influence the votes on articles of impeachment or not. I dont think so. I dont think anything today influences that. I dont think anything over the past couple of weeks really changes anybodys vote. We are where we are. On the impeachment front, youre going to have probably adam schiff, who actually was a part of this hearing in that he defended some of the fbi efforts in this rebuttal to devin nunes, which came out that devin nunes was really accurate according to the ig and what he put out. I dont think, i think you will get a party line vote, possibly some democrats in the house for voting against impeachment and then the son of this where the senate is. Barring some other major shoe to drop, and we dont see me she was in the sky, this is going to come down to the g. O. P. According to president. We will watch very closely, thank you for your patience and certainly will have all that coverage. Imagine if you are looking at the federal reserve, a tedious but that might be. Weve got wyoming senator come hes the chairman of the Senate Republican conference. Senator were to be from here . Tell you what i heard today was disturbing and alarming, neil. I think people all across the country look at this and said the fbi has failed and what it is supposed to be doing. I think it has taken the law into its own hands. In terms of when you look at these 17 errors and omissions, these are major problems with the fbi and there are a number of us who have been big supporters of the fisa courts in terms of surveillance were going to now have to take a second look at how this was abused by the fbi lying to the cia. Can you imagine such a thing can come and heal . Neil do you think that horowitz pulled his punches quick mike windt Democrats Ask them whether this would be an investigation if it was rightly initiated, he said yes. Whos right . Well, im taking a look at the big picture. I think this was intentional and aimed at President Trump. Weve seen what has happened as a result, certain the consequences of this misuse of the fbi and abuse of power as i see it but from a Bigger Picture everyone in america, whether you are protrump or antitrump ought to be concerned about what the fbi has done here in terms of deciding to take the law into its own hands at all levels. One of the other networks had a headline that the fbi screw ups at all levels, at the highest level we have seen that. I think its a lot of concern and its a very bad day for the fbi and something that should be of concern to all americans, neil. Spew and you know what, senator, if it turns out that the president is impeached in the house and it goes do you guys in the senate, do you know if any of your republican colleagues who would go along with it . I think number one, neil come in the sun it will be a much fairer process that we have seen in the house, which was an absolute lack of the fairness and due process that one should expect. When you look at what evidence was brought forward. To me, the evidence is weak. It is very flimsy. I think thats why we see the democrats are somewhat pulling back by having a press conference one day on usmca at the same time as having an impeachment conference. At this point as a party, republicans are reunite united. There is no way i can see a number of republicans changing sides from the standpoint of voting to remove the president. You need 20 republicans to see that. I go to all of the meetings, i just dont see people talking that way at all. I think people are offended at the unfairness of the process so far. Neil, what im struck by this think your conversations especially with bret baier, we hear things again and again in these hearings and they become conventional wisdom. They turn out not to be true. The big thing we heard today is that there is this big golf or big dispute between attorney general barr and Inspector General 18. When you look closely at what bar side it is in the case. What barr complained about as they opened investigation on the thinnest of suspicions. Horowitz explained that leaf common sense aside, if youre going to strictly look at what their procedures are, the bar is so low in terms of suspicion for opening an fbi investigation, that they can open an investigation on the thinnest of suspicions. That is not the dispute. Barr went on to say that given all of that the level of suspicion they had in his view was insufficient to justify the steps taken. The steps taken of course where the fisa and the informant. Neil thank you very much. The president might respond to all of these developments today. Recently i received a remarkable letter from a 12yearold boy named Austin Polonsky from san francisco, california. In the letter austin summed up the meeting of hanukkah. He said on hanukkah, it is a tradition in the light the menorah and place it by the window. We do this to exemplify how we are not afraid to show who we are or what we believe in. In austins letter we asked if he could celebrate hanukkah with my family at the white house and this year we are thrilled to let you know that austin is with us today. Where is austin . We got it open in four months and its right now open and maybe someday they will build a more expensive version of it but it cant get much better come out right robert . I think ron can tell you it cant get much better than what we have. They wanted me to sign an order for anywhere from 1000000000 2 billion and they were going to look for a piece of land for the subject land in jerusalem is very rare and very expensive. I said do you think we have a piece . David friedman are a great ambassador a fantastic job. They did a fantastic job. They want to spend 2 billion, so i think we can do it for about 250,000, maybe 300,000. We will save a billion dollars and we have a better location than any location we couldve gotten. Its been open now for a long time. We used all jerusalem stone. Friends of mine like jerusalem stone over here it costs a fortune come over there it wasnt so expensive. Ive also recognized israels sovereignty over the Golan Heights. [applause] i said to bob, so what was bigger, bob, what we did for israel in terms of jerusalem and moving the embassy to jerusalem becoming the capital of israel or the Golan Heights, which for a 52 years theyve been having meetings in the Golan Heights and Nothing Happened since i came along. Bob kraft which is bigger, which is more important of the jewish people . He said neither. I said what is happening . He said what you did by terminating the Iran Nuclear Deal is bigger than both. I think that is true. I think that is true. I think it could be true. I sort of agree with that. Today we are taking another historic action. In a few moments i will sign an executive order to combat antisemitism. This action makes clear that title vi of the Civil Rights Act, which prohibits the federal funding of universities and other institutions that engage in discrimination applies to institutions but traffic and antisome indicates. This is a very powerful document that we are sending today and with been a very big story over the past couple of days when they heard. As you know they had almost universal support in congress and yet they didnt get it done. This has gone on for years and years. Theyve almost had universal support but there was always a roadblock. This year there is no roadblock because im doing it myself. Its much easier. We have support from many in congress. This is our message to universities. If you want to accept the tremendous amount of federal dollars that you get every year, you must reject antisemitism. Its very well. [applause] my administration will never tolerate the suppression, persecution, or silencing of the jewish people. We have also taken a firm stand against these socalled divestment and sanctions movement, or bds. You know that very well. I have to tell you Jared Kushner and ivanka have been talking to me about this for three years now, may be longer than that. I go back about three years where something that i could do about it. In this position we can do things about it. Before that not quite as much. I would be just like you will. Successful, doing nicely, but not for this. Theyve been talking from the beginning of the administration, theyve been bringing this up. We forcefully condemn this antisemitic campaign against the state of israel and its citizens.
